Publisher not deterred by Barrick
Releasing book today linking gold firm to alleged deaths

A small Quebec publishing house is giving the green light to a book linking Barrick Gold Corp. to the alleged deaths of Tanzanian miners in 1996, despite the threat of libel lawsuit.

Toronto-based Barrick, the world's biggest gold miner, tried to delay the publication of the book Noir Canada: Pillage, corruption et criminalize en Afrique (Black Canada: Plundering, Bribery and Crime in Africa), published by Ecosociété, by threatening a lawsuit last week.

The authors of the book - described as three academics - review a series of abuses and crimes in Africa that would have been committed by Canadian-owned mining, oil and pharmaceutical companies.

Barrick is targeted, among others, and linked to an incident in which 52 miners were allegedly buried alive at the Tanzanian mine of Bulyanhulu in 1996.

The mine was owned at that time by Vancouver-based Sutton and sold to Barrick in 1999. But the authors suggest that Barrick acted with Sutton to prepare the deposit for large-scale development.

The Bulyanhulu property in Tanzania is said to be the largest gold deposit in east Africa, containing an estimated 8.8 million ounces of gold.

Barrick was tipped off by the publisher's summary of the book posted on its website that linked the mining company to the incident. It promptly threatened to sue the publishers and authors for libel.

Although it has not yet reviewed the full book, Barrick argued in its lawsuit that the allegations are "false and libellous," were never substantiated and are defamatory.

The company also stressed that the events took place three years before its purchase of the property.

The publishing house was "shocked" by the lawsuit threat and held an emergency meeting Sunday night to decide whether to go ahead with the distribution of the 1,750 copies of the book today, as planned.

Calling the lawsuit a "means of intimidation," Ecosociété announced yesterday afternoon that it was going ahead.

"We are not going to draw back from those threats," the publishing company said in a statement. "It's a question of freedom of expression."

The lead author of the book, Alain Deneault, said in an interview that the book doesn't directly hold Barrick responsible for the incident, but rather brings together a "variety" of opinions on the Bulyanhulu case.

"We also give Barrick's point of view," he noted.

Deneault explained that the authors' goal is to shed some light on crimes committed by Canadian companies in Africa.

"It's not just Barrick. There are a lot of other cases. We are not saying that all the allegations are true, but it would be almost impossible that all the allegations were false," Deneault said.

Barrick spokesman Vince Borg said the company would review the book before proceeding with the lawsuit.

"If it repeats allegations that have no basis in truth, we'll have to consider further remedies," Borg said.

On its website, Barrick has posted a report from the World Bank's Office of the Compliance Adviser/Ombudsman, which investigated the allegations in 2002.

The CAO found that there is nothing to substantiate allegations of 52 murders at Bulyanhulu, or allegations that people in the local communities are being intimidated or undermined by anything or anyone.

Looks like Barrick Gold is following up on a previous threat:

On April 30th, Canadian mining giant Barrick Gold announced it is making good on threat of legal action against a small, non-profit Quebec publishing house. The world's largest gold mining company - which took in $1.73 billion last year - is suing Les Éditions Écosociété and the authors of the book Noir Canada: pillage, corruption et criminalité en Afrique for an incredible six million dollars - 25 times the amount the publisher says it makes in a year. The company also wants all copies of the book pulled from shelves.

The books principal author, Alain Denault, and the publishing house immediately denounced the lawsuit as a SLAPP (Strategic Lawsuit Against Public Participation) meant simply to silence the mining company's critics. Both the author and the publisher have pointed out that the book is thoroughly researched and relies heavily on research that is publicly available.

In the suit, Barrick claims it has been defamed by the contents of the book, and that the authors and publisher have undertaken a widespread smear campaign against the company. The book outlines alleged human rights abuses carried out by Barrick Gold in various African countries, including the deaths of more than 50 Tanzanians in 1996 and fuelling the civil war in the Democratic Republic of Congo.

A spokesperson for Écosociété has called on the Quebec government to act quickly to instate legislation that would outlaw SLAPP lawsuits. Deneault and Guy Cheyney, coordinator at Éditions Écosociété, will be holding a press conference Monday, presumably to discuss their next step.

Recently, Sir, you released a public statement regarding the mining industry in the African country of Tanzania, that has touched off a justifiable outrage in the Tanzanian Cyberspace and in some segments of the Press.

You wrote that you've had "the privilege" of seeing the yet-unreleased Presidential report on the ailing, corruption-laden mining industry in Tanzania. People are wondering how a foreign investor was able to gain access to a report which has just been turned over to the President by an inquiry commission, before the real stakeholders of the country's Mining resources have had a chance to see it.

Such a blatant leak of a presidential report would have been a no-no in Canada or the US, where your businesses originate from. So, why lower the standards when dealing with small countries Mr. Sinclair? We may be regarded as, or I guess we are, insignificant, impoverished, little failing states on the edge of the universe, but we are not cadavers yet, and such flagrant disregard of our laws and honor of the Presidency is extremely disconcerting to some of us, citizens, albeit the President himself is not bothered, if he actually gave you "the privilege" of a peek at it!

And Mr. Sinclair, if the President or the Commission had the inexplicable "friendliness" to show you the report before its formal release to the general public, why would you disparage the people and the Commission with your thinly veiled call to the President not to follow recommendations to fix a malfeasant industry which serves but a venal few? And if you have no problem with the report's recommendations, as you confusingly wrote, why tell the President not to disturb the markets with the report's recommendations?

I just don't know who gave you the "privilege" to see this report before us, the people.

Such behavior is the type of Superpower hegemony that is decried around the world. It's the type of paternalistic thinking that's giving America, and it's cronies a bad name. It provides excuses to those who cause destabilizing atrocities we are seeing around the world!

Some of us were just puzzled and dismayed.

If you don't halt your public dissemination of privileged information you might have, we will consider that to be a clear and present assault to the dignity, independence and honor of the Tanzanian people and our way of life.

We will consider you not as a friend to our country and Tanzanian people but an emerging and obvious threat to our quest for equality, dignity and prosperity or us and our posterity. In our own way we will mount a PR offensive against you and the presence of your investments in Tanzania, till you apologize for this and halt your offensive actions. This we will do.
