Inaitwa checks and balance, no arm of government has ultimate power , but if the law is broken then the court can disolve parliament if its there illegally..The only person who can dissolve Parliament is the president,and not the court ,but t can give directive which can be overturned by the president or Parliament itself .
The constitution cannot force leaders into people even the courts know that...those are elective sits not appointments.to be able to meet that criteria you'll have to change the mentality of most Kenyans and it can't happen overnight.. If the presidential election was annulled by supreme court for not being in accordance with the constitution, do you think parliament will be allowed to sit there illegally? The constitution is the supreme law of the land, no arm of government is bigger than the constitution.. Because the constitution represents the soverign will, if it says 2/3 gender then that's what needs to happen

With the jubilee numbers they'll easily call for a referendum to ammend the constitution you of a the people you should know that......but personally I think those were political statements they'll do nothing of that sortThank you

But the MP's were sworn in illegally in the first place!! Therefore making their swearing in 'null and void" They think they are MPs but in real sense they are not!!! Read that 1st chapter of the constitution, last paragraph, any attempt to establish a government that is not in compliance with the constitution is illegal....They annulled because the president had not been sworn in ,once sworn in the judiciary's hands are handcuffed same way with the Parliament once they are sworn in its only the President who can dissolve the Parliament and not judiciary my friend .read the constitution in a broader perspective you will understand. executive and the legislature is there to check the judiciary not to abuse its powers.

When we voted for this constitution, some laws were too ambiguous, they they say what should happen but don't describe step by step how it should happen...Nakuhurumia kijana ,but anyway jipe moyo. what is the illegality part of it? because of the 2/3 gender rule? it was not even passed in Parliament. again you can not force people to elect women simply because they are vying ,they must demonstrate their capabilities .
Ohh and to answer your question, the illegality part of it is that they failed to pass a law within the timeline stipulated by the constitution... It was the responsibility of parliament to pass a law that was going to define how the 2/3 gender rule of elective position was going to be achieved.
