KENYA is quietly lobbying African countries to boycott the upcoming 23rd Commonwealth Heads of Government Meeting in Colombo, Sri Lanka from November 15 to November 17, 2013.

Diplomatic sources told the Star that Kenya is pushing the move over the union's failure to take a decisive stance against the prosecution of President Uhuru Kenyatta and his deputy William Ruto at the ICC.

Already, Uganda, Tanzania, Rwanda, Nigeria, South Africa and Zambia have been roped into the plan and may miss out in the meeting. South Sudan and Burundi which had launched bids to join Commonwealth have suspended their bids indefinitely.

The Commonwealth is comprised of 53 member states, mostly former colonies of the British Empire. The Queen of England, Queen Elizabeth II heads it. Member states have no legal obligations to one another.

“Kenya is determined to force in a favorable and decisive action against the ICC trials against its president and deputy president. The Commonwealth miss would be part of this bigger agenda which the world must appreciate has been forced on Kenya by the court,” the source added.

Another government source confirmed: “It is almost a foregone conclusion by now that Kenya will not show up. And with it, East Africa and other African countries. By that time, the president is supposed to be at the ICC. The deputy president will be in charge here.”

The Commonwealth meeting would also be taking place three days after the start of Uhuru's trial on November 12. The meeting will the first in 40 years in which Queen Elizabeth II will not attend owing to old age. She is 87.

Her son Prince Charles will instead represent her. The meeting is already facing several other boycotts over the choice of Sri Lanka as the host country. Canada's Prime Minister Stephen Harper has already stated that he would not attend in protest of Sri Lanka's poor human rights record.

Harper has even gone ahead and threatened to stop contributing to the body if no action is taken against Sri Lanka. In the UK, parliament's foreign affairs select committee has called on Prime Minister David Cameron to boycott it over same reasons as Canada. Cameron has however said he will go.

In India, Prime Minister Manmohan Singh is yet to make up his mind on whether he will attend or not. An Indian snub would even be more devastating to Commonwealth as it is the Commonwealth's biggest member.
In Africa, Gambia, the home-country of ICC Chief Prosecutor Fatou Bensouda became the latest country to quit the Commonwealth early this month.

"The government has withdrawn its membership of the British Commonwealth and decided that the Gambia will never be a member of any neo-colonial institution and will never be a party to any institution that represents an extension of colonialism,” it announced.

The revelations on Kenya's offensive against the body comes barely a week after the African Union took a decisive action against the ICC by asking Uhuru to snub his trial in November. It also comes days after the court allowed Uhuru to skip most of the ICC sessions when his trial commences in November.

During the AU meeting in Addis Ababa, Uhuru gave a strong nationalistic speech in which he said Africa must “distrust the blandishments of those who have drunk out of the poisoned fountain of imperialism.”

He said described colonialism (which brings together the Commonwealth nations) as “most unjust of institutions.” He told of the irony of West preaching justice to “a people they have disenfranchised, exploited, taxed and brutalised.”

Uhuru said the philosophies, ideologies, structures and institutions that visited misery upon millions for centuries ultimately harm their perpetrators.

“Thus the imperial exploiter crashes into the pits of penury. The arrogant world police is crippled by shambolic domestic dysfunction. These are the spectacles of Western decline we are witnessing today,” he said in Addis.

The Kenyan snub on Commonwealth would also be in furtherance of Kenya's approach to the 68th United Nations General Assembly (UNGA) meeting in New York last month when Uhuru missed out citing ICC pressures.

At the time, Kenya justified the UNGA miss saying the President “cannot be out of the country at the same time as the deputy President.” Ruto's trial at the ICC was ongoing.

“Owing to these developments, Kenya will for the first time since our independence 50 years ago, not be represented at a political level during the High Level Week of the United Nations General Assembly that the President was scheduled to attend from 23rd to 27th September 2013,” a State House statement announced ahead of the meeting.

The snub, in wording and tone, was a silent protest to the failure of UN Security Council to defer the case against the president.

PRESIDENT Uhuru yesterday called on Kenyans to resist neo-colonialism.
He said freedom fathers resisted colonialism five decades ago and Kenya should follow in their footsteps by rejecting imperial domination.

Speaking during the Mashujaa Day celebration as the country prepares to celebrate 50 year of internal rule on December 12, he said the struggle to defend the country's independence is a daily calling for all Kenyans.

"We must honour of heroes by staying true to our heritage in rejecting all forms of domination and manipulation in our time," Uhuru said.

He said our fore fathers fought for the country independence and succeeded before and the country should emulate them.

"They may be powerful and rich, but so were the colonialists. They may disrespect and even hate us; we have defeated their ilk before," the President said.

Uhuru said freedom fighters ushered in a new dawn of equality, dignity and sovereignty which must be defended at all times.

"The struggle to defend our independence is a daily calling for all Kenyans, and all the people of Africa," he said.

The President said some people were disturbing him and his deputy William Ruto in reference to International Criminal Court cases but said the issue will end soon.

"Some people from outside are disturbing us but it will soon be over," Uhuru said.

During the African Union summit in Addis Ababa on October 11, Uhuru accused ICC of being used to interfere with Kenyan people.

He said Western powers are the key drivers of the ICC process.

"They have used prosecutions as ruses and bait to pressure Kenyan leadership into adopting, or renouncing various positions," he said.

He said close to 70 per cent of the ICC's annual budget is funded by the European Union and the threat of prosecution usually suffices to have pliant countries execute policies favourable to them.

"Through it, regime-change sleights of hand have been attempted in Africa. A number of them have succeeded. The Office of the Prosecutor made certain categorical pronouncements regarding eligibility for leadership of candidates in Kenya's last general election," he said.
Uhuru said the prosecution proposed undemocratic and unconstitutional adjustments to the Kenyan Presidency.

"These interventions go beyond interference in the internal affairs of a sovereign State. They constitute a fetid insult to Kenya and Africa.

African sovereignty means nothing to the ICC and its patrons," he said.

He attacked Western countries which he accused of meddling in African affairs.

Uhuru said as heirs of freedom fighters, AU should prevent member states from being controlled once again by outsider powers.

"Liberation heroes founded the Organisation of African Unity, which was dedicated to the eradication of all forms of colonialism.......It has been necessary, therefore, for African leaders to constantly watch out against threats to our peoples' sovereignty and unity," he had said.

let me get this right: tanzania is part of the east african community on boycotting the commonwealth meeting?
to protect kenyatta from the ICC? wait a minute...I don't get it.

BUT...Tanzania is NOT a part of the east African community on oil refineries and pipelines, railroads and international trade? mmh! i don't get it!

if we are going to boycott the commonwealth, there should be another reason...not this one for gods sake!

Agriculture minister William Ruto wants the secret envelope containing names of the post-election violence suspects handed over to the International Criminal Court at The Hague without further delay.

Mr Ruto says the two-month period given by former UN secretary-general Kofi Annan to Kenya to make a new attempt at setting up a local tribunal to try the suspects was unnecessary.

So Kenya can withdraw from commonwealth, for their own reasons, though it's very unnecessary for us to follow their example.

Tena,,,Tanzania imo ndani ya Afrika,,na Afrika mashariki,,,kwani ni mmoja wa inchi kadha ambazo
zilikua zimeshikilia msimamo mkali wa kujiondoa katika ICC.

Attorney General wa TZ,,ni mmoja wa inchi kadhaa,,kama Ethiopia ambao walikua,,enjoined,,
in UhuRuto case,,,kwa wale ambao hawana habari.

Kama unaichukia,,,yaani,,you have a personal problem with Kenya,,,hivyo,,,,

Ndugu yangu wewe hujamjua vizuri huyu kikwete unaempigia tarumbeta hapa! tuachie sisi tumetoka nae mbali,halafu nikuulize,hivi Tanzania mnaikumbuka tu wakati wa mikakati yenu ya kujinasua kutoka ICC? Msifikiri sisi ni wajinga kiasi hicho,tunawajua marafiki wa kweli wa jamhuri yetu tukufu.

pili, katika siasa hakuna marafiki au maadui wa kudumu au kunao?? wanaomsifu kikwete, ambae tunamwona tuu maghazetini na kwenye luninga. lakini hatujui mengi kuhusu uongozi wake ndani ya tanzania. nasikia tu wabunge tanzania wameongeza vita zaidi bungeni chini ya uongozi wake.


Sasa kurudi kwenye mada yenyewe inaonekana wanaoisponsor ICC lazima kuanza kujitakasa kutoka kwa kuhusika kwa maana kesi zinaonyesha dalili ya kuanguka. kwanini jICC kama ni zuri liwe ni mwiba wa kujidunga anavyosema banki moon??

imefikia wakati ambapo uhuru na ruto na wanasiasa yeyote kukosa mamlaka tena juu ya swala la ICC, imebaki kusuluhishwa kati ya UNSC na AU. na kati ya mapendekezo Au wametoa ni hakuna kiongozi anayetawala africa anapaswa kuhudhuria ICC
