KMA revokes Mailu, Muraguri membership over doctors' strike

The Kenya Medical Association has revoked the membership of Health CS Cleopa Mailu and PS Nicholas Muraguri.

The association said the two have committed crimes of omission and commission amid the doctors' strike which entered its 73rd day on Tuesday.

"KMA hereby revokes the membership of the two for one year," the association said in a statement.

It further asked President Uhuru Kenyatta to fire the two for failing to contain the doctors strike

"We demand that the President immediately sacks the CS and PS who we consider to be collectively responsible for this crisis," read the statement.

KMA said negotiations cannot take place while doctors are in jail and said it was ready to be enjoined in mediation talks.

"This is to offer technical support and ensure a resolution to this crisis," read the statement signed by 15 representatives.

The association asked other health workers' associations to support efforts for a comprehensive solution to the crisis.

"All our members in health facilities and institutions shall not be offering any services for 48 hours effective midnight today," it said.

KMA said further instructions will be issued should the doctors still be in jail at the expiry of this period.

The representatives asked health workers to converge at the court of appeal in solidarity with their colleagues.

Striking doctors in Mombasa earlier said they will escalate the strike and ask those in the private sector to join them.

KMPDU Coast branch secretary general Abi Mwachi added that a team had already been identified to rally the public to support their course.

The Labour court effected its month-long jail sentence for doctors union officials on Monday after their refusal to call of their strike.

Trial Judge Hellen Wasilwa ordered the medics to end their strike that started on December 5, 2016 or go to prison for one month.

"Negotiations will take place but you will serve your sentence after contempt of court," she ruled.

Opposition leader Raila Odinga termed the ruling "horrifying and disturbing" and asked his lawyers to appeal.

Doctors are demanding the fulfillment of the CBA that includes a 300 per cent pay rise and better working conditions.

They have also accused the government of failing to stock public hospitals with basic medicines and supplies of items such as gloves.

THE PEOPLE’S PETITION TO THE PRESIDENT OF KENYA: RESOLVE THE HEALTH CRISIS NOW

Preamble:

On December 5th 2016, members of Kenya Medical Practitioners, Pharmacists & Dentists Union (KPMDU) went on strike effectively paralyzing healthcare in public hospitals throughout Kenya. This was due a dispute over Collective Bargaining Agreement (CBA) signed in 2013 between KPMDU and the Ministry of Health.

Situation Report:

  • As at 13th February 2017, 72 days later, the dispute has not yet been resolved.
  • On 13th February 2017, officials of KPMDU were arrested for contempt of a court order that the officials should ask their members to resume work the union continues to engage the government to resolve the dispute.
  • On 14th February 2017, the Kenya Medical Association gave notice for its members in private hospitals and universities to strike in 48 hours, revoked membership of Cabinet Secretary Dr. Cleopa Mailu and PS Dr. Nicholas Muraguri
  • During the period of the said strike, Kenyans have undergone untold pain waiting for services that for some never came: as at 21st January 2017, a report by Saturday Nation revealed that at least 200 people had succumbed to their aliments (https://www.nation.co.ke/news/doctors--strike-rages-on/1056-3781074-p4rhunz/ As at 14th February 2017, this number could only have gone up.
  • Delicate, life-saving procedures cannot be performed on patients, and even essential medicines are unavailable.
The Petition:

We, the people of Kenya, drawing our mandate from the Constitution of Kenya 2010 that:

All sovereign power belongs to the people of Kenya (Article 1) and through our democratically elected representatives and through the three state organs (Executive, Legislature & Judiciary) wish to petition the following to resolve the health crisis immediately:

1. His Excellency, Uhuru Kenyatta, President of the Republic of Kenya.

2. The Chief Justice of the Republic of Kenya, Justice David Maraga

3. Speaker of the National Assembly, Hon. Justin Muturi

4. Speaker of Senate, Hon. Ekwe Ethuro

5. Chairman of the Council of Governors’ of Kenya, Gov. Peter Munya

We, the people of Kenya, wish to draw the attention of President of Kenya to Article131(2)(e): The President shall ensure protection of human rights and fundamental freedoms and the rule of law.

We are dismayed that for the past 72 days our right to the highest standard of health care (Article43(1)(a) has been grossly violated, leading to untold and preventable suffering. The very right to life has been threatened. Children cannot access health services; mothers are giving birth in death-threatening circumstances.

In addition, and in full appreciation of the independence of the Judiciary, we wish to point the Chief Justice to the fact that 70 days, in matters of life and death, is too long a time to wait for justice for the families who cannot afford treatment in private hospitals. As we call for justice for poor and sick, we pray that justice will be fast in coming, as per Article159(2)(d); 159(3)(a)

To all our President and representatives through the above institutions: while we appreciate the autonomous nature under which you must function, we hope that you can sit at the same table and bring back our doctors, and ensure our health facilities are fully functional: the people who have died will not be coming back.

Wamekataa mshahara walioongezewa na serikali wa asilimia 40 wakisema kuwa ni wa chini kuliko ule walioafikiana mwaka 2013.

Karibu madaktari na wauguzi 5000 kutoka hospitali 2000 za umma, walianza mgomo wiki ya kwanza ya mwezi Desemba na wagonjwa wamekuwa wakikosa matibabu.

Appeals court frees doctors' union officials, talks to resume

A Court of Appeal has ruled that seven doctors jailed on Monday should be released from prison with immediate effect.

Judges Wanjiru Karanja, Hannah Okwengu and Jamilla Mohamed said negotiations will take place over seven days and that they will return to court on February 23.

The talks are to come up with a report aimed at calling off the strike that has lasted more than two months and that private doctors had joined.

The Kenya National Human Rights Commission will lead the negotiations. The Council of Governors has also agreed to take part in the talks alongside KMPDU officials.

Officials set for release are chairman Samuel Oroko, secretary general Ouma Oluga, treasurer Daisy Korir, deputy treasurer Evelyne Chege, Allan Ochanji, Mwachonda Chibandzi and Titus Ondoro.

Cord leader Raila Odinga earlier accompanied lawyers to the Supreme Court to appeal the ruling that jailed the union officials.

Oluga and six others were handcuffed and taken to various prisons on Monday to serve their month-long sentence

Raila said this was "horrifying and disturbing" and promised his lawyers would take action, where he said the Jubilee government had failed.

He and other Opposition leaders were seen in court today ready to hear the appeal by lawyer James Orengo, who is Siaya Senator.

Doctors chanted outside the court, sand and dance as the proceedings went on.

Health workers, who have been on strike from about 73 days now, have always turned up for proceedings, sang and danced in shows of support for their colleagues.

"Tuko tayari, Mailu akija sote tuko tayari," they were heard saying today. (We are ready, when Health CS Cleopa Mailu comes...we are all ready).


The mocked the Cabinet Secretary and sang songs indicating that he was their enemy.

"Akija mbele yako, kanyaga, kanyaga...sote tuko tayari," they continued singing in Kiswahili.

Mailu told the Senate Health committee on Tuesday that he could get doctors back on the negotiating table and that he ensure the crisis ends.

He also said he will do anything possible to ensure doctors' union officials are released from prison.

The CS accused Principal Secretary Nicholas Muraguri of insubordination saying he refused to take part in the talks.

The 5,000-member doctors' union wants the government to implement a deal agreed in 2013 to raise basic salaries by 150 to 180 percent.

They want a review of working conditions, job structures and criteria for promotions, and address under-staffing in state hospitals.

Doctors are demanding a 300 per cent increase in their salaries and improved working conditions in line with their 2013 CBA.
