In a letter to the electoral commission, the second in as many weeks, the alliance insisted that her candidature was not only illegal but had also acquired a ‘criminal aspect.'

They threatened to move to court if it emerges that the registration information used to clear Ms Kilonzo turns out to be false.

"Jubilee wishes to state unequivocally that we shall pursue this matter in both the civil and criminal Courts; should the IEBC capitulate to the undemocratic forces hell-bent of propping up an unqualified candidate," read the letter in part.

It was signed by URP's secretary-general Fred Muteti, his Narc counterpart Fidelis Nguli and TNA's secretary for legal affairs Jasper Mbiuki.

Tuesday, the three officials pointed out several ‘irregularities' in the details that had been used to clear her to vie for the post.

The claimed that Ms Kilonzo had provided her registration centre as Karen, which they said, was non-existent.

"Karen had twelve (registration centres) none of which was called Karen," read the letter.

They further argued that her registration details, done in BVR format, were said to have been taken in 2011. "However, BVR commenced in 2012," said the leaders.

They requested IEBC to present them and the public, scan copies of the by-election candidature documents presented by Ms Kilonzo.

The officials alleged that certain IEBC officials had connived to assist Ms Kilonzo be registered as a voter.

However, Ms Kilonzo has previously insisted that she is a registered voter and dismissed those questioning her registration as part of a wider scheme by her rivals to scuttle her chances.

Preliminary Investigations - Kethi Diana Kilonzo Did Not Register As a Voter!

· Here and there: Serious food for thought: -

· A few days ago, The National Alliance (TNA) complained to the Independent Electoral and Boundaries Commission (IEBC) that lawyer Kethi Diana Kilonzo, daughter of the late Makueni Senator Mutula Kilonzo is not a registered voter and is therefore ineligible to contest the Makueni by-election.

· TNA, through its secretary for legal affairs Jasper Mbiuki wrote to the IEBC saying that Kethi was not a registered voter and is therefore not qualified to run.

· TNA says that Kethi does not appear in the voter registration roll and did not vote in the March 4 General Election.

· In their letter, TNA used Kethi Identification Card number 21216762 to confirm that she is not under the IEBC register.

· The party further told IEBC that it does not have the legal authority to register any new voters with respect to Makueni Senate by-election.

· But a top IEBC official said on Wednesday, June 26, 2013 that TNA did not follow the right procedure on objecting the Wiper party's nominee for the July 22 by-election.

· "It is not the work of an individual or political party to direct the commission on how to certify the qualification of a candidate. They should have waited for the IEBC to accept her nomination papers and raise the objection," he said.

· The official said TNA would in any case have written to the IEBC returning officer for Makueni and not the commission's chairman, Ahmed Issack Hassan.

· Wiper chairman David Musila said he suspected that TNA only checked for Kethi's name on the Makueni voters' register.

· While a candidate must be a registered voter, he or she must not necessarily be registered in the ward, constituency or county where they intend to run for elective office. One only needs to be registered as a voter anywhere in any part of the country.

· The downside of not being registered as a voter in Makueni will be that Kethi cannot vote for herself in the by-election.

· But many questions are cropping up. Why, for instance, has Kethi been so subdued, almost defensive, about the contents of TNA's letter;

· Where did she, actually, register as a voter; has she got any witnesses, any concrete and/or tangible evidence;

· What is the name of the polling station; who was the officer in charge of that station;

· When, exactly, did she register as a voter, the day, the date, the time; can the returning officer clarify and/or confirm all these details;

· Why is Kethi's name not in the IEBC voters' register, whether she registered using her passport or not;

· How come her name is not in any of the IEBC's records save for the "acknowledgement slip" she has "suddenly produced";

· Where did she get the acknowledgement slip; when did she get the acknowledgement slip; who gave her the acknowledgement slip;

· Why didn't Kethi confirm, like all patriotic Kenyans, whether or not her name was in the IEBC voters' register, prior to the elections, and there was more than adequate time to do so;

· As the leading lawyer for AFRICOG, during the petition where she strived (unsuccessfully) to prove that IEBC had committed errors, why did she not find it prudent to give her case as an example of voters whose names were not in the voters' register (despite having "actually" registered), if indeed she registered as a voter anywhere in any part of the Republic of Kenya, et cetera?

· Is Kethi trying to be too clever by half; is Kethi trying to engage in fraudulent games and who at the IEBC is helping in this criminal activity;

· Is CORD (read Marriage-of-Evil-Minds a.k.a. Coalition for Rigging and Doctoring!) trying to be too clever by half; is the Coalition for Rigging and Doctoring trying to engage in fraudulent games and who at the IEBC is helping in this criminal activity?

· We are trying to confirm beyond all possible doubt but, believe it or not, good people, our preliminary investigations point to the fact that Kethi Diana Kilonzo did not register as a voter anywhere in any part of Kenya;

· And that Kethi Diana Kilonzo did not vote anywhere in any part of the Republic of Kenya! Her close friends have "reluctantly" confirmed this very shameful position!

· One is left wondering what kind of a person this Kethi is: Could she not even have wanted to vote for her father, in which case she should have chosen to register, if at all, at Makueni;

· What was she trying to prove at the Supreme Court if indeed she did not participate in the elections;

· Does she believe in anything or is she just a gun-for-hire, a prostitute of sorts really;

· Was she just acting before the cameras spewing meaningless rubbish she hardly believed in; and so, is the Kethi Diana Kilonzo Kenyans were treated to a fraud, after all?

· Whether the TNA complained using the right channels or not (and they must learn how best to handle such things next time!), is neither here nor there;

· TNA may indeed have been amateurish, silly and rather pedestrian – and could have left a registered voter to complain on behalf of all law-abiding patriotic Kenyans – but the question remains: Is Kethi Diana Kilonzo a register voter anywhere in any part of the Republic of Kenya; and where did she get the acknowledgement slip she is flashing all over the place?

· Who, at the IEBC, gave her that acknowledgement slip? Legal action must be taken, pronto, against all those involved in this dastardly and fraudulent act!

The fact of the matter is that there were/is multiple registers and there is no telling who is who or what is what!
That is the background upon which Kenyan elections were held. Mpaka leo, hakuna mtu anayeweza kusema kwa
uhakika hii ndio register kamili inayonyesha raia wa Kenya waliosajiliwa kupiga kura.

Cord and Jubilee renewed their rivalries on Friday at a tribunal investigating the eligibility of Ms Kethi Kilonzo to contest the Makueni Senate seat.

The dispute revolves around whether Ms Kilonzo, who wants to succeed her father Mutula Kilonzo, who died on April 27, is a registered voter.

The tribunal will on Saturday check the master register to ascertain if she is a listed voter.

The decision was arrived at after a day-long stormy hearing, which exposed the behind-the-scenes political fights over Ms Kilonzo.

It emerged that the Jubilee coalition wooed Ms Kilonzo for the seat, but challenged her eligibility to contest the election when she chose Cord instead. She was cleared last week to run on a Wiper ticket.

It also emerged that Ms Kilonzo's name was not in the register for Makueni County, and also not in the register for the whole country, but it could not be established if her name was in the Green Book - the primary register - which is what today's sitting will seek to determine.

A former assistant minister and a member of the Jubilee Coalition exposed the fight for Ms Kilonzo between the two major coalitions, admitting that he was seeking to block Ms Kilonzo's bid for the seat because she declined to join them and opted to contest through the Cord coalition.

Mrs Agnes Ndetei said that she tried several times to persuade Ms Kilonzo to vie on any of the Jubilee Coalition parties, but after she turned down the offer, she challenged her nomination, claiming she was not a validly registered voter.

Mrs Ndetei admitted that after the death of Kethi's father Mutula Kilonzo, she visited Kethi's mother twice to talk over the issue and also visited Ms Kilonzo's house with a view to persuade her, but she declined.

"I went to see Kethi's mother to persuade her to vie for the seat on a Jubilee ticket. I also visited Kethi's house and waited for her for two hours, but did not meet her," she said.

However, Ms Kilonzo's answers to the allegations were straightforward and to the point. "I am a duly registered voter with a valid acknowledgment card issued to me by IEBC registration officers," she said.

She said she registered in Karen at the NCC social hall and was issued with the acknowledgment card, which she presented to the Makueni County returning officer to get the nomination certificate. Mrs Ndetei said the Jubilee Coalition's wish was for Ms Kilonzo to vie on a Narc Party ticket.

"After she refused and I heard that she was being sponsored by Wiper Democratic Party, I decided to stop her after realising that questions were being raised on whether she is registered as a voter," she said.

The former Kibwezi MP, who vied unsuccessfully for the Makueni Women Representative seat admitted that she decided to challenge Kethi's nomination on the advice of Jubilee Coalition's secretary for legal affairs, Mr Jasper Mbiuki.

Another complainant, Mr John Kuria, was put to task to explain how he got Kethi's documents despite being a resident of Naivasha. He said that he brought the complaint because his party, Peoples Party of Kenya, was also fielding a candidate in Makueni and that the candidate should not compete with someone who is allegedly not registered as a voter.

When Ms Kilonzo was asked how she registered without having her original identification documents, she said that it was the IEBC officials who can answer the questions since her concern was to be registered, which was duly accomplished.

She stated categorically that she would be seriously disappointed by the commission if it turns out she was not a registered voter.

"My duty as a Kenyan was to apply to be registered as a voter. It wasn't my duty to verify if indeed I was registered or if my details were entered in the green book," Ms Kilonzo said.

She added that it was not a big deal if her name was not in the register since the Supreme Court and even IEBC officials had found out that the process of voter registration was flawed, leading to some voters not in the register casting their votes in the last elections.

Makueni County Returning Officer, Mr Salad Boru said the commission's staff checked Ms Kilonzo's documents and they were in order and that the only problem was that they did not locate her name in the register at Makueni County.

They then checked the registers for the whole country against her ID number, but then Ms Kilonzo's name did not show up, he said.

"It is at that point that I realised the process was likely to take longer than the ordinary case, where all details could be found," Mr Boru said.

The IEBC tribunal on Monday ruled that Cord's Kethi Kilonzo was not a registered voter but upheld the nomination of Jubilee's Prof Philip Kaloki to vie for the Makueni senate seat.


The tribunal spent Friday and Saturday trying to determine whether Cord's Kethi Kilonzo and and Jubilee's Kaloki met the threshold set out in law to participate in the by-election which was occasioned by the death of Senator Mutula Kilonzo on April 27.

The tribunal revoked Ms Kilonzo's certificate of nomination and said it would commence investigations as to how it was issued.

However, Prof Kaloki argued that he resigned from Wiper party and joined Narc within the time limits.

"We rule that the nomination of Kaloki by Narc was within the 45 days and thus was valid," ruled the tribunal.

Prof Kaloki's candidature was contested by Wiper on grounds that he was still a member of the party.

Court dismisses activist case

Earlier, a suit filed to halt the IEBC tribunal proceedings over the qualification to contest in the Makueni by-election was dismissed shortly before the tribunal issued its ruling.

The High Court dismissed the application filed by Okiya Omtatah, a civil society activist, after it held that the tribunal had the mandate to determine nomination disputes.

Mr Omtatah had filed the suit asking the court to consider it urgent and issue interim orders stopping the tribunal pending determination of constitutional questions that he raised.

He asked the court to suspend any decision made by the tribunal on the fate of Wiper's Kethi Kilonzo and Narc's Philip Kaloki, whose candidacy was the subject of complaints before the tribunal.

The activist claimed that the tribunal, which consists of IEBC commissioners, could not sit as a judge in a matter in which the commission is a party.

That would be against the rule of natural justice and would violate the rights of the two aspirants, he argued.

Justice David Majanja dismissed the suit, ruling that granting the orders would prejudice the IEBC which has a legal mandate to determine disputes emanating from nomination of candidates for elections.

The judge said that the two aspirants would still have an opportunity to bring the matter to the High Court if they will be dissatisfied with the tribunal's ruling.
