When the matter was called on for hearing, the appellants were
represented by a battery of practitioners. These were Messrs. Mashaka
Ngole, David Shilatu, Dominicus Nkwera, Desderius Hekwe, Hamisi
Mayombo and Ms. Lilian Mushemba, all learned counsel. On its part, the
respondent Republic enlisted the services of Ms. Rose Suite, learned
Senior State Attorney, assisted by Mr. Isack Mangunu, learned State
Attorney. It Is instructive that, in the course of the submissions by the
counsel for the appellants, grounds seven and eight were abandoned,
leaving the appeal with seven grounds which were argued by Messrs
Ngole and Nkwera, while the rejoinder was done by Mr. Hekwe.
The appellants' gravamen of complaint in ground one was that
assessors who sat with the learned trial Judge were not sufficiently
summed up consistent with the requirement of section 298 (1) of the
Criminal Procedure Act (CPA). Mr. Ngole's argument, which was seriously
contested by the respondent's counsel, was that vital points of law and
substance of the evidence were not stated. This included the ingredients
of murder, the question of standard of proof and the person on whose
shoulders the burden of proof lies. Mr. Ngole further contended that
matters of credibility of witnesses, and the defence testimony adduced by
the appellants were also left unguided. He contended that, whils
