Jamii yetu inahitaji mabadiliko makubwa SANA tena ya haraka. Mitandao ndio inaharibu hawa watoto kiasi hiki. Wanaangalia picha chafu (pornography). Ubaya ni kwamba ukishaanza kuangalia tu unakuwa mtumwa kama mtu anayetumia madawa ya kulevya. Linalofuata ni kufanya ulichoona kwenye hizo video chafu. Nawasikitikia sana vijana watakaoingia kwenye ndoa miaka kumi na zaidi ijayo.

Baadhi ya wanafunzi wa kike katika Shule za Msingi na Sekondari jijini Mwanza, wamedaiwa kujihusisha na mapenzi ya kinyume na maumbile, kwa kile kilichoelezwa kukwepa kubeba mimba na kupelekea kufukuzwa shule.

Hayo yamebainika mkoani Mwanza kwenye kikao cha wadau wa elimu, kilicholenga kujadili mkakati wa kutokomeza mimba za utotoni ikiwemo kutoa elimu juu ya madhara ya kufanya mapenzi, katika umri mdogo.

Matoke Jackson ni Mkurugezi wa Asasi ya Usaidizi wa Kisheria ya Wilaya ya Ilemela (ILABU) ameibainisha kuwepo kwa tatizo hilo kwa changamoto hiyo kwa wanafunzi hasa wa shule za msingi kujihusisha na mapenzi ya kinyume na maumbile.

Mkurugezi wa Asasi ya Usaidizi wa Kisheria ya Wilaya ya Ilemela (ILABU), mkoani Mwanza, Mateko Jackson anasema kwamba, wamegundua tatizo katika Shule za Msingi zilizoko katika Jimbo hilo, linaloongozwa na Mbunge Angelina Mabula, ambaye pia ni Naibu Waziri wa Ardhi.

Jackson anasema kwamba, "watoto wa Darasa la nne wanajua namna ya kufanya mapenzi" yakiwemo "mapenzi ya kinyume na maumbile," na kwamba mapenzi ya aina hii "yamelipuka sana kwenye Shule za Msingi kuliko shule za Sekondari.

Taarifa hii, kama inavyoonekana kwenye video fupi hapo juu, imezua taharuki kubwa ya kimaadili au tuseme paniki kuu ya kimaadili (great moral panic) katika jamii, taharuki hii ikiwa haina uwiano na uhalisia wa tukio lenyewe. Kwa mfano, katika taarifa hii hakuna majibu kwa maswali haya ya kitafiti:

  1. Swali kuu la utafiti lilikuwa ni lipi?
  2. Katika dodoso la utafiti maneno "mapenzi ya[liyo] kinyume cha maumbile" yalipewa fasili gani?
  3. Shule gani za msingi zilihusika katika utafiti?
  4. Shule gani za sekondari zilihusika katika utafiti?
  5. Utafiti huo ulihusisha sampuli ya wanafunzi wangapi kati ya kundi lengwa la wanafunzi wangapi?
  6. Wanafunzi wa shule za msingi waliohojiwa ni wangapi na waliothibitika kujihusisha na tabia husika ni wangapi?
  7. Wanafunzi wa shule za sekondari waliohojiwa ni wangapi na waliothibitika kujihusisha na tabia husika ni wangapi?
  8. Walimu wa wanafunzi hawa wanasema nini kuhusu uwepo na chimbuko la tabia husika?
  9. Wazazi wa wanafunzi hawa wanasema nini kuhusu uwepo na chimbuko la tabia husika?
Napendekeza kuwa taharuki hii imekuzwa na mambo mawili.

Kwanza, hadhira yake inajumuisha Watanzania ambao ni wahitimu wa shule za Msingi, Sekondari na Vyuo ambao hawajawahi kusoma seskolojia (sexology). Hawana weledi unaoiwezesha kutofautisha kinaganaga kati ya "mapenzi yaliyo kinyume cha maumbile na mapenzi yasiyo kinyume cha maumbile."

Na pili, ni kwa sababu mwasilisha taarifa hakutoa maelezo yanayoiwezesha hadhira yake kupata jawabu kamilifu kwa swali lifuatalo: "Mapenzi yaliyo kinyume cha maumbile ni kitu gani na sio kitu gani?" Katika maelezo yake, anaonekana kutokuwa na uhakika kama anaongelea "mapenzi yaliyo kinyume cha maumbile" au "mapenzi ya jinsia moja."

Na kwa sababu hizi mbili, baadhi ya waandishi wa habari waliomnukuu wanafanya kazi kama minara ya simu inavyosafirisha mawimbi ya sauti bila kuyafanyia maboresho ya kimaudhui. Hawakumwuliza maswali ya nyongeza ili kusaidia katika kuziba pengo la maarifa lililopo.

Nisema kuwa, ombwe la majibu kwa maswali haya katika taarifa ya mtafiti pamoja na wepesi wa habari za waandishi wa habari waliomnukuu linanikumbusha Nasaha za
Wahenga wa Kale wa Magharibi mintarafu umuhimu wa mawasiliano sanifu.

Kwa mfano, katika hotuba yake iitwayo "The Last Speech," Pericles Xanthipus (470-400KK), anatwambia kwamba, "mtu yeyote ambaye ana maarifa lakini hana uwezo wa kutumia maneno fasaha kueleza mawazo aliyo nayo juu ya vitu anavyoviona katika mazingira yake ni sawa na mtu asiyejua kitu chochote." Yaani:


"A man who has the knowledge but lacks the power to express it clearly is no better off than if he never had any ideas at all."

Maneno haya yanamhusu Jackson na walimtuma kujingisha umma, kwani hawajatwambia maneno "mapenzi ya[liyo] kinyume cha maumbile" yanamaanisha nini, na hawaonekani kama wanaelewa maana zake zote.


Napendekeza kwamba, kuna viungo nane vya kupapasa mazingira ya binadamu, yaani: macho, masikio, ulimi, pua, ngozi, dhakari, papuchi, na ngoko.

  1. Jicho (eye) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa mwanga (visual sensory system);
  2. Sikio (ear) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa sauti (auditory sensory system);
  3. Ulimi (tongue) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa ladha ya vyakula vinywaji (gustory sensory system);
  4. Pua ni kiungo cha mwili kinachopapasa na kutambua uwepo wa harufu za vitu mbalimbali (olfactory sensory system);
  5. Ngozi (skin) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa kiwango cha baridi, joto, maumivu, mikwaruzo, nyufa na mgandamizo unaotokana na kani inayoikabili ngozi katika sehemu husika (somatosensory system);
  6. Dhakari (penis) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa kiwango cha baridi, joto, maumivu, mikwaruzo, nyufa na mgandamizo unaotokana na kani inayoikabili shafti yake kwa sababu ya kubanwa na kuta za kitu chenye mgandamizo unaoanzia pande mbili zinazotazamana kama ifanyavyo jenitalia ya kike (Male genital sensory system);
  7. Papuchi (vagina) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa kiwango cha baridi, joto, maumivu, mikwaruzo, nyufa na mgandamizo unaotokana na kani inayoukabili ukuta wake wa ndani kwa sababu ya kutanuliwa na kitu kigumu kama vile shafti ya jenitalia ya kiume (Female genital sensory system).
  8. Ngoko (anus) ni kiungo cha mwili kinachopapasa na kutambua uwepo wa mgandamizo unaotokana na kani inayoukabili ukuta wake wa ndani kwa sababu ya kutanuliwa na kitu kigumu kama vile kinyesi (Anal and rectal sensory system).
Kwa hiyo, tupu ya mbele ya mwanamume (dhakari) na tupu ya mbele ya mwanamke (papuchi), ni viungo vya kupapasa mazingira ya binadamu na pia viungo vya kuzaana.

Kwa sababu hii, sayansi ya ujinsia wa binadamu (sexology) inatufundsha kuwa, tupu za mbele za binadamu, yaani uume na uke, zina kazi mbili. Kuna kazi ya kuzaana na kazi ya kupapasana.

Yaani "penises and vaginas are reproductive organs and sensory organs."

Hizi tupu za mbele zinarejewa kama viungo vya uzazi pale zinapotumika kwa ajili ya kuzaana. Na hizi tupu za mbele zinarejewa kama viungo vya kupapasa pale zinapotumika kama nyenzo za kuchuana kimapenzi.

Kwa ujumla, basi, maneno ya Jackson, yaani "mapenzi ya[liyo] kinyume cha maumbile" yana utata.


Lakini mawasiliano sanifu yanahitaji matumizi ya misamiati yenye maana isiyoyumba (univocal terms).

Na dosari hii tayari limeleta madhara. Tayari nimeona mahali fulani kuwa tayari watuhumiwa anaowangelea wamefukuzwa shule.

Labda wafanya maamuzi walitumia tafsiri ya maneno "against the order of nature" iliyo kwenye biblia uu kwenye Kanuni ya Adhabu CAP 16 RE 2002. Lakini, huko nako hakuna tafsiri yake ya kisheria.

Hivyo, ni rai yangu kwamba, Waafrika tunapaswa kufikiri kwa sauti ili kuepuka utata huu na hivyo kuboresha mawasiliano kati yetu.

Kuna wakoloni mamboleo huko nje ya Afrika na vibaraka wao hapa kwetu bado wanajenga hoja kwamba wanafunzi wasifundishwe, wasiongelee wala kujadili kitu chochote kuhusu ujinsia wa binadamu isipokuwa mambo yale tu ambayo wao wanayaruhusu.

Lakini, huu ni mkakati wa kumjingisha Mwafrika. Na tukijingishwa na tukakubali kujingika tutakuwa mazuzu na anayetujingisha huku akijuakuwa anatuambia mambo ya kijinga atatudhaurau.


Kwa sababu ya umuhimu wa kutenganisha sheria za nchi isiyofungamana na dini yoyote na Misahafu ya Kidini, tayari mataifa kama vile
Singapore wametenganisha misamiati ya kidini na sheria za Bunge la nchi yao.

Katika sheria yao, "Penal Code (Amendment) Act 2007 (No. 51 of 2007)," ambayo nimeambatanisha hapa chini, vifungu vya 68 hadi 72 vinaonyesha vema jambo ninaloliongelea hapa.

Kuhusu sheria hii ya Singapore, tunasoma haya, maneno muhimu yakiwa yamewekewa rangi kwa ajili ya kuonyesha msisitizo kwamba kuna uwezekano wa kuzingatia ukweli na uwazi katika kutunga sheria zetu:


68. Sections 375 to 376D of the Penal Code are repealed and the following sections inserted

“Rape 375.—(1) Any man who penetrates the vagina of a woman with his penis — (a) without her consent; or (b) with or without her consent, when she is under 14 years of age, shall be guilty of an offence….

Sexual assault by penetration: 376.—(1) Any man (A) who — (a) penetrates, with A’s penis, the anus or mouth of another person (B); or (b) causes another man (B) to penetrate, with B’s penis, the anus or mouth of A, shall be guilty of an offence if B did not consent to the penetration. (2) Any person (A) who — (a) sexually penetrates, with a part of A’s body (other than A’s penis) or anything else, the vagina or anus, as the case may be, of another person (B); (b) causes a man (B) to penetrate, with B’s penis, the vagina, anus or mouth, as the case may be, of another person (C); or (c) causes another person (B), to sexually penetrate, with a part of B’s body (other than B’s penis) or anything else, the vagina or anus, as the case may be, of any person including A or B, shall be guilty of an offence if B did not consent to the penetration….

“Sexual penetration of minor under 16: 376A.—(1) Any person (A) who — (a) penetrates, with A’s penis, the vagina, anus or mouth, as the case may be, of a person under 16 years of age (B); (b) sexually penetrates, with a part of A’s body (other than A’s penis) or anything else, the vagina or anus, as the case may be, of a person under 16 years of age (B); (c) causes a man under 16 years of age (B) to penetrate, with B’s penis, the vagina, anus or mouth, as the case may be, of another person including A; or (d) causes a person under 16 years of age (B) to sexually penetrate, with a part of B’s body (other than B’s penis) or anything else, the vagina or anus, as the case may be, of any person including A or B, with or without B’s consent, shall be guilty of an offence. (2) Subject to subsection (3), a person who is guilty of an offence under this section shall be punished with imprisonment for a term which may extend to 10 years, or with fine, or with both….

69. Chapter XVI of the Penal Code is amended by deleting the sub-heading “Unnatural offences” immediately above section 377.

70. Section 377 of the Penal Code is repealed and the following section substituted therefor:

“Sexual penetration of a corpse 377.—(1) Any man who penetrates, with his penis, the vagina, anus or mouth, as the case may be, of a human corpse, shall be guilty of an offence. (2) A man who is guilty of an offence under subsection (1) shall be punished with imprisonment for a term which may extend to 5 years, or with fine, or with both. (3) Any person (A) who causes any man (B) to penetrate with B’s penis, the vagina, anus or mouth, as the case may be, of a human corpse, shall be guilty of an offence if B did not consent to the penetration. (4) A person who is guilty of an offence under subsection (3) shall be punished with imprisonment for a term which may extend to 20 years, and shall also be liable to fine or to caning.”


Mtafiti mmoja, Stewart Chang, katika andiko lake, “The Postcolonial Problem For Global Gay Rights (tazama kiambatanisho),” ameandika maneno yafuatayo kuhusu marekebisho haya:

"The Original text of section 377 in the old Singapore's Penal Code read as follows:

'Whoever has carnal knowledge against the order of nature with any man, woman or animals, shall be punished with imprisonment for life, or with imprisonment for a term which may extend to 10 years, and shall also be liable to fine. Explanation - Penetration is sufficient to constitute the carnal intercourse necessary to the offence described in this section (Singapore’s Penal Code (Cap. 224, RE 1985)).'


"In 2007, the Singapore Parliament's reasoning for deleting this paragraph was that societal values had changed regarding consensual oral and anal sex between heterosexual adults.

"That is, as the Penal Code reflects social norms and values, deleting section 377 was the right thing to do as Singaporeans, by and large, do not find oral and anal sex between two consenting male and female in private offensive or unacceptable.

"This fact was clear from the public reaction to the case of PP vs. Anis Abdullah in 2004 and was confirmed through the feedback received in the course of the Penal Code review consultation."


Kesi ya PP vs. Anis Abdullah (2004) ya Singapore haina tofauti sana na kesi ya Amber Rutty hapa Tanznaia.

Kwa ujumla, yaliyofanyika Singapore yanaweza na yanapaswa kufanyika Tanzania. Linalowezekana leo lisingoje kesho. Naongelea kifungu cha 154 katika sheria ya Kanuni ya Adhabu ya Tanzania CAP 16, RE 2002. Yaani:


154. Any person who—
(1) has carnal knowledge of any person against the order of nature; or
(2) has carnal knowledge of an animal; or
(3) permits a male person to have carnal knowledge of him or her against the order of nature,
is guilty of a felony, and is liable to imprisonment for fourteen years.

Wapenzi wote ambao wanafanya mapenzi ya kondomu, mapenzi ya mdomo wanakiuka kifungu hili cha sheria zetu, kwa kuwa matendo yote haya ni "carnal knowledge of any person against the order of nature."

Hivyo, kama kifungu hiki kitatekelezwa kwa ukamilifu na Jeshi la Polisi la Tanzania wahusika wote watafungwa miaka 14 jela, na jela zote zitajaa!

Kwa hiyo, kutumia kifungu hiki dhidi ya Amber Rutty na kuwaacha hawa watu baki ni ubaguzi wa kisheria. Kusudi haki itendeke, ama kifungu hiki kitekelezwe kwa usawa au kifutwe kabisa.

Mimi napendekeza kifutwe na kuandikwa upya kama walivyofanya watu wa Singapore. Lakini., mawazo yangu kuhusu marekebisho yni haya:


154B. (1) Any adult male person who is not a medically certified homosexual person and who engages in pedication with any adult male person who is not a medically certified male homosexual person; or

(2) Any adult female person who is not a medically certified female homosexual person and who engages in tribbing with any adult female person who is not a medically certified female homosexual person; or

(3) Any homosexual male person who engages in pedication with any homosexual male adult person without his consent; or
(4) Any male person who engages in pedication with any female adult person without her consent; or

commits an offense.



Basi, nimalizie hoja yangu kwa kusema kuwa, katika kufanya kazi hii ya kufuma Imani ya Jamii kwa Ajili ya Taifa Jipya (a social doctrine of the new nation), tukumbuke maneno ya Pericles Xanthipus (470-400KK), anayetwambia kwamba, "mtu ambaye ana maarifa lakini hana uwezo wa kutumia maneno fasaha kueleza mawazo aliyo nayo juu ya vitu anavyoviona katika mazingira yake ni sawa na mtu asiyejua kitu chochote."
