MAIGE. 3.A.:
Article 13 (1) of the Constitution of the United Republic of Tanzania,
2017 ("the Constitution"), provides for equality before the law and
prohibits any form of discrimination. Under sub-article (3) thereof, such right and other civic rights set out in part III of the Constitution are justiciable. To ensure that such right is duly protected, sub-article (6)
requires the state authority to put in place procedures which are appropriate or that which observe the following principles

might have already affected the appellant, would have not been dealt with by the criminal court. Come what may, in as long as what are alleged to have been committed or omitted are prohibited by statutory laws, they
would, if proved, amount to abuses of powers by the respective
government authorities to the extent that they are utra vires the law. Such an illegal conduct can effectively be addressed by way of ordinary judicial review whose primary purpose is to supervise the legislature and executive
branches where they exceed their statutory powers. This was theposition in the Attorney General v. Dickson Sanga (supra) where it was observed:

his oral submissions, the Solicitor General contended that, a remedy of judicial review is available to the accused personf on alleged abuse o f authority by
the DPP. Apart from agreeing with the Solicitor Genera!'it is our firm view that the Constitution which is the
supreme law o f the land frowns on the abuse or misuse
o f procedures in dispensing crim inal justice.
Thus, in case o f any abuse by the DPP the safeguard and remedy is to seek judicial review before the High Court by
invoking the Law Reform (Fatal Accidents and Miscellaneous Provisions) Act, [CAP 310 R.E. 2002] as correctly asserted by the Solicitor General."
Kiongozi huyu mkuu wa Chadema Freeman Mbowe alitiwa mbaroni huko jijini Mwanza usiku wa kuamkia tarehe 21 mwezi Julai, 2021. Chama chake cha CHADEMA, kiliwataka wafuasi wa chama hicho kuingia mtaani kumtafuta baada ya juhudi zake za kumtafuta kukwama na hawajui walipo, baada ya Mamlaka kutosema lolote kwa muda kuhusu kukamatwa kwa Freeman Mbowe.
Baadae Polisi walikuja kuthibitisha kumkamatwa na kwamba amesafirshwa kutoka Mwanza kwenda Dar es Salaam na kuunganishwa kwenye kesi ya ugaidi.
Taarifa ya Msemaji wa Polisi, David Misime ilisema kuwa Mbowe hakukamatwa kwa tuhuma za kupanga na kuandaa kongamano la Katiba mpya jijini Mwanza bali alifahamu tuhuma zinazomkabili.
Julai 26, 2021: Alifikishwa mahakamani
Freeman Mbowe alifikishwa katika Mahakama ya Hakimu Mkazi Kisutu kwa mara ya kwanza Julai 26, 2021 na kusomewa mashtaka mawili ikiwemo la ugaidi. Baada ya kusomewa maelezo Freeman Mbowe hakutakiwa kujibu chochote kwa kuwa Mahakama hiyo haina mamlaka, kesi ikahairishwa hadi Agosti 5, 2021 kusubiri nyaraka ili ihamishiwe Mahakama kuu.
Agosti 6, 2021 Alisomewa Mashitaka
Freeman Mbowe ambaye ni kiongozi wa zamani wa Kambi Rasmi ya Upinzani Bungeni (KUB) na wenzake watatu (makomandoo) walisomewa mashtaka sita yakiwemo ya kufadhili vitendo vya ugaidi na kukusanya pesa kwa kufanya vitendo hivyo.
Mashtaka mengine ni kukusanya fedha kwa ajili ya kufanya vitendo vya kigaidi, kukutwa na silaha aina ya bastola na kukutwa na sare za jeshi kinyume cha sheria. Kati ya mashtaka hayo sita, Freeman Mbowe anakabiliwa na mashtaka mawili ambayo ni kula njama na kufadhili vitendo vya kigaidi.
Agosti 9, 2021: Rais Samia azungumzia Kesi ya Mbowe
Rais wa Tanzania Samia Suluhu Hassan licha ya kusema hawezi kuzungumzia zaidi kesi ya Freeman Mbowe kwa kuwa iko Mahakamani, aliiambia BBC kuwa mashtaka dhidi ya kiongozi huyo wa Upinzani hayakuchochewa kwa sababu za kisiasa.
Pamoja na mengine kauli yake hiyo iliibua mjadala mzito kwa wafuatiliaji wa kesi hiyo na siasa za Tanzania kwa ujumla.
Septemba 03, 2021: Kuanza kusikilizwa kwa kesi
Kesi hii ilianza kusikilizwa kwenye Mahakama kuu ya Makosa ya Rushwa na Uhujumu Uchumi ikitokea Mahakama ya Hakimu mkazi Kisutu ambayo haikuwa na mamlaka ya kusikiliza kisheria.
Jaji Elinaza Luvanda alijitoa kusikiliza kesi hiyo kufuatia maombi ya Freeman Mbowe, kwa niaba ya washitakiwa wenzake kudai kuwa hawana Imani na Jaji huyo kama atatenda haki. Nafasi yake akapangiwa Jaji Mustapha Siyani.

Maana yake DPP, IGP POLISI, Mwanasheria Mkuu wa Serikali wamepewa ruksa kutukamata, kutufungulia kesi, kutukandamiza kisheria bila kuwajibika kutufikisha korti na mahakamani ndani ya saa 48 toka kutiwa nguvuni.
Kesi zingine za watu ambao bado wanashikiliwa bila kufikishwa mahakamani ndani ya saa 48, kwa ruling / tafsiri ya Mahakama ya juu kabisa Tanzania yaani Mahakama ya Rufani Tanzania iliyotolewa leo 30 agosti 2024 itachukuliwa kama ndiyo utaratibu sahihi hadi hapo Katika Mpya itapotamka vinginevyo kuondoa utata wa kisheria unaotoa manufaa kwa DPP na IGP POLISI ....
Tanzania hatuna mahakama, bali majengo yaliyopewa majina ya mahakama. Lakini ndani ya majengo hayo wamejaa maharamia wa CCM kwaajili ya kuihadaa Dunia.
Hukumu ya Sugu iliandikwa na mkuu wa mkoa na viongozi wa CCM wa mkoa, kisha kupewa hakimu kwenda kuisoma mahakamani.
Rostam Aziz naye alikwishatamka kuwa Tanzania haina mahakama, kwani majaji huwa wanapigiwa simu toka ikulu kuwaelekeza wanatakiwa kutoa hukumu ya namna gani.
Kusubiria haki toka mahakama za Tanzania, ni sawa na kumsubiria kenge azae mwanadamu.
Katiba hii ya viraka ambayo bunge hili la chama kimoja huwa halitaki kabisa kutia viraka vingine muhimu kwa ajili ya 4R, kuondoa uchaguzi kusimamiwa na TAMISEMI, wakurugenzi DED wasisimamie uchaguzi mkuu, kuzuia kuchukuliwa bila kufikishwa kituo cha polisi, haki ya kufikishwa mahakamani ndani ya saa 48, wananchi kuhamishwa kwa nguvu ya dola n.k
