MAHAKAMA YA RUFANI: CMA HAINA MAMLAKA WAFANYAKAZI WA UMMA
Mahakama ya Rufani ya Tanzania imesema Tume ya Usuluhishi ya wafanyakazi (Commission for Mediation and Arbitration-CMA) haina mamlaka ya kusikiliza na kutolea maamuzi kesi zinazohusu migogoro ya wafanyakazi wa umma.
Kupitia kesi ya rufaa ya madai CIVIL APPEAL NO. 12 OF 2022 TANZANIA POSTS CORPORATION VERSUS DOMINIC A. KALANGI mahakama hiyo ya juu zaidi ya Tanzania imesema migogoro ya wafanyakazi wa umma inatakiwa kuishia ndani ya Serikali, pale mfanyakazi anapofukuzwa kazi na mkuu wa idara au shirika la Serikali anatakiwa kukata Rufaa kwenda Tume ya Utumishi wa Umma, na endapo mfanyakazi atakuwa hajaridhika na maamuzi ya Tume ya Utumishi wa Umma basi anatakiwa akate rufaa kwenda Kwa Rais wa Jamhuri ya Muungano wa Tanzania na maamuzi ya Rais yatakuwa ya mwisho, hii ni Kwa mujibu wa Kifungu Cha 25 Cha sheria ya utumishi wa umma Public Service Act (Cap 298 R.E. 2019)
Dominic A. Kalangi alikuwa mfanyakazi wa Shirika la Posta (Tanzania Posts Corporation), mwaka 2017 ajira yake ilisitishwa Kwa utovu wa nidhamu.
Dominic alipeleka malalamiko yake CMA ambapo alishindwa kesi akakata Rufaa Mahakama kuu Mtwara ambapo mahakama kuu ikaamuru Shirika la Posta limlipe fidia ya mishahara ya miezi sita Dominic A kalangi. Shirika la Posta likakata Rufaa Mahakama ya Rufani ya Tanzania
Kwa Mujibu wa sheria Shirika la Posta la Tanzania ni Mali ya umma linalomilikiwa na serikali hivyo wafanyakazi wake ni watumishi wa umma.
"Going by the wording of the above-quoted provision, it is unambiguously clear that all disciplinary matters or disputes involving public servants are exclusively within the domain of the Public Service Commission whose decision is appelable to the President. As correctly submitted by Ms. Kinyasi and as amply demonstrated above, the CMA has no jurisdiction to adjudicate upon such matters."
