OFISI ya Bunge imesema kuna uwezekano wa kubadilishwa au kufutwa kabisa kwa Muswada wa Sheria ya Marekebisho ya Katiba wa mwaka 2011, endapo itaonekana kuna sababu za msingi.Hayo yamebainishwa katika taarifa kwa umma iliyotolewa jana na Idara ya Habari, Elimu kwa Umma na Ushirikiano wa Kimataifa ya Ofisi ya Bunge.

"Muswada huo, ambao Bunge liliupitishwa baada ya kuusoma kwa mara ya tatu, ambao unasubiri kuwa sheria baada ya Rais kutia saini na kuwa sheria utaendelea kusimamiwa na kutekelezwa kama sheria nyingine yoyote ambayo utekelezwaji wake unaweza kusababisha mtizamo tofauti na hivyo kupelekea kufanyiwa marekebisho endapo itaonekana kuwa ipo sababu ya kufanya hivyo na mbunge yeyote, kamati au Serikali," ilisema taarifa hiyo na kuongeza:

"Kwa hiyo endapo sababu zitaonekana kuwa za msingi, basi kubadilishwa au kufutwa wote na Bunge. Kwa hiyo kwa taratibu za uendeshaji, Bunge haikuwepo sababu ya msingi kuzuia muswada huo usisomwe kwa mara ya pili na pia hapakuwa na kanuni zozote, zilizozuia usisomwe kwa mara ya pili kwa kuwa ulikidhi mahitaji yote kikanuni."

Ilisema baada ya kusomwa kwa mara ya kwanza Bungeni, wananchi hupata fursa ya kushiriki kutunga sheria ama kwa kushiriki wao wenyewe kutoa maoni au kupitia wabunge ambao ndiyo wawakilishi wao.

"Wakati wa kujadili muswada huu mara baada ya kusomwa kwa mara ya pili na kabla haujasomwa kwa mara ya tatu, wabunge walikuwa na nafasi ya kuwasilisha mawazo yao kwa kuchangia," ilieleza taarifa hiyo.

Imeeleza kuwa baadhi ya wabunge walitekeleza demokrasia hiyo kwa kuwasilisha mapendekezo yao pamoja na jedwali la mabadiliko.

Taarifa hiyo ya Bunge ambayo imekuja huku kukiwa na shinikizo kubwa kutoka kwa baadhi ya wanasiasa wakiongozwa na chama kikuu cha upinzani cha Chadema na na wanaharakati chini ya Jukwaa la Katiba, ilifafanua kuwa muswada huo ulilenga kuweka chombo ambacho kitafanya kazi ya kuchukua maoni ya wananchi ili kuyapeleka katika Bunge la Katiba ambalo litakuwa na nafasi ya uwakilishi wa kila mtu katika jamii.

Pia imesema muswada huo ni kama mingine iliyopitishwa na Bunge na unaweka utaratibu wa kuwafikia wananchi, kuwasikiliza na kupata utashi wao juu ya mapendekezo ya kuandika Katiba Mpya ili kila Mtanzania aweze kushirikishwa.

"Lakini muswada wenyewe hauhitaji ushiriki wa moja kwa moja wa wananchi isipokuwa kupitia kwa wawakilishi wao; wabunge, walipitisha kwa kauli moja kuwa Sheria na siyo Katiba kama inavyoelezwa na baadhi ya wadau."

"Bunge limeuchambua Muswada wa Sheria na kuupitisha kuwa sheria na siyo muswada wa kubadilisha katiba. Katiba sasa haitobadilishwa, bali itaandikwa upya na Serikali iliyopo madarakani kwa sasa na Bunge lake."

ASKOFU Mkuu wa Kanisa Katoliki Jimbo Kuu la Dar es Salaam, Mwadhama Polycarp Kardinali Pengo, amesema angependelea mchakato wa Katiba mpya uendelee haraka ili iweze kutumika katika Uchaguzi Mkuu ujao wa mwaka 2015.

Amewataka Watanzania kutambua umuhimu wa suala hilo ili iweze kupatikana haraka kwa lengo la kuepusha vurugu zinazoweza kujitokeza.

"Kama inawezekana ni vyema tukatumia hata muda wa kipindi cha mwaka mmoja ujao ili tuweze kuipata Katiba hiyo, miaka minne ijayo tunatarajia kuingia katika Uchaguzi Mkuu, hivyo kama tutachelewa kuipata inaweza ikaleta hali isiyo ya kawaida," alisema Pengo.

Alikuwa akizungumza wakati akitoa salamu za Sikukuu za Krismasi na Mwaka Mpya wakati
alipozungumza na waandishi wa habari jana jijini Dar es Salaam.

Tayari Muswada wa Marekebisho ya Katiba wa Mwaka 2011 umepitishwa na Bunge lililopita na umeshatiwa saini na Rais Jakaya Kikwete ili kuwa sheria, tayari kuanza mchakato wa
kupata Katiba mpya.

Kwa mujibu wa Waziri Mkuu Mizengo Pinda, Katiba mpya inatarajiwa kuwa imepatikana mwaka 2014, mwaka mmoja kabla ya Tanzania kuingia katika Uchaguzi Mkuu wa tano tangu kuanza kwa mfumo wa vyama vingi nchini mwaka 1992.

Kumekuwapo na vuguvugu kubwa kuhusu mchakato huo wa Katiba tangu Rais Kikwete alipotangaza kuwa anataka kuwepo na mchakato wa kuandika Katiba mpya na hatimaye
muswada huo ukapelekwa bungeni, ambako mara ya kwanza Aprili mwaka huu, ulipata upinzani mkubwa kwa wabunge.

Serikali ilisikia kilio na maoni ya wabunge na wadau wengine na kwenda kuurekebisha kabla ya kuuwasilisha katika Bunge lililopita Novemba mwaka huu, ambako ulipitishwa Novemba 18, mwaka huu, tayari kumwezesha Rais kuunda Tume ya kukusanya maoni kuhusu mchakato huu wa kuunda Katiba mpya.

Aidha, katika hatua nyingine, Kardinali Pengo amechukizwa na viongozi wanaojifikiria wenyewe kwa kutaka kujiongezea posho, huku wananchi walio chini yao wakiendelea kuandamwa na umasikini.

Kauli yake imekuja wakati umma wa Tanzania ukiwa umekasirishwa na taarifa za wabunge kuongezewa posho kutoka Sh 70,000 hadi Sh 200,000 kwa vikao vyao, hali ambayo imezusha malalamiko makubwa.

Kardinali Pengo alisema, "tabia hiyo haifai kwa taifa letu ambalo linajivunia jubilee ya miaka 50 ya Uhuru uliopatikana kutoka kwa Mwingereza mwaka 1961."

Alisema inashangaza kuona licha ya mishahara na marupurupu wanayoyapata viongozi hao, bado wanaendelea kung'ang'ania ongezeko la posho badala ya kufikiria namna ya kumwokoa kimaisha mwananchi masikini zaidi aliye chini yao.

"Hivi kama mtu unapata mshahara kama wa mbunge na maslahi mengine anayoyapata katika kazi yake, unawezaje kuona maisha magumu, inapaswa waache kujifikiria wenyewe ili kumuokoa mwananchi wa chini," alisema Pengo akitoa salamu hizo wakati alipozungumza na vyombo vya habari.

Aidha, amewataka wananchi kuacha kufikiria kuwa maisha ni kubahatisha na badala yake wajitume katika kufanya kazi ili kujikomboa kimasha huku akitolea mfano falsafa ya Baba wa Taifa, Mwalimu Julius Nyerere kuwa Uhuru ni Kazi.

Alitumia nafasi hiyo kuipongeza Serikali kutokana na msimamo wake wa kutounga mkono suala la ushoga, aliosema hauna tofauti na uendawazimu kwa kuwa unakwenda kinyume cha maagizo ya Mwenyezi Mungu.

Pia alisema vurugu za vyama vya siasa na maandamano yanayoendelea kutokea nchini, inaonesha kutoelewa vyema mfumo wa vyama vingi kutokana na kuathiriwa na mfumo wa
chama kimoja, suala aliloeleza kuwa linaweza kupata suluhisho pindi Katiba mpya itakapopatikana.

Kuhusu maandamano ya wanafunzi wa vyuo vikuu, alisema umefika wakati kwa wanafunzi hao kutafuta namna ya kufikisha madai yao badala ya vurugu zinazisababisha uharibifu wa mali.

Pia aliitaka Serikali kutafakari nini chanzo cha maandamano hayo na kuondoa uonevu palipo na uonevu huku ikitambua kuwa vurugu haziwezi kuzimwa kwa silaha.

"Kama mtoto wa mkulima ananyimwa mkopo huku wa mbunge anapewa mkopo, kwa vyovyote lazima utakuwa unatengeneza mazingira ya kutokea vurugu," alieleza Pengo.

RECENTLY, Wilson Mukama, the general secretary of the political Party of the Revolution ‘Chama cha Mapinduzi' (CcM), came out with the statement that the veteran ruling party is considering proposing that Tanzania should adopt the concept of Proportional Representation (PR) as part of the country's efforts at good governance. [HabariLeo, November 29, 2011].

Generally speaking, proportional representation is an electoral system designed to represent in a legislative body each political party or other grouping/independent candidates in proportion to their actual voting strength within the electorate concerned.

There are different kinds of the system. In one of its forms, proportional representation sees to it that the electors ‘vote' by numbering the candidates aspiring for the available post in their order of preference. In the event, any votes received by a candidate in excess of those needed to be ‘voted' into Office are transferred to other candidates.

The different types of the system notwithstanding, however, the basic principles underlying proportional representation elections remain the same. These are that all voters deserve representation; and that all political groups in society deserve to be represented in their legislatures in proportion to their strength in the electorate.

In other words, everyone should have the right to fair representation no matter what!
If nothing else, this mode of voting helps to secure representation of minority groups in proportion to their inherent strength on the ground. It also helps to save time, energy, funds, patience and other resources by making by-elections down the political road redundant and, therefore, unnecessary.

Government by Democracy provides a fundamental way in which the people at large control their Government. This is usually done through a combination of methods that entail universal suffrage, rule by the majority, and the right/duty to oppose the Government of the Day!

‘Universal suffrage,' of course, means that - with a few specific, statutorily-backed exceptions - citizens are enabled to elect their own representatives… And, the right to oppose and criticize Government as a duty is vital to bona fide Democracy. Ideally, this must be unequivocally recognised in the Constitution, and respected by the Government of the Day as a matter of course.

It is in the light of the foregoing, then, that we should view the CcM intimation at Proportional Representation not with a jaundiced eye, but with renewed hope. This is especially predicated upon the fact that those among us who really matter in the nation's daily life are correctly seeing the light on the road to a richer democracy.

In this, they must be encouraged - pushed, if necessary - to pursue that noble path to its logical conclusion… In other words, every stone must not be left unturned; every opportunity must be taken, to ensure that the Proportional Representation concept is firmly entrenched in the Constitution-making processes that are already ongoing in Tanzania.

The prime goal should be to ensure that the system becomes operational in the next general elections which will be conducted at the Local Government level in October 2014, as well as the Presidential, Parliamentary and Council elections which are tentatively slated for October 2015.

Doing this is bound to save Tanzania and Tanzanians from the hassle and ghastly ‘costs' which have become routinely associated with by-elections in Tanzania. Regrettably, this has been the case especially following resumption of the multi-party political system via legislation in 1992, and the first multi-party general elections in 1995, after a little more than a generation of single party politics and elections.

Important here, it must be stressed, is that the idea as broached by the ruling party must not be allowed to wither and peter away. It must be carried up and forward with the enthusiasm it deserves.

Equally important is also the need for the relevant authorities - not least of them the ruling party and its respective Governments, as well as other stakeholders in the nation's welfare - to carefully choose the variety of proportional representation Tanzania needs.

Reportedly, more that 80 per cent of the scores of the countries using proportional representation at the national level - ranging from Albania and Angola to Uruguay, Wallis-&-Futuna, and including South Africa - practise the Party List voting type of proportional representation, with minor variations here and there.

Perhaps we should start by considering this, whereby voters indicate on the ballot paper their preference for a particular political party (or independent candidate). These are then allocated seats in proportion to their share of the vote...

In any case, let's give proportional representation a chance. That is the least it deserves from lovers of bona fide Democracy.

Zimbabwe: Mugabe and ‘Shangirai'. Kenya: Mwai Kibaki and Raila Odinga. Zanzibar: Karume and Maalim Seif. Will it be Congo with Kabila and ‘Shisekedi'? Imagine a country in Africa called the Democrazed Republic of Kweusi with 10 million voters.

It is election time…This word ‘election' reminds me of a joke: A Westerner once asked a Chinese man, "How often do you have elections in your country? I mean, how frequently?" The Chinese man replied, " Ah, in China men have one election in the morning and one election in the evening…evely day".

The westerner understanding the problem that some Chinese have in pronouncing their R's as L's decided not to pursue the subject further… Back to my story: It is election time in the DRK. The country has three main political parties; the Democratic Party of Kweusi (DPK) is the one currently in power.

The others are the Peoples Party of Kweusi (PPK) and the Kweusi Kwanza Party (KKP). The campaigns have gone on very well and very peacefully by third world standards. There has been the usual political mudslinging, some riots and violence at campaign meetings, but miraculously no one has been killed.

The press has had great fun with election news, cartoons and documentaries. So far even noises about irregularities at polling stations have been minimal. In Africa, incumbent parties are known to hold the controls of the election rigging machinery, but so far DPK (the ruling party) has not been openly accused of doing so.

The other parties are warily waiting for the election results… they are thinking that either the DPK has reformed from its vote stealing days or the theft of votes has been done so cleverly that they have not been able to find proof of its existence. It's all ears to the electoral commission announcement.

As usual in Africa each party is expecting to win and will declare the results null and void if they are not voted into power. The results come out: DPK has won the election with 40% of the vote. Kweusi Kwanza has 30% and PPK has won 20%.

The remaining 10% has gone to the remaining small parties. Supposing their constitution
needed a majority of over 45% for a clear victory, this would be a stalemate. In spite of the diversity in their policies, if the constitution of their country allowed KKP (30%) and PPK (20%) to form a coalition government with a total of 50%, this could give victory to this pair, leaving out DPK, the simple majority winner.

In the election scenario above, if the constitution had said the winner is DPK by a simple majority, then the will of four million voters takes precedence over the six million. In the case of the coalition government, the will of five million voters take precedence over the other five million for the period until the next election.

In many cases, politics is not just leadership and public service; it is also a livelihood, and a good one at that; a life of fame and fortune (and posho). People are ready to invest heavily in politics in order to reap the benefits of election victory. Many will not accept a complete defeat as reward for their efforts because, after all, they really do have political support; the millions who voted for them.

The solution to the above is a power sharing agreement as what has happened in Zimbabwe, Kenya and Zanzibar. These could be the new models for African democracy. We have been sharing food and sharing shelter. We are now even sharing costs of education and health. Why don't we share power? The only question is how.

KATIBU Mkuu wa chama tawala, Chama Cha Mapinduzi (CCM), Wilson Mukama amesema Jaji Mkuu mstaafu Augustino Ramadhani alikuwa sahihi kutoa uamuzi kuwa suala la mgombea binafsi lilikuwa la kisheria na si la kisiasa.

Akichangia mada ya Kuzitafakari Upya Taasisi za Kisiasa na Utawala Tanzania iliyotolewa na Dk Mohammed Bakari wakati wa Mkutano wa 18 wa Hali ya Siasa Tanzania jana kwenye Ukumbi wa Blue Pearl, Ubungo jijini Dar es Salaam, mahakama bado haijaonyesha dalili za kulinda Serikali iliyopo madarakani na kuwakandamiza wanyonge na kutokana na maamuzi ya mwaka 2010 ya suala la mgombea binafsi.

Mukama alisema bunge ndicho chombo pekee chenye uwezo wa kutengua sheria na si mahakama.

"Ilipopitishwa kuwapo vyama vingi nchini lengo ni kuvifanya vyama vijijenge kuwa taasisi na si mtu mmoja na kuona mgombea binafsi kutowezekana kwa sababu hakuna watu watakaokuwa wakimwangalia mwenendo wake katika taasisi yake."

Aidha, amesema michango ya wajumbe ilionyesha CCM inachangia kuwapo migogoro, imejaa hisia kuliko uhalisia na kudai kuwa tofauti za kimawazo si migogoro.

Pia Mukama alisema haiwezekani kwa Chama cha Demokrasia na Maendeleo (Chadema) kupewa nafasi ya kutengeneza katiba wakati hawana ridhaa ya wananchi.

"Hoja zao walitakiwa wazipeleke bungeni wao wakatoka nje, hatuwezi kuendesha nchi kwa kiuanaharakati kwa kuwakusanya wahuni na kudai ndio nguvu ya umma," alisema na kusisitiza wananchi wanahitaji majawabu ya matatizo yao ya msingi na si majibu.

Akiwakilisha mada ya Demokrasia na Mabadiliko ya Uchumbi, Profesa Samuel Wangwe alisema pamoja na kuwapo na juhudi za serikali za kuboresha uchumi, bado hakuna mageuzi ya kweli yaliyofikiwa mpaka sasa.

Alisema katika sekta ya kilimo tangu mwaka 1960, bado kilimo kina tija ndogo na kudai kuwa pamoja na kuwapo dira ya maendeleo ya mwaka 2025, bado hakuonyeshi dhamira ya dhati ya kufikia dira hiyo.

Naye Dk Benson Bana akitoa mada ya Demokrasia na Mageuzi ya Kijamii Tanzania: Nini Kifanyike, alisema kunatakiwa kuwapo kwa uboreshwaji katika uwanja wa siasa, uchumi na elimu na matumizi ya TEKNOHAMA.

KATIBU Mkuu wa chama tawala, Chama Cha Mapinduzi (CCM), Wilson Mukama amesema Jaji Mkuu mstaafu Augustino Ramadhani alikuwa sahihi kutoa uamuzi kuwa suala la mgombea binafsi lilikuwa la kisheria na si la kisiasa.

MUkaama hajausoma uamuzi wa mahakama ya Rufaa...............wao walisema kuwa suala hilo ni la kisiasa na wala siyo la kimahakama....................kwahiyo Muakama anajionglea tu.....................na anashindwa kuelewa kuwa mahakama iliongopa kwa sababu katiba na haki zake siyo siasa pekee lakini ni sheria pia............
 
Mukama alisema bunge ndicho chombo pekee chenye uwezo wa kutengua sheria na si mahakama.

Huyu mtu ccm ilimwokota wapi?........hata katiba yetu haijui......................ukweli ni kuwa katiba imeipa mamlaka mahakama kutengua sheria zozote zile zilizotungwa na Bunge kama zinakiuka katiba..............................kauli ya Muakama inasikitisha sana.................Bunge nalo lina mipaka yake na chombo chenye mamlaka ya kuthibiti hiyo miapaka ya kutunga sheria ni mahakama tu.........nina wasiwasi mkubwa na upeo wa Mukama katika kukisaidia chama cha mapinduzi....
 
"Ilipopitishwa kuwapo vyama vingi nchini lengo ni kuvifanya vyama vijijenge kuwa taasisi na si mtu mmoja na kuona mgombea binafsi kutowezekana kwa sababu hakuna watu watakaokuwa wakimwangalia mwenendo wake katika taasisi yake."

ingelikuwa hili ni kweli basi ufisadi nchini humu usingelikuwepo kwa sababu vyama vya siasa vingeliwathibiti wanachama wake........Mukama hana uwezo kwa cheo ambacho ccm wamempa.........
 
Pia Mukama alisema haiwezekani kwa Chama cha Demokrasia na Maendeleo (Chadema) kupewa nafasi ya kutengeneza katiba wakati hawana ridhaa ya wananchi.

Hivi Muakama anajua kweli ridhaa ya wananchi ni nini?..............kuwa na wabunge ndiyo ridhaa yenyewe na asichoelewa Muakama ni kuwa katika katiba iliyopo Bunge halina mamlaka ya kutunga katiba mpya ila kuirekebisha hii iliyopo...........

MWENYEKITI wa Kigoda cha Mwalimu Nyerere Profesa Issa Shivji amekosoa Sheria ya Mchakato wa Kuundwa kwa Katiba mpya iliyosainiwa na Rais Jakaya Kikwete hivi karibuni na kusema kuwa ni mbovu na haitazaa katiba bora. Novemba 29 mwaka huu, Rais Jakaya Kikwete alitia saini Muswada wa Sheria ya Mabadiliko ya Katiba ya mwaka 2011 huku kukiwa na malumbano makali kutoka asasi za kiraia, vikiwemo vyama vya siasa, kupinga hatua hiyo kwa maelezo kwamba, mchakato huo uliendeshwa kwa mizengwe na Hata hivyo, taarifa ya kusainiwa muswada huo iliyotolewa na Ikulu kwa vyombo vya habari, ilieleza kuwa hatua hiyo ya Rais Kikwete, ilikamilisha safari ya kutungwa kwa Sheria ya Mabadiliko ya Katiba ya Mwaka 2011 baada ya Bunge kupitisha muswada huo uliowasilishwa na Serikali huku ikiweka wazi kuwa Serikali itaendelea kusikiliza maoni na mawazo ya wadau na wananchi mbalimbali kuhusu namna ya kuboresha sheria hiyo. '' Mheshimiwa Rais Kikwete anatoa wito kwa mwananchi yeyote mwenye maoni ama mawazo ya namna ya kuboresha Sheria hiyo, ajisikie yuko huru kutoa maoni yake na Serikali itasilikiza na kuchukua hatua zipasazo'' ilieleza sehemu ya taarifa hiyo iliyotolewa na Kurugenzi ya Mawasiliano ya Rais, Ikulu Akizungumza katika kipindi cha Kipima Joto kinachorushwa na kituo cha televisheni ya ITV juzi usiku, Profesa Shivji ambaye ni mmoja wa magwiji wa sheria hapa nchini, alisisitiza kuwa sheria hiyo ni mbovu na kamwe haitazaa katiba bora wanayoitaka wananchi na kuwashauri kwenda kupinga jambo hilo mahakamani.

Akichambua sheria hiyo, Profesa Shivji alikosoa kifungu cha 21 akisema kuwa inashangaza kwani kinazuia hata watu kuikosoa sheria hiyo. "Mimi nasema kuwa sheria hii ni mbovu…Katika sheria hii, kifungu hiki kinanizuia hata kusema, sheria hii ni mbovu'. Mimi sijui kulikuwa na fikra gani kuweka kifungu kama hiki, kitu kimoja tu ni kwenda mahakamani kuipinga." Alisema. 

Akichambua kifungu kimoja baada ya kingine katika sheria hiyo, Profesa Shivji alisema kuwa imewatenga kabisa wananchi katika mchakato mzima wa kuandikwa kwa katiba mpya. "Wananchi wanatakiwa kushirikishwa tangu hatua ya kwanza, kwa mchakato wa Bunge, yaani sisi wenyewe tumeshirikishwa kupitisha sheria hiyo kuhakikisha vyombo vyote vinavyohusika vinafuatwa." Alisema Profesa Shivji.

Akitoa mfano wa Kamati ya Bunge ya Masuala ya Katiba, Profesa Shivji alisema kuwa, haikufanya kazi yake kikamilifu hivyo kuwanyima wananchi fursa ya kutoa maoni. "Tulianza awali lakini hatukukamilisha…hatukuwa na sababu ya kutokukamilisha. Tulipoanza kwenye makongamano yale yaliyofanyika tulipata maoni ya wananchi, baada ya kupata maoni, ndipo mchakato wa kuunda katiba,'' alisema Tume ya Rais ya Katiba Kuhusu Tume ya Rais ya Kuunda Katiba, Profesa Shivji, alisema haipaswi kuwa moja kwa moja chini ya Rais bali pia ishirikishe wananchi. 


Alitoa mfano wa tume ya aliyewahi kuwa Gavana wa Benki Kuu ya Tanzania (BoT), Edwin Mtei iliyoshughulikia Marekebisho ya Fedha na Tume ya Rais ya Ardhi lakini akasema, Tume ya Katiba siyo ya rais, Hii siyo Tume ya Rais, ni Tume ya Katiba (Constitutional Commission), inayoundwa chini ya sheria zilizopitishwa na Bunge. Hata tume iliyounda Katiba ya mwaka 1977 iliundwa chini ya Mkataba wa Muungano.
Sheria ile ilitaja wazi kwamba rais akikubaliana na Rais wa Zanzibar, ataunda Tume ya Katiba" alisema. Aliendelea kusisitiza ushirikishwaji wa wananchi katika tume hiyo akisema kuwa rais anapaswa kuzingatia maoni ya wananchi katika uteuzi wa wajumbe wake. "Mfano taasisi mbalimbali za jamii zetu, taasisi za serikali, vyombo vya habari, vyuo vikuu, wanaweza kupendekeza majina mawili, tunaona kwamba hawa watu wanafaa kuwa wajumbe, halafu rais anateua kupitia hayo. 

Hiyo ndiyo namna ya kuwashirikisha wananchi lakini kwa sheria ya sasa hatujui rais anatumia vigezo gani," alisema.
Bunge la Katiba Kuhusu Bunge la Katiba, alisema idadi ya wajumbe 600 wa Bunge hilo ni kubwa mno ukilinganisha na idadi ya Watanzania 40 milioni, hali ambayo alisema italifanya Bunge hilo kutumia gharama kubwa bila sababu. Alitoa mfano wa Bunge lililounda katiba ya uhuru ya India la mwaka 1947 akisema lilikuwa na wajumbe 250 na wakati huo idadi ya wananchi wakiwa 100 milioni.
Alikosoa pia uwiano wa idadi ya wajumbe hao akisema kuwa kati yao, teluthi mbili, yaani wajumbe 400 watakuwa ni wa CCM. Akasema hali hiyo itawanyima fursa wananchi ambao si wanachama wa vyama vya siasa. Kura ya maoni Kwa mujibu wa Profesa Issa Shivji, japo wananchi watapata nafasi ya kupiga kura ya maoni, bado kuna hatari ya kutopata katiba bora kwani hawakupata nafasi ya kutosha ya kutoa maoni yao. 


"Katiba inaweza kuwa na ibara 500, inawezekana kati ya hizo hupendi ibara mbili tu. sasa ukisema hapana ndiyo umeikataa katiba yote kwasababu hatukufuata vizuri mchakato," alisema na kuongeza; "Hata Hitler aliingia madarakani kwa kura ya maoni". Aliongeza kuwa kuna hatari katiba ikapitishwa na idadi ndogo ya wananchi hasa kutokana na tabia ya wananchi kutopenda kupiga kura.
"Sheria hiyo inasema kuwa asilimia 50 ya waliopiga kura siyo waliojiandikisha. Unaweza kukuta katiba ikapitishwa na asilimia 20 tu ya wananchi".


Mjadala huo pia uliwahusisha Mbunge wa Ubungo (Chadema), John Mnyika na Mjumbe wa Kamati Kuu ya chama cha UDP, Isaac Cheyo ambao pia waliipinga sheria hiyo. Kwa upande wake Mnyika alieleza sababu ya wabunge wa Chadema kususia mjadala wa katiba na kutoka nje ya ukumbi wa Bunge akisema kuwa walipinga muswada huo kusomwa kwa mara ya pili. Alifafanua pia hatua ya chama hicho kwenda Ikulu kumwona rais akisema kuwa rais ni upande wa pili wa Bunge. Mnyika alisisitiza kuwa Chadema hawatasubiri kwenda mahakamani, ili kupinga sheria hiyo bali watafanya mikutano nchi zima na kueleza ubaya wa sheria hiyo.


"Tutakwenda kwa wananchi tuwaambie ubaya wa sheria hii. Watapiga kura ya hapana, hata kama hatutapata katiba, tutakuwa tumeleta mabadiliko". Naye Cheyo alisema mchakato mzima wa kuandikwa kwa katiba mpya umehodhiwa na rais huku wananchi wakizuiwa kutoa maoni yao. "Bunge la kutunga katiba ni Bunge la chama kile kile, limekuwa likiaminiwa na chama hicho hicho.

Tuangalie ‘composition'(wanaounda) ya Bunge, inachukuwa watu gani, vinginevyo tutakuwa hatuwatendei haki wananchi," alisema Cheyo. Awali asasi mbalimbali ndani ya jamii zikiongozwa na Jukwaa la Katiba Tanzania, zilieleza kutoridhishwa na hatua zilizochukuliwa na serikali katika kuendesha na kusimamia mchakato mzima wa kupitishwa kwa sheria hiyo.
Wanaharakati walitishia kuitisha maandamano endapo Bunge lingeipitisha sheria hiyo huku Chama Wanasheria Tanzania, kikitishia kufikisha suala hilo mahakamani. Hata hivyo tangu Rais Kikwete aliposaini sheria hiyo, amekuwa akikutana na makundi mbalimbali, wakiwemo viongozi wa vyama vya siasa na kupokea maoni ya kuhusu kutungwa kwa katiba mpya.

THE envisioned new Tanzania constitution should lead Zanzibar to complete economic independence, Mr Seif Sharif Hamad, Civic United Front (CUF) Party Secretary General told Zanzibaris last weekend, adding that it would be a great opportunity for change.

"We need to have a say in monetary and fiscal policies and plan our taxation. Harmonization of tariffs between Tanzania mainland and Zanzibar is a blow to our economy," Seif said at a public rally held at Kibanda-maiti ground in the municipality.

He adds, "We need to establish our own central bank to manage the economy including the value of currency against foreign money (US dollar). We need to have oil and natural gas out of the union."

Amid cheers of jubilation, Seif, Zanzibar's first vice-president under the Government of National Unity (GNU), appealed to Zanzibaris to put aside their political differences and fight for the interest of Zanzibar.

He said unity among Zanzibaris is crucial now in the run up to giving of opinions on new union constitution to be finalized by referendum.

"Our unity during the writing of the draft bill on the proposed new constitution prompted the union government to consider our demands," he added.

Seif said out of the 13 demands from Zanzibaris towards writing new constitution, ten were considered including the issues of referendum, Presidents Kikwete and Shein to have equal powers in decision making and equal representation in the "constitution commission."

The vice-president asked Zanzibaris not to be afraid to give their views even on sensitive issues such as union matters.

"We have a lot of problems in the union, for example out of the 80 Bank of Tanzania (BoT) staff in Zanzibar, only four are Zanzibaris and this is an unacceptable ratio."

He said, although his party was in the government, he is not afraid of highlighting problems, as his deputy Secretary General, Mr Ismail Jussa, asked party fans to ignore people and sections of media trying to 'destabilize' the party.

He added that CUF and its members remain united for the island's development.[/TD]

Kama watalazimisha katiba ambayo ndio mwongozo wa maswala ya nchi na wananchi ipite kwa mantiki ya Kinazinazi maana tunajua Magamba wamepitisha muswada kinazi na kishabiki!!! Asante bwana Ruta. Kwa kweli kinachofanyika kwa sasa katika mchakato wa katiba mpya ni changa la macho tuu. Kama Rais alikubali kuwa muswada ulikuwa na mapungufu, kwanini aliusaini kama si usanii? Pili, kwa sheria hii iliyosainiwa na Baba Ridhiwani imejidhihirisha wazi kuwa katiba itakayoundwa si katiba mpya hata kidogo, bali ni urepeaji wa hii iliyopo, ambayo ina viraha vingi kama barabara za lami za hapa Bongo. Hapa Serikali itatutungia katiba chini ya mwamvuli kuwa ni mpya. Hima watanzania tuwe macho. Kama wanataka tukubali kuingia katika mchakato wa katiba mpya, na tuamini kuwa katiba inayoundwa ni mpya, lazima itushirikishe sisi wananchi katika nyanja zote za kuiandaa. Tatu, wasomi na wataalam wa Bongo waache kuwa na kigeu geu. Hivi karibuni wametangaza na kuainisha mapungufu ya sheria hii, baadaye wanakuja kutangaza kuwa wanajiandaa kuwaelimisha wananchi jinsi ya kutoa maoni. Maoni ya nini kama wameshaona kuwa sheria ni mbovu? Halafu baba Ridhiwan anatangaza tumpelekee maoni kuhusu maboresho ya sheria ya katiba mpya, wakati huo huo sheria yenyewe inakataza mtu yeyote kuikosoa. Hamuoni kuwa Baba Ridhiwani anatutega?
Wengi hawaelewi ni kwa nini tunataka katiba mpya................ni kwa sababu tunataka raia wote tushiriki kuitunga katiba hiyo kupitia wawakilishi ambao tutawachagua sisi wenyewe kwa kazi hiyo tu...........hatutaki wabunge waturekebishie katiba iliyopo kwa sababu wataongozwa na masilahi yao binafsi.......na hivyo kutelekeza masilahi ya raia wengi wanyonge.................


Huko nyuma CCM walipokuwa wanafanya marekebisho ya katiba ya 13 walijaribu kuwatumia mawaziri katika kuinadi kile walichokiita ni "WHITE PAPER" ambayo ilizingatia masilahi ya viongozi tu..............................kwa kujineemesha wenyewe..........na walipoipitisha walijisifu sana kuwa ilikuwa imeandaliwa na wananchi jambo ambalo halikuwa la kweli hata kidogo........................................


Hili sasa limekuja kugundulika kuwa siyo la kweli hata chembe kwa sababu kiu ya watanzania kujipatia katiba yetu wenyewe badala ya hii iliyopo ya kuwalinda viongozi ipo pale pale...............................................


Sasa katiba mpya tutaipima kuwa hii ni mpya kama itazingatia vigezo vifuatavyo katika kuiandika:-

a) Bunge litapitisha sheria ya kuanzishwa mchakato wa wapigakura kuchagua wawakilishi wao wenyewe kupitia majimbo yao ya uchaguzi na wilaya zao kupata watakaoiandika katiba mpya...........................


b) Katika uwakilishi huo watumishi serikalini wakiwemo wanasiasa watazuiwa kuwemo kama wajumbe wa MKUTANO huo wa KIKATIBA...............................wanasiasa hao ni wale ambao wanashikilia nyadhifa za aina yoyote ndani ya vyama vyao vya siasa au wanashikilia nyadhifa zozote serikalini ikiwemo Bungeni......................


c) MKUTANO huo wa KIKATIBA utaratibiwa shughuli zake na kamati ya wataalamu ambao usaili wake utafanywa na Kamati ya Bunge inayoshughulikia masuala ya sheria na katiba.....na wajumbe hao wateule wa MKUTANO wa KIKATIBA kupitishwa na Bunge baada ya nafasi hizo kuwa zilitangazwa kwenye magazeti na waombaji kujitokeza.................

Mchujo utafanywa na Kamati hiyo ya Bunge tajwa..........................


d) MKUTANO huo wa KIKATIBA unapaswa uwe umemaliza kazi yake katika kipindi cha miaka miwili kwa sababu watapewa mapendekezo mengi kutoka kwa wadau mbalimbali hivyo hawana sababu ya kupoteza muda mwingi katika kukusanya maoni......ingawaje watafanya vikao vya wazi na umma maeneo mbalimbali nchini kukusanya maoni hayo................kwa muda maalumu........................

e) Baada ya kukamilisha mapendekezo yao watayakabidhi kwa MWANASHERIA MkUU ambaye atapaswa ndani ya siku 90 awe amewakilisha mapendekezo ya sheria ya kujadiliwa Bungeni.......na kupitishwa...................

f) Baada ya Bunge kuyapitia na kuyapitisha mapendekezo ya Katiba Mpya wananchi wapewe nafasi ya kupiga kura ya maoni...........hivyo tunahitaji sheria ya kura ya maoni kwa kazi hiyo na nyinginezo zitakazojitokeza..................

g) Iundwe mahakama maalumu ya kusikiliza kero za wananchi juu ya kero za raia zitakazojitokeza wakati mchakato huu wa kuandika katiba mpya unaendelea.................

Haya ni maeneo machache ambayo ninaona yafaa kuwa ni uangalizi wa kuhakikisha serikali iliyopo madarakani haitutupii changa la macho kwa kuiita ni KATIBA MPYA huku ni KATIBA ya viongozi tu kama zile zilizotangulia...................mwenye mchango wa ziada wa kuboresha haya mapendekezo anakaribishwa................
 
Katiba ni sheria mama hivyo huwezi kutumia sheria za kawaida zinazopitishwa na wabunge kwa maana ya simple majority ya wabunge waliokamilisha koram ya siku hiyo ili kurekebisha sheria ambayo ilipitishwa kwa theluthi mbili ya wabunge kwa kila sehemu ya Muungano.

Nimepitia jinsi Kenya walivyorekebisha katiba yao nikaelimika ya kuwa wao kwanza walikuja na muswada wa marekebisho ya katiba yao na kuweka vifungu vya kuupa utaratibu wao wa uwazi na ukweli kwa maana shirikishi nguvu kisheria ambao ulitoa mamlaka ya kuanzisha sheria za kuirekebisha katiba. Zaidi ya theluthi mbili ya wabunge walipiga kura ya kuvikubali hivyo vifungu vya kikatiba na hivyo baada ya kuifanyia marekebisho katiba yao waliweza kuunda sheria za kuunga mkono marekebisho tajwa ya kikatiba.

Sisi tumetanguliza mkokoteni kabla ya farasi kwa maana ya kuunda sheria za kawaida kabla ya kuirekebisha sheria mama yaani katiba iliyopo ili kutoa mwanya wa hizo sheria tulizozipitisha kuirekebisha katiba ziwe hazikiuki utaratibu wa kikatiba wa kuirekebisha katiba tajwa.

Matokeo yake sheria za marekebisho ya katiba zinakosoa muhimili wa kikatiba na ndiyo maana mchakato wake unaonekana ni batili kwa sababu haujatajwa ndani ya katiba iliyopo, hauna ushirikishi na unalenga kuzima kiu ya mabadiliko ya kewli ya kikatiba.

Tusisahau JK and Co are mere turncoats..............si ccm manifesto au hata ngonjera za JK wakati wa kutuomba kipindi cha pili waliaahidi katiba mpya..................kwa hiyo hivi sasa wanaharakisha ili kuzima kiu ya kweli kwa kutuletea hili igizo la tasnia ya filamu babaishi.........

Wengi ya wanaopinga sheria hii ya marekebisho ya katiba wamejikita zaidi katika kukosoa baadhi ya vifungu vyake wakati ulaini wa kufanya hivyo ni kuangalia katiba iliyopo mbona haitoi fursa za marekebisho tajwa kwa kuhusisha vyombo nje ya Bunge la Jamhuri ya Muungano?

Mfano tu, uhalali wa hiyo tume kikatiba unatoka wapi? Haijatajwa ndani ya katiba iliyopo sasa inapata wapi uhalali wa kukusanya maoni ya kurekebisha katiba iliyopo? Ilipaswa kwanza katiba iliyopo itoe uhalali wa utaratibu huu mpya wa kutumia tume na hata hayo mabunge mawili katika kuipitisha katiba tajwa baada ya kufanyiwa marekebisho amabyo yataungwa mkono na theluthi mbili za wabunge wa pande mbili za Muungano.

Haya hayajafanyika kwa sababu JK na wababaishi wenzie wanajua kabisa ndani ya nafsi zao ya kwamba hawana uhalali bungeni wa kupitisha utaratibu walioutumia kwa maana hawawezi kupata kuungwa mkono na theluthi mbili za wabunge na hivyo wakatafuta njia ya mkato ya kuanzisha mchakato wa kurekebisha katiba iliyopo bila ya kuzingatia katiba yetu imeweka utaratibu upi wa kuirekebisha na kwa kufanya vinginevyo wakawa wamekuja na sheria tajwa ambayo inakinzana na katiba iliyopo................huu ni ukiukwaji wa katiba iliyopo............

Katiba iliyopo inatoa mwanya wa Bunge la Jamhuri ya Muungano wa tanzania kurekebisha katiba iliyopo lakini tume, mabunge ya pande mbili za Muungano na hata kura ya maoni tajwa havijatajwa.........

Nionavyo JK na vyama vya upinzani wanafikiri ya kuwa.................the ends can justify the means.........and vice versa......."they are dead wrong"..............well keeping the politics involved at bay I can confidently argue that this constitutional process is futile abinitio..........................badilisha katika katiba iliyopo vifungu kwanza ili ujipe mamlaka ya kuirekebisha katiba iliyopo..........acheni kutafuta njia za mkato tena za panya buku kuirekebisha katiba iliyopo...................mwishowe suala hili itabidi lifike mahakama kuu ili iamue kama kweli Bunge lina uwezo wa kikatiba wa kuunda sheria za kawaida tu.........ambazo zahitaji simple majority ya wabunge waliohudhuria kikao kile ili mradi koram tu itimie na kupitisha sheria ya kuinyambulisha katiba iliyopo ambayo ilipitishwa kwa theluthi mbili ya wabunge wa Jamhuri ya Muungano wa Tanzania kama siyo ukiukwaji wa katiba wa wazi kabisa..................??????????????????

Longa maoni yako, pia...............................utusaidie kutafuta sheria bora na ambazo zitahakikishia kila mtanzania masiisha bora na wala siyo hizi ngonjera tupu.........
