Kwenye mada umeeleza suala la notisi ya kuondoka,
"Kuhusu notisi ya kuondoka, mpangaji ambaye kodi yake imeisha hapewi notisi isipokuwa kama mkataba wake unasema hivyo."
Sheria ya Ardhi Na. 4 ya mwaka 1999 inasema tofauti na kilichoelezwa hapo juu
Kisheria, in absence of an express term in the contract, the law has provided implied terms which binds
the parties and applies in the same way as express terms.
Kifungu Na. 88 (2) (b) kinasema kuwa,
"There shall be implied In every lease covenants by the lessor with the lessee empowering the lessor to terminate the lease by serving a notice of intention to terminate the lease on the lessee where any rent is unpaid for one month after the due date for payment whether or not a demand in writing for payment has been made by lessor or an agent of the lessor."
Hivyo, inamaanisha kuwa hata kama mkataba usipoeleza suala la kupewa notisi, bado kupewa notisi ni "implied term" (ni lazima notisi itolewe)
