Mtakumbuka mwezi uliopita mnamo 27.01.2014 na kuendelea kulikuwa na mjadala mkali ulioshika hatamu kwenye vyombo vya habari, ambapo waziri wa kazi na ajira Mhe. Gaudensia Kabaka alitoa tamko la serikali na kuzitaka kampuni zinazofanya udalali wa kuajiri ikiwemo Erolink kusitisha zoezi hilo mara moja, na kuwahamishia wafanyakazi hao kwenye kampuni husika wanakofanyia kazi kabla au kufikia tar. 28.02.2014

Vile vile alitoa wito kwa makampuni hayo kujisajili kwa Kamishna wa ajira ili waweze kufanya kazi zao kwa kufuata sheria za kazi tofauti na awali.

Sasa jana tar. 27.02.2014 ikiwa imebaki siku moja kabla ya tarehe iliyotajwa na waziri kuwa ndiyo deadline, Erolink imewatumia wafanyakazi wake wanaofanya kazi customer care ya pale Vodacom sijui tuite ni taarifa, waraka mfupi au barua (nachelea kuiita barua maana haijakidhi vigezo vya kuitwa barua maana haina muhuri wa ofisi pamoja na kasoro kibao). Katika maelezo ya 'barua' hiyo waliyotumiwa Erolink inasema kuwa ime-decline wito wa Kamishna wa ajira inayowataka wajisajili kama Private Employment Promotion Agency kwa sababu Erolink haijawahi kusajiliwa kama Private Employment Promotion Agency.

Naomba niweke maelezo ya hiyo barua hapa;

Reference is made to the Minister’s Decree ordering all Private Employment Promotion Agencies to cease operating as outsourcers of services.

We would like to inform the staff that Erolink has never been registered as Private Employment Promotion Agency by the Commissioner for Labour, and although we are grateful to the Commissioner for his invitation to us to register as a Private Employment Promotion Agency under section 20 of the National Employment Promotion Service Act Cap.243 R.E 2002, we have decided to respectfully decline the said invitation and concentrate on our core business of outsourcing services to clients

Hao jamaa wanatumia loophole ya jeuri sheria kumdharau waziri wa kazi na kamishna wa kazi kwa sababu ni sheria zetu za ajira ndizo zenye lots of discrepancies zinazotoa loop hole kwa kampuni iliyosajiliwa kama kampuni ya ushauri, "consultancy" kuwa huru kufanya biashara ya ushauri wowote, au kutoa huduma zozote "job consultancy" ikiwa inclusive bila hitaji lolote la kujisajili kwa kamishna wa kazi!, wakati sheria hiyo ilipotungwa na nadhani ni mpaka sasa, haijapelekwa Brella kuwa annexed as a conditional ya kusajili consultancy companies!, sheria hiyo inawahusu makampuni ya uwakala wa ajira!.

Mfano sisi jf, sijui tumejisajili kama tunatoa huduma gani, ila kwenye memorandum yetu, tukiweka moja ya majukumu yetu ni kutoa huduma za ushauri wa ajira, Brella wanatusajili, na TRA, wanatupa Business License bila hitaji la kwanza tujisajili kwa kamshna wa kazi!.

Hata sheria yetu ya ajira ina makosa ndio maana wajanja wanayatumia makosa haya to their advantage!.

Mfano sheria yetu inaruhusu mtu kuajiriwa kama kibarua, mwisho ni miezi 9, baada ya hapo lazima mtu huyo apewe ajira rasmi!. Sheria haimfungi mwajiri ni baada ya kipindi gani kupita haruhusiwi kuendelea kuajiri vibarua!, hivyo waajiri ili kukwepa kuajiri watu ajira rasmi, kwanza wana outsource huduma za uajiri kwa makampuni binafsi, kisha hayo makampuni binafsi yanaajiri vibarua kila baada ya miezi 9 iliyowekwa kisheria, wana sign mkataba upya!. Hakuna sheria ya kuwazuia kuajiri vibarua na kuwaachisha kisha kuajiri tena!. Lengo la sheria lilikuwa zuri kwa kazi za msimu, mfano uvunaji au maonyesho ya sabasaba tuu, au shughuli maalum, huhitaji kuajiri mtu wa ajira ya kudumu!. Wanachofanya makampunbi haya ni kuajiri vibarua kwenye kazi za kudumu kupitia makampuni mshenzi ili kukwepa uwajibikaji!.

Kisheria jamaa wako right, huyo waziri, wala kamishna hawana cha kuwafanya, sana sana wakitaka kutumia ubabe, jamaa watawashitaki mahakamani!.

Hakuna sheria ya kuwazuia kuajiri vibarua na kuwaachisha kisha kuajiri tena!. Lengo la sheria lilikuwa zuri kwa kazi za msimu, mfano uvunaji au maonyesho ya sabasaba tuu, au shughuli maalum, huhitaji kuajiri mtu wa ajira ya kudumu!. Wanachofanya makampunbi haya ni kuajiri vibarua kwenye kazi za kudumu kupitia makampuni mshenzi ili kukwepa uwajibikaji!.

Kisheria jamaa wako right, huyo waziri, wala kamishna hawana cha kuwafanya, sana sana wakitaka kutumia ubabe, jamaa watawashitaki mahakamani!.
