Tusiandikie mate wakati wino upo. IGA inasema:
Article 5:1 (page 16): The State Parties ( serikali husika) agree that DPW shall have the EXCLUSIVE right to develop manage and/or operate the Projects specified in Appendix 1, Phase 1 directly or through its affiliates.
Article 5:4 (page 16) The State Parties agree that Phase 1 Projects ( as defined in Appendix 1) shall be the priority projects for development and implementation. The Government of Tanzania shall ensure that TPA does not consider any other proposals for any of the Phase 1 Projects from the signature date until such date as discussions between DPW and TPA have been terminated or at the expiry of a period of 12 months from the signature date of this Agreement, whichever is the sooner.
Kwa sababu Agreement ilikuwa signed tarehe 25 October 2022 ina maana kuwa TPA watakuwa na haki ya kuangalia proposals nyingine kwa ajili ya awamu ya kwanza ifikapo tarehe 25 Okoba 2023. Shida ya hii ni kuwa bado kifungu cha kwanza kinaipa DPW exclusive right ya kuendeleza maeneo yaliyoainishwa katika IGA. Aidha kama itagundulika kuwa TPA haikufanya juhudi zozote za kuingia katika HGA kwa sababu tu walitaka miezi 12 ipite, DPW watakuwa na haki ya kudai fidia. Na fidia hiyo haitakuwa ndogo.
Isipokuwepo HGA kwa uzembe wetu tutajikuta Johannesburg mbele ya msuluhishi ambae bila shaka tutaamuriwa tulipe fidia na tutekeleze kile ambacho serikali yetu ili ji commit kufanya.
