This lettered request is a notorious misconception of the clear position of the law. The security of the tenure of judges can only be assailed by the alleged misconduct while in office as a judge but not before or after he catapulted to be one.


The matter of Biswalo has nothing to do with his performance as the judge of the High Court, so it will be an abuse of inquiry powers if the president interdicts him and forms a tribunal to investigate him. This is because those powers of probing judges were limited to acts of commission or omission while in judicial service, not before or after such service.

The proper approach in this matter is to arraign the individual in a criminal court to face all the allegations pummelling him, and if he is convicted then automatically he will be disqualified to be the judge of the High Court.

Other pettifoggers have joined the chorus that he resigned as a judge, but sadly, that will not exonerate him on the criminal indictments. We are very much afraid.

It is imperative for lawyers to be astute in these issues of fundamental nature in dispensing of justice not being too partisan and urging for violations of clear provisions of the law!

An A220-300 operated by Air Tanzania (ATCL) remains attached in The Netherlands over a land rights dispute between Tanzania and two Swedish investors.

This comes after Swedish companies EcoDevelopment in Europe AB and EcoEnergy Africa AB - which on April 13, 2022, were awarded a USD165 million award against Tanzania over a revoked land rights claim - on November 8, 2022, persuaded the District Court of Limburg in Maastricht to uphold the attachment of 5H-TCH (msn 55047) owned by Tanzania's state-owned TGF - Tanzania Government Flight (Dar es Salaam).

According to the court docket, the Tanzanian aircraft has been grounded in Maastricht since January 2022, reportedly due to engine problems. On June 16, 2022, it was seized by order of a provisional relief judge of the District Court of Limburg.

Tanzania argued the attachment was unlawful because, on June 15, 2022, the state applied to the Tribunal of the International Centre for Settlement of Investment Disputes (ICSID) to annul EcoDevelopment's award. Tanzania also filed a request to the ICSID Tribunal to continue the stay of enforcement of the award. ICSID registered the request on June 21, 2022. On the same day, it provisionally stayed the enforcement of the award pending a decision by an ad hoc committee. The Swedish claimants filed their objections on August 16, 2022.

On November 1, 2022, the ad hoc ICSID committee issued a decision on their objections, followed by the Dutch court's decision on November 8 that ICSID's provisional stay of enforcement of the award only took effect on the date that the institution registered the state's annulment request, which was on June 21, 2022. The Dutch court also found no grounds for lifting the aircraft's attachment.

EcoDevelopment first brought a claim to the ICSID on August 25, 2017, under a Sweden-Tanzania bilateral investment treaty (BIT) entered into on March 1, 2002. They claimed that the Tanzanian state had violated the BIT by unlawfully expropriating their land title at Bagamoyo. The Swedish companies invested USD52 million over more than a decade to develop the Bagamoyo project for the local production of sugar, renewable electricity, and fuel.

The same A220-300 was seized in Johannesburg O.R. Tambo, South Africa on August 23, 2019, in a then unsuccessful attempt by an elderly Namibian farmer, Hermanus Steyn, for compensation owed to him by the Tanzanian government after it had expropriated his farm in 1982. Steyn had an outstanding claim of USD16 million, which, with interest, totalled USD33 million.

In December 2019, Tanzania secured the release of one of its DHC-8-Q400s, 5H-TCF (msn 4608), after Steyn had it attached too by a Canadian court in pursuit of his compensation.

The state-owned airline also faced legal action in a London High Court in February 2020 when it was fined more than USD30 million for outstanding lease payments of an A320-200, 5H-MWH (msn 630), from Liberian company Wallis Trading.

In 2018, another Dash 8-400, 5H-TCE (msn 4559), was seized by Stirling Civil Engineering following the Tanzanian government's unwillingness to settle a USD38.7 million debt awarded to the Canadian contractor by the International Court of Arbitration in 2010. The case pertained to a cancelled USD25 million civil engineering contract. The turboprop was eventually released after reaching a settlement.

All of ATCL's aircraft are owned and leased from TGF, but the government now wants to shift ownership to the airline, arguing this would reduce costs for both state entities. Still, industry observers say this would have little benefit as both bodies are state-owned and therefore subject to future international claims against the Tanzanian government.

It strikes us as a more personal matter than a traffic offence was brewing there, which the driver could have been fined digitally and the matter to end there.

In alternative, the traffic officer could have got in touch with his colleagues ahead where the driver was heading, and he would have been apprehended henceforth

Mheshimiwa is overzealous to side with the traffic officer who could have been soliciting bribes.

Mheshimiwa ought to retract his orders and permit a thorough investigation that must secure both sides of a coin.

We declare honory and academic doctorates proffered by public universities to national leaders laced with CCM brand amount to "conflict of interest." And, bribery!

Mwendazake PHD was fake, expounding why the whistleblower paid the ultimate price: his own dear life! Mwendazake had etched an evil precedence of which most CCM politicals have been emulating with horrific consequences!

The president appoints all senior officers in those universities, and it is insubordination for those dons and politicians running those colleges to award the president with such honours. Power inequity between employees and employers ought to have made such awards for academic recognition of excellence a forbidden fruit.


No amount of high-pitched decibels hailing from the Parliament can change facts that awards from public institutions to their appointer are morally corrupt, unacceptable, and obfuscate pecking order, culminating into one chieftain victim: accountability.


Once the award recipients are alerted to malpractices into those institutions, they will be toothless to rein in on such gross misconduct because their hands are tied down by official bribes.

Some will flash a defence of times have changed, and immorality is the new world order. We adamantly disagree in all four corners.

The House Speaker was trigger happy to defend the merits behind the UDSM, awarding the president with topnotch accolades. What she missed to take in her wobbling stride was a conscience convicting query whether it is morally astute for presidential sidekicks to assess the performance of their boss. Does not that scenario erode tools of accountability?

The chancellor, vice chancellors, and other academia behind this controversial decision are presidential appointees, so how come they abuse their positions spook the odds? An employee is now appraising the employer is the basement of morality! And, to accept debasement is in itself worrisome of whether the beneficiaries still have the ambit to arraign on malpractices in public institutions.


With the dwarfing of morality, few will fault our speaker because nothing matters much anyway.

Nyerere was a principled man this is why he never accepted such bribes from his minions because he knew the very day he succumbed to those delicacies he would have placed himself in a strait jacket ceding his disciplinary powers against those cunning acolytes.

JK, the UDSM Chancellor, is unscrupulous and never wiseman, so it surprises nobody when he goaded this ignominy to advance political aspirations. To him, anything goes if it helps to cross the 2025 presidential elections bridge. He has no qualms, at all, to obliterate national public values and ethical conduct in order to achieve parochial political goals. We say a bogus doctorate is not what is needed in this specific situation.

This also confirms why Nyerere, in his nonparailed humility, is posthumously highly esteemed. He was a paragon of exemplary leadership many would eschew for a piece of a loaf. The JKs and ilk will have no legacy imprint to flourish because pride, arrogance, and the lust of life rule them to the detriment of loftier aspirations of an equitable and accountable national building.

Mwigulu Nchemba will be sacked from the cabinet. It is no longer a question of if or when, but the decision is already made.


We say so because his relationship with the Parliament is at tipping point. He has been trolling MPs who have been poking competence questions at his ministry of finance. And, Nchemba is a braggart, condescending, and abrasive such characters are too toxic, alienating, and polarising, henceforth, unsuitable to the cabinet purposed to forge a sense of national unity, diversity and belonging. What is shocking he has not been addressing concerns raised by Parliamentarians but reminding them he holds a doctorate in economics and, therefore, omniscient, a titular only reserved to Our Maker! He also enjoyed demeaning MPs, citing Parliament rules to cudgel their contributions. Instead of generating light in the Parliament, he has been stoking emblems of discord and enmity.

His imminent sacking will terminate his 2030 presidential ambitions once and for all.

His presidential stab was going nowhere because he lacked political skills that commenced and ended with humility, sentient accommodation, and staunch alignment with MPs who would have helped him to cross that bridge.

But his intellectual arrogance and pride have razed any political bridge he would have needed to launch his quaking presidential candidacy. Summing it all, he is a cat among the lilles and, therefore, does not fit in this cabinet like him or not!


We confidently say it is truly over.

His axing will fulfil President SSH's stance, which can be capped as follows:
