You could have done better using some other example or analogy. You cannot hail Mugabe as having showing true and correct "African leadership" for chasing White settlers in Zimbabwe while at the same time showing appreciation for Tony Blair or Ian Smith's scathing criticism against the same Mugabe for being a racist dictator and murderer.

What makes you think that only your opinion and/or interpretation is the one that's correct? And then as if on a cue, you have the audacity to accuse me of enforcing my views upon others (Yourself included). Whatever Mr Masha said may sound as pure 'nonsense' to you but not necessarily so to many other people. It appears like you have a hsrd time accepting this most basic fact of life!

New mining legislation suffers major setback

-Now unlikely to be passed any time this year

THE government has officially confirmed that the proposed new legislation for the country’s mining sector is not likely to be passed in the foreseeable future.

The Commissioner for Minerals, Dr Peter Kafumu, told THISDAY in an interview in Dar es Salaam that mining firms have shown jitters about the proposed changes to the laws currently in place.

He said more dialogue is required between the government, mining companies, and other stakeholders to reach an amicable conclusion.

The proposed new national mining policy is also still under discussion, Dr Kafumu said.


’’The recommendations have been made, but some of the investors in this sector seem reluctant to agree on some of the key issues,’’ he added.

He said a special committee has been designated to work on the proposed changes to the national mining policy.


This effectively means that Tanzania, which has suffered an estimated loss of $400m (approx. 500bn/-) within the past decade from low royalty fees, tax avoidance and tax evasion by some of the major gold mines, will continue to lose out from mining revenue.

Critics of the country’s mining regime say the nation has been receiving ’peanuts’ from its vast mineral wealth largely thanks to an outdated mining policy and bad mining legislation.


The new mining legislation was originally expected to be tabled in parliament in April this year. However, it has since been revealed that the major mining companies operating in the country were behind the subsequent delay.

According to industry experts, the mineral development agreements (MDAs) signed between the government and mining companies would be a major stumbling block in the enforcement of a new mining legislation.

For example, a controversial 2007 contract signed between the government and Pangea Minerals Limited (a subsidiary of Barrick Gold Corp.) for the Buzwagi gold mine binds the state to maintain the same taxes and fiscal laws applicable to the company at the time, for the entire duration of the mine.

This translates to a minimum of 25 years, and a maximum that by the terms of the pact is more or less indefinite.

Dr Kafumu explained that the presidential mining sector review committee had made comprehensive proposals on changes to the mining policy and legislation.

Therefore, he noted, it is unlikely that the new mining legislation will be ready this year, based on the complexity of the task at hand.

’’The process of enacting a new law is arduous...we expect to conclude consultations on the recommendations for the mining policy at the end of this month. Therefore, I don’t think the proposed new law will be ready for tabling in parliament any time this year,’’ he remarked.

The chairman of the parliamentary energy and minerals committee, William Shellukindo, is amongst those who have criticised the government for the delay in tabling the much-awaited bill intended to make key changes to the country’s mining sector legislation.

The presidential mining sector review committee chaired by retired judge Mark Bomani recommended in its July 2008 report that the government should own a 10 per cent stake in all mining companies operating within the country.

The report also advised the government to increase mining royalties on precious metals from 3 to 5 per cent, while tax relief on fuel imports for gold mines should also be abolished.

Wao wanataka wajenge bomba la kusafirisha mafuta ghafi mpaka Mombasa ambapo yatasafishwa halafu Uganda ipate mahitaji yake kutoka Kenya (kwa kusafirishwa kwa njia ya barabara). Hii ina maana mafuta yaliyochimbwa Uganda yanaweza kuwa aghali Uganda kuliko Kenya. Museveni amekataa na anataka ijengwe refinery ya kusafisha mafuta nchini Uganda. Wawekezaji na wafadhili (wa nchi za Magharibi) hawataki. Kwa hiyo Museveni ametafuta na kupata msaada kutoka Iran ili kuinusuru Uganda kutoka kwa hawa manyang'au.
