Tanzania in move to avoid oil war with Malawi

31 July 2012, Sweetcrude, DAR ES SALAAM - Tanzania has urged a halt to Malawi's oil and gas exploration activities in the disputed waters of Lake Malawi.

The emerging East African powerhouse wants to resolve a border dispute over the stretch of water with Malawi before exploration activity continues, Reuters reported.

The foreign affairs ministers or both nations met in the Tanzanian city of Dar es Salaam at the weekend to discuss the continuing territorial dispute, according to the news wire.

"Malawi claims that the whole lake belongs to the country according to colonial boundaries … But our stated position is that half of the lake belongs to Tanzania," Reuters quoted Assah Mwambene, a spokesman for Tanzania's foreign affairs ministry, as saying.

"Some planes have been spotted flying over Tanzania's side of the lake conducting the oil exploration activities … there is still room for negotiations over the correct border between Tanzania and Malawi," he continued.

In September last year Malawi awarded Surestream Petroleum of the UK the Rift Valley acreage of Blocks 2 and 3 in Lake Malawi, beating competition from Tullow Oil, New Age, Ophir Energy, Kosmos Energy and the Lonrho Group.

The company is due to begin shooting 5000 kilometres of 2D seismic over Burundi's portion of Lake Tanganyika next April on blocks B and D.

Early this year neighbouring Mozambique put on hold plans to offer acreage in a part of Lake Malawi which it claims. A restricted bidding round was due to be launched early last month but this was postponed due to"unforeseen reasons", the country's National Petroleum Institute said in January.

At around the time of independence quite a few people in Tanzania wanted to claim a huge part of Lake Malawi or Lake Nyasa . Cool heads eventually prevailed, as most Tanzanians, including the legendary President Julius Nyerere, understood the importance of respecting boundaries emanating from colonial times.

During most of Dr Kamuzu Banda’s rule, Tanzania never really pushed this crazy idea of dividing up the lake. The issue was almost forgotten during the rule of Dr Bakili Muluzi and thereafter. In fact, Dr Bingu wa Mutharika commissioned a company to start exploring oil in the lake. Tanzania said nothing at that time.

Now we have a new president and all of sudden the Tanzanians are demanding that our government stop all exploration activities in the lake until all border issues have been clarified. Why now?

Folks, there is a reason why we have tradition. Tradition may appear useless and outdated but it is important because it usually become established after a long experience. In politics there is what is known as ‘presidential protocol’. These are small things which over the years have proven to be niceties a president must or must not do in order to represent his/her country correctly.

You would think some of them are not important but they are. Here are a few of them – presidents never bow for other presidents in public; presidents never escort anybody to their car; presidents walk with their arms spread outwards apparently projecting power and being in control; presidents usually put on a solid color (one color) necktie because it portrays power; when two presidents greet each other while facing the camera, each of them jostle to be on the right side so that his palm will face the camera- another sign of power, apparently; when in company of other presidents, they try to be the last one to enter the door – a fatherly gesture; there is an interesting video clip of Chairman Yassier Arafat and PM Ehud Barak jostling to be the last one to enter a room at Camp David. The sight of President George W Bush gently pushing PM Gordon Brown into Number 10 Downing Street before himself angered some British political experts.

Statesmanship is a game because image is everything in international politics. A country’s image depends a lot on the demeanor of its leader. President Barak Obama likes to pat other leaders on their back after greeting them; you thought that was an unplanned coincidence? Just remember, how your father used to pat you on the back when you were a good boy!

It is said that Bill Clinton failed to get a good deal at his summit with Boris Yelsin in Moscow because President Clinton having sprained his ankle arrived in Moscow on a wheelchair. The sight of a sick American president is said to have psychologically emboldened Boris Yelsin. Ghana is said to have regained its respect in West Africa when President J.J. Rawlings arrived at the 25th Organization of African Unity meeting in Togo in July 2000 in a military uniform portraying a very youthful image.

The presidency is acted on a world stage. What a president says and does is very important!

When Joyce Banda took over the presidency, she made it appear like Malawi will now be doing everything the donor community tells her to do. In fact some British newspapers were so pleasantly surprised with this that they called us ‘a donor fearing nation’.

President Joyce Banda went to London and even bowed before Queen Elizabeth, a very strange gesture considering that both are heads-of-state. Well, all these words and actions have now collectively given an image of a weak leadership in Malawi. The world has sensed blood. Now Tanzania has decided it is time to split up the lake. Notice that they did not bring up this crazy idea when Muluzi or Mutharika were in charge.

If we dignify Tanzania’s unreasonable request, one wonders what the next thing will be. Are they now going to claim Chitipa? Will Mozambique now claim Mulanje Mountain?

Government must make clear that no part of Malawi is up for discussion – full stop! It is time to show strength. Tell Tanzania that Lake Malawi was, is and will always be Malawian.

Surprisingly, after all these arrogant statements by the Tanzania government, our government’s response is at best a whimper. The minister of foreign affairs has issued a statement saying the issue will be settled ‘amicably’. Really, Mr. Minister? What could be an amicable statement? Are you planning to even dignify Tanzania’s unreasonable demand? Do you plan to divide up the lake? How can you have an amicable settlement to an unreasonable demand?

Malawi: 2012, July: "But our terms are clear on this. According to the 1890 ecoland agreement between Britain and Germany, the border between Malawi and Tanzania is the edge of the waters of Lake Malawi. So we are very clear about that but we will continue to engage with Tanzania as a good neighbour," Patrick Kabambe, Principal Secretary, Principal Secretary in the Ministry of Foreign Affairs and International Cooperation, Malawi quoted by Malawi's Daily Times.
Tanzania: 2012, July: "We don't want Tanzanians to ask for permission from Malawi to fetch water or fish from Lake Nyasa. If we don't reach a consensus, we will take recourse in international law." Tanzania‘s Attorney General Judge Frederick Werema, responding to a concern from the Member of Parliament for Mbeya Region (special seats), Hilda Ngoye.

Kamuzu and Nyerere
The gist of the dispute:
T he dispute is about who owns what is, as far as Malawians are concerned, Lake Malawi and as far as Tanzanians are concerned, Lake Nyasa.
According to Malawi, this isn't even a subject for debate. Malawi owns 100% of Lake Malawi and if we are to go by the vision of Malawi's founding president, Dr. Hastings Kamuzu Banda, Malawi just like its predecessor the Maravi Kingdom should in fact http://www.iss.org.za/pubs/Books/Evol_Revol Oct 05/Chap5.pdf extend to some parts of present day Tanzania and even Mozambique.
According to Tanzania on the other hand, the lake is shared and the <span style="text-decoration: underline; http://edocs.nps.edu/npspubs/scholarly/theses/2011/June/11Jun_Msafiri.pdf boundary of these two neighbouring countries should follow the median line in Lake Nyasa.
This is the official stance of the Tanzanian Government hence any Malawian activity beyond this line are deemed "trespassing". The Historical Context; This dispute traces its origin to the Berlin Conference, and trouble is rooted in the Berlin Act of 1885, that was signed by the 13 European powers that attended the conference that formalised the BBC - History - British History in depth: Slavery and the 'Scramble for Africa'
Scramble for Africa
According to documents on the demarcation of the border around Lake Nyasa encapsulated by the Anglo-Germany Treaty of July 1, 1890 &#8211; verbatim &#8211; the border runs as below:"To the south by the line that starts on the coast of the northern border of Mozambique Province and follows the course of the Rovuma River to the point where the Messinge flows into the Rovuma. From here the line runs westward on the parallel of latitude to the shore of Lake Nyasa. Put to Kamuzu Banda by Tanzania's Julius Nyerere that the map between independent Malawi and Tanzania should follow the median line, in his unique blunt style Dr. Banda responded as below: "We will never recognize or accept this claim: we will never agree to the suggestion or proposal. The Lake has always belonged to Malawi&#8230;.Everyone knew Nyerere as a coward and communist inspired jellyfish: We know while pretending to be a staunch supporter of the OAU, Nyerere is the worst agitator and betrayer of the cause for which the Organization was formulated. History, geography or even ethnical knowledge will convince Nyerere that four districts to the South of Tanganyika belong to us by nature. It is only that we respect the feasible unification of Mother Africa that we do not claim these districts. All that we are doing is setting [sic] historical truth."
Dr. Banda in 1962 reinforced his claim in addition to the authority of the Anglo-Germany Treaty of July 1, 1890 with some maps from the "http://www.societyofmalawi.org/talks/nationalarchives.pdf. He even went as far as suggesting to Mwalimu Julius Nyerere that a part of http://www.ajol.info/index.php/asr/article/viewFile/23256/19939 Mozambique was supposed to be part of Malawi&#8211; then still Nyasaland.
But as is usually case in any dispute, Tanzania is equally able to produce maps that show the median as the boundary, but such maps have never disputed the contents and spirit of the Anglo-Germany Treaty of July 1, 1890.
Pre-Independence Treaties and the Lake Malawi /Nyasa dispute:
The reason this dispute will not disappear any day soon is rooted in Malawi's and Tanzania's divergent views vis-à-vis pre-independence treaties including the Anglo-Germany Treaty.
Julius Nyerere, as the first Tanganyika Prime Minister, prepared a policy document for implementation after independence in which the Secretary-General of the United Nations was informed thus:
"As regards bilateral treaties validly concluded by the United Kingdom on behalf of the territory of Tanganyika, or validly applied or extended by the former to the territory latter, the Government of Tanganyika is willing to continue to apply within the territory, on a basis of reciprocity, the terms of all such treaties for a period of 2 years from the date of independence [i.e. until 8 December 1963] unless abrogated or modified by mutual consent. At the expiry of that period, the government of Tanganyika will regard such of these treaties, which could not by the application of the customary international law be regarded as otherwise surviving, as having terminated."
As a result, http://edocs.nps.edu/npspubs/scholarly/theses/2011/June/11Jun_Msafiri.pdf Tanzania refused to recognize the treaties that naturally gave the lake to Malawi on independence on 6 July 1964 since its allegiance to such expires on December 8, 1963.
And this was the major recipe for this dispute because, it meant that in practice; Malawi and Tanzania now had different points of reference, which explains the continued stand-off.
Parties that have different points of reference in any argument are as good as parallel lines. They can never meet. In the least, it explains where Malawi and Tanzania are at, with respect to Lake Malawi a.k.a Lake Nyasa.
In all likelihood, Dr. Banda would have viewed such a policy, which was supposed to be outward looking but designed in a way that only serves internal interests, with utter contempt.
Any merit in Tanzania's claim to half the lake?
Having said all this one then wonders if Tanzanians are mad to be claiming half the lake and on what basis some map makers show the median line as the boundary. There are several International Conventions that deal with rights associated with water.
Rights associated with water that is not flowing are called littoral. Generally land beneath non-sovereign lakes are owned by the surrounding upland owners. When all the deeds call to the lake, each owner has title to a centre point. This principle is referred to riparian rights and is the basis for Tanzania's claim.
Should Malawi buy this?
From the statement of Patrick Kabambe, Malawi's Principal Secretary in the Ministry of Foreign Affairs and International Cooperation, this seems like a far-fetched idea and one is tempted to subscribe to this thought.
"Indeed, we went for discussion on the border issue and we categorically put it to them that as far we are concerned, the entire lake belongs to Malawi."
The point is: if one person unilaterally decides to annul existing international treaties (like the Anglo-Germany Treaty &#8211; which by the way is all there is on this &#8211; and both Tanzanians and Malawians were not represented which makes them both victims); why should another person suffer from subscribing to the treaty?
Advice to Malawi: Let's by all means meet, eat, drink together, and talk with Tanzania. But the talking will not undo the Anglo-Germany Treaty.
As Dr. H. Kamuzu Banda used to say, we are all brothers and sisters &#8211; the maps and divisions were imposed on us by the colonialists; therefore, let us all (Malawians and Tanzanians) fish and swim in the beautiful Lake Malawi.
But please, our brothers and sisters from across the border shouldn't stop us from exploring ventures that can lift our livelihood and economy.

It is sad that this is happening after Bingu is gone. Tanzanians knew very well the response they could have gotten from Bingu if they tried to make this unreasonable claim during his time.

Of course, Tanzania and Mozambique are concerned about oil exploration in the lake!
Even though it's "our" lake, they fish in it; they bathe in it; they water their crops from it; they rely on it just as we do in Malawi. If there is an oil spill disaster, for example, they will also be seriously affected.
Let them voice their (justifiable) concerns&#8230; just as long as they accept once and for all that the lake is Malawi's.

This lake belongs to Malawi read the treaty 1890. Claiming any portion is a provocation .Tanzania stop it. The only sober request which we can consider should be asking Malawi not to explore oil because any spillage will affect them since they also depend on it for there livelihood period. We have already been kind to allow them to fish swim and use it without asking them to pat tax for usage. Hi Fellow Malawians.
I must declare interest that I am a Tanzanian. I am a man of full age. Since my childhood I was taught that Lake Nyasa is shared by Malawi, Mozambique and Tanzania. It is not true that Tanzanians are now demanding split of the lake at this time. Personally I have been shocked by news that the lake belongs to Malawi only, even Mozambique is ignored at this time, I don't know why. Even most international maps show the border of Malawi and Tanzania to be on the lake's center line.
In view of the above, it is my opinion that let us sit down together and each party present justification of the ownership of the lake, in case no amicable solution will be reached we will go for international arbitration. There is no need for war! Overall in case war will be the only solution, there is no doubt Malawi will be defeated forthwith. If the war will be longer, it will never take more than a week to settle the issue, but why war?
This dispute is mainly influenced by Great Britain after WWII, remember that Burundi and Rwanda were part of German East Africa but later GBR offered the same to Belgium and today are free countries as you all understand. It is true that the agreement of 1890 favors Malawi as the sole owner of the lake, during the rule of GBR in Tanganyika, the same GBR allowed sharing of the lake on the center line as per our claim today, indeed international law recognizes sharing of water bodies through the center line. Tanganyika became independent in 1961 at that time Nyasaland (Malawi) was still under the GBR colonialship, sharing of the lake continued till 1964 when Nyasaland became independent. Dr. Kamuzu Banda initiated the move of claiming 100% ownership of the lake, he also pursuaded Nyerere that lake Tanganyika is solely owned by Tanganyika thus Zaire (DRC), Burundi and Zambia have no right to use the waters of the same; he further persuaded Nyerere to take part of Mozambique (the Makonde area) to Tanganyika and the remaining be taken by Malawi, these ideas did not reach the Nyerere's consideration. It is indeed clear that there was no good relationship between Banda and Nyerere due to different perceptions on South Africa's apartheid regime of the Boers, Banda was supporting them while Nyerere was against them. So, the lake Nyasa dispute remained unsettled up to date. Since Malawi has engaged a company to explore gas and oil for the entire lake, Tanzania is now seeking for amicable solution before exploration is concluded.
We in Tanzania believe that &#8216;Watanzania wote ni ndugu zangu na Afrika ni moja' which means &#8216;all Tanzanians are my brothers and sisters and Africa is one'. There is no advantage at all of killing our brothers and sisters in Malawi.
Lets us opt for diplomatic solution.

This is a twist in the tail. These are problems of our own making because when it was announced that a company was undertaking a feasibility study on the prospects of drilling oil deposits in the disputed lake, many Malawians living along the lake voiced out vehemently. Some of this noise opened up eyes of these same people claiming that the lake is also theirs.
I attended a course at a Military college in TZ and they talked quite a lot of bad things about Malawi, some of it very demeaning. The lake issue was also touched whereby they still believe that Malawi should have consulted them first before changing the name from Lake Nyasa to Malawi; saying that looking at the geographical formation of Malawi it would simply take them something like 10 &#8211; 15 minutes to fly their jet fighters from Chitipa to Nsanje then back to base in TZ, that at one point Malawi was almost shared between TZ/Zambia and Mozambique due to poverty. During the Kamuzu era they at one time mobilised their forces onto the borders waiting for the advancing Malawi Defence Force personnel who too (it was believed) were ready for battle. I told them that their intelligence had fed them with very wrong information because we were in barracks doing our own thing.
I am therefore not surprised that they have decided to take advantage of the leadership weaknesses which is very unfortunate indeed. We just hope all will be handled professionally; this is why we have learned Malawians in the fields of International Relations, International Conflicts, Political/Military/Police experts etc who should now be in the forefront advising the Head of State.

Your Permanent Secretary in Malawi's Ministry of Foreign Affairs, Patrick Kabambe, so arrogantly saying that Lake Nyasa (Malawi?) being inside of, and as such, part of Malawi. From his tone, I entertain grave doubts whether such a 'hothead", would even "stoop" so low as to sit on a negotiating table!
The Heligoland treaty referred was a "Temporally settled colonial disputes between Germany and Great Britain" and clearly stated at Article VI that "Any correction of the demarcation lines described in Articles I to IV that becomes necessary due to local requirements may be undertaken by agreement between the two powers. It is understood, in particular, that commissioners will meet as soon as possible to undertake such a correction with regard to the borders described in Article IV. Article VII.
It is quite interesting that the fellow does not seem to be aware of the UN Convention on the Law of the Sea of 10th December, 1982, which came into force on 16th November, 1994. This Convention became necessary due to increasing disputes relating to water resources-fishing, minerals (oil and gas) and the shifting of boundaries due to natural causes. This is the principal law governing disputes relating to water bodies. By the way, the Convention applies to lakes, rivers and other waterways-the Suez, the Panama Canals etc.
As per this convention, the international community agreed that for states sharing a water resource, the boundary between them should be to part the water body equally to those who share it.
Tanzania ratified the Convention and pledged to be bound by it on 30th September, 1985 (being the 24th country do so). But the mother of all surprises, is that this same Malawi ratified and undertook to be bound by the Convention on 28th September, 2010,(being the 161st), probably after a long soul-searching.
Under International law, the Convention is superior to any other arrangement. The Heligoland Treaty that Malawi is holding up as its ace has no force in International law. I don't know why you seemed to turn a blind eye to this &#8216;naked truth"
The contributor here does not purport to be an expert on the Law of the Sea, but this country boasts of such luminaries in the field like none other than our own Joseph Sinde Warioba and Ambassador James Kateka who have variously served as Judges in matters relating to the law of the sea.
On the other hand, Malawi has only a Mr. Munthali who saw us being doomed in the Dowans' case!
In law there is a maxim that &#8216;things speak for themselves"-res ipsa loquitur. From what said Kabambe fellow, it did not sound like you are prepared for tete-a-tete negotiations. As a prelude, Tanzania may send a protest note-a note verbale-and gauge the response, after which then the matter may go the International Arbitral bodies.
It is pertinent at this juncture to point out that these joint-Commissions have been in existence since the days of Hastings Kamuzu Banda. Malawi's arrogance met equal force in Mwalimu's no nonsense stance.
Now why do people think they can fool around Tanzanians?

For me its better to die in the battle front than watch L.Malawi divided. History, geography all count too strongly against the baseless claims by the Tanzanians who lack peace with not only Malawi but also other neighbours like Uganda and Kenya. During the freedom struggle of southern Africa your former president Kamuzu Banda had close ties with Boars of south africa and he was used to betray his fellow africans in such a way that he claimed some part of Tanzania but he failed.At the same time Tanzania was used as center and home for freedom fighters from southern Africa and other countries.Kamuzu Banda mission to expand border failed despite of few attempt and Tanzania was strong to defend its borders.

Guys, a war is something very different from "riot police operations". I did a research in a refugee camp (Congolese refugees in western Tanzania), a war is not something to hope for. Of course if it happens, you have no choice but to back your soldiers&#8230; never the less, that is not like a video game&#8230; I was also lucky to have a feel of being near to a place where live arms exercises were being conducted (Kigoma &#8211; Tanzania)&#8230; That tremour was itself scary, eventhough I knew that it was just a peaceful military exercise&#8230;!! Yes, we have sent peope to missions in Comoros, Congo, Lebanon, Liberia, Darfur and many other places&#8230; never the less, as an African, I want to preserve Nyerere's thinking that our Military should be only for defence&#8230; I do not want to see my fellow Afrians suffer for something which can be sorted out simply through reasoning.

Wait until Civic United Front (CUF) or Chama Cha Maendeleo (Chadema) come to power. For CUF, I know their first move will be to delink Zanzibar from your fake Nyerere-Karume union. Currently, you are a de facto one party state. You have not yet tasted real democracy and its challenges. No matter how long it will take, you will remember these words I have just spoken.

King Solomon took the baby and gave it to its real mother. The story here clearly synonyms to the baseless claims Tanzania is making to have lake Malawi shared 50/50. The 50/50 sharing also reveals an element of knowledge deficit on the part of Tanzania. It just shows that they dont know the geographical morphology of lake Malawi. Remember,that we do not have problems for the coastal dwellers to bath, fish, drink from the waters of L. Malawi. That has been the case all along. What is not negotiable is lunatic mentality of sharing the lake 50/50. My fellow Malawians know that Tanzania is a Goliath by territory but tactless militarily.

This about it. People around the lake have fished and depended on the lake for centuries before the coming of colonialists. Mosha you need to read your history again, Mr Spawk is right the Chagga did want to their own republic a claim which was even represented to the Queen as head of the commonwealth, they had their own administrative government, many Mengis with Chief Marealle being the overall chief of the Chaggas, it is true after independence this cooled down and precisely because of this tha Nyerere abolished chiefdoms, considering that he himself came from an insignificant chieftain he feared the more powerful chiefdoms will overpower his reign so he abolished chiefdoms, which I think was a good and a wise thing to do for the unity of our country. If Mr Mosha read and understand what is going on in Tanzania we have seen the emergence of some political parties who still have the desire of having a chagga republic, this has been said in public and demonstrated in action.

And do you know the reasons what the political atmosphere at that time. Colinialists had to do every means possible to separate us so as to rule us easily. Now, you want to talk about tribalism during colinialism or post that ?

When I hear some comments both from Malawians and Tanzanians it sounds sickening. My augement is that both you are wrong you think big ot broader before you putting comments. I can see majority using abusive & arrongant language for whose benefits. Tanzanian have wedged war in the past, Malawian have not BUT all in All I do not think be Malawians or Tanzanians WAR is not the best option NEVER EVER. Both of us we need to think using our own brain rather than depending on PM like Cameron.
I suggest everybody to get away from from thinking that British can trigger us to go into crisis because of Lake Nyasa.

Common people on both sides should be careful on politicians coming out with such "war" "war" "war" statements on their mouth!
War isn't something to wish/desire for. Wars in Afrika have the tendency of never ending. Guys look at Somalia&#8230;is that what you and I want..?
Malawians of the border and Tanzanians of the border (and hereby even Zambians of the border) are already a one people, for we have mixed through intermarriages and languages on both sides..!
I am a Tanzanian from the border, with blood relatives on the other side&#8230;by the way even the very current chief of staff of Tanzanian army comes from Kyela border, thus possibly (likely) with relatives in Malawi!
Dare on both sides we forget that we are to those wazungu who are to come explore and invest; we are before them just other blacks and Afrikans. To them we are just the same..!
We all on both sides have "wars" already to fight every day, battling against abject poverty, underdevelopment, ignorance, superstitions, diseases, corruptions (of our very leaders who comes out with such nasty statements) and etc name what and what more..!

LAKE NYASA SINCE 1889 WAS SHARED BY THREE COUNTRIES. BRITISH, MOZAMBIQUE AND GERMAN. AFTER THE HELIGOLAND TREATY GERMAN WERE ASKED TO LEAVE THE WESTERN PART OF THE LAKE TO BELONG TO BRITISH OF THE NYASA LAND. SO OUR BROTHERS FROM TANGANYIKA-GERMAN EAST AFRICA HAD POSSESION OF THE EASTERN PART OF THE LAKE. THATS THE BASIS OF THE STAND OF OUR BROTHERS FROM TANZANIA.
It was from the same treaty, that lake Tanganyika was also shared to the ZAIRE in which TANZANIANS share half of it.
ITS GOOD FOR EVERY MALAWIAN TO REMEMBER THAT WE WERE COLONISED BY BRITISH, BUT AFTER THE WORLD WAR, TANZANIA WAS ALSO TAKEN BY THE BRITISH.
