NEW discoveries in the controversial Buzwagi gold mining agreement signed between the government and Barrick Gold Corporation subsidiary company Pangea Minerals Limited suggest even less value in terms of state revenue and national economic benefits from the planned $400m (approx. 520bn/-) investment.

While royalty on exports has been set at the industry standard of 3 per cent (for gold) and 5 per cent (diamonds), there are specific caps set on exactly what the investor company will pay to both the central government and local government authorities in Kahama District, Shinyanga Region where the mine will be located.

The agreement, signed in London last February by Energy and Minerals Minister Nazir Karamagi on behalf of the government and Barrick Gold Tanzania Limited's executive general manager (operations) Gareth Taylor representing Pangea Minerals Ltd, specifies a set limit of $200,000 (approx. 260m/-) in maximum amount that Pangea Minerals Limited would be legally obliged to pay each year in local government tax.

A similar ceiling is also cited for road toll taxes that the project shall be required to pay every year under the Fuel and Road Tolls Act of 1985.

Furthermore, the project implementing company may not pay more than $10,000 (approx. 13m/-) in any one year for ''any duty, levy, charge, fee or compulsory contribution'' that has not been specified in the agreement.

With regard to the land at Buzwagi where the mine is to be set up - an area covering about 24.49 square kilometres ? Pangea Minerals Ltd is not required to pay any taxes on the property in excess of $2,000 (approx. 2.6m/-) per square kilometre per annum.

Legal experts have confirmed to THISDAY that this means regardless of any developments made on the land or any future increases in the property value, the investor may pay a maximum of just $48,980 (approx. 63m/-) per year in taxes on the land throughout the lifespan of the mine.

Another interesting clause in the agreement is Article 4.1.3, which specifies that Pangea Minerals Ltd will make a fixed contribution of $125,000 (approx. 162.5m/-) by December 31 of each calendar ?year of production? to the state-run national economic empowerment fund.

But as legal experts point out, there is a catch here too. For the document defines a ''Year of Production' as a time when production from the mine reaches a 'minimum of 20,000 ounces of gold contained in ore or concentrate, as the case may be, during the applicable calendar year.'' In other words, for each year that the gold mine management declares production to be less than the stated 20,000 ounces, the government will get no contribution for its empowerment fund.

''So, minus the 3 per cent royalty which is itself negligible, Tanzania as a country will earn a mere $583,980 (approx. 760m/-) from the Buzwagi gold mine each year,'' Dar es Salaam-based lawyer Tundu Lissu told a local television talk show earlier this week.

Lissu, who works with the Lawyers Environment Action Team (LEAT) and is noted for his extensive researches into the country's mining industry, described the Buzwagi deal as 'scandalous' and asserted that the planned investment would be of little benefit to the national economy.

He cited government figures presented in parliament recently suggesting that out of $2.614bn (approx. 3.4tr/-) in total gold exports over the past ten years, Tanzania earned just $78m (approx. 100bn/-) in royalty.

According to the government's 2006/07 figures, minerals (almost entirely dominated by gold) accounted for around 63 per cent of the country's total export revenues. But paradoxically, the minerals sector (particularly gold) contributes a paltry 2.7 per cent to Tanzania's gross domestic product (GDP), or total economic output.

Meanwhile, minister Karamagi has this week steadfastly avoided making any comment on the Buzwagi deal or his own role in it, especially with regard to the circumstances of its signing in a London hotel on February 17 this year.

Among other things, the agreement legally binds the government to maintain the same taxes and fiscal laws applicable to Pangea Minerals Ltd today for the entire duration of the mine, which is a minimum of the next 25 years and a maximum that by the terms of the pact is more or less indefinite.

The minister responsible for mining is given extraordinary discretionary powers to extend the company's special mining licence as he or she sees fit, without any limits on duration.

An earlier report by THISDAY revealed that at least one key provision in the original final draft of the agreement, approved by the government's advisory committee on minerals, was deleted by hand just before the signing, effectively exempting Pangea Minerals Ltd from paying any taxes falling under the East African Customs Management Act of 2004.

And going by the document itself and signatures therein, it appears there were no witnesses to the signing for either of the two parties involved.

At the time the Buzwagi deal was signed, the fourth phase government under President Kikwete had announced the start of a formal review of the various existing gold mining policies, laws and contracts, and the suspension of any new major mining contract signings until the review process was completed.

Vyama vinne vya upinzani vimesema vitasambaza nakala ya mkataba wa madini wa Buzwagi kwa wananchi nchi nzima ili waweze kuusoma na kujionea wenyewe.

Katika hatua nyingine Katibu Mkuu, Wizara ya Fedha Bw. Gray Mgonja, jana alitangaza nia ya kumfikisha mahakamani Katibu Mkuu wa CHADEMA Dk. Wilbrod Slaa kwa madai ya kumdhalilisha kwa kumuita mfisadi.

Uamuzi wa vyama hivyo vya upinzani kusambaza mkataba huo, ulitolewa jana jijini Dar es Salaam na Kaimu Katibu Mkuu wa CHADEMA, Bw. Victor Kimesera, alipozungumza na waandishi wa habari.

Bw. Kimesera alitoa msimamo huo kwa niaba ya vyama vya NCCR- Mageuzi, CUF, CHADEMA na TLP.

Alisema watatoa nakala nyingi na kuzisambaza kwa wananchi bila malipo na baadaye kuzunguka nchi nzima kuwahimiza kuusoma ili wajue kwamba wapinzani sio wazushi wa kutunga habari za uongo.

Aliongeza kuwa viongozi waliotuhumiwa kula rushwa hawajibu hoja iliyo mezani na badala yake wamekuwa wakimtisha Dk. Slaa kwamba watampeleka mahakamani.

Alisema baada ya wapinzani kuibua tuhuma za rushwa viongozi mbalimbali wa serikali wamekuwa wakitoa majibu yanayotofautiana hali inayoonyesha kwamba wanakarupuka.

Alifafanua kuwa mmoja wa viongozi hao alimuomba Dk. Slaa kupeleka vielelezo vyake katika vyombo vya sheria ambapo mwingine alisema wapinzani ni wazushi na wala hakuna kiongozi aliyekula rushwa.

Bw. Kimesera alisema, kukaa kimya kwa muda mrefu kwa viongozi wanaotuhumiwa ni dalili zinazoonyesha kwamba wamekula rushwa.

Wakiongea kwa kupokezana, viongozi kutoka vyama hivyo walijigamba kwamba hawaogopi kile walichoita mkwara wa vigogo bali wanawataka waharakishe kumfikisha mahakamani Dk. Slaa ili wakaumbuke zaidi.

Akizungumza jana na waandishi wa habari juu ya tuhuma zilizotolewa na Dk. Slaa dhidi yake, Bw. Mgonja alikanusha kula rushwa na kusema anasikitika kwa kuchafuliwa jina lake.

``Mimi nimekuwa mtumishi wa serikali kwa muda wa miaka 33 na sijawahi kuambiwa mfisadi lakini leo naambiwa hivyo, lazima nimfungulie mashtaka Dk. Slaa,`` alisema.

Bw. Mgonja ni kigogo wa pili kutangaza nia ya kumburuza Dk. Slaa ambapo juzi Waziri wa Nishati na Madini Bw. Nazir Karamagi naye alitangaza uamuzi kama huo.

Kigogo mwingine aliyejitokeza na kukanusha madai ya tuhuma ya rushwa dhidi yake lakini yeye hakutaka kufungua mashtaka ni Mbunge wa Musoma vijijini ambaye pia ni mwanasheria maarufu Bw. Nimrodi Mkono.

Kama ilivyokuwa kwa Bw. Karamagi alipozungumza na waandishi wa habari juzi, Bw. Mgonja na yeye alizungumza kwa kifupi na hakutaka kujibu maswali nje ya kile alichozungumza.

Kwa upande wake, mwanasheria wa mazingira Bw. Tundu Lisu alisema, hakuna kosa kisheria mwananchi kupata nakala ya mkataba unaolalamikiwa ambao ulisainiwa nchini Uingereza.

Alisema Ibara ya 18 ya katiba ya nchi inaruhusu kila mwananchi kupata habari, hivyo kifungu hicho kinamlinda mtu atakayekutwa na mkataba huo kutochukuliwa hatua.

Aliahidi kumtetea mahakamani mtu yeyote atakayekamatwa na serikali kwa madai ya kukutwa na mkataba huo.

Kwa taratibu na sheria za sasa ambazo zimekuwa zikilalamikiwa sana, mikataba ni siri ya serikali. Hata hivyo, mikataba inaweza kuonwa na wabunge kama kutakuwa na haja ya kufanya hivyo.

Vehicle inspection contracts up for review

Contracts awarded to foreign-based vehicle inspection agencies came under fire on Tuesday, with stakeholders pressuring the government to review them immediately.

The management of the Tanzania Bureau of Standards, the official custodian of the agreements, succumbed to the pressure and agreed to revisit them.

Vehicle importers and dealers as well as Members of Parliament have repeatedly faulted the contracts as needlessly costly and involving cumbersome procedures.

``Yes, we accept your recommendations that the agreements be reviewed. I promise to institute severe penalties against agencies issuing inspection certificates on non-inspected vehicles imported into the country,`` said acting TBS Director General, Charles Ekelege at a meeting called to discuss the contracts and a number of other issues.

The stakeholders described the new and foreign-based inspection system as non-profitable to Tanzania, adding that the agencies earn more than what goes into the government`s coffers.

They also accused the agencies of issuing inspection certificates on non-inspected vehicles with impunity, saying some imported vehicles come with serious technical and other defects.

``The $20 the government gets for each vehicle imported into Tanzania is peanuts when the inspection agencies meanwhile get between $120 and $150. It is all a cruel waste and misuse of the country?s resources,`` vehicle dealer Shakil Ansari, Managing Director of Japan International Trading Co. Ltd, told the meeting.

``After all, few if any of these agencies ever conduct vehicle inspection in real the sense of the word.

They issue inspection certificates even to vehicles that have not been screened,`` noted Ansari, adding that in many cases importers and dealers receive imported vehicles that have numerous faults but bear certified inspection stickers.

He recommended that the government conduct vehicle inspections locally and steer clear of unnecessary expenditure and revenue leaks while also improving the management and control of the inspection system.

Said Ansari: ``It is quite possible to subject imported vehicles to strict inspection after they have been brought in - even just before they are registered.

That way the government would generate more revenue and car importers would be spared the multiple charges of importing vehicles that obtain under the current system.``

Infrastructure Development ministry official Philemon Minja admitted that inspection agencies are a drain on the country`s resources that would be better spent on development programmes.

``Scarce resources that would have been much better spent spurring economic growth are taken by the agencies in the name of imported vehicle inspections.

TBS needs to team up with other stakeholders in drawing up better inspection models able to help the government create jobs for our people, increase public revenue and control the quality of vehicles making it into Tanzania,`` he said.

National Institute of Tanzania tutor Hans Mwaipopo meanwhile questioned the competence of foreign-based inspection agencies, stressing that many imported vehicles have serious defects like faulty engines and gears.

``Imported vehicles have numerous faults despite the so-called inspections conducted abroad. I therefore find the qualifications and competence of those foreign agencies highly questionable,`` noted Mwaipopo, adding: ``I think, we should revert to the old local-based inspection system because we don?t see any difference between the new and foreign inspection system and the old one.``

Dr Samwel Nyantahe, a highly rated Tanzanian mechanical engineer, also questioned the quality of the foreign agencies` inspection.

He said they are fond of attaching good inspection stickers onto non-inspected vehicles, a factor that impacts negatively on the country`s economy.

But Maxmillian Sondo from Tanzania Resource Centre (TRC) differed with his colleagues, extending qualified support to foreign-based inspection agencies but also suggesting that the current contracts be thoroughly reviewed ``so that agencies issuing inspection certificates to non-inspected vehicles are appropriately penalised``.

``TRC has immense expertise in contract reviews and is ready to help TBS in reviewing these agreements with vehicle inspection agencies. We should incorporate clauses in the contracts that provide for stringent penalties against bogus inspection agencies,`` he observed.

Industries, Trade and Marketing ministry official Jacqueline Maleko supported the idea of reviewing the contracts and proposed stiffer penalties for defaulters.

``However, TBS can hardly play a really active role in controlling standards unless it complies with the international standards. The government and all other stakeholders must help the bureau in this respect,`` she said.

Wrapping up the deliberations, Ekelege expressed satisfaction over the stakeholders` views on foreign-based vehicle inspections and promised to work on all the shortfalls pointed out.

He said TBS would impose more stringent penalties against agencies found issuing certificates in respect of non-inspected vehicles or colluding with vehicle importers in breaking the law.

``Agencies issuing fake inspection certificates will face the music. The penalties envisaged will deter the agencies from engaging in such malpractices. It?s going to be very hard for culprits,`` he pointed out.

Added the TBS executive: ``We will work on the criteria and standards for use in selecting agencies so that we get competent performers of the tasks before us.

We will continue inviting more inspection applications in the countries concerned to enhance competition.``

TBS has already commissioned six foreign-based agencies to conduct vehicle inspections.

They are Japan Auto Appraisal Institute (Japan), Total Automotive Service (Dubai), Sime Darby (Hong Kong), Jabal Kilimanjaro (Sharja - UAE), Jaffar Mohamed Ali Garage (Dubai - UAE), and WTM Utility Services (the UK).

``Tenders for these contracts were advertised in the local and international media,`` said TBS Head of Inspection Katabwa Joshua, dismissing as baseless speculations that they were awarded secretly.

CHAMA Cha Mapinduzi (CCM), kimewatumia wanasiasa waliojiunga kutoka Upinzani kuzima hoja za mbunge wa Kigoma Kaskazini, Bw. Zitto Kabwe, kuhusu mgodi wa Buzwagi wilayani hapa, kuhusu mkataba wa madini kusainiwa Uingereza.

Wakihutubia mkutano wa hadhara juzi wanasiasa hao Bw. Tambwe Hiza aliyetoka CUF na Bw. Shaibu Akwilombe aliyetoka CHADEMA, walisema Bw.Zitto alitunga uongo na anatafuta umaarufu wa kisiasa.

Awali, Katibu Mkuu wa CCM, Bw. Yusufu Makamba, aliyeanza kuhutubia, aliwaeleza wananchi wa hapa kuwa madai ya Bw. Zitto ni ya uongo yenye lengo la kukwamisha uwekezaji na maendeleo ya wananchi wilayani hapa.

Alisema wananchi wanapaswa kumpuuza, kwani ana lengo la kukwamisha ajira ya vijana wapatao 600 watakaoajiriwa na mwekezaji wa Kampuni ya Barrick wakati mgodi wa Buzwagi utakapoanza kazi.

Bw. Makamba alisema anashangazwa na baadhi ya wananchi wa Kanda ya Ziwa kumpokea Bw. Zitto kama shujaa wakati hoja zake zilikuwa si za kweli na kuwataka watu wa hapa, atakapokuja wasimpokee kwa namna hiyo wakati wa ziara yake.

Bw. Akwilombe alisema yeye anamfahamu vizuri Bw. Zitto kuliko watu wa hapa, na kwamba hoja zake zilikuwa za kutunga ili kutafuta umaarufu, kwa kuwa hakuna sheria yoyote inayozuia mkataba kusainiwa nje ya nchi.

Alidai yeye akiwa CHADEMA walipanga mbinu za kutengeneza uongo ili wapate umaarufu na kuongeza kuwa hata mkataba wa Reli yaTAZARA ulisainiwa China, lakini reli ilijengwa nchini, hivyo akawataka wananchi wampuuze Bw. Zitto.

Bw. Akwilombe alisema akija kuhutubia masuala ya mgodi wa Buzwagi, kama anavyohutubia sehemu zingine za Kanda ya Ziwa na kupokewa kishujaa wampuuze.

Naye Bw. Hiza alisema CHADEMA wanatumia kigezo cha mgogoro wa mkataba wa Buzwagi kuzunguka nchi nzima kutafuta umaarufu na kujipatia wanachama.

Alisema lengo kuu la Bw. Zitto kuzusha hoja hiyo bungeni ni kutaka iundwe tume ya kuchunguza utiwaji saini mkataba huo ili yeye awe Mwenyekiti wa Tume hiyo ili ajipatie posho wakati wa uchunguzi.

Alisema mbunge anapoanzisha hoja ikifanikiwa kuundiwa tume yeye anakuwa ndiye Mwenyekiti, hivyo mgogoro wa Buzwagi lengo lake lilikuwa kutafuta fedha za Tume hiyo ambayo ingefanya uchunguzi hadi Uingereza ulikofungiwa mkataba.

Bw. Hiza alisema kama Tume ya Malima ilitumia sh. milioni 100 uchunguzi wa uwekaji mkataba wa Buzwagi ungegharimu zaidi ya kiasi cha pesa, kutokana na uchunguzi wake kufika Uingereza.

Alisema mkataba uliowekwa ni halali na taratibu zote zilifuata sheria za nchi na kuwataka wananchi wasiyumbishwe na hoja za wapinzani ambao alidai yeye anawafahamu.
 
Hivi kweli hao jamaa hata sijaona kama wamejenga hoja katika maelezo yao. Kweli Mzee Makamba ameishiwa makada. Hivi kweli unaweza kuwachukua hao watu wakaenda kuzima moto uliowashwa? Sijaona hoja ya msingi iliyotolewa hapo kwenye maelezo hayo na sijui hata kama wananchi wa huko wanaweza kuelewa somo kwa wepesi wa hoja zilizotolewa na Akwilombe na Hizza. CCM inatakiwa iwe makini inapowatumia watu waliotoka upinzani, badala ya kusaidia kukipandisha chati chama wataishia kushusha hadhi ya chama.

Kwa kifupi ni kwamba Hizza na mwenzake Akwilombe naona wameishiwa na ndiyo maana Akwilombe alipoenda Tunduru alizomewa!
 
Maji yakimwagika hayazoleki. Kama ni kuchemsha tumeshachemsha, haiwezekani kuubatilisha tena. Labda kama nguvu kubwa ya umma ikiamua kwa kuandamana na kufanya mgomo.Je, hilo linawezekana? Kwangu mimi naona ni gumu maana Watanzania wengi ni mdebwedo.
