BENGHAZI,

Libya — U.S. Sen. John McCain, one of the strongest proponents in Congress of the American military intervention in Libya, said Friday that Libyan rebels fighting Moammar Gadhafi's troops are his heroes.

The top Republican on the Senate Armed Services Committee made the remark after arriving in Benghazi, a city that has been the opposition capital in the rebel-held eastern Libya.

McCain said he was in Benghazi "to get an on the ground assessment of the situation" and planned to meet with the rebel National Transition Council, the de-facto government in the eastern half of the country, and members of the rebel military.

"They are my heroes,"
McCain said of the rebels as he walked out of a local hotel in Benghazi. He was traveling in an armored Mercedes jeep and had a security detail. A few Libyans waved American flags as his vehicle drove past.

WASHINGTON — President Obama has authorized the use of armed Predator drones to attack Libya government forces fighting the rebellion against Col. Muammar el-Qaddafi as NATO struggles to regain momentum since taking command of the operation from the United States.
The deployment of armed Predators, announced Thursday by Defense Secretary Robert M. Gates, was in part a reaction to changing tactics by the Qaddafi forces, which are intermingling with civilian populations and mounting attacks from unmarked trucks and other vehicles, making them difficult to identify and attack by high-flying NATO fighters and bombers

A presidential statement read on state broadcasters said the government was "freezing and closing all the assets in Gambia held on behalf or in the name of" Gaddafi, including a luxury hotel and a children's amusement park. Diplomatic sources in Gambia were reported as saying about 20 people have been affected by the move, with orders out for "all staff of the Libyan embassy in Banjul representing the Gaddafi government to leave the country within 72 hours".

Libya: army may leave Misurata to tribes

Libya's army may quit fighting in Misurata because of Nato airstrikes and allow local tribes instead to lead the fight against rebels, according to the deputy foreign minister.

Rebels in the embattled town of Misurata have claimed a significant blow against Col Muammar Gaddafi's troops by dislodging snipers from the town's highest building after weeks of bloody clashes.

"Now there is an ultimatum before the Libyan army. If they can't resolve the problem in Misurata then the people from the region... will move in," Khaled Kaim said. "The situation in Misurata will be eased, will be dealt with by the tribes around Misrata and the rest of Misrata's people and not by the Libyan army," he said.

"The tactic of the army is to have a surgical solution but with the airstrikes it doesn't work."

Misurata is Libya's third-largest city and has been besieged by the Libyan army for nearly two months. Hundreds of people have been killed in clashes between rebels and government forces. The international community has accused Libyan forces of firing indiscriminately at civilian areas. Rebels in the embattled town claimed a significant blow against Col Muammar Gaddafi's troops by dislodging snipers from the town's highest building after weeks of bloody clashes.

Pro-Gaddafi marksmen inside the eight-storey insurance office block have terrorised the Libyan town and are thought to have killed scores in the past month. Rebel militiamen ousted them after taking several buildings along the strategic main thoroughfare of Tripoli Street, enabling them to cut supplies to a Gaddafi unit and dozens of rooftop snipers.

Residents celebrated after snipers left the bullet-pocked building according to witnesses. A rebel spokesman said: "The snipers nightmare is almost over. "The insurance building is free of snipers at last. Most of Tripoli Street is free of snipers too. People are celebrating in the streets."

Lawyer Drafts Articles of Impeachment Over Libya
Posted on April 7, 2011 by Ben Johnson

Someone has finally been moved to action by Barack Obama's increasingly lawless administration. Bruce Fein, a former high-ranking official in the Reagan Justice Department who wrote the first article of impeachment against Bill Clinton, has drawn up formal articles of impeachment against the president. Fein explained the final straw was Obama's unwise, unauthorized, and unconstitutional military action against Libya. "Barack Hussein Obama has mocked the rule of law, endangered the very existence of the Republic and the liberties of the people, and perpetrated an impeachable high crime and misdemeanor," he said...

Ben Smith at Politico reports, "Fein said a number of Congressional offices have expressed interest in his proposal." Fein told Smith "at least two dozen" Congressmen view the Libyan intervention as "a serious constitutional crisis."

The Libyan intervention has further separated Obama from his party's left-wing base. Liberal Democrat Dennis Kucinich of Ohio became an outspoken critic, while conservative RepublicanRon Paul of Texas agreed the bombing constituted "an impeachable offense."

Congressman Trent Franks, R-AZ, and former Speaker of the House Newt Gingrich have raised the possibility of impeaching Obama over his refusal to defend the Defense of Marriage Act (DOMA). Other supporters of impeachment range from Congressman Tom Tancredo, to talk show host Tammy Bruce, to conservative activist Howard Phillips.

A poll last month conducted by Public Policy Polling last month found that 60 percent of Tea Party members and nearly half of all Republicans favored impeachment.

As the pressure on Obama mounts, some of his supporters have become (more) unhinged. On Monday, two San Franciscans attacked a 29-year-old man holding an "Impeach Obama" sign....

ARTICLE OF IMPEACHMENT OF PRESIDENT BARACK HUSSEIN OBAMA

RESOLVED, That Barack Hussein Obama, President of the United States, is impeached for high crimes and misdemeanors, and that the following article of impeachment to be exhibited to the Senate:

ARTICLE OF IMPEACHMENT EXHIBITED BY THE HOUSE OF REPRESENTATIVES OF THE UNITED STATES OF AMERICA IN THE NAME OF ITSELF AND OF ALL OF THE PEOPLE OF THE UNITED STATES OF AMERICA, AGAINST BARACK HUSSEIN OBAMA, PRESIDENT OF THE UNITED STATES OF AMERICA, IN MAINTENANCE AND SUPPORT OF ITS IMPEACHMENT AGAINST HIM FOR HIGH CRIMES AND MISDEMEANORS IN USURPING THE EXCLUSIVE PREROGATIVE OF CONGRESS TO COMENCE WAR UNDER ARTICLE 1, SECTION 8, CLAUSE 11 OF THE CONSTITUTION.

ARTICLE I

In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress to initiate war under Article I, section 8, clause 11 of the United States Constitution by unilaterally commencing war against the Republic of Libya on March 19, 2011, declaring that Congress is powerless to constrain his conduct of the war, and claiming authority in the future to commence war unilaterally to advance whatever he ordains is in the national interest. By so doing and declaring, Barack Hussein Obama has mocked the rule of law, endangered the very existence of the Republic and the liberties of the people, and perpetrated an impeachable high crime and misdemeanor as hereinafter elaborated.

I.
THE IMPEACHMENT POWER

1. Article II, Section IV of the United States Constitution provides: "The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors."

2. According to James Madison's Records of the Convention, 2:550; Madison, 8 Sept., Mr. George Mason objected to .......

II.
THE "DECLARE WAR" CLAUSE

9. Article I, Section VIII, Clause XI of the United States Constitution provides: "The Congress shall have the power … To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;"

10. Article II, Section II, Clause I of the United States Constitution provides: "The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States."

11. The authors of the United States Constitution manifestly intended Article I, Section VIII, Clause XI to fasten exclusive responsibility and authority on the Congress to decide whether to undertake offensive military action.

12. The authors of the United States Constitution believed that individual liberty and.....

.......
III.
USURPATION OF THE WAR POWER OVER LIBYA

47. President Barack Obama's military attacks against Libya constitute acts of war.

48. Congressman J. Randy Forbes (VA-4) had the following exchange with Secretary of Defense Robert Gates during a March 31, 2011 House Armed Services Committee Hearing on the legality of the present military operation in Libya:

Congressman Forbes: Mr. Secretary, if tomorrow a foreign nation intentionally, for whatever reason, launched a Tomahawk missile into New York City, would that be considered an act of war against the United States?

Secretary Gates: Probably so.

Congressman Forbes: Then I would assume the same laws would apply if we launched a Tomahawk missile at another nation-is that also true?

Secretary Gates: You're getting into constitutional law here and I am no expert on it.

Congressman Forbes: Mr. Secretary, you're the Secretary of Defense. You ought to be an expert on what's an act of war or not. If it's an act of war to launch a Tomahawk missile on New York City would it not also be an act of war to launch a Tomahawk missile by us at another nation?

Secretary Gates: Presumably.

49. Since the passage of United Nations Security Council resolution 1973 on March 19, 2011, the United States has detonated over 200 tomahawk land attack cruise missiles and 455 precision-guided bombs on Libyan soil.

50. Libya posed no actual or imminent threat to the United States when President Obama unleashed Operation Odyssey Dawn.

51. On March 27, 2011, Secretary of Defense Robert Gates stated that Libya never posed an "actual or imminent threat to the United States." He further stated that Libya has never constituted a "vital interest" to the United States.

52. United Nations Security Council resolution 1973 directs .....

.....actions, relying instead on the undisclosed legal opinions of White House attorneys.

61. President Barack Obama, in flagrant violation of his constitutional oath to execute his office as President of the United States and preserve and protect the United States Constitution, has usurped the exclusive authority of Congress to authorize the initiation of war, in that on March 19, 2011 President Obama initiated an offensive military attack against the Republic of Libya without congressional authorization. In so doing, President Obama has arrested the rule of law, and saluted a vandalizing of the Constitution that will occasion ruination of the Republic, the crippling of individual liberty, and a Leviathan government unless the President is impeached by the House of Representatives and removed from office by the Senate.

In all of this, President Barack Obama has acted in a manner contrary to his trust as President and subversive of constitutional government, to the great prejudice of the cause of law and justice and to the manifest injury of the people of the United States.

Libyan rebels claim breakthrough
Tripoli, Libya (CNN) -- Despite government claims that Moammar Gadhafi's soldiers were withdrawing from the besieged city of Misrata, fierce fighting erupted Saturday and rebels said they had retaken control of the main thoroughfare.

The rebel gains came as the United States conducted its first Predator drone airstrike Saturday afternoon, said Pentagon spokesman Capt. Darryn James
Keeping with U.S. practice not to comment on drone strikes, the Pentagon offered no other information.

In Misrata, an opposition spokesman told CNN that Tripoli Street, notorious now for rooftop snipers, was back in rebel hands and that they would open it back up to the public once unexploded ordnances were defused.

Battles were continuing on the eastern gates of the city, said the spokesman, who did not want to be identified for safety reasons. He said a wounded loyalist soldier told the rebels that he had not eaten in five days.

"This confirms that our rebels in Misrata have liberated Misrata and that Libya is still in one piece, not two, the way Gadhafi hoped," Bani said. "In regards to the tribes fighting the rebels; how would you believe that a person will fight his brother? And who are the tribes that are supporting Gadhafi, anyway?"

Bani said some of Gadhafi's fighters were negotiating to surrender their weapons to the rebels in exchange for the assurances that they would not be harmed.

Against the backdrop of American drone attacks on Muammar Qaddafi's forces, President Nicolas Sarkozy of France announced plans to travel to Benghazi to meet the country's opposition, reported Agence-France Presse.

Mr. Sarkozy agreed to meet with the Transitional National Council sometime next week, a top presidential aide said in Paris.

On Friday, US Senator John McCain, Republican of Arizona, visited Benghazi, the center of the uprising, as a show of support for insurgents trying to overthrow Colonel Qaddafi. He urged his government to recognize the rebel council as the country's government and provide financial assistance and more military aid to the insurgents.

Libyan Forces Withdraw From a Besieged City, and the Rebels Wonder Why

24libya2-span-articleLarge-v2.jpg

Associated Press
Government troops retreated to the outskirts of Misurata under rebel fire and the opposition claimed victory after officials in Tripoli decided to pull back forces loyal to Col. Muammar el-Qaddafi.

By ROD NORDLAND and DAVID D. KIRKPATRICK

BENGHAZI, Libya - In a sudden shift after nearly two months of heavy siege, government forces withdrew from the western city of Misurata on Saturday.

By afternoon, forces loyal to Col. Muammar el-Qaddafi had abandoned all but two buildings, where they were surrounded and under pressure to surrender, rebel spokesmen and independent observers said. But there was little celebration in Misurata as government forces on the city's outskirts continued to launch barrages of artillery into the heart of the city, killing 24 people on Saturday alone, local doctors said.

The departure came so quickly that even rebel leaders puzzled over whether the withdrawal was a true military victory, a subterfuge by pro-Qaddafi forces who might return in plain clothes, or a strategic redeployment to new fronts in the mountains along the western border with Tunisia.

"It's a trick," declared Col. Ahmed Bani, the chief spokesman for the rebel forces at their provisional headquarters in Benghazi. "He's playing deadly games. He can't give up Misurata this easily. He knows that if Misurata falls in our hands, it opens the way for Tripoli to fall in our hands."

After pounding the city with rockets, mortar shells and sniper fire for nearly two months, killing hundreds, the government announced Friday that it would pull back its forces from Misurata to let area tribes move in. In a postmidnight news conference Sunday, Libya's deputy foreign minister, Khalid Kaim, said that the military had not withdrawn from Misurata but merely ceased operations in order to give tribal leaders a chance to negotiate a resolution to the siege.

Mr. Kaim said leaders of tribes that depend on Misurata's port - including the Warfalla, the Tarhuna, the Zlitan and the Tawargha - had asked the government for a chance to try to settle the conflict. But if no deal was reached in 48 hours, Mr. Kaim said, more than 60,000 armed men from the tribes would move in, and the Libyan Army remained in position to attack as well.

"If the tribes move into the city, then I think it will be very, very bloody, and I pray to God we can avoid this," Mr. Kaim said, suggesting Misurata could foreshadow the tribal civil war many Qaddafi supporters foresee if Colonel Qaddafi steps down.

Some area tribes - notably the Warfalla, Libya's largest tribe - have historic rivalries with the people of Misurata. The Warfalla also dominated the armed forces besieging the city, so substituting armed tribe members for uniformed soldiers may amount to little more than discarding the uniforms. That tactic would also help government forces evade NATO attacks by blending in with civilians.

NATO's new mission of bombing for 'regime change' in Libya does not appear to have merely failed, but seems to have actually worsened the humanitarian crisis in the North African country.

In an interview with Press TV, Abayomi Azikiwe, editor of Pan-African Newswire, discusses the situation including NATO's neglect of humanitarian concerns despite formal agreements reached.

The following is a transcript of the interview:

Libya: western leaders call for Nato to assassinate Gaddafi

Senior western leaders called for Nato to adopt an assassination policy against Col Muammar Gaddafi to salvage the bombing campaign in Libya from a descent into stalemate.

By Toby Harnden, Washington and Robert Winnett 6:50PM BST 24 Apr 2011

The calls came as Col Gaddafi was reported to have strengthened his grip on power by repatriating billions of dollars in overseas assets that should have been frozen by UN sanctions.

On Sunday, there was growing pressure on Coalition forces to directly target Col Gaddafi with military strikes.

Senator Lindsey Graham, a Republican member of the Senate Armed Services committee, said that the quickest way to end the emerging stalemate was to "cut the head of the snake off". He said: "The people around Gaddafi need to wake up every day wondering, 'Will this be my last?'

Senator John McCain, who visited Libya at the weekend, also said that the Libyan dictator should be targeted but argued that it was more important to increase American firepower over Libya. He said: "It's pretty obvious to me that the US has got to play a greater role on the air power side. Our Nato allies neither have the assets, nor frankly the will - there's only six countries of the 28 in Nato that are actively engaged in this situation."

William Hague, the Foreign Secretary, also on Sunday refused to rule out using remote-controlled American drones to assassinate Col Gaddafi. Mr Hague said "who and what is a legitimate target depends on their behaviour." However, he denied that there was a stalemate in Libya and ruled out proposals to partition the country.

Mr Hague said he was still hopeful about sanctions beginning to undermine the regime, despite the reports of Libya circumventing the UN-led financial crackdown.

The European Union and United States have barred access to more than $60 billion in Libyan bank accounts and funds but other nations have done little or nothing to prevent Col Gaddafi and his associates sustaining themselves.

Col Gaddafi has moved billions of dollars back to Tripoli since the rebellion began in mid-February, according to European, American and United Nations officials who spoke to the Los Angeles Times.

The full scale of sanctions-busting is unknown, partly because many investments in companies and financial institutions hide Col Gaddafi's identity.

Libya's circumvent of the sanctions has complicated Nato's efforts to end Col Gaddafi's four decades in power. His ability to siphon off cash has also hampered attempts to persuade his advisers and military commanders to flee.

Officials said the case was a cautionary one about the limits of sanctions and could be compared with Saddam Hussein's success at getting around international sanctions in the years before the 2003 invasion of Iraq.

Kenya and Turkey are among the countries with strong economic ties to Libya that have resisted carrying out the freeze, mandated by UN Security Council resolutions in February and March. A number of other African countries have also been reluctant.

China, India and Russia, three of the world's biggest economies, have resisted European and American attempts to expand the sanctions. They argue that such actions could damage their own industries.

A UN diplomat told the "Los Angeles Times" that "only a handful" of governments had reported back to the Security Council enforcement committee, which oversees the sanctions, that they had blocked access to Libyan assets.

"We've done pretty well," the diplomat said. "But when you're dealing with somebody as sophisticated as Gaddafi, with such sprawling commercial interests, this has been an uphill struggle.... It's been hard." Under UN rules, governments don't have to report their efforts to comply with sanctions until late June.

This four-month delay "is a major weak flank in the system", the diplomat said, and Gaddafi "understands the system".

Nato Planes Hit Gaddafi Compound In Tripoli

7:41am UK, Monday April 25, 2011
A Nato airstrike has badly damaged buildings inside Colonel Muammar Gaddafi's compound in Tripoli - one of them apparently his office.

Reports said at least two powerful missiles struck the compound in the capital early on Monday.

Libyan government officials claimed the airstrike was an attempt on Col Gaddafi's life - but Nato said it was targeting his forces.

Three TV stations went off the air for about half-an-hour following the explosions, among the biggest to hit Tripoli so far. The target of the Nato attack appears to have been office buildings in Col Gaddafi's compound.

Walls were blown out, roofs caved in and debris was spread over a wide area.

Some officials at the scene said there had been a number of injuries, although others contradicted that. Nato insists it has been actively targeting command and control positions.
