China recognised the rebel National Transitional Council (NTC)
as Libya's "ruling authority", the Chinese Foreign Ministry said on Monday, saying the Council had vowed to respect Beijing's interests after tensions between the two sides.

"We hope that the various treaties and agreements previously signed between China and Libya will continue to remain effective and be conscientiously implemented," said Ma.

[h=1]Syrian TV says Muammar Gaddafi still in Libya[/h]A Syrian television station that has broadcast messages from Muammar Gaddafi in the past said on Monday the fugitive Libyan leader was still in Libya, but it was unable to air his latest message for security reasons.

"We were due today or last night to have a televised speech of the leader of fighters, but for security reasons the appearance of this televised message has been postponed," Mishan Jabouri, owner of the Arrai channel, told viewers.


"It was meant to show the leader among his fighters and people, leading the struggle from Libyan lands, and not from Venezuela or Niger or anywhere else," he said.


He read out the text of what he said was a message from Gaddafi, quoting the ousted leader as saying: "We cannot give up Libya to colonisation one more time.... There is nothing more to do except fight till victory."

Gaddafi's son Saadi 'arrives in Niger'

One of the sons of the fugitive Libyan leader, Col Muammar Gaddafi, has arrived in neighbouring Niger.

Niger's justice minister said Saadi Gaddafi had been in a convoy which was heading towards the capital, Niamey.

Col Gaddafi's whereabouts are unknown. He has said he will die in Libya.

Anti-Gaddafi troops now control most of Libyan territory, including the capital Tripoli. They have been trying to seize several cities controlled by loyalists, including Bani Walid and Sirte.

Niger says Saadi Gaddafi under surveillance, not detained

Niger said on Monday it is keeping the son of Muammar Gaddafi, Saadi, under surveillance and has not detained him.
"Nothing has changed in the government's position. There is no international search for him. Like the others he is just under surveillance," a government spokesman said, referring to other Gaddadfi loyalists who have recently fled to Niger.

Report: Both sides have committed war crimes in Libya

Tripoli, Libya (CNN) -- The regime of ousted leader Moammar Gadhafi and the rebel government -- the National Transitional Council -- have both committed war crimes during the conflict in Libya and someone needs to take control to stop abuses from continuing, Amnesty International said in a report released Tuesday.

The 112-page report detailed many examples of abuses by the Gadhafi loyalists, which included "mass killing of prisoners, torture, enforced disappearances, and arbitrary arrests."

But the report also spotlighted what Amnesty called a problem with the National Transition Council in controlling divergent groups of anti-Gadhafi fighters.

The report said rebel fighters have conducted revenge attacks on prisoners and, at one point, conducted house-to-house raids killing people they thought were Gadhafi mercenaries.

"The NTC is facing a difficult task of reining in opposition fighters and vigilante groups responsible for serious human rights abuses, including possible war crimes; but has shown unwillingness to hold them accountable," the report says. "So far, NTC officials have not provided details of any measures taken to address such concerns."

Gadhafi officials could not immediately be reached for comment on the report.

The NTC released a statement about the report Tuesday.

"The Amnesty report is overwhelmingly filled with the horrific abuses and killings by the Gaddafi regime, however there are a small number of incidents involving those opposed to Gaddafi, the NTC strongly condemns any abuses perpetrated by either side," the statement said. "The NTC is firmly committed to upholding human rights and the rule of law, both international and local, the violation of rights no longer has a place in Libya."

Amnesty said it was up to the NTC to fix these issues.

"It is a war crime for any party to a conflict to kill prisoners,"
Amnesty said. "The onus now is on the NTC to do things differently, end abuses and initiate the human rights reforms that are urgently needed."

The report comes a day after the country's interim leader gave a speech from Tripoli and promised to rebuild Libya's institutions and justice system.

"We aim to establish a state of law, a state of welfare, a state where Islamic Sharia law is the main source of legislation," said Mustafa Abdel Jalil, chairman of the NTC. "This matter requires several things, primarily unity of classes and non division and the soul rejection of hatred and envy -- not taking law into your own hands."

Jalil was justice minister under Gadhafi before defecting to join the opposition in February.

No, only one side commited the crime and that is West(NaTo), they sponsored Al Qaeda men for initiating violence in Libya, they involved themselves to subbotage the soveringty of African country ( Libya) by training gangmen from Bengharz, they dropped depleted Uranium bombs in civilian settlements, they have stolen Libyan monetary reserves, they are directing gangmen from Bengarhz to kill any body with black coloured skin and many more.

AU Panel On Libya to Meet in Pretoria

Pretoria - The African Union panel on Libya will meet on Wednesday in Pretoria to discuss the latest developments in the North African state, International Relations Minister Nkoana-Mashabane said on Tuesday.

The committee -- led by President Jacob Zuma -- will meet in Pretoria to discuss a range of issues concerning Libya, Nkoana-Mashabane said at an international co-operation, trade and security cluster briefing. The panel also consists of the heads of state of Uganda, Mauritania, Mali and Congo-Brazzaville

"These leaders will be meeting to review the progress of the outcome of the AU Peace and Security Council meeting which was held last month."

In their summit in August, the AU reconfirmed their commitment to the AU roadmap as the best option to resolve the conflict in Libya. Nkoana-Mashabane said one of the key issues that the leaders will look into is the situation in Libya post Colonel Muammar Gaddafi regime.

The AU has sought in vain to mediate between Gaddafi and the Libyan National Transitional Council (NTC) rebels, who have rejected the continental bloc's proposals.
In turn, the AU has not recognised the NTC, which now controls most of Libya's territory.

As the fighting intensifies, Gaddafi's whereabouts remain unknown. The ousted leader said last week that he had not fled to Niger and would fight to death in his country.

Nkoana-Mashabane said the AU plan can only work if the parties are prepared to talk to each other.

She reiterated that the NTC is an opportunity for an interim all inclusive government that will prepare for a democratic government through democratic elections, preceded by an interim constitution.

These elements, she said, are referred to in the original AU roadmap, which spells out the way forward, and should include the drafting of a new constitution under the supervision of the transitional government, and a referendum on the new constitution leading to democratic elections.

Asked what "inclusive" interim government meant, Nkoana-Mashabane said it should "represent all the political forces in the country."

This shows that the AU is still entangled in a bureaucratic quagmire while events on the ground are proving to be beyond the Organisation's ability to adjudicate. Let's hope the post-Gaddafi AU has not yet become a spent force!

Nigeria's minister of Foreign Affairs, Olugbenga Ashiru, yesterday said that no Nigerian has died or is being harassed in Libya. According to him, his assertion followed on discussion between Nigeria and officials of the National Transition Council (NTC) of the embattled North African country.

He also said there was nothing hasty about Nigeria's decision to recognise the NTC in Libya, noting that in taking the position on Libya, Nigeria was patient and always hoping that the superior logic of dialogue would prevail. The minister, who spoke at a media briefing to mark President Goodluck Jonathan's 100 days in office, maintained that if Nigeria had not taken the stand, there would have been more bloodshed and the victims would have turned to blame Nigeria.

"Nigerians were being protected in Libya as a result of the recognition accorded to the NTC, which is the group we felt was gaining ground," Mr Ashiru said. "A Nigerian in Libya sent out a text message which was forwarded to me. I put a call across to him and he happens to be the leader of Nigerians in that country. I assured him of safety and also called the NTC that no harm must come to any Nigerian and, in fact, any black in Libya and they assured them that nothing will happen to them. So no Nigerian has died in Libya."

Reasons for decision

On why Nigeria supported the NTC, he explained that Nigeria's over-riding interest in Libya are threefold: "One, to achieve an early end to the conflict, thereby preventing further loss of innocent lives, regardless of who the culprits are. Two, to support processes which would allow the Libyan people decide the future of their country. This is consistent with our new foreign policy focus to support the consolidation of democracy in Africa.

"In taking the position we took on the Libyan crisis, Nigeria was patient, always hoping that the superior logic of dialogue would prevail. For instance, our support for the AU Road Map was premised on the expectation that the protagonists would see the wisdom in embracing dialogue rather that a recuse to military solution.

"The AU Road Map, therefore, failed because of lack of faith on the part of the belligerents. In the circumstance, Nigeria had to act to reaffirm its leadership and also to continue to demonstrate our country's commitment to the consolidation of democracy in Africa, a value which is central to our country's new foreign policy focus."
