Uchaguzi US: 2020

Uchaguzi US: 2020

The Grand Unified Theory of America [GUTA] still posits that Trump will be the inaugurated president in 2021. Here is a speculation on what may happen in the intervening time. Remember, speculation does not mean endorsement for or against any presidential candidate.

1. Biden may choose to take the higher road and concede, saying "United States is bigger than" himself and Trump. And that, "although I won, I decide to let Trump take second term if that is what will keep the republic." This speculation sounds least likely.

2. A judge or some legislatures may give Trump Electoral College electors despite Biden's ostensible win. Either Trump wins straight away or neither have the 270 seats required to win, therefore Trump wins through a Congressional vote.

3. The Supreme Court of United States hands the victory to Trump.

4. Both Biden and Trump remain relentless. Trump exhausts all legal and legislature options. Trump invokes The Insurrection Act and the Militia Act, and rule by decree, claiming he is to fix the electoral system. Things get kinetic and ugly.
...

3. The Supreme Court of United States.... <<<<============ THIS SCENARIO IS AT PLAY AT THE MOMENT.

They are humoring him. Tomorrow is the 10th. Let's see if they will win the case.
As we await these theatrics to play out, sore loser Donald Trump has today lost yet again a Wisconsin lawsuit seeking to disqualify more than 221,000 ballots and overturn his loss to Democrat Joe Biden in the battleground state.

Meanwhile over 3,000 Americans are dying of COVID-19 everyday!

And President-Elect Joe Biden is right now continuing to announce and introduce his cabinet picks! Kweli wajinga ndio waliwao!

From what is floating around in the internet, it appears to be true that, by the letter of the constitution, the four states contravened the constitution by changing the rules of election without involving their own legislatures. But the remedies sought are tricky as you have pointed out. Therefore it is likely the following events will take place:

1. The SCOTUS will conduct hearing of the Texas et al. vs Pennsylvania et al case.
2. The SCOTUS will rule against parts of the plaintiffs requested remedies.
3. The SCOTUS will agree with the plaintiffs that indeed the constitution was infringed, and hence EITHER the SCOTUS will rule to:

A: Toss the extra ballots counted after voting ended, handing Trump the win straight-away; OR
B: Toss the election results of the four states, and direct The Congress to elect the President and the Senate elect the VP.

SCOTUS decisions 9-0 or 5-4.

Which constitution are you talking about? The federal constitution doesn't cover state elections. That's the work of the state constitution. Therefore, in this case the supreme court has to examine the constitution of each state separately and then issue a ruling that addresses election violations, if exist, in each individual state. And with that in mind, I don't think the supreme court will be in a position to issue one legal remedy which covers all four states. How do you toss the Votes in Georgia, when the election was clean? How do you toss the votes in PA when the GOP led legislature wanted the absentee and mail-in vote to be counted after the election. How do you invalidate Wisconsin votes, when the supreme court had already ruled what wasn't legal in the election laws of that state before the election?

Zakumi may be now some people will come off their slumber and accept that President-Elect Joe Biden will be sworn in as the 46th US President on January 2021 as I have insisted all along. Donald Trump is being played and thick as he is he believes he can destroy the pillars of democracy as envisaged in the US constitution. Nobody, I repeat, nobody is above the Law in the US.

In 2016, a complete moron fluked his way to the presidency and there is just no way that mistake can be repeated...not in the US that some of us happen to know. Now may be a few misguided opinions as to which are fake news and which are alternative facts about unfounded conspiracies will be shelved.

I think that why this guy has declare a good number of bankruptcies. He isn't a strategic leader at all. It seems when he can get into a messy, he can find a way to get out of it.

In 2016 campaign, Obama mentioned that Trump doesn't posses even rudimentary knowledge on how the government works. Now everything is open for everybody to see. How does he continue to push for this?

That's why at times I don't respond to opinions that I feel are not worth responding to...I consider that beneath my dignity. Trump is fighting for his life, he knows exactly what is in store for him. He is sinking and all he can do now is clutch at straws hoping they can save him. Sadly he is dragging the whole GOP with him.

Indeed those are interesting points. We won't find out because the SCOTUS dismissed the case without conducting hearing.

Now, what next in the USA 2020 election comedy? It looks it does not disappoint in providing entertaining twists. Time to get more popcorn.

In the year 2000 Gore-Bush debacle, a Tanzanian newspaper reported in its main headline: UNITED STATES JOINS THE THIRD-WORLD IN ELECTION FRAUD. There was an official of the Federal government who complained about that headline. This election cycle the Tanzanian newspapers have not come up with a headline that solicit some response from the US.

The SCOTUS chose option 1: not to conduct hearing of the Texas case.

The GUTA theory appears to not explain USA very well, for now. Time to toss it to the dustbin now, or wait a little longer?

Just because you can file a lawsuit, it doesn't mean the court will hear it. We pay attention to sensationalized political issues that divide the nation; however, that's a tiny percentage of what the court engages. So before you file a case at the highest court in the land, make sure you have compelling reasons and evidence to back up your case. Otherwise, start your case at the lowest court.

Now it appears that GOP thinks the SCOTUS ruling has set a precedent that states can do whatever they want, and hints at secession.

Looks like Trump's judiciary options are not feasible pathways for reelection.

Mlenge , kama Zakumi alivyosema hapo juu. Hapa kuna 'misconception au misconstrue''

Hukumu ipo hivi, katika SCOTUS kuna majaji 9.

1. Wawili wakasema ' ilikuwa muhimu kusikiliza kesi'' na huu ndio umekuwa msimamo wao, Justice Alito and Thomas Clarence. Mwisho wa Andiko lao wakasema maneno haya ''...but would not grant other relief'

Justices Alito na Clarence wanasema kuwa wangependelea au kutoa (grant a motion to file a bill) but would not grant other relief. Kwamba wangependa kesi itajwe ingawaje wasingekuwa na maoni tofauti na ilivyo sasa.
Ndio msingi wa neno '' other' kama ilivyotumika.

2. Kesi iliyokuwepo ni ya Texas dhidi ya state nne, kwamba, Texas na hasa yule AG alikuwa na ''feelings' kuwa Michigan, Pen, Wisc, and Georgia hazikutendewa haki .

SCOTUS wanasema kuna 'lack of standing'

Actually we know why the court dismissed the case without hearing it. Texas failed to show how elections in those four given states infringed or violated constitutional rights of people of the state of Texas. In simple terms, this case is similar to a person who files a divorce case on the behalf of his neighbor's wife on the grounds that his neighbor's wife deserves much better.

Between now and January 2021 or between now and 2024, you will hear a lot of amusing things. That's how the politics in the US has become. It's very irrational. One of the reasons for that is the system itself. It is open for abuse. I think some Americans are abusing it unknowingly. Take for example the house representatives. Every two years, there is an election for the representatives. In modern days, this is very unstable proposition as it has forced a good number of representatives to become hype-partisan. They view people on the other side of the political spectrum as enemies, and they should be no common grounds. Every thinks about the next election cycle and the best platform to help him stay relevant with voters.

In regards to 2000 election, it was a debacle. This is a very developed country and it was a shame that the country was put on spotlight because the officials couldn't figure out how to allocate few mixed votes, and they had to take the issue all the way to the supreme court. However, there was a good lesson that came out of that. The state of Florida has improved its voting system. For example, on election day Florida can announce the winner without any issue. That's remarkable and first world election.

In this election cycle, Tanzania was in its own election messy. A day or two before the election, the internet was down and it took more that a week to restore the internet normalcy. On top of that, the government was busy cracking down the opposition. So the Tanzanian media was a bit on the edge as the media couldn't chastise the election in the US while the home election wasn't that clean.

The only best option for Trump is to wait for 2024. I told you before.
There shall never be Trump 2024. If indeed Biden becomes the President. Trump will be arrested/prosecuted, together with his close family and associates. And it will be the end of GOP. Voter apathy would be of the proportion never seen before in the right of the aisle politics. Trump still have options, but those options may plunge the republic into kinetic and ugly scenes. The options include military takeover or invoking The Insurrection and Militia Acts. I don't know if he will cross the Rubicon and go for those options.

What does the part I bolded say about the states that took longer, laden with issues, to announce the winner?

Bon appettit...

So, it means the SCOTUS is not interested in matters related to the election. That means if The Trump side puts some shenanigans in the electoral procedures that are remaining, the SCOTUS won't get involved. Right?

Mlenge, umekazania kuhusu kesi kati ya SCOTUS and State bila kuangalia 'origin' ya suala zima na SCOTUS imekataa kusikiliza katika ground zipi.

Labda tuanze kujadili kitu kimoja, ni nini hasa malalamiko ya Texas?
Pili, ni ipi ruling ya SCOTUS?
