For a person who claims to be kenyan, you have very little knowledge of Kenyan law. KDF can not act locally unless an external enemy has moved into the country's borders eg Al shabaab or foreign military,If they are to be deployed locally then parliamentary approval is necessary and the president can not override the parliament if they do not approve. Note the border is Kenyan territory so it is local.


(3) The Defence Forces--

(a) are responsible for the defence and protection of the sovereignty and territorial integrity of the Republic;
(b) shall assist and cooperate with other authorities in situations of emergency or disaster, and report to the National Assembly whenever deployed in such circumstances; and
(c) may be deployed to restore peace in any part of Kenya affected by unrest or instability only with the approval of the National Assembly

Also note there is a difference between moving battalions location and deploying them for active duty within kenya. He can move any military barracks he wants, but he can not deploy them locally without approval of parliament

It is within the mandate of the president and the KDF to protect the integrity of Kenya territory. At this point all options are open i.e dialog and military but Kenya will not accept anything from the ICJ.

What I gave you is the constitution of the country(Kenya) with regards to local deployment of KDF. Lamu and Kapedo there was no need for approval because they went to support the Administration police(Border patrol unit) and the General service unit (Refer to point b ). They did come back with a report to parliament after the operation through the national security council.

It seems you have not read that part, or you choose to ignore the fact that in both cases, the Administration police and the general service units ie. The Kenya police were leading and KDF was offering support.

He has no knowledge of the kenyan law, even though he claims to be a Kenyan. I have also come to the realization that Tanzanians are suffering from a sort of Kenya derangement syndrome. Anything Kenyan totally triggers them to boiling point, which shows their own inferiority complex.

While the Kenyan Army deployment in Somalia formally joined the African Union Mission in Somalia (AMISOM) on June 11, the Kenyan Navy and Air Force (which has also carried out bombing operations over Kismayo) were not included in the agreement and thus do not come under the Ugandan-dominated AMISOM command structure.
Kenyan warships are now playing an important role degrading the defenses and military capacity of those al-Shabaab militants who have not seized the opportunity to join the civilian flight out of Kismayo. There are reports that al-Shabaab has attempted to stiffen its resistance by bringing in hundreds of reinforcements in armored vehicles (Jowhar.com [Mogadishu], September 7). Even if al-Shabaab is forced to make a strategic withdrawal from Kismayo, occupying AMISOM forces are almost certain to be met by improvised explosive devices, land-mines and ambushes by hidden militants (after the pattern of Mogadishu).
After reportedly being provoked by an al-Shabaab gunboat, a Kenyan navy ship fired ten rounds on Kismayo on September 3, while the port area and airport were shelled the next day (Daily Nation[Nairobi], September 5; VOA, September 4; BBC, September 4). Kenyan ships fired on what they believed to be a Kismayo arms cache on September 5, killing a reported seven Shabaab militants and destroying a stockpile of "technicals" [armored battle wagons], arms and munitions (RFI, September 6). A Kenyan ship fired on a Shabaab anti-aircraft emplacement on September 11.

Dude don't you understand how bieng Commander in Chief works? As the commander in chief, he has the powers to deploy troops incase of emergency then inform parliament later. Think of a situation where the country is invaded by a foreign force. Do you want the president to start asking for permission for troops to be deployed?

When the US $100m drone was downed by Iranian forces in the Persian gulf, the US military prepared a retaliatory strike to Iran military installation, Donald trump said he came within 10 minutes of approving the military strikes.. He did not have to ask Congress for permission, but if he had approved the strike and Iran had retaliated, he would have been forced to ask for permission to go to war with Iran....


Why does the president sometimes asks for permission and sometimes doesn't apart from the emergency explanation above? Other reasons include consequences, budgetary allowance, and countries justification and approval.

Consiquences and Budgetary allowance:
(Lamu deployment actually had parliamentary approval in the later stages, the KDF are under orders to follow Kenya police procedure so KDF is not in control the Kenya police Commander is in charge of all the troops including KDF). As for the case of Kapedo, There were no consiquences for the CiC to deploy, the troops were going to use the same budget that had already been approved by parliament. It wouldn't cost any more money. As for a case like deploying the Navy in a situation like that, you need serious budgetary allocation separate from regular budget, (KNS jasiri spends about sh10million a week in active deployment) So if you don't ask for parliamentary approval for the war, how is parliament gonna create a special budget for your war chest! Imagine if he declared war and parliament refused to budget for the war!!!
A good example is Donul Trump building a wall on the Mexican border, as the CiC he has the power to order his military to build a wall and secure the country but since he doesn't have the majority in Congress anymore, he didn't get the $5B budget he needed for it, after multiple trys he decided that he was going to take $2B from the Pentagon and reappropriate it to the wall, this is allowed since Congress had already given the money to Pentagon to secure America and the wall can be considered part of the 'securing'.
Also, asking for parliamentary approvals means the president is looking to share any other consiquences or backlash. If something were to go wrong it wouldn't be just him, parliament will also share the blame.

Justification and approval:
In a perfect democracy, parliament is a representation of the people from every constituenc, so having the approval of parliament means it's not just a one man's decision, it gives you justification and approval from your citizens, which means to the international world, it will be a Kenyan division to deploy the Navy and not just the president decision.. it will give Uhurus decision more legitimacy in the geopolitical areana that he has the approval of parliament.

Keep dreaming! I know you guys hope and pray for Kenya's downfall but we keep getting stronger. We have defeated somalia when said bare was president and he had the support of America and partly Russia, our only ally was britain and we still defeated said bare. PROOF: Northeastern that was claimed by somalia is still Kenyan territory.

One immediate consequence of the Shifta insurgency was the signing in 1964 of a Mutual Defense Treaty between Jomo Kenyatta's administration and the government of Ethiopian Emperor Haile Selassie.

Barre advocated the concept of a Greater Somalia (Soomaaliweyn), which refers to those regions in the Horn of Africa in which ethnic Somalis reside and have historically represented the predominant population. Greater Somalia encompasses Somalia, Djibouti, the Ogaden in Ethiopia, and Kenya's former North Eastern Province, regions of the Horn of Africa where Somalis form the majority of the population to some proportion.In July 1977, the Ogaden War broke out after the Barre's government sought to incorporate the various Somali-inhabited territories of the region into a Greater Somalia, beginning with the Ogaden. The Somali national army invaded Ethiopia, which was now under communist rule of the Soviet-backed Derg, and was successful at first, capturing most of the territory of the Ogaden. The invasion reached an abrupt end with the Soviet Union's shift of support to Ethiopia, followed by almost the entire communist world siding against Somalia. The Soviets halted their previous supplies to Barre's regime and increased the distribution of aid, weapons, and training to the Ethiopian government, and also brought in around 15,000 Cuban troops to assist the Ethiopian regime.The United States stepped in and until 1989, was a strong supporter of the Barre government for whom it provided approximately US$100 million per year in economic and military aid.

The war thus marked the beginning of decades of violent crackdowns and repressive measures by the police in the NFD coupled with allegations and unsubtle innuendo on the part of the Kenyan media charging the region's almost exclusively Somali inhabitants with "banditry" and other vice.

A particularly violent incident referred to as the Wagalla Massacre took place in 1984, when the Kenyan provincial commissioner ordered security forces to gather 5,000 men of the Somali Degodia clan onto the airstrip at Wagalla, Wajir, open fire on them, and then attempt to hide their bodies. The deal, known as the “Bamburi Understanding”, was a reassurance following a non-committal statement made by Mr Duncan Sandys, the British Secretary of State for the Colonies, in 1964.
Without making any concrete commitment, Mr Sandys had told Kenya’s new government that in case of an attack by Somalia, it was probable that Britain would intervene.
Somalia, which was then considered to have one of the region’s most powerful armies equipped with sophisticated Soviet-made weapons, had threatened to annex the north eastern part of Kenya in pursuit of its Greater Somalia policy. President Jomo Kenyatta’s administration had since independence in 1963 been grappling with a secessionist conflict in the north east, known as the Shifta War, that was supported by Somalia. Indeed, Somali Prime minister Muhammad Egal had told British MPs in 1962 of the intention to unite all territories occupied by Somalis in Kenya and Ethiopia
