Usichokijua kuhusu Katiba ya Kenya

Watanzania wengi walifurahishwa sana na hiyo iliyoitwa Katiba mpya ya Kenya na pengine si ajabu hata ndiyo moja ya sababu ya sisi pia kuanza mchakato wa kuandika hii iliyoitwa Katiba Mpya.

Lakini kuna kitu ambacho nafikiri Watanzania wengi hawakijui kuhusu Katiba Mpya ya Kenya, ambapo kwa maoni yangu nafikiri ni usanii mtupu kwa mfano Cheo cha Mkuu wa Wilaya hakijafutwa kama ilivyo hapa kwetu na bado anateuliwa na Raisi wa Nchi.

Yaani kwa maana nyingine hawa Magavana wao wa County hawana madaraka yoyote kwa maana kuna Mkuu wa Wilaya ambaye ndiye muwakilishi wa Raisi kwenye hiyo county na ndie ana mamlaka na Dola hapo kwenye county na siyo Gavana wa county, sasa ndiyo wamefanya nini?

Lakini kuna kitu ambacho nafikiri Watz wengi hawakijui kuhusu Katiba Mpya ya Kenya, ambapo kwa maoni yangu nafikiri ni usanii mtupu, kwa mfano Cheo cha Mkuu wa Wilaya hakijafutwa kama ilivyo hapa kwetu na bado anateuliwa na Raisi wa Nchi.

Yaani kwa maana nyingine hawa Magavana wao wa County hawana madaraka yoyote kwa maana kuna Mkuu wa Wilaya ambaye ndiye muwakilishi wa raisi kwenye hiyo county, na ndie ana mamlaka na Dola hapo kwenye county na siyo Gavana wa county, sasa ndiyo wamefanya nini? Si ni kama Bongo tu?

The devolved government, proposed during the making of the new constitution, is primarily geared towards achieving two main objectives.

• Involve the people in governance
• Allow better supervision and implementation of policies at the grassroot level

The county Government, which has since replaced the provincial administration, constitutes of a county assembly and county executive. The responsibilities of the county assembly include:

• Exercising the powers of enacting laws at the county level
• Acting as an oversight instrument on the county executive
• Approval of plans and policies for smooth operation and management of resources and county institutions

Even at county level, democratic principles are observed. The people elect the members of the county assembly at Ward level. All the same, additional slots are reserved for nominations. This ensures that membership is well distributed by gender, marginalized groups and persons with disability.
The county assembly is headed by a county Speaker who by law is not supposed to be a member of the assembly.
The county executive on the other hand is charged with the responsibility of exercising executive power at the county level, implementing laws for administration of the county as well as carrying out other executive functions of the county. The county executive gives the people an opportunity to be more actively involved in lawmaking. The county executive is led by a governor who is directly elected by the people at the county level. The appointment of the county executive members is placed under the mandate of the governor, and approval is subject to the county assembly.
Point of note: The executive members are answerable to the governor and shall not be members of the county assembly.
Currently the Kenya devolved government consists of 47 counties representing the initially recognized districts and each one of them forms a county government. Every county government shall further decentralize its services and coordinate its functions in order to efficiently serve the interests of the people of Kenya at the local level.

The Provincial Administration will derive its authority from the mere fact that its very nature is 'a system of administration' and nothing else. Consider the Sixth Schedule - Transitional and Consequential Provisions, Part 4 - Devolved Government, Article 17:

17. Within five years after the effective date, the national government shall restructure the system of administration commonly known as the provincial administration to accord with and respect the system of devolved government established under this Constitution.
So it will essentially exist (in whatever name) as an extension of the National Executive.

Tanzania should also have gone for the devolved system of government.

Clearly you have no clue of Kenya's constitution.There's no clause that has provided such happenings,the government just did that for better coordination and security.But the governors are the head of the executive of the counties, meaning have all the powers given by the people.

FYI the courts ruled the government's move to appoint the county commissioners as Unconstitutional but nothing happened. My point is the governors are the head with most powers, answerable only to the populace, as provided in the constitution, as in via the County Assemblies, The, Parliament and the Senate.

Though the answerable part has had issues you know we are still adapting to the new stuff, and slowly getting better in its comprehension.

I wish Tanzania best of luck, and get the best constitution that will help you, you should adopt things that are unique to you and will adress your problems.

Kwenye Katiba ya Kenya kuna magava wa County na Macomissioner wa County, Magavana wanachaguliwa na Wananchi na Macomissioner wanateuliwa na raisi wa moja kwa moja kwa maana nyingine hawa ni wawakilishi wa Raisi kwenye hizo county.
