William Ruto ICC trial thread.

Interesting, it is day one and you are already drawing conclusions. There are several days a head. Why don't you just sit back and follow proceedings. There is no doubt where you stand in this case.

Kiswahii kinakupiga chenga sio. Sasa wewe, mimi niandike kwa Kiswahili halafu wewe unijibu kwa Kiingereza. Bado unaamini unaeleweka zaidi kama utatumia lugha hiyo?

Why don't you just pass your message without attacking my language. After all you understand what i mean. If you are a guru in Kiswahili then why don't venture in to writing set books for schools. You could earn handsomely.

It is in the best interest of everyone that justice prevails. This is true even for the accused. For this reason we can only sit back and watch the unfolding turn of events without passing judgements yet. After all how do we know if the accused were not framed for political expediency?

why do you say they were fiamed, wakati wao wenyewe walisema wapelekwa icc hawaogopi..tuacheni sheria ifuate mkondo wake.viongozi wengi wa kiafrika wamekuwa big headed na kukiuka haki za binamamu kwa kutumia nafasi zao..yoyote anayetumia nafasi yake vibaya lazima akumbane mkono wa sheria.hili sio suala la kisiasa, mtabaki mnanyoosheana vidole na kulaumiana wakati mambo yako wazi..cha msingi ni kujenga defence ili kuwaokoa hao ndugu (masters)wenu.kunyosheana vidole hapatasaidia chochote.

The ICC case is starting to collapse like a house of cards. Shame on the prosecution.

The trial for Kenya Deputy President William Ruto and former radio presenter Joshua Sang will be adjourned after the completion of the defense teams' openingstatements tomorrow until Tuesday next week, after the first prosecution witness failed to arrive at The Hague in time.Following the development, the Deputy President is expected to briefly jet back to Kenya tomorrow, three weeks earlier than his expected return.

The first prosecution witness, who was not disclosed, was scheduled to begin testifying on Wednesday, September 11th but the prosecutor’s office said the witness was still on the way and would arrive at The Hague on Thursday.

The witness is one of 22 lined up by the prosecution to testify in the cases against Ruto and Sang.

Meanwhile, Ruto’s lawyer Karim Khan has asked the court to withdraw the cases against his client, saying the dropping out of witnesses in the case indicates Ruto has no case to answer. “I don’t want your honors or anybody in this courtroom or watching, to be under any illusion why those witnesses have withdrawn or dropped or don’t come. There is a rotten underbelly in this case which the prosecutor has swallowed hook, line and sinker, indifferent to the truth,” said Karim Khan.

The Defence team of Deputy President William Ruto has dragged the name of former Prime Minister Raila Odinga into his ICC trial, after playing a video clipshowing Odinga “calling for mass action.”

Odinga is later seen correcting his statement after Ruto whispered to him the words “peaceful mass action.”

Lawyer Karim Khan played the video four times to the court maintaining that his client had nothing to do with the bloody events that followed the controversial 2007 election.

Khan argued that Ruto did not ask anyone to kill or loot property of those perceived as enemies of the Orange Democratic Movement (ODM), to which he belonged at the time.

In the clipdated December 31, 2007 Odinga can be seen and heard calling for mass action arguing that the 2007 poll was rigged. Ruto is then heard whispering to him to include the word ‘peaceful’ in his call.

“It is very clear that it is William Ruto who utters the word ‘peaceful’. The whisper to the leader of ODM Raila Odinga is a qualification that is very important,” said Khan.

“It is a whisper that we say silences this prosecution and it is a whisper that is deafening. It gives the bench an insight into how erroneous this prosecution is.”

On December 30, 2007, immediate former President Mwai Kibaki was declared the winner of the General Election that was conducted on December 27. He was then hurriedly sworn in on the same day under controversial circumstances.

The following day, Odinga maintained that the poll and the declaration of Kibaki as the winner was erroneous.

After Kibaki’s swearing-in, widespread violence broke out in Kenya.

Khan further maintained that Ruto did not have a hunger for power as has been claimed by the Office of the Prosecutor in justifying his alleged role in fanning the violence.

Khan argued that Ruto supported a Luo leadership in 2007 and would not have done so if he was power thirsty.

“I don’t have doubts about Madam Prosecutor (Fatou Bensouda) and her Deputy but about the fundamental systemic failings in the Office of the Prosecution. This case got off to the wrong start based upon wrong evidence and wrong focus,” he said.

Khan added that the Office of the Prosecutor was trying to do everything in its power to mend the flaws in her case.

Reports coming in indicate that the court will be forced to adjourn on Wednesday because the prosecution’s Witness Number One has not yet arrived in Netherlands and will get there on Thursday.

Khan further urged Bensouda to drop her case because it was based on falsehoods adding that she needed to review her evidence and question the motive of her witnesses.

“Everything ever since the case started has been an attempt to squeeze in facts that don’t fit in relation to an ultimate imperative to get Mr Ruto,” he argued.

Khan had earlier also played video clips showing Ruto calling for peace and saying that the ODM was not interested in violence.
