zinazoashiria kua mabwana Uhuru Kenyatta na William Ruto watachomoa kujifikisha mahakamani. Tayari wabunge
wa mrengo wa Jubilee washasema kua wanataka kuleta mswada bungeni na kwengineko ili Kenya ijiondoe katika
hii Mahakama. Tatizo la huu mtazamo finyu ni kwamba hata wakijiondoa, zile kesi ambazo tayari zipo mahakamani

The International Criminal Court has dismissed as inconsequential a move by MPs allied to the Jubilee Coalition to withdraw from the global court ahead of the hearings facing President Kenyata and Deputy President William Ruto.

An ICC spokesman was categorical that the case against Kenya's two top leaders and journalist Joshua Sang would go on even if Kenya withdrew from the Rome Statute that established the international court.

Said ICC spokesman Fadi el Abdallah: "As indicated in the Rome Statute of the ICC, a withdrawal does not have any impact on the open cases nor on the State's obligations regarding cases that are already open before the ICC."This came as Mr Ruto prepared to submit today the list of his entourage, including MPs, to the Netherlands embassy for clearance to travel eight days to the beginning of his trial at The Hague.

It is understood the Dutch embassy in Nairobi has demanded the list after it became clear that MPs allied to the Deputy President plan to travel in large groups to give him "moral" support at The Hague as he seeks to extricate himself from the charges of crimes against humanity.

FREE THE TWO PRINCIPALS

The countdown to the trial of Mr Ruto and President Kenyatta as from November 10, has triggered fresh efforts by Jubilee Coalition MPs to push through a Bill for Kenya to withdraw from the Rome Statue in the hope that it will free the two principals.

However, the ICC on Monday described the move by Leader of Majority in the National Assembly Aden Duale as "futile", stating that the case against President Kenyatta, Mr Ruto and Mr Sang will proceed even if Kenya withdraws its membership from The Hague.

He also pointed out that an application for withdrawal would take at least one year to be effected.

"A withdrawal can be effective only one year after the deposit of the withdrawal notification to the United Nations Secretary General," he said via email from The Hague.

Separately, ICC outreach officer for Kenya and Uganda Maria Kamara told the Nation that withdrawal can only have an effect on future cases.

"The withdrawal will not affect the (current) cases. It can only affect future cases which the court may wish to pursue," she said on phone.

An official from Mr Ruto's office, who sought anonymity, said arrangements for the hearing of the case, which begins next Tuesday, were at an advanced stage with a full list of the entourage having been prepared for submission to the Dutch embassy.

"The list of those travelling with the Deputy President will be submitted tomorrow to the embassy for clearance. There are MPs who want to be with him at The Hague, so they have been included. After clearance, bookings in the Netherlands will follow," the official said on Monday.

But in Nairobi, a team of MPs accused ICC Prosecutor Fatou Bensouda of conspiring with certain non-governmental organisations and the opposition to try President Kenyatta and his deputy.

The MPs, who announced their plan for a second push to pull Kenya out of the ICC Statute, also accused some Western nations in the alleged conspiracy.

They singled out Ms Gladwell Otieno of African Centre for Open Governance (AfriCog).

"We are aware of the thinly-veiled conspiracy between the local civil society organisations, namely AfriCog, and the political detractors of the Jubilee government and their sulking neo-colonial western cahoots," said Tiaty MP Asman Kamama on behalf of his colleagues.

They spoke as Mr Ruto's lawyer Karim Khan requested the ICC presidency to set aside the judges' decision in July to block his client's prayer for part of the trial to either be staged in Kenya or Tanzania.

He argued that the decision of the plenary of ICC's 14 judges was swayed by a last-minute application by Ms Bensouda based on information provided by Ms Otieno.

"The defence submits that the plenary decision must be vacated due to gross procedural unfairness arising from the submission of the ‘Prosecution's Observations on the possibility of holding parts of the trial in Kenya or alternatively in Arusha, Tanzania'," he said.

"Instead of rejecting the late submission by the Prosecution, or alternatively adjourning the Plenary session in order to allow the defence and other interested parties (in particular Kenya and Tanzania) to respond to and/or make observations on the Additional Submissions, the Plenary of Judges accepted the Prosecutor's filing. It is clear that these additional submissions of the Prosecution were either decisive or weighed heavily on the deliberations and decision of the Plenary of Judges," he added.

Last week, Trial Chamber presiding Judge Chile Eboe-Osuji questioned the last-minute change of mind by Ms Bensouda over the venue of the trials and harshly criticised an open letter written to ICC President Judge Sang-Hyun Song by Ms Otieno two days to the plenary sitting.

"In their change of position that was, for the first time, communicated a day after the ‘Open Letter', the Prosecution also argued that no part of the trial should be conducted in Kenya, because of the risk of demonstrations. It is notable, that the Prosecution did not press any point that the demonstrations would be violent," Judge Eboe-Osuji said.

Addressing a morning news conference at Nairobi's Serena Hotel, the more than 40 MPs announced that besides attempts to withdraw the country from the Rome Statute, they would deal with ICC politically.

The MPs said they would support a Bill to repeal the Rome Statute. The Bill is to be sponsored by Mr Duale.

Consequently, they want Speakers of the two Houses of Parliament to recall the National Assembly and the Senate to start the anti-ICC efforts.

A motion has been lined up in Parliament calling for Kenya's withdrawal from the Rome Statute that established the International Criminal Court.

Coming days before Deputy President William Ruto's appearance at The Hague next week to face charges of crimes against humanity, the action might have a bearing on whether Mr Ruto and President Uhuru Kenyatta - whose case is set for November -will honour summonses by the ICC.

Leader of Majority Aden Duale told a fund-raising meeting that Jubilee would use its numbers in Parliament to ensure the motion sails through.

"I know I will get the necessary support from fellow MPs to pass the motion and sign Kenya out of the Rome Statute so that we can have our freedom back," he said.

He said MPs, Senators and Governors allied to Jubilee also planned to hold countrywide prayer rallies for Mr Kenyatta and Mr Ruto.

"It is time we used a political solution to deal with this issue. Jubilee will use its numbers to end Kenya's relationship with the ICC," said Kericho Senator Charles Keter.

The leaders said President Kenyatta would personally lead the prayer rallies during Mr Ruto's trial, which starts next Tuesday. Mr Kenyatta's trial start on November 12.

"As soon as Mr Ruto leaves for The Hague, the rallies will start under the direction of President Kenyatta and when the Deputy President returns, he will take over as Mr Kenyatta leaves for The Hague," said Mr Duale, the Garissa Town MP.

The Jubilee leaders, who included Kericho County Women representative Hellen Chepkwony and MPs Jimmy Angwenyi (Kitutu Chache North), Kimani Ichungwa (Kikuyu), Kanini Kega (Kieni) and Erick Keter (Belgut) dismissed claims by Cord alliance leaders that there would be a power vacuum during the trials.

"When Ruto is at The Hague, the President and Parliament will work together and when President Kenyatta goes, Mr Ruto will be in charge. The rest can watch from a distance," said Mr Duale.

He said about 100 MPs would accompany Mr Ruto, with 30 legislators from the Senate and National Assembly flying out of the country each week to offer him support."We will also debate the ICC issue every day when Mr Ruto is away and disclose to Kenyans who the ‘owners' of the ICC are and give the names of those who are behind the case," he said.

Mr Keter said it was not a coincidence that calls for a referendum to change the constitution started just as Mr Ruto and Mr Kenyatta were preparing to attend the trials, saying it was a ploy by Cord leaders to undermine the popularity of the two leaders while they are away.

The leaders spoke as the ICC announced it would hold a status conference on President Kenyatta's case this Friday. The President is not required to attend the conference in person.

The ICC has also scheduled a press conference on the eve of Mr Ruto's trial to clarify any issues related to the cases facing him and former radio presenter Joshua Sang.

It is good to withdraw all future ICC efforts in kenya, so those tu-threats by Icc have no impact even if they jail them it is the same people (parliamentarians) that agreed on the rome statutes....luckily...we are yet to see tyranny of numbers in parliament again to withdraw from ICC ..we are starting to see the real monster behind the ICC

Kwa mtazamo ulo hapo juu ndo utaelewa why JK is having a tough time with the EAC (read Uhuru
and his 2 Amigos). Chuki iliibuka mostly baada ya hio rebuff ya JK maana I believe he weighed the
options and consequences of such an act. Dar-es-salaam would have to go rogue against the
international community just like Nairobi is about to. That is not the nature of Tanzanians na Vasco

For more than six months the press in Kenya has created the impression that all is well and good in the country. The amount of information being horded is staggering. But things are about to take a dramatic turn. With the beginning of the Hague trials for Uhuru and Ruto, this nation is about to go through a nightmare like we've never witnessed before. We warned about electing the duo, but those who thought they were smarter dismissed our fears.

Let me put the present predicament for Kenya in stark terms. It is like this: our President and his Deputy must decide whether to attend the Hague trials, where the evidence points to their culpability. They will be locked up. On the other hand they may decide to pull Kenya out of the Rome Statute and refuse to cooperate with the ICC. Should this happen, they become international fugitives and Kenya becomes a pariah state. That is the reality of the moment!

This nation is about to come to terms with the tragedy of tribalism and greed for power. Those who felt these guys had to lead Kenya at whatever cost are about to be visited by the angel of darkness. They will gnash their teeth and their children will cry the tears of blood. Their wives will wet pillows with the sweat of midnight nightmares when they see their husbands scratch boils in their cells at the Hague. That is the prophecy of one whose voice was ignored ahead of the March 4 elections.

If church leaders want to pray, the time is now, because once the first pillar that holds Kenya starts breaking, the rest will come tumbling like rocks from a mountain. The only sensible prayer now is that the Lord cleanses the State House with the blood of His son, Jesus Christ, so that this nation may have true healing and a fresh start. Meanwhile, let the press continue to dance naked in the field, because like the Pharaoh in Egypt, the Lord has blinded them so He can destroy them!

A time is coming...!

Bunge la Kenya limeitisha kikao cha dharura kujadili kujiondoa kwa nchi hiyo kama mwanachama wa Mahakama ya kimataifa ya Uhalifu ICC.

Naibu wa Rais wa Kenya William Ruto alikuwa amepangiwa kufika mbele ya mahakama hiyo ya ICC wiki ijayo kujibu mashtaka ya uhalifu dhidi ya binadamu. Naye rais Uhuru Kenyatta anatarajiwa kufika mbele ya mahakama hiyo mwezi Novemba.
Uamuzi huu umechukuliwa kutokana na shinikizo kutoka kwa wabunge na wanachama wa chama kinachotawala cha Jubilee kutaka kuondolewa mashtaka yanayowakabili viongozi Uhuru Kenyatta na William Ruto.
Naibu wa Spika Joyce Laboso amepanga kikao hicho kufanyika Siku ya Alhamisi. Hata hivyo hata ikiwa bunge hilo litapitisha hoja hiyo, kujiondoa kama mwanachama wa ICC, ni uamuzi ambao lazima ufikishwe kwa wananchi katika kura ya maoni.

Baada ya kupita hapo ndipo itawasilishwa kwa baraza la Usalama la Umoja wa mataifa kupata idhini na kueleza sababu kamili za kutaka kuchukua hatua hiyo, pamoja na kuwa wananchi wenyewe wameamua.
Hata hivyo kwa mujibu wa sheria za mahakama hiyo ya ICC, hata kama nchi itajiondoa kama mwanachama, kesi ambazo zilikuwa tayari zimeshawasilishwa katika mahakama hiyo kuwahusu raia wa nchi hiyo, lazima zitaendelea kusikizwa hadi mwisho na hukumu kutolewa.
Kwa hiyo hata ikiwa Kenya itajiondoa sasa, viongozi wao Uhuru Kenyatta na William Ruto bado wanayo mashtaka ya kujibu mbele ya mahakama ya ICC.
