ODM storm Uhuru Park briefly

Attempts by ODM leaders to hold their rally at Uhuru Park for the third time were thwarted by police.

ODM chairman Mr Henry Kosgey, treasurer Omingo Magara and Ugenya MP-elect Mr James Orengo yesterday managed to access the heavily guarded Uhuru Park grounds.

However, attempts by the group to hold an impromptu press conference were thwarted when police lobbied teargas canisters to disperse them.

The media and the MPs-elect retreated towards the Serena Hotel. Orengo and Magara have vowed to continue with the struggle until their conditions are met.

"This country has regressed to the dark days. The police are acting as if Kenya is a military state. These scenes cannot be compared to 1982, 1992 and 1997," Orengo said.

Members of the public who were slowly gathering to witness the spectacle between the leaders and the police were forced to scamper to safety.

The leaders said despite the cancellation of the demonstration they would soldier on until they get a chance to address their supporters.

"The battle continues. We are still making other attempts until reason prevails," Magara said.
 
RUTO TONES DOWN ON ELECTION IMPASSE as NYONGO MAINTAINS POSITION
William Ruto appeared to be toning down on its hardline stance demanding only for an international mediator to intervene and lead dialogue between the opposition and the government.

However at Orange House Nyongo was demanding that a transitional government be set up so as to facilitate a Presidential run-off in three months time.

A demand that government spokesman Alfred Mutua said the government had no issue with as long as "it is in the constitution, but for now there is no war in Kenya so lets do away with the issue of an international mediator, we can be able to talk without mediator, we do not have warlords in Kenya."

Running battles within Nairobi city streets
One person died and properties worth millions of shillings went up to flames when Supporters of Orange Democratic Movement (ODM) engaged police in running battles in the city and its environs after they were barred from attending a rally at Uhuru Park.

A petrol station and five cars were torched by the protesters who were angered after ODM leaders were also stopped by a contingent of police officers as they marched to Uhuru Park shortly after a meeting with South African bishop Desmond Tutu at Pentagon house.

Despite the ban on the meeting hundreds of supporters had trouped in the city as early as 10 am.

The party had vowed to defy an order by the police commissioner outlawing the rally and said it expected the police commissioner to provide security.

While calling off the rally Police Commissioner Major general Hussein Ali cited volatile security situation in the country as reason for canceling the meeting.

He also warned that those who attended the rally would be arrested.
"The season for political rallies in the country is over. There will be no more rallies and we will ensure that none takes place," said Ali.
Kenya National Commission on Human Rights has however questioned the legitimacy and legal basis of barring anyone from holding political rallies.
Police used tear gas canisters to disperse the youth who were moved in groups.

Along Thika road, the rowdy supporters of ODM were dispersed by police as they threatened to move to the city center.

Passengers were forced to flee for their lives as the unruly youth threatened to burn vehicles. It took the intervention of police to bar them from burning vehicles.

Elsewhere, at Railway headquarters there was uncertainty as a group of youth forced their way in stabbing to set a blaze the company where the police intervened and settled the menace.

All routes traversing through the fly over which Kenya polytechnic and Bunyala road remained closed as police officers held total guard in all corners of the station. In railway servant quarters commonly known as Landmawe police had a hard task to settle and evict protester who had sneaked in the resident. Police used tear gas canisters to disperse the intruders in the residential area.

In the city civilians sought refuge in church compounds as people flocked in the compound of Holy Family Basilica and Neno Evangelism Center.
By mid day the city was almost deserted as police continued to patrol the city.

Uhuru park grounds was under tight security and was a no go zone.
Business that seemed to have resumed only a day before was halted as shops were closed for fear of looting. The public service vehicles were also forced to leave the city leading to transport problems for the commuters who had arrived in the city for business.

ODM has issued a raft of demands that will lead to the unlocking of political impasse over the disputed presidential elections.

The party has also called for the establishment of an international mediating body to examine the documents pertaining presidential tally.
ODM leader Raila Odinga also wants elections to be held in three months.
He however said the elections must be overseen by a completely independent electoral commission and he is willing to compete with president Kibaki in the elections.

Huyu Kibaki tukimuita dikteta tutaonekana tunamuonea? Iweje aendelee kuwatumia mawaziri waliokataliwa na wananchi?

Kuchelewa kuteua baraza la mawaziri na mawaziri wa zamani kuendelea kuwa wasemaji wa serikali inaashiria kushindwa kwa jamaa. Hivi hajiulizi kwamba 2002 aliposhinda aliwasikia waliokuwa mawaziri wa Moi wakisema kitu? Lakini leo hii utasikia Martha Karua anakuwa referred kama msemaji wa upande wa serikali, au Amos Kimunya ama Raphael Tuju kama waziri wa mambo ya nchi za nje mpaka anafikia mahali pa kusema Kufuor hajaalikwa na serikali, yeye ni nani na anajuaje kwamba serikali haijamwalika? Kweli watu wakitaka kuchezea katiba huwa wanaffanya kila wanaloweza ili tu kulinda maslahi ya ufisadi wao!

Na hapa ndipo ninaposhawishika kuamini kwamba hili swala la wizi wa kura lilikuwa engineered na hao hao ambao mpaka leo hii bado wako mbele mbele na kutoa matamko as if wao ni wasemaji wa serikali na kumbe hawako mahali popote kwenye organisation ya serikali.

Jamani, wakimbizi kutoka Kenya wanajaa Tanzania, Uganda na Sudan! Kama hujui Kikalenjin unauliwa! unaulizwa swali kwa lugha hiyo na kama huwezi kujibu kwa kiKalenjin ndo mwisho wako! Na sasa madai kuwa uchaguzi uliopita ulikuwa si wa haki yanazidi.
 
Naona MKJJ mashambulizi ya hoja yamemzidi ameamua kuingia mitini sasa, lakini ingekuwa vizuri kama angejibu zile hoja za wanaume. Of course mwenzake kiltime amejaribu, lakini naona hajafanikiwa kutetea yasiyoweza kuteteeka wala kuhalalisha yasiyohalalishika!

Where are the middle class and professionals in this saga? Nawaona wanasiasa na Machingas wa Kibera.

Wasomi wengi wamejifungia ndani, wanaogopa kupoteza maisha yao, mali zao na influences zao.

Hii ndio tofauti na Eastern Europe ambako maandamano na migomo kama hiyo ilikuwa inaandaliwa na professionals na middle class, hivyo kuifanya ipangwe vizuri.

Kwa Afrika hata wakati wa kudai ukoloni, professionals walikaa kimya, kwa Tanzania wakamwacha mwalimu akihangaika na Wazaramo wake kudai uhuru.

Tatizo kubwa la Afrika ni sisi wasomi, tunaojiita wasomi. Yaani bora tunashiba basi hatuko tayari kusaidia kudai haki ya wanyonge.

Mtanzania hapa umenigusa. Huku niliko nina majirani zangu ambao ni wasomi wa kutoka UD, SUA na Mzumbe pia. Kila nikiongea nao kuhusu mabadiliko TZ, wananiona kama mhaini. Hawataki kabisa kuhusika katika hilo. Kwa kweli nimesikitika kidogo kuhusu misimamo yao ya kutetea Status quo. Bila wanaangalia nusu iliyojaa ya glasi, badala ya ile nusu iliyo tupu.

Kama hiyo sample yangu itakuwa representative kwa population ya wasomi wa Tz, tumekwisha.

KENYA: THE LOSS OF INNOCENCE


It is slowly becoming clear that the violence in the slums of major Kenyan cities and the bushes of Rift Valley have as much to do with the outcome of the elections as with the resentment of perceived Kikuyu domination. Any lasting solution towards peace must involve avenues to address and possibly dismantle the perception that Kikuyus are out to systematically reap where they did not sow. It is time to be real my friends.

Before we can move on, we must all agree that the manner by which Kibaki was installed president does not help the situation. In fact, the arrogance portrayed by his key players, from KICC to State House and beyond, has only cemented the ill anti-Kikuyu sentiments spreading like wildfire across the nation. Even the Kikuyu elite and some poor Kiambu village folks are patting themselves on their backs in congratulatory acknowledgment of having stolen this one 'legally' . The rest of the country is in awe and amazement at how this heist of voting rights was completed in very short order. FACT: The presidency was stolen. Yes my friends, it is time to face the truth.

Back to the violence. Every chap of average intelligence is well aware that the burning of churches in Eldoret will have to be avenged. The killing of Kikuyu folk countrywide will have to be avenged. Let us keep it real folks. Mungiki folk have been sharpening their pangas since the eve of Dec 27th, 2007. Yes my friends, these jamaas are fast regrouping and this time with the support of every Kikuyu who saw pictures of heavily protected Kikuyu-folk-laden convoys enroute from RV to Central. We will never be too sure but we have an idea of what the humanitarian govt. forces deployed in opposition areas are all about. Looking for answers in the bullet riddled bodies in Kisumu morgues is of no consequence. Yes my friends, ukweli ni mbaya. We are all victims.

So what next? Mungiki will soon strike and more tears will flow. The govt. will then follow-up and use all its military might to purge any signs of anti-govt. rebellion. After a couple of weeks of running battles, the Kenyan people will get tired and slowly revert to their normal day to day activities. They will give up to the powers that be at which point, Kazi Itaendelea. Yes folks, let us not imagine that Kibaki will step down or budge from the seat of power. The reality is that Kenyans must pay rent and put food on the table. We actually will have no choice but to retreat to our obscure shelters as we watch Kimunya, TransCentury and other assorted Kibaki lieutenants share out Safaricom among other delicacies. Yes folks, with one policeman on every street for months, an uneasy peace will return to Kenya. What about the anti-Kikuyu sentiments? What of those who say that Kibaki's action has legitimized every fallacy they've heard of Kikuyu's before? Yes we will walk the streets again, but what will happen when lets say a Luo man driving in the deep of Nyeri accidentally knocks down and kills an old Kikuyu woman crossing the street? Do you now see the type of scars a stolen election has etched onto the Kenyan psyche? Will we ever be brothers and sisters again under a tattered flag that does not recognize the value of our votes? These wounds will remain with us for years after these jamaas have retired to their Muthaiga homes. These wounds will follow us to every ballot box going forward. These wounds will determine the city we choose to work in, the schools we send our children to and the areas we choose to open up businesses. These wounds will make us turn a blind eye to the evils committed against our brothers from other communities. With these wounds, the jokes of Bwana Ojwang and Mama Kayai will loose meaning. With these wounds, some sheng words such as Musakhulu, Musapere and Mujaka will no longer be politically correct. The reality is that some of us are very happy with the turn of events. Some of us are mad as hell. All of us will remain insecure for years. Ask yourself why, the next time you board matatu number 16A to Kayole.

We will return to our work stations throughout the country and use the next five years trying to relocate to work areas close to our native homes. Only an insane Luo man will take up that promotion in Muranga town. This is serious trouble my friends. You see, the thing is that as a country, we have lost innocence. We can never talk of Rwanda with a chip on our shoulders. In all, the theft at KICC has made us grown men. Never again will we be able to propagate the notion that Kenya is a peace loving country. We are as fallible and as volatile as all other African countries. Kenya, as a bastion of democratic ideals, has been buried by the actions of Mwai Kibaki. This is the only man who could have ordered the PNU machinery to stop and desist from topping up the vote results from his strongholds. This is the man who may have chosen to resign after seeing the questions raised by the ECK chairman and some commissioners, observers etc. Any prudent man of singular leadership qualities and intelligence would have averted the crisis at KICC by doing the right thing......i.e. let the people decide.

But more importantly, when the election news is old news, what will Kenyans do to ensure peace in future? This is what I suggest. First and foremost, the fallacy that Kikuyus are bent on dominating other Kenyans must be dismantled. Let us choose to really get to know our neighbors. More often than not, you will find out that the struggles faced by most Kikuyus are similar to those faced by all Kenyans. They are just as poor and led by a coterie of the same bunch of inept leaders that the rest of the country displays. Whereas it is unlikely that you will find other communities doing business or settling in Central Kenya, the prevalence of Kikuyus in other areas may well be a simple result of population growth. If we have ever needed each other, this is the time. This is the time for national healing and reconciliation. Do not expect solutions from political leadership. Let us join multicultural churches. Let us demand that our workplaces reflect the face of the country. Let us choose peace.

If we continue fighting and shedding blood on behalf of our political leaders, nobody will be left behind for them to lead.

RAIS Mwai Kibaki amesema yuko tayari kuunda serikali ya mseto na mpinzani wake mkuu wa chama cha ODM, Raila Odinga.

Msimamo huo mpya wa Rais Kibaki umekuja siku moja baada ya juzi kusema kuwa atakuwa tayari kushiriki katika mazungumzo yoyote mpka hapo ghasia zinazoendelea nchini humo zitakapoisha.

Hata hivyo, pamoja na kukubali kuunda serikali ya mseto na wapinzani wake, Rais Kibaki pia amemtaka Odinga atambue kwanza uwapo wa mamlaka ya serikali, akiimanisha kumtambua kuwa yeye ni Rais halali wa Jamhuri ya Kenya.

Msimamo huo wa Rais Kibaki, huenda ukagonga mwamba kutokana na msimamo wa Odinga ambaye alipendekeza serikali ya mpito ambayo itaanda uchaguzi mpya wa Rais ndani ya miezi mitatu. Tayari Odinga alishatamka wazi kwamba hamtambui Rais Kibaki kwa madai kuwa anaamini kwamba aliiba ushindi.

Habari za kubadili msimamo kwa Rais Kibaki kumekuja baada ya kufanya mazungumzo na mshindi wa Tuzo ya Nobel, Askofu Mkuu Desmond Tutu kutoka Afrika Kusini, ambaye alikuwa nchini humo katika juhudi za kurejesha amani nchini Kenya.

Hata hivyo, msimamo huo mpya wa Kibaki bado haujakidhi mashariti yaliyotolewa juzi na mpinzani wake Odinga, ambaye anataka serikali ya mpito itakayoitisha uchaguzi ndani ya kipindi kisichozidi miezi mitatu ambao utasimamiwa na waangalizi huru wa kimataifa na si Tume ya Uchaguzi ya chini hiyo (ECK).

Akizungumzia msimamo huo wa Rais Kibaki jana, Askofu Tutu, alisema uamuzi wa rais huyo kuundwa serikali ya mseto unalenga kumaliza machafuko ya kisiasa ambayo yameikumba nchi hiyo.

"Rais Kibaki amekubali wazo la kuundwa kwa serikali ya mseto ili kumaliza machafuko ya kisiasa ambayo yametokea baada ya uchaguzi," alisema Askofu Tutu.

Askofu Tutu alifafanua kwamba, Kibaki hakuwa akipinga kuunda serikali ya mseto, lakini alitaka kutambuliwa kwa mamlaka urais na serikali yake.

"Rais hakuwa akikataa kuundwa serikali mseto, lakini ilipaswa kutambuliwa mamlaka ya serikali inayoongoza," alisema Tutu katika mkutano wake na waandishi wa habari mara baada ya kumalizika kwa mazungumzo yake na Rais Kibaki, jijini Nairobi jana.

Tutu ambaye anaheshimika duniani kutokana na mchango wake mkubwa wa harakati za ukombozi wa wausi wengi nchini Afrika Kusini na kupinga kwa nguvu ubaguzi wa rangi uliokuwa ukifanywa na utawala wa Makaburu wachache nchini humo, amekuwa nchini Kenya kama sehemu ya juhudi za kimataifa kutafuta suluhu ya machafuko.

Askofu huyo tayari alikwishafanya mazungumzo na Odinga wa ODM, ambaye pia anayelezwa kushinda uchaguzi huo.

Katika mazungumzo hayo ya juzi Alhamisi, Odinga alitoa msimamo wake huo na kupinga ECK kwa maelezo kwamba ndiyo imevuruga uchaguzi wa Desemba 27, ambao matokeo yake ndiyo yamesababisha machafuko kwa siku saba mfufululizo hadi kufikia jana.

Kwa kuangalia msimamo wa ODM, wachambuzi wa mambo ya siasa za Kenya wanaona msimamo wa Kibaki bado unaweza usimshawishi mpinzani wake mkuu Odinga kuweza kubadili msimamo wake wa kutomtambua kama Rais na kutaka serikali ya mpito na uchaguzi mwingine.

Wakati huo huo, Ufaransa imetoa msimamo wake na kusema matokeo ya uchaguzi huo yaliyompa ushindi kuwa yalikuwa na kasoro nyingi.

"Inasemekana ni vita ya kikabila. Ndio, bila wasiwasi, katika Afrika hali ndivyo ilivyo, lakini pia ni suala la demokrasia," Kouchner aliiambia redio RTL .

Alisema anahisi uchaguzi wa nchi hiyo ulitawaliwa na wizi wa kura na hata nchi za Marekani, Uingereza zinajua hilo.

"Je kura za uchaguzi ziliporwa au la? Nadhani hivyo, wengi wanadhani hivyo, Wamarekani wanawaza hivyo, Uingereza wanawaza hivyo kwa kuwa wanaijua nchi hiyo vema," alisema.

Marekani juzi ilimtuma Waziri wake mdogo wa Mambo ya Nje anayeshughulikia Afrika, Jendayi Frazer nchini Kenya kwa ajili ya mazungumzo zaidi na pande zinazohusika katika mgogoro uliopo sasa nchini humo. Frazer, alitarajiwa kufika nchini Kenya jana na kufanya mazungumzo na Odinga na Rais Kibaki.

Rais Georg Bush na Umoja wa Ulaya (EU) kwa upande wao, wamezitaka pande mbili za ODM na PNU kushirikiana katika kuunda serikali ya umoja wa kitaifa

"Ni muhimu kwa wananchi wa Kenya kuacha ghasia na umwagaji damu, "alisema Bush katika mahojiano maalumu na Reuters yaliyofanyika White House.

Alipoulizwa mtazamo wake kuhusu uwezekano wa Kibaki na Odinga kuunda serikali ya pamoja, alijibu: "Natumaini wanayo fursa ya kukaa pamoja na kufanya utaratibu kama huo ili kuondoa majeraha na visasi na mgawanyiko uliotokana na uchaguzi huo."

Kwa upande wa EU,Mkuu wa Sera za Nje za umoja huo Javier Solana na Rice, walikubaliana kusimamia kwa karibu juhudi za kurejesha hali ya amani nchini Kenya.

Hata hivyo, EU na Marekani zimesema jukumu la hatma ya Kenya liko mikononi mwa raia wenyewe wa nchi hiyo.

"Ni jukumu la pande zinazopingana nchini Kenya kuamua aina ya serikali, jambo la msingi tunalosisitiza ni kuingia katika mazungumzo," alisema Solana.

Tayari waangalizi wa uchaguzi wa kimataifa kutoka EU, waliukosoa matokeo ya uchaguzi wa rais wakisema yalikuwa na kasoro nyingi.

Ghasia nchini Kenya jana ziliingia katika siku ya saba tangu kutangazwa matokeo hayo Desemba 30, ambayo yalimtangaza Kibaki kuwa rais.

Zaidi ya watu 500 wanaeelezwa kuawa katika ghasia hizo ambazo zimeikumba zaidi miji ya Kisumu, Nairobi, Eldoreti na Mombasa na tayari juhudi mbalimbali za kimataifa zimeanza kufanyika kutafuta suluhisho.

...Another Idea: Why Kenyans should not fight each other

From the onset, I wish to state that I'm a Kikuyu and I voted for President Kibaki on Dec 27, 2007. I voted for him thinking he was the right man to lead Kenya. But times have changed. I have seen another character in Kibaki, which, like most Kenyans, did not know of.

If the laws of the land allowed voters to recall their votes, I would have been the first to do so. The man I voted for has ashamed me and I regret why I wasted my fuel driving back to the city from my rural home to the city centre to vote for him. I voted for him to win a clean election but not to steal an election he had lost fairly.
Kenya has been bleeding for the past five days and the blood of innocent Kenyans – butchered by state agents and angry voters protesting the election theft – will haunt all of us for many years to come.

Why are Kenyans fighting each other? The blame squarely lies under the feet of Emilio Mwai Kibaki and the small clique that surround him for stealing an election in broad-day light! Newspaper commentators have argued that Kibaki and his clique should have used a little intelligence. I wholly agree with them.

One would have expected Kibaki to be somehow remorseful after stealing the election from Mr Raila Odinga. But the Kibaki we saw on TV on Thursday evening did not show any signs of being remorseful. He was maintaining his usual arrogance and daring those who do not agree with him for a fight.

Kibaki has been happily following the slaughter of innocent Kenyans from the confines and comfort of his State House bedroom. To him, the blood that is being spilt is just like the water you can fetch from a stream. This is the same contempt he has ruled Kenya with for the past five years.

I'm not shocked by Kibaki's actions. Kenyans should be wiser. What does Kibaki stand to lose even if the violence escalates? Nothing. He has all the wealth and his children and grandchildren are well taken care off. The only thing they would do if the worst happened is to jump into a plane and take off and leave the rest of us swimming in our own blood.

Those who are expecting Kibaki to resolve the current political crisis, which he is squarely to blame for the election robbery, are badly mistaken. How is expected to resolve a national crisis if can't solve his own domestic problems with his wife? Kenyans know the public dramas – leave alone the private ones! - staged by his wife. And the man maintains the same gloomy face through out as his wife had done nothing!

Kibaki has no business being the President if he can't for once present himself as a leader. Those who have been in Kenya for the past five years know Kenya only had a figure-head President and not a leader.

For instance, Kibaki watched in the past five years as NARC, the party that swept him to power in 2002, disintegrated and finally died without making efforts to save the situation. Perhaps, he'll wait in the same manner until Kenya disintegrates from the current violence right under his eyes!

I appeal to my fellow Kenyans to become wiser and know that Kibaki cares less about their plight. All he cares about is to be called the President of the Replic of Kenya! Is this a man worth dying for? The answer is NO. The people who voted were not enemies. The people who voted for Raila or Kibaki were not enemies. Their common enemy is Kibaki – he refused to form a party and refused to go out to campaign early knowing he would steal the votes even if Kenyans rejected him.

Kibaki has the guns, the police, the military and other state agents at his disposal to kill and maim anyone who does not tow the line. Mr Odinga has the Kenyan people right behind him.

I appeal to my fellow Kenyans that instead of killings each – which is what Kibaki wants – we should allow the illegitimate Kibaki administration to cling to power. We are now more wiser. Five years is not a long time. The entire Opposition can opt to back Mr Odinga in 2012 and we collectively ensure the Kibaki clique does not pull another surprise on us.

We'll then deal with Kibaki as an individual and not punish the entire Kikuyu community for mistakes done by a single man who has no control of his wife.

History will judge Kibaki harshly. Kibaki's actions and conduct are unacceptable to any right-thinking Kenyans – except for his few fanatical Kikuyus who reason like him.

As you read this the entire region surrounding Kenya is in a mess. Raw materials not being able to reach factories in Tanzania has slowed down production. The price of petrol has shot up dramatically in Uganda and there are serious shortages of the same in Rwanda. Aid which all goes through Kenya has been delayed to Somalia, Congo, Sudan etc. causing great suffering. In other words the economies in the entire region and beyond would be greatly affected if Kenya shuts down

Lovers split over ethnic clashes

When his restaurant was burned down by opposition protesters after Kenya's disputed election, Frank Ndungu thought things could get no worse.
Then his girlfriend dumped him because he was from the wrong tribe.

"This is double jeopardy," the anguished 23-year-old told Reuters in Kisumu, a western town in the opposition heartland where he is now sleeping rough outside a police station.

"I have lost my business as well as my sweetheart. Even love has not been spared here."
Ndungu is from the same Kikuyu ethnic group as President Mwai Kibaki, whose controversial victory at Dec. 27 polls has triggered riots and tribal violence in which more than 300 people have been killed.

Nancy, the long-term girlfriend he had planned to marry after she finished her university studies, is a Kalenjin.
Some of the worst clashes of five days of turmoil have included Kikuyus and Kalenjins.
But Ndungu was not expecting the SMS text message he received from Nancy two days after his place was torched.

"Because of the resentment, hate of my family, clan and tribesmen to the Kikuyu I am afraid you can never be welcomed here. We have to call it quits because we have no future," said the message, which he showed to Reuters.

Not only have the Kikuyu and Luo supporters of Kibaki's rival Raila Odinga been afflicted by the violence that threatens to wreck Kenya's image as one of Africa's most stable nations.

Charles Mochache, a 45-year-old man from the Kisii tribe, is also heartbroken. He fled his home fearing attack by opposition supporters, leaving behind his Luo wife and their four children.

"We were married for 10 years. We love each other but we cannot stay together," he said. "I don't see myself going back." Back at the Kisumu police station, Ndungu has lost his restaurant and his girlfriend, and fears for his safety.

He is bitter, but says he is not looking for revenge. "I don't blame anyone. We need each other," he said. "My family is in Eldoret, the worst affected area. I don't even know if they're alive. This is serious psychological and physical torture."
Meanwhile, Kenyans fleeing ethnic clashes into Uganda have reported tribal killings, rape and looting by hordes of machete wielding gangs.

Mr Robinson Kagwima, 58, of Amagoro in Teso District of Kenya said the assailants suspected to be supporters of the leading opposition leader, Mr Raila Odinga, chopped into pieces 250 head of his cattle, burnt his pick up truck before razing his house.
"While my cows were being cut and house burnt, the Administration Police which is 300 metres from my home watched with their hands folded," Mr Kagwima said.

"The police was bribed to allow looting and killing." Mr Kagwima has family in Kiambu, Limuru but he can not join them because ethnic tension in Kenya.

The residents claim the police shot in the air after the attackers vanished into the forests. "Even after firing in the air [by the police], it would not take long for those boys [attackers] to come back to check if we have left," a woman who claimed two of her neighbours were raped by the mob said.

Mr Michael Karanja, 64, also a resident of Kiambu said the attacks erupted on Friday last week in his village at around 9.00p.m. He said he heard residents scream before gunshots rung out.

"We were ordered to vacate immediately," Mr Karanja, a mechanic said. He said even if Raila was to win the elections, violence against the Kikuyus in Teso District was bound to happen "as other people claim we are Ugandans."

"The attackers raped women, molested them and killed whoever identified himself as a Kikuyu. Even if we went back now we would be killed," Mr Karanja said.
The Principal Immigration Officer at Malaba, Mr Robert Kanuma, said as of yesterday 1,040 Kenyans had gone through the border post.

It is not only the Kikuyus fleeing but the Kenyans of Asian origin. "18 Kenyans of Asian origin went through Malaba yesterday and 10 others today," Mr Kanuma said.

Why Kivuitu must be held accountable for poll chaos

About 5.30pm on December 30, Electoral Commission chairman Samuel Kivuitu and two other commissioners huddled in a tiny room and, exclusively through state-funded Kenya Broadcasting Corporation, announced President Kibaki re-elected. Within an hour, the President was sworn in at State House at a function in which the national anthem was not played and in the absence of the diplomatic corps. Then the country was thrown into chaos.

In the fullness of time, history will apportion culpability over the current anarchy. At the moment, however, Mr Kivuitu should take full responsibility. But as he tries to run away from this responsibility to blame the chaos on pressure from PNU and ODM Kenya, I wish to offer the correct legal position over the whole saga and how the country can wriggle out of it.

The Electoral Commission of Kenya (ECK) was created pursuant to Section 41 of the Constitution and thus has security of tenure and independence. Section 42A sets out its mandate to be mainly two-fold - the registration of voters and the maintenance of the voter register, as well as directing and supervising civic, parliamentary and presidential elections.

The National Assembly and Presidential Elections Act, Cap 7, and its subsidiary, the Presidential and Parliamentary Elections Regulations sets out the legal framework that enables the ECK to effectively and fully conduct elections. The election of political leaders is a key component of any nation state that claims to be a democracy. To be legitimate, the electoral process must not only be free and fair, but also be seen to be so.

The regulations clearly set out the road-map for conducting elections, voting, votes counting and tallying, announcing results and challenging the process.

Presidential, parliamentary and civic elections are conducted at the polling stations, which are so located that voters have access to them with the least inconvenience and such that the ECK and the Government provide the logistics, the materials and security. At the moment, there are nearly 27,000 polling stations.

Each station is headed by a presiding officer, assisted by poll clerks. On the polling day, voters are given specific times within which they may cast their votes in person and not by proxy. All through the entire voting process, candidates' agents, the media and accredited observers have free and unlimited access to the polling centre to witness the voting.

At the close of voting, the presiding officer and his clerks, in the presence of the agents, the media and observers, proceed to count the votes. Once the counting begins, the law stipulates that it shall not stop until it is completed. The results are then announced at the polling stations. The presiding officer then makes three packets each separately holding valid, disputed and spoilt ballot papers.

The officer makes another three packets holding spoilt papers, marked copy register and counterfoils of used ballot papers. He also prepares a statement that summarises the voting at the polling station, which he signs. It is countersigned by all the agents present. The packets are sealed and the agents are free to affix their own seal. The two sets of packets, the statement and the ballot boxes are transmitted to the returning officer at the constituency level.

The returning officer, once he receives the packets and boxes from the polling stations, proceeds to tally the votes. This is done in the presence of the candidates' agents and the media. Vote recounting is not gone into, except for those disputed, and the returning officer has discretion to confirm or vary the disputed ones only. He shall never change the valid or spoilt votes. He then proceeds to announce to all present the results of both the presidential and parliamentary votes.

The returning officer is obliged in law to then fill Forms 16, 16A and 17A, which set out the results and the votes cast for each presidential and parliamentary candidates. The statutory forms are signed by the officer and the candidates' agents. The agents, the media and observers are allowed to make and keep copies of the three forms, which are then physically delivered to the ECK headquarters in Nairobi.

On receiving them the ECK gives all parliamentary and presidential candidates 24 hours to lodge complaints, if any, including demanding a recount or retallying. The ECK is obliged to, within 48 hours, allow the recount or retallying. All candidates and the ECK therefore have 72 hours to resolve any disputes. It is only after the period that the ECK can announce the winners of each of the 210 parliamentary seats and issue a certificate known as Form 17 to each elected MP and Form 18 to the elected president. The results are then gazetted.

With due respect to Mr Kivuitu, it was irregular, unlawful and void in law to announce the results on December 30 and swear in the President on the same day. The ECK boss announced the results when he did not have the original Forms 16, 16A and 17A from each constituency, refused to allow the 24-hour period for candidates to lodge complaints and declined to allow retallying.

He told the world that his returning officers had gone underground, and that he did not have powers to order retallying. On the day the results were being announced, Special Gazette Notice No. 12612 was issued declaring Mr Kibaki the president. Mr Kivuitu deliberately misled the world and subverted the law.

Section 5 of the Constitution states that the president shall be elected in accordance with the Constitution and the National Assembly and Presidential Elections Act, Cap 7. Non-compliance with the mandatory provisions vitiates the process.

In law, the fundamental principle is that a void process does not confer legitimacy. A public officer acting in compliance with the law must comply with the substantive, formal and procedural conditions laid down and at all times act in good faith and for the public good. As a repository of these constitutional and statutory powers and duties, Mr Kivuitu was obliged to be faithful to the process and not be influenced by external forces, as he has admitted.

By his infidelity to the law, he has failed the country and must undo the mistakes. Section 5 of the Constitution states that a president duly elected is the one who has the highest votes cast.

The ECK can invoke its powers under the Constitution to retally all valid Forms 16 and 16A and retract the results and announce the valid ones. The announcement of results on December 30 was a ministerial act that does not invalidate the ECK's constitutional powers.

The Constitution states that any other law that is inconsistent with the provisions of the Constitution is void to the extent of inconsistency. Thus, Mr Kivuitu must take the high road, invoke the ECK's constitutional mandate and review the forms and give Kenyans the president they elected, be it Mr Kibaki or ODM candidate Raila Odinga.

The tough stands taken by ODM and President Kibaki's PNU are theatrics which will not help the country. Neither party has any constitutional mandate that is the ECK's monopoly. If he allows the status quo to stay, Mr Kivuitu will one day be held to account for the bloodshed and property destroyed.

The country's unity and future rest on his shoulders, and he cannot pass the buck.
