France's Kouchner believes Kenyan vote rigged

PARIS (Reuters) - French Foreign Minister Bernard Kouchner said on Friday he believed Kenya's election was rigged, the strongest international comment yet on the disputed vote that sparked unrest in which more than 300 people have died.


"It is said that it is an ethnic battle. Yes, without doubt, in Africa it is often that. But it is also a battle for democracy," Kouchner told RTL radio.


"Were the elections rigged or not? I think so, many think so, the Americans think so, the British think so, and they know the country well."

Nawatakia maandamano mema!!! lakini kumbukeni hawa ni majirani na kumbukeni narudia tena tofauti ni kati ya Wananchi wa Kenya, Kibaki ni Mwananchi wa Kenya na Raila ni Mwananchi wa Kenya, ODM ni chama cha Kenya, na PNU ni chama cha Kenya. Hata kama source ni Uchaguzi au Ukabila au namna yoyote ile. Let them deal with it first!!! Kabla pili pili ya shamba haijawawasha!!!

Kama ingekuwa Kenya na Ethiopia,,, well tungekuwa na nguvu zaidi ya sisi kusimama kama chama na kama Taifa kusema lolote kwa urahisi zaidi!

Zimbabwe tuko nao, sio kwa kusema Shangarai ni Mbaya au Mugabe ni Mzuri,,, ni kwa kusema Uingereza acheni/mpeni basi nafasi Mugabe afanyie kazi mambo ya Ndani ya nchi yake!!! Nadhani huo ndio msimamo wa Tanzania.

Tunawahitaji watu kama Bush kwa wakati huu wenye uwezo wa kushawishi kumnyanyua Kibaka Mzima mzima kutoka Kenya bila kutumia akiri na dipolomasia nyingi sana.

1. Kabaki na Raila wakutane kama viongozi na kuongea- hata kama iatabidi kuwe na uchaguzi tena- ila waache ubabe na ubinafsi waongee kama Wanakenya!

2. ODM waende mahakama ya EA. Kwa kuwa Kenya ni signatory wa EA na hii mahakama ina mahakimu wa nchi za Kenya, Uganda, Burundi na Rwanda na Tz- maamuzi yao yatakuwa fair! Je do you recall ile case ya members wa Kenya EALA na ruling ya EA mahakama? Kulikuwa na fairness!
3. EA as a region we need institution zaidi ya mahakama za member states so as to resolve crisis of this nature- in the future!

Sidhani kama Kibaki ataachia madaraka kwa sasa kwa sababu anaogopa kuja kuhukumiwa kwa mauaji (genocide).Na hili ndilo linalomfanya azidi kuwa mjeuri kila kukicha.!
Na vilevile nadhani ni busara kuweka serikali ya mpito na kurudia uchaguzi na halafu kuwe na tume huru ambayo itasimamia uchaguzi kama walivyosema wapinzani.

The truth is hata akiwaambia they will not listen to him. They can listen to Ruto or Moi but not Raila. Thats why when raila was campaining there, alikuwa "anauzwa" au marketed na leaders wa waKalenjin sio yeye mwenyewe. Coast alikwa marketed na akina Balala na Western alikuwa marketed na akina Mudavadi. It is his Lieutenants ambao wanatakiwa kuchukua the blame if one must argue wrongly that ODM is the cause of the crisis in its strongholds. Raila is not even the chairman of ODM. That is Dr. Henry Kosgey, a Kalenjin from Eldoret. He is only the presidential candidate.

This is not so. Eg, History tells us that due to the proximity between the Chagga and the Arusha a certain measure of ethnic enemity between these communities existed for many years even before the creation of Tanzania. But by using political methods, Nyerere and CCM somehow mellowed these tensions and made the two communities to exist today as if they have never ever fought any war. But the distance between Luoland and Kikuyuland is like the distance between the Nyakyusas of Mbeya and the Hayas of Bukoba. They simply dont have historical ethnic enemity

You reminded me something very interesting indeed. Do you know that once upon a time there was no tribe called Chagga neither Pare?

This was the originality of those names:-


Chagga is a name from Pare community and Pare is name from Chagga community!!!

Due to war which i'm not sure whether it ended automatically or not, but here was the interesting story...

Chagga sent out Pare communities/families from the mountains... and during the war they were saying "wapare" meaning "sending them out" wakimbize... to the low land from the mountains.

Pare people responded with "vachagha" meaning "leave them alone" or in swahili "waache hao"

So the name Wachaga and Wapare emerged. Chagga remains in Moshi and Pare ,,, in low lands

This history could have actually made Chagga and Pare to be enemy forever but thanks God that He brought his son Nyerere,,, where he completely made national unity a reality and now the issue of chagga and pare remains as history and not painfull to both community at all!!!

Today, Pare and Chagga are marying each other like crazy!!

At least this is what have been narated to me by my elders...

Hii inatoka moja kwa moja kwenye talking point za Kibaki. Yeye anacreate chaos, watu wanakufa (kumbuka wengi wamekufa kwa kupigwa risasi na jeshi na polisi) chini ya order ya Michuki ya shoot to kill. Na sasa ameona kila kitu kinageuka na anataka Raila nawe akose.

Unajua kwa nini mafisadi wa Kenya wanamuogopa Raila? Kwa sababu the guy hana kashfa. Hana pesa ya wizi toka serikalini kama wengine. Kila wizara aliyofanya kazi aliifanya vizuri na kuletea maendeleo wananchi (unakumbuka ile gas station aliyovunja Nairobi baada ya city kujaribu for 5 years bila mafanikio). Aliamuru waliochukua ardhi kwa haramu warudishe, amezuia for a while IPO ya safaricom mpaka value ya ikaongezwa (inabidi karamagi ajifunze how to wait from this guy) no wonder hata marekani ya bush haitaki sana awe on top.

Baada ya kukosa kashfa ingawa wametumia kila aina ya trick kumpatia kashfa wameshidwa sasa wanataka kumdiscredit kwa chaos waliyoanzisha wao.

Shukran kwa hili. Nimesisitiza kwamba kupungua kwa ghasia hivi sasa ni mojawapo ya results za hawa lieutenants kuwaeleza wakwao wawache ghasia hizi. In fact, Viongozi wa ODM wameweza kwa takriban aslimia 70% kupunguza ghasia ambazo polisi/serikali imetumia bunduki, gesi za kutoa machozi na malungu bila mafanikio makubwa. Eti mpaka sasa Kibaki anawaomba wanaODM wawapoeshe moto waKenya. Sasa swali ni hili: which mandate has that government ambaye haiwezi ku govern na inaomba upinzani iisaidie kufanya hivyo?

Kama demokrasi hakika inaheshimu dizisheni ya ballot boxi, basi kwa maoni yangu wacha watu watawaliwe na wale wanaotaka kutawaliwa nao. Usifosi mambo. Hii sio tofauti sana na ile ishu tunayofahamu kila mmoja wetu ya kumposa mchumba. Kufosi mapenzi kwa kweli haifai. Hata ukikufosi na ukubalike kwajili eti unauwezo kwa kufosi hali iwe hivyo unavyotaka wewe usisahau kwamba huyo unayemfosi bado atabaki na wake ampendaye moyoni. Usisahau pia kwamba, mapenzi yao ikiwa ni ya dhati na enye umuhimu mkuu maishani mwao basi linalowezatokea si geni kwetu walimwengu.

Kadri, inapozidikudhihirika tungizingatia matamshi kama ya Foriegn Minista wa Ufaransa, kwamba kweli PNU waliiba kura ndivyobasi inabidi wachukuliwe hatua ambazo kila anayefanya kosa hili la jinai huchukuliwa. I was struck yesterday listening to BBC Swahili interviewing one of the Kikuyu ladies who had been chased out of Kakamega. She did not blame ukabila, or ODM except she said Kibaki should go because he did not win the election. This was a victim yet she still had a sense of what is right. It is not too late for Kenya.

Ubabe wakati wa uchaguzi ni tatizo Afrika kama vile tatizo la ukimwi.

Hii yote inatokana na ukweli kwamba mtaji wa viongozi wote wa Afrika ni fedha za serikali zao. Kuachia ngazi maana yake ni kuuachia mtaji.

Ndo maana Mugabe kavuruga nchi viongozi wa Afrika wanamtazama tu kwani hata wao wanania hiyohiyo.

Why Kivuitu must be held accountable for poll chaos

About 5.30pm on December 30, Electoral Commission chairman Samuel Kivuitu and two other commissioners huddled in a tiny room and, exclusively through state-funded Kenya Broadcasting Corporation, announced President Kibaki re-elected. Within an hour, the President was sworn in at State House at a function in which the national anthem was not played and in the absence of the diplomatic corps. Then the country was thrown into chaos.

In the fullness of time, history will apportion culpability over the current anarchy. At the moment, however, Mr Kivuitu should take full responsibility. But as he tries to run away from this responsibility to blame the chaos on pressure from PNU and ODM Kenya, I wish to offer the correct legal position over the whole saga and how the country can wriggle out of it.

The Electoral Commission of Kenya (ECK) was created pursuant to Section 41 of the Constitution and thus has security of tenure and independence. Section 42A sets out its mandate to be mainly two-fold — the registration of voters and the maintenance of the voter register, as well as directing and supervising civic, parliamentary and presidential elections.

The National Assembly and Presidential Elections Act, Cap 7, and its subsidiary, the Presidential and Parliamentary Elections Regulations sets out the legal framework that enables the ECK to effectively and fully conduct elections. The election of political leaders is a key component of any nation state that claims to be a democracy. To be legitimate, the electoral process must not only be free and fair, but also be seen to be so.

The regulations clearly set out the road-map for conducting elections, voting, votes counting and tallying, announcing results and challenging the process.

Presidential, parliamentary and civic elections are conducted at the polling stations, which are so located that voters have access to them with the least inconvenience and such that the ECK and the Government provide the logistics, the materials and security. At the moment, there are nearly 27,000 polling stations.

Each station is headed by a presiding officer, assisted by poll clerks. On the polling day, voters are given specific times within which they may cast their votes in person and not by proxy. All through the entire voting process, candidates’ agents, the media and accredited observers have free and unlimited access to the polling centre to witness the voting.

At the close of voting, the presiding officer and his clerks, in the presence of the agents, the media and observers, proceed to count the votes. Once the counting begins, the law stipulates that it shall not stop until it is completed. The results are then announced at the polling stations. The presiding officer then makes three packets each separately holding valid, disputed and spoilt ballot papers.

The officer makes another three packets holding spoilt papers, marked copy register and counterfoils of used ballot papers. He also prepares a statement that summarises the voting at the polling station, which he signs. It is countersigned by all the agents present. The packets are sealed and the agents are free to affix their own seal. The two sets of packets, the statement and the ballot boxes are transmitted to the returning officer at the constituency level.

The returning officer, once he receives the packets and boxes from the polling stations, proceeds to tally the votes. This is done in the presence of the candidates’ agents and the media. Vote recounting is not gone into, except for those disputed, and the returning officer has discretion to confirm or vary the disputed ones only. He shall never change the valid or spoilt votes. He then proceeds to announce to all present the results of both the presidential and parliamentary votes.

The returning officer is obliged in law to then fill Forms 16, 16A and 17A, which set out the results and the votes cast for each presidential and parliamentary candidates. The statutory forms are signed by the officer and the candidates’ agents. The agents, the media and observers are allowed to make and keep copies of the three forms, which are then physically delivered to the ECK headquarters in Nairobi.

On receiving them the ECK gives all parliamentary and presidential candidates 24 hours to lodge complaints, if any, including demanding a recount or retallying. The ECK is obliged to, within 48 hours, allow the recount or retallying. All candidates and the ECK therefore have 72 hours to resolve any disputes. It is only after the period that the ECK can announce the winners of each of the 210 parliamentary seats and issue a certificate known as Form 17 to each elected MP and Form 18 to the elected president. The results are then gazetted.

With due respect to Mr Kivuitu, it was irregular, unlawful and void in law to announce the results on December 30 and swear in the President on the same day. The ECK boss announced the results when he did not have the original Forms 16, 16A and 17A from each constituency, refused to allow the 24-hour period for candidates to lodge complaints and declined to allow retallying.

He told the world that his returning officers had gone underground, and that he did not have powers to order retallying. On the day the results were being announced, Special Gazette Notice No. 12612 was issued declaring Mr Kibaki the president. Mr Kivuitu deliberately misled the world and subverted the law.

Section 5 of the Constitution states that the president shall be elected in accordance with the Constitution and the National Assembly and Presidential Elections Act, Cap 7. Non-compliance with the mandatory provisions vitiates the process.

In law, the fundamental principle is that a void process does not confer legitimacy. A public officer acting in compliance with the law must comply with the substantive, formal and procedural conditions laid down and at all times act in good faith and for the public good. As a repository of these constitutional and statutory powers and duties, Mr Kivuitu was obliged to be faithful to the process and not be influenced by external forces, as he has admitted.

By his infidelity to the law, he has failed the country and must undo the mistakes. Section 5 of the Constitution states that a president duly elected is the one who has the highest votes cast.

The ECK can invoke its powers under the Constitution to retally all valid Forms 16 and 16A and retract the results and announce the valid ones. The announcement of results on December 30 was a ministerial act that does not invalidate the ECK’s constitutional powers.

The Constitution states that any other law that is inconsistent with the provisions of the Constitution is void to the extent of inconsistency. Thus, Mr Kivuitu must take the high road, invoke the ECK’s constitutional mandate and review the forms and give Kenyans the president they elected, be it Mr Kibaki or ODM candidate Raila Odinga.

The tough stands taken by ODM and President Kibaki’s PNU are theatrics which will not help the country. Neither party has any constitutional mandate that is the ECK’s monopoly. If he allows the status quo to stay, Mr Kivuitu will one day be held to account for the bloodshed and property destroyed.

The country’s unity and future rest on his shoulders, and he cannot pass the buck.

Kenyans feel cheated, they feel they are impotent when it comes to matters regarding them, that there is a group of people who decide their lives!

So even if Raila gives up, it wont help. The feeling that we are controlled by some powerful figures will still be there and the hatred. The wananchi will still resist the Kibaki administration hata Raila atolewe kwenye equation hili nzima. They made their vote, international community including TZ, US, UK and France agree what is in State House is not the true result of the wananchis votes. Kwa kifupi basi let what Kenyans voted for be respected. That group of tribalists that argue a Luo cannot lead Kenya have just been proven wrong by Raila receiving the highest number of votes in Kenyan electoral history. Wasitubebeshe mimba halafu wakati tunapozaa watunyanganye mwana wetu nakutuletea dolly eti tukilia tujisitiri nalo.

Kibaki should step down and aheshimu his fellow Citizens of Kenya. Kenya is a Republic and not a Kingdom. In a Republic, No one is above the law.

Kenya violence: University living in fear

Caesar Wamalika, chaplain at the University of Eastern Africa in Baraton, in Kenya's Rift Valley, spoke to the BBC to give a personal account of how a crowd of more than 1,000 people threatened to storm his campus unless some ethnic groups left.

It all began soon after the election results were announced. A number of groups from the local community broke into war songs and raided the shopping centre next to the university.

They looted all the shops that belong to Kikuyus and Kisiis. Then they broke into the rented off-campus houses of some students and then a crowd of about 1,000 people surged to the university gate and shouted that they wanted to storm the university.

They demanded that all Kikuyus, Kambas, Meru, and Kisii people leave the university within two hours. That was the only way to save the university from being stormed.

They said they would stay at the gate until their demands were met. Three armed policemen arrived and spent time negotiating with the crowd. Finally the police advised us to evacuate the named ethnic groups.

We put those specified faculty and students, numbering about 250, into three university vehicles and they were taken to Kapsabet Police station under police escort. They have been there for four days. Several attempts have been made to take them home.

The police tried and take them to Eldoret international airport but there were too many road blocks set up by different gangs and so they had to return to the police station. There is no way anyone can get out.

The situation at the police station is not good. There is no food or clean water, but their worst fear is the possibility of the station being stormed, as such threats have been made. The police are few and overstretched.

There are about 300 faculty members from the Luo and Luhyia community, international workers and students who are still holed up within the campus with me.

We have been having daily threats from the crowds of people outside the campus. On one occassion, we had to give a bull for them to slaughter to guarantee us peace.

It is a nightmare to meet them. All of them are armed with machetes, bows and arrows. Some are drunk and others baying for blood. I have never seen anything like this. One needs to be diplomatic when speaking to them.


Violence swept the country after the elections
We have managed to succeed in pleading with the militia to allow us transport to send food to those at the police station. It took three hours to go through road blocks to reach Kapsabet, which is only 15 km away.

There has been a change of heart from some commanders and militia leaders who have the university's adminstration. They said that on humanitarian grounds, the faculty with children and pregnant mothers should be allowed to return to the campus.

They also told us students of the other communities should also be allowed back. It sounded like good news. We shook hands. We asked them to transport food to Kapsabet. They agreed and used their own vehicles.

But the food never arrived. We then found out that the militia who were escorting the food had been beaten and their vehicles smashed by another group.

That is the problem we are facing - having to negotiate with different militia groups who all have their own separate terms that we have to try and fulfil. The roadblocks are manned by between 100 and 500 people - in some major road blocks you will have a thousand.

This morning, as a political rally was announced, the crowd came again to the university gate, this time demanding that we join them in a mass demonstration. We feared being put on the front line and probably be first to face the armed police.

Our University public relations officer managed to negotiate with them to leave - but they have chained the main gate, locked it and gone away with the key. No vehicle can get in or out of the campus now. We pray that they don't come again to force us out.

There is a shortage of essential items. Nowhere to buy food, we don't have telephone calling cards and there is no fuel. The market is deserted and shops are closed. While the situation is calming down, there is still fear of what the next day might bring. We are still making efforts to escort our faculty safely away from the police station.
