The government yesterday played down early prospects of an overhaul of the constitution, saying there was no pressing need for such an expensive undertaking amid other nation building challenges.The newly appointed Minister for Constitutional Affairs and Justice Ms Celina Kombani said the government was contented with amendments of the supreme law whenever there was a need.
She told The Citizen in a telephone interview that the state was also not ready to initiate a process to re-write the constitution since it has not received any formal appeal from those advocating for constitutional reform.

Celine "Dion" Kombani wake up, unataka formal appeal iwe namna gani hiyo hebu tueleze, kwani mwaka 1977 kulikuwa na formal appeal iliyoletelezakutungwa kwa katiba mpya. Mbona unaanza kupwaya madarakani haraka hivyo.

Watu wanataka Katiba mpya sasa au unataka waingie mitaani ndo ujue kuwa hiyo ndo application yenyewe.

The government yesterday played down early prospects of an overhaul of the constitution, saying there was no pressing need for such an expensive undertaking amid other nation building challenges.The newly appointed Minister for Constitutional Affairs and Justice Ms Celina Kombani said the government was contented with amendments of the supreme law whenever there was a need.
She told The Citizen in a telephone interview that the state was also not ready to initiate a process to re-write the constitution since it has not received any formal appeal from those advocating for constitutional reform.

The Minister spoke shortly after attending the first full cabinet meeting chaired by President Jakaya Kikwete at State House in Dar es Salaam.

It was the first government’s reaction to a wave of mounting calls from various quarters for a complete re-write of the constitution.

But yesterday Ms Kombani said she considered such calls “pedestrian” and that the government would only be willing to listen or act on the demands when a formal request is presented.

“Let them come with something concrete and in writing, showing which sections have problem, why and suggest the alternative. The government should not be forced to respond on these sensitive issues through reading newspapers,” said the minister.

Ms Kombani’s reaction would appear to dampen the hopes that a dialogue could be established soon to chart the route to take over the matter, which has gained momentum since the October General Election.

But reacting to the Minister’s stance yesterday, the leader of official opposition in Parliament Mr Freeman Mbowe and his predecessor Mr Hamad Rashid Mohammed of the Civic United Front (CUF) said the government should not look for excuses to escape from its responsibility.

“It is irresponsible for the minister to want to cheaply dismiss such a national issue. You don’t seat in the office and wait for official complaints while it is obvious the cry for constitutional reform is a cry of the majority,” said Mr Mbowe.

Mr Hammad said his party has filed more than three letters to the government demanding talks over constitutional changes to no avail.
“Who does not know the long cry of having the new constitution, we wrote a letter to President Kikwete when he took over the office in 2005, likewise to former President Benjamini Mkapa but nothing has been done,” the Wawi MP said. He said in the ninth parliament he prepared a private motion but was not given a chance either.

A Mzumbe University political analyst Dr Elisante Gabriel also said the government should act without delay for public interest because it occupied a central role in public matters that cannot be overlooked.

Yesterday the Tanganyika Law Society (TLS), which on Sunday added to the review call pressure, reiterated that it would drive forward the reforms agenda and hoped to bring the government on board.

“Tomorrow (today) the TLS governing council will be holding its ordinary meeting and one of the major issues that will feature is how we kick start the process to have a new constitution,” said TLS president Mr Felix KIbodya.

He said TLS believes that lawyers have a unique opportunity to push for the changes and that it was their legal duty to do so. “It is part of our cardinal duty,” he emphasised.

Earlier Ms Kombani said the overhaul of the constitution was a costly affair that could not come overnight. The Minister cautioned that if not handled properly, it could plunge the nation into serious problems.

Asked why the government should not take charge, the minister responded: “When we see a problem we go for amendments that we implement smoothly without pressure. The problem I see here is that they want an overhaul, while we think amendments are for the time being sufficient,” she said adding that many countries have chosen this road.
The minister further claimed that the craving for a full review was not in the interest of citizens and the government.

Huyo ndiye waziri aliyeaminiwa na JK kuiendesha wizara ya katiba na sheria. Hizi comment hazijatoka kwa mtu msomi mwenye kuipenda nchi yake bali kutoka kwa jambazi au jambazi mwenza anayeiba demokrasia ya wengi.
KATIBA ina matatizo makubwa hata kipofu anajua lakini huyu wazimu anasema tumwandikie na tumpe mapendekezo.
Kweli kuchagua ccm ni maafa makubwa

From this you can read from the minds of the so called african administrators! They (administrators) are unwilling/ can't integrate the situation! Mpaka watu wauane! Shame on us Africans

Katiba mpya ya nini bana, ni kupoteza rasilimali za nchi tu bure. Hakuna katiba mpya vipengele vyenye matatizo leteni tuvirekebishe. WELL DONE MRS. KOMBANI
 
I think that a petition for changing the constitution should be written and signed by all citizens of URT and be presented to this minister. It is high time she started doing what the tax payers have sent her to do, instead of making lame and ridiculous statements, like the one she has just made.
 
I thought we the people are the ones who knows whats important, whats needed. Expensive undertaking?...... dont make me laugh

Just ask her how expensive and you will laugh more....she is already planning to get a big meal ou of it....if they cant tell wahat SADC stands for...surely they dont know evene wahat the katiba is all about

Si unajua majibu ya ccm, oh tunataka mhimili mmoja ushikwe na jinsia nyingine wakati hiyo haikuwa issue. Kukataa katiba ni kuahirisha tataizo katiba si ya ccm ni ya wananchi wote. imepitwa na wakati mmno kwa sababu:
1. ilitungwa wakati wa mfumo wa chama kimoja
2. Kutokana na 1 juu madaraka makubwa yamewekwa kwa raisi
3. wakati huo haki za msingi hazikuwepo, sasa zimewekwa lakini hazikidhi mahitaji ya wananchi
4. inakuwa vigumu kwa raia wa kawaida kudai haki zao za msingi

Kwa kuonyesha kuwa katiba imepitwa na wakati angalia hii katika miaka 33 ya uhai wake katiba imefanyiwa marekebisho mara 15 yaani wastani ya kila miaka miwili katiba inarekebishwa mara moja.
 
Kukubali katiba mpya kwa CCM ni sawa na kujichimbia kaburi wenyewe!CCM wamekuwa wakishinda chaguzi mbalimbali kwa sababu ya ubovu wa katiba iliyopo!

Kinachotakiwa ni wananchi wa kada zote, vyama vya siasa, na taasisi mbalimbali kusimama kidete kudai haki ya kuwa na katiba mpya itakayopelekea tume huru ya uchaguzi itakayotenda haki kwa vyama vyote kwasababu anayeibiwa kura si vyama vya siasa bali ni sisi wananchi tunaonyimwa viongozi tunaowachagua kwa maendeleo ya taifa!!

Kenya ni tofauti na Tanzania. Binadamu ni wale wale, hivi hakuona kimbunga cha kudai matokeo ya uchaguzi,kwenye miji ya Arusha na Mwanza?????????.
Umma upo pale unasubiri kuhamasishwa, sijui atajificha wapi. Watu wasikilizwe katiba mpya ni muhimu.
Waziri amka usilale kumekucha sasa Watanzania wanataka katiba mpya sio hii ya kifisadi!!!!!!!!!!!
 
Ninaelewa Tanzania ni muungano wa nchi mbili yaani Tanganyika na Zanzibar. Katika mfumo wa sasa Zanzibar inayokatiba yake na pia kuna katiba ya jamhuri ya muungano yaani Tanzania. Ni dhahiri Zanzibar inabadili katiba yake (kama inavyotokea mara kwa mara) kwa ajili maslahi ya wazanzibar ndani ya muungano. Najiuliza ni chombo gani kinalinda maslahi ya Watanganyika? Hatuna bunge, hatuna raisi, ....! Now i'm asking myself, how can we protect Tanganyikans interests in this so called muungano. I'm just thinking loudly!
Napendekeza kwanza tuwe na katiba ya Tanganyika, then tuibadilishe katiba ya Jamhuri ya Muungano ili kukidhi yaliyomo katika katiba hizi za nchi mbili, NAPENDEKEZA.
 
Kitaeleweka tu acha aendelee na majibu ya kitoto wakati watu wanataka katiba......Hapo Wizara ina mzigo na si Waziri ana Mzigo! huyo mama hatoweza hiyo Wizara :hungry:
