Movement: Tunataka Katiba Mpya Tanzania

Matokeo ya uchunguzi wa Kamati ya Bunge kuhusiana na mradi na mkataba wa Umeme kati ya Tanesco na RDC, umebainisha kuwakulikuwa na mapungufu makubwa ya kiutendaji ambayo yalitoa mwanya kwa kuvunjwa kwa sheria, miiko na kanuni na kuishia kuruhusu Uhujumu wa Taifa kwa kutumia ofisi za Serikali.

Hivyo basi, tuwasilishe ombi kwa wabunge wetukutaka Mikataba yote iliyopita ya Uwekezaji, Ubia, au Ununuzi yaliyofanywa na Serikali au Mashirika yake,yawasilishwe kwa Bunge kwa uchunguzi na uhakiki.

Mikataba bomu kama IPTL, RDC, ATCL, NBC, Kiwira, Rada, ATC-Airbus, Kopta za Jeshi, Bomba la Mafuta, Buzwagi, na mingine ambayo imefanyika katika miaka 13iliyopita, irudiwe, ihakikiwe na ikiwezekana isitishwe au iandikwe upya kwa Manufaa ya Taifa.

Majibu ya Kishenzi kutoka Serikali kuwa Mikataba ni siri ya mwekezaji na mtumishi wa serikali aliyetia sahihi yasikubaliwe.

Tumeona Richmond ilivyotaka kufanywa siri na tunabaini kuwa Waziri Mkuu alihusika na kuliaibisha Taifa kwa kushinikiza na kuliingiza Taifa hasara kwa kuleta mkataba wa kibiashara kwa kutumia Kampuni ya kitapeli.

Tusikubali kulaghaiwa na kwa kutumiwa kwa utashi wa Siasa, bali manufaa na maslahi ya Taifa yapewe kipaumbele!

Ingekuwa vizuri kweli kupitia mikataba yote iliyotajwa, lakini wabunge hawana ubavu wa kufanya hivyo. Kwa vile karibu wote ni wa CCM, hawawezi kuilazimisha serikali ya CCM kuwaruhusu kupitia hiyo mikataba. Huu wa Richmod uliwezekana tu kwa vile JK alitaka kumtema Lowasa.

Kumbukeni kwamba hata kabla ya kuundwa kamati ya Richmond, Mizengo Pinda alishakwenda kumwakilisha Waziri Mkuu kwenye mkutano, na akatoa hotuba kama Waziri Mkuu (na si kama mwakilishi wa waziri Mkuu). Richmond imetumika kumwondoa Lowasa. Hili limetoa mwanya wa kuwatema vile vile wengine ambao nia ya kuwatema ilishakuweko. The Richmond scandal is the excuse; it is not the reason for the coming reshuffle.

Hakuna nia ya dhati ya kusafisha ufisadi. Do you expect CCM leaders to incriminate themselves! Ufisadi utaendelea kushamiri mpaka CCM itakapokaa benchi. Hapo ndipo viongozi wapya wataweza kupitia hiyo mikataba. Kwa sasa mlie tu.

Tusikubali kulaghaiwa na kwa kutumiwa kwa utashi wa Siasa, bali manufaa na maslahi ya Taifa yapewe kipaumbele!

Ningeshauri serikali isitishe mipango ya kuweka mikataba mipya effectively ili sheria mpya itungwe yenye kuhakikisha kuwa maslahi ya Taifa yanapatikana kwanza. Kisha, mikataba iliyopitishwa ichunguzwe upya, itenguliwe na kisha kuandika upya.

Sioni kwanini viongozi wa serikali wanakubali kupitisha mikataba ambayo haina at least 50% ya faida inabakia Tanzania. Hata kama hawa Barrick na makabaila wengine watatengeneza barabara au kujenga hospitali nk, hiyo wafanye kwa hiari yao wenyewe, cha msingi ni kuwa serikali inapata walau nusu ya kile kilichovunwa.

Tuliambiwa kuwa adui wa maendeleo ni umasikini, ujinga na maradhi. Evidently wakati huo ufisadi ulikuwa haujagunduliwa! Ufisadi huu wa 10% kwa viongozi ndio unaotumaliza kuliko ujinga, umasikini na pengine maradhi!
 
Tukimaliza miradi ya ubinafsishaji pia lazima tuingie kwenye mambo ya ujenzi barabara na uboreshaji wa miundombinu kwa ujumla wake..... Hapa yapo mengi ya kuangaliwa:
1. Mchakato wa kufanya tenda na kutoa kazi zote (tender process and award)

2. Barabara zetu zimekidhi kiwango kama kilivyoamuliwa na wahandisi wetu?

3. Yale mafuta na vifaa vilivyoingizwa nchini kwa madhumuni ya kujenga barabara hizo bila kodi "duty free" yalitumika ipasavyo?

4. Wataalamu wangapi wananchi waliweza kuajiriwa katika miradi hii - "Technology transfer"

5. Kuna barabara zimejengwa kwa zaidi ya muda uliopangwa (tuliweza kutumia kipengele cha "Liquidated damages?? If YES pesa ziko wapi? If NO, why NOT?

Na mengine meeengi tuu.... Tukimaliza hapa then tuingie kwenye majengo ya shule, zahanati nk.....

Unajua Mwalimu, waswahili walisema ukitaka kumla nyani usimtazame machoni; pia tukumbuke kila jambo lazima kuwe na mwanzo na kwetu sisi kama Tanzania mwanzo tumeshauona hivyo sidhani kama ni halali kwetu kusema eti ni "changa la macho" bali ni kuendelea kupiga mawe mpaka JK aendeleze libeneke. Kuiondoa CCM although may sound possible, lakini tukumbuke kuwa itachukua muda mrefu kwa hilo kutokea so kuliko kungojea hilo, tuendeleze libeneke la mjadala tuwe na "Hoja za Nguvu" humu ndani ili kilichotokea wiki iliyopita kiendelee kama kawa..... CCM or NO CCM, Nyani lazima akomwe mchana kweupeeeee, na usiku ikiwezekana.....Aluta Continua!!

Ingawa wazo linavutia lakini sidhani kama linatekelezeka hasa ukizungumzia mikataba YOTE. Hii italeta logjam ambayo itaongeza gharama. Angalia hali ilivyo kwenye manispaa ambapo madiwani wana uwezo kama huo! Sidhani kama kuna nchi ambayo bunge ndilo lenye mamlaka ya kupitisha mikataba. Huu tupende tusipende ni wajibu wa serikali.

Kinachotakiwa ni kuhakikisha kuwa watendaji wenye uchungu na uwezo ndio wanaoongoza idara za serikali. Tumeona tofauti ya PPRA na TAKUKURU. Bunge linaweza kudai kupitisha viongozi wote wakuu wa idara za serikali na kuwa wawe wana uwezo wakuwahoji ikibidi. Kingine ni kuwa mikataba yote iwe wazi. Taratibu, minutes za vikao vilivyopitisha kandarasi n.k. vyote viwe wazi. Hapo kila mtu ataweza kuchangia na wale wenye nia mbaya wataweza kuona aibu. Ile ambayo itaonekana ina walakin, bunge linaweza kuwaita na kuwahoji wahusika.
 
Fundi, hapo umesema kitu cha kweli na mimi naongeza kwamba tuanze "with a new slate" kwa kufanya yafuatayo (based on my small understanding of the system in Bongoland):
1. Ifanywe perforamance evaluation ya idara za serikali
2. Ifanywe technical evaluation ya miradi yote ya ujenzi
3. Ifanywe applicability evaluation ya bodies kama Procurement Authority
4. Ifanywe performance evaluation ya regulatory bodies - madaktari, accountants, wahandisi, makandarasi etc

Na nyingine kama hizo...... Hili ifanywe na an outside/neutral body... Wao wanajua namna ya kufanya na kupitia baadhi ya miradi/maofisi/idara na kufanya kazi yao. Inajulikana ni makosa mengi yataonekana lakini kwangu nipo interested na mapendekezo ya kitaalamu kutokea kwao. Vitu ambavyo kwangu ni muhimu kwa sisi kama Tanzania kujua na kufanyia kazi includes but not limited to:
1. Uwezo wa watendaji
2. Sheria na miongozo ifuatwayo - mingi ni ya zamani na imepitwa na wakati na haipelekei kuwepo na upinzani na kumtunza/kumsaidia client (Serikali)
3. Planning/budgetting/Prioritizing/Implementation and Quality Control katika utendaji. Utashangaa pale Mkuu wa Wilaya anapokaa kazini bila kujua yeye kwa mwaka atasema amepata mafanikio kiasi gani sababu hajui namna ya kujiwekea vigezo vya ufanisi. Pia swala la budgetting/forecasting halipo kabisa kwenye vichwa vya wengi wetu!
4. Negotiations capacity for procurement and contacts management units - Richmond says it all!!

Kwa hiyo mimi sisemi tufanye audit ili kujua ubadhirifu wa pesa pekee lakini ili huyo mtaalamu atuambie wapi kwenye mapungufu kisha tujue na kuboresha. Kukamata mwizi pekee sio tija bali kuangalia namna ambavyo mwizi aliweza kuiba na kufanya marekebisho ndiyo tija pekee!!!

Kinara wa Ubepari marekani, Bunge lake likisema hakuna mkataba, hakuna anayeweka sahihi. LIkisema Mkataba ni batili, Serikali kuu huanza kujinyeanyea.

Sisi na Wabunge wetu, tumekubali kuburuzwa na Serikali Kuu eti kwa kutuambia kuwa Wabunge hawana mamlaka kuhoji au kupitia Mikataba kabla na baada ya kutiwa sahihi.

Je ikiwa mmoja ya Mkataba ni kuuza Mlima Kilimanjaro na mkataba huo ndio ile ya kujifunga mpaka hatuwezi kujitoa na kutugharimu?

Tusiendelee kukubali porojo. Katiba ya nchi, Katiba ya CCM yenyewe pamoja na maazimio yake na miiko inasema kuwa ni wajibu kulinda mali ya nchi.

Yaliyofanyika ni uharamia na hakuna gharama yeyote mbaya kusitisha na kupitia mikataba hii upya. Leo waniambia tukubali kuendelea na limkataba la Buzwagi for the next 25 years kwa ajili ya logjam?

If a price of gold is at US $1000.00 today and by 2015 is estimated to be at US$2000 (hypothetically), why should Tanzania continue to receive fixed earnings based on gold price of 2007 which was US $800.00?

Haya ya mikataba yenye vipengele "kitanzi" si tuliyataka wenyewe? Mfano, mkataba wa Richmond, tunaweza kuusitisha kutokana na mazingira ya Rushwa. Tusiogpe kufanya "ubabe" kulinusuru Taifa letu.

Ikiwa wawekezaji watakuja na masharti ya kukataa Mahakama na Sheria zetu na kukimbilia London au NY, why sign the damn contract? we should tell them to go and screw themselves.

Sisi shida yetu ni rushwa na ufupi wa kuona mbali. Barrick is not the only company in the world. Leo tungewatolea nje, dhahabu yetu ingeendelea kutulia ardhini ikisubiri wakati muafaka kuchimbwa.

We have many competitors in the world. We have succumbed into giving in to the first one who claims Gold will have no value in 10 years. Instead of asking for proof and check out the markets, we fly to London and sign a freaking binding contract for 25 years!

Ujinga, uvivu na uzembe wa kufikiri ulioambatana na papara, njaa, wivu na tamaa za kutajirika zimetufikisha hapa tulipo.

Muulizeni Lowassa, hata kama hakupata sembuse mkanda au chupi kama hongo, ilikuwaje alidanganyika kwa business card? Hivi alishindwakutumia uwezo wake Kimadaraka kuwapigia Ubalozi wa Marekani kuomba reference? Au kwa kuwa Daraja alishapewa ufunguo wa jiji wakajua mambo powa?
 
Hoja hii ya Kayombo ni ya kijinga na inahamasisha Serikali kuendelea kujifanyia mambo "kitemi" bil akujali kuwa Mahakama na Bunge vina Nguvu za kulichunguza. Ni kwa misingi hii hii, inabidi Mawaziri wasiwe Wabunge wawe ni watu huru na Bunge!

Govt denies MPs access to contracts with investors

The government has stated categorically that it will not present to parliamentary committees contracts it enters into with investors because doing so would contravene the principle of separation of powers.

Planning, Economy and Empowerment deputy minister Gaudence Kayombo told the national Assembly here yesterday that, according to the country`s Constitution, the powers of the State authority are separately exercised and controlled by three pillars - the executive, the judiciary and the legislature.

The Constitution stipulates that each of the three arms shall discharge its functions according to the law and none shall usurp functions or authority not falling under its jurisdiction, he explained.

He added that the issue of contracts involves the government, by virtue of its being the organ vested with executive powers, and the respective investors.

According to Kayombo, the principle of best practices worldwide requires that such contracts be kept away from the public domain ? which rules out the possibility of taking the contracts to Parliament.

The deputy minister was responding to a question by Bububu legislator Cosmas Masolwa, who had wanted to know whether the government had any plans to present to parliamentary committees the contracts its enters into with investors for verification before they are sealed.

There have long-running appeals nationwide that all agreements pass through the Parliament for verification, especially after some of those the government had entered into with foreign investors were found to be questionable and going against the nation?s interests.

But Kayombo explained that Parliament was an organ vested with supervisory powers over public affairs and had full powers to question the conduct of the Executive arm of the state, including entry into and execution of contracts.

?When Members of Parliament ask the government about the validity or otherwise of agreements entered into with investors they are supposed to get correct answers on the implementation of such contracts,? he said.

However, he warned that MPs should not use that right to usurp the role of the Executive with regard to the contracts.

He said the most that legislators could do is to advise the government on how best to go about executing the contracts ?but without going to the extent of verifying them?.

The deputy minister noted that whenever MPs suspect that there is corruption in the contracts, they have powers under the 1998 Parliamentary Immunities, Powers and Privileges Act and Parliamentary Standing Orders to direct that legal measures be taken against the people involved.

Asking a supplementary question, Karatu legislator Wilbroad Slaa wondered how MPs could advise the government on contracts that they had not seen.

?Mr Speaker, we are told that we can advise the government on how best to go about the agreements. I wonder what advice we can give while the government keeps treating the issue of contracts as top secret,? he observed.

After Richmond Saga, would government have legs to stand to defend this argument?

Sioni ni kwa nini SISIEMU wanaendelea kujidanganya kwamba vyama vya upinzani kushinda na kuwa majority Bungeni ni ndoto,wakati nguvu mpya kibao kama yangu mimi MADELA WA MADILU zinajiandaa kuingia kwenye sakata la siasa mwaka 2010.

Kama kungekuwa na utawala mzuri, tungeweza kushirikiana na wawekezaji kwa namna ambayo ingetajirisha Tanzania. Botswana wanafanya hivyo, na tumeshatoa data za huko mara kadhaa kwenye forum zetu hizi.

Ok Tedi mine posts bonanza in 2007

THE State is among major beneficiaries as copper/gold miner Ok Tedi Mining Limited records a massive income of K5 billion for the year ended December 31, 2007.This is compared to K4.64 billion earned in 2006.

Dividends paid by the Western Province based mine from last year's earnings totaled K1.4 billion of which K1.2 billion was for the benefit of PNG interests including the State. Total taxes and dividends for the year were close to K1.3 billion.

OTML said in its "Summary of key results" that full year sales revenue was K5 billion, 8 per cent higher than 2006 reflecting sustained high copper prices, 12 per cent higher average gold price and 7 per cent higher volume of concentrate shipments.
Net profit was K2.04 billion compared to K1.88 billion for 2006.

Total gold production for the company was 498,790 ounces, which was 9 per cent lower than 2006 production but maintained to keep OTML among the top three PNG gold producers. The company also reported that net cash generated last year before dividends was down on the previous year due to the combined effect of higher spending on capital projects, timing issues on the payment of income tax relating to other years and a large increase in working capital.

OTML also reported that mining royalties were 11 per cent lower than 2006 with the Fly River Provincial Government and mine area landowners each receiving K45 million. On the expenditure, OTML paid K58 million in other compensation during the year which included land lease payments, trusts and Community Mine Continuation Agreements (CMCA). "Mid-term CMCA review was successfully finalized during 2007 and involved over 500 villages and regional meetings with independent facilitators and observers," the company said.

"Agreement was reached on a four-fold increase in payments by OTML as part of an overall increased benefits package totaling just over K1 billion."

The company also said that the mine waste and tailings project to remove pyrite from mine tailings, thus reducing future impacts on the river system was approved by the Government and was currently under construction.

Commissioning of the plant is due to start in July.
Ok Tedi realized an average copper price for the period of $US3.35 (K9.86) per pound, compared to $US3.24 (K9.54) for 2006.

OTML's shareholders are PNG Sustainable Development Program Limited (52 per cent), Inmet Mining Ltd (18 per cent) and the National PNG Government (30 per cent). The PNG Government holds equity directly (15 per cent), and on behalf of the Western Province (12.5 per cent) and landowners from the mine area (2.5 per cent).

Hivi wataalamu wetu wakubwa wanaotufundishia wanasheria wetu pale mlimani hawawezi kututengenezea japo "sample" ya katiba, au hata template ambayo tunapojadili upungufu wa katiba tunaweza kuitumia kama reference? Maana sasa hata wengine tunashindwa kuamua tunachotaka ni kipi, marekebisho ya katiba au uandishi wa katiba mpya? Tukitumia neno "marekebisho" inamaanisha sehemu zilizoharibika/zisizofaa zinafahamika, zifanyiwe ukarabati.

Tukitumia maneno "kuandika upya katiba" ina maana katiba iliyopo ni mbovu sana, iko far below the minimum acceptable standards, na pengine, ni ya kutupwa kabisa tuanze upya. Kuhusu "marekebisho" nadhani tunazo references, mfano ripoti ya Tume ya Nyalali, na ile ya Kisanga. Kuhusu kuandika upya, sifahamu kama tuna reference yoyote. Nadhani tuweke mjadala wetu kwenye mwelekeo: zipi sababu za kutaka kuandika katiba mpya badala ya marekebisho tu?
