New administration under Samia Suluhu gives hope after 5 years of hopelessness

After fletcherizing this yarn we came to a very sad conclusion the Chief Justice not truthful. And, moreover he is posing a real threat to judicial independence from the invidious executive interference... What hurts most, he is parlaying the judicial gavel to undermine not only the oath he took but the sanctity of the office he waves his magic wand...

Our beef with judicial appointments has always been lack of transparency and competitive process. It is also mind-boggling to even contemplate that when the appointer is a Muslim most juicy jobs go to Muslims, and vice versa is equally veritable. For a reason which remains esoteric all of sudden it is they who have qualifications. Non Muslims all of sudden they are unqualified. Only Muslims know the intricacies of the judiciary and they are thoroughly versed with the "doctrine of separation of powers". Other contenders were spurned because on those critical areas of knowledge were dumb, and this is why they got a SNUB on their faces... had Mwendazake been around the opposite would have been canvassed, justified and upheld as the gospel truth! Regrettably, we are a witness to Mwinyi Sr. & JK reigns dejavu...times gonna be tough for Christians in the public service until mama retires, it seems....however, there will be dollops of fake love placating Christians just to obfuscate the ulterior motives of the new boss in town which is to address what she perceives as rampant injustices inflicted against Muslims since colonial times despite the fact that Muslims loved Madras more than western education...so the religious injustices were self imposed and to pass the blame to the innocent is simply preposterous!

Two top judicial appointments all have favoured one religious affiliation related to the appointer just to insult our collective intelligence the ChiefJustice flaunts merits!!!!!. And, when a Christian thumbs up miscarriage of justice you have to wonder whether he is what God accurses as a "lukewarm Christian [emoji3583]" Didn't God say He knows those who call themselves Christians but aren't Christians.... except they are a Synagogue of Satan? It is obvious without further need of concrete evidence we may have one: a bellyworshipper..

Are SDA really Christians or are they not Muslims by default? Look at their names: Juma, for example, is not a Christian Yclept....

Horrifyingly, the findings of the Warioba constitutional commission included the appointment powers of the president be clipped but the Warioba sellout was very hypocritical and had committed perfidy when those powers were left intact in the commission's illegal constitutional draft proposals. Starved of an independent judicial appointments body to advertise, conduct a rigorous interviewing and vetting process as a result the judiciary has been condemned into an executive puppet, and it deeply worries when we witness the Chief Justice is a key plank to undermine and condone the insubordination of constitutional imperatives of the independence of judiciary just to get his personal bread buttered both sides...

Is he not Judas Iskariot?

We thinks not....

OUR concern is not really religious favouritism but an opaque judicial appointments process which yields such weird appointments. CCM is transfixed to shape the judiciary in its own image and values in order to capture and preserve its own strategic interests which include a preservation of NEC in its hitherto structure and modus operandi as an ultimate body to massively and perpetually rig them back to power whenever an occasion demands. The electorate have been divorced from choosing leaders of their own preference! Little surprise a police state is hatched to ensure the electorate will never rebel and run amok the dicey circumstances nurtured in injustices.

CCM stay in power overwhelmingly depends on an ironclad control of the instruments of power which the judiciary is such a pivotal force to swat away any attempt to address electoral injustices. And, having a president who never shies away from enmeshing herself in controversies is a two edged sword. We know she despises the power of the voters when she was candid enough when she conceded "...hata msipotuchagua tutaunda serikali.....uongozi wangu ni wa carrot and stick...." The less we dilate on those two statements the better for everybody. Evidently, her management style will be to compromise meritocracy in order to promote total loyalty to her parochial interests.

Of all the instruments of power, CCM consider the Court of Appeal as the most important institution to keep them in power. This narrates why CCM sympathisers within the judiciary are the ones who are rewarded, and those who are not never get the green light to sit and decide cases at the highest Court of the land.

No wonder the Appeals Court sees no evil when electoral laws undress NEC from her constitutional mandate to manage elections and that power is handed back to the CCM president through his proxies called DEDs. DEDs on behalf of their appointer declare elections in favour of CCM notwithstanding what voters had decided. All this happens because the Court of Appeal is and will always be an accomplice of electoral injustices against the people of TZ so long as the presidential powers of judicial appointments are wide, unchecked ....and are wantonly abused.


OUR TAKE

What unifies CCM and the judiciary is not religious affiliations as we earlier explored but symbiotic association interests are the ones gluing them together. A Muslim not siding with CCM is unlikely to be patted on the back because of his religion but if he bows down to the "maintenance of the status quo" interests of the authorities through "churning out" executive appeasing rulings, abinitio.

The president claims she is atribal but we know her totem is Zanzibara and CCM, and moreover, CCM is also a tribe albeit a political one. More than 99% of her appointments, so far, favours her political tribe CCM while non-CCM tribal outfit is left to scavenge for the crumbs, if any.... "makombo" to declare it with a SHOUT of the voice of an archangel.

Even uzanzibara is also a tribe.....

So we rule this atribal claim spurious.

 
If wishes were gold beggars would ride. If you want to arraign misappropriation of public funds the best place to start is to end electoral injustices. If democratic representatives are illegal expect everything they touch is illegal.

The scripture very instructive here: forgive and move on because if you contend with a fool you will be like him.

Musiba was a hireling to defame whoever Mwendazake perceived as a political threat. With Mwendazake no longer relevant in our political equation Musiba became very dysfunctional and disoriented. Now, without the easy cash filling up his purses for his insidious services to character assassinate the so called enemies of the DEEP STATE he is broke, forsaken and very perplexed. Winning a case against Musiba may be sending a right message that puppetry never pays but without the pecuniary rewards one has hoped for.. a poor man never pays up his debts so to speak up leading us to a question why incur all these expenses for nought?

Musiba publishing company has gone under and he is embroiled in a multi billion decree with Shangazi wa Taifa after he had lost a high court libel suit in Zanzibar. He will never be able to settle that colossal amounts ordered by the court. He is not even attempting to play act humility or ask for mercy because he seems baffled by the horrific turn of events. He is still smarting from being dumped in CCM parliamentary nominations in a manner which clearly showed he had overvalued his subterfuge services. Used and dumped still hurts him... From being called Mheshimiwa Mbunge to an incognito and a nondescript to boot, and overburdened with unpayable bills doubled with being accosted with animated creditors closing in for a killing... the guy may turn out fending off suicidal inclinations. Just spare his soul by forgiveness lest the Almighty God remember our sins which are a multitude...

If these lawsuits continue to bombard him and given his underlying health issues compounding the maths we are very reluctantly to restrain ourselves from contemplating what will become of him...in few months to come, we are very much afraid to disclose....

OUR VIEWPOINT

Forgive him even if he is still playing intransigence and move on. The guy needs a break after the demise of his chief sponsor... a casualty of Mwendazake gross misconduct deserves mercy even if his bloated ego teaches him otherwise.

Very difficult to trust this regime.

Why?

Here are our reasons.

Everything earmarked here is either covered in the budget or was already promised to be done by a special fund of "kodi ya Uzalendo". So, what we have seen here is either double allocation or there is an intentional confusion or overlapping of the budget.

Either way, there is no way we can evaluate how the budget will be implemented seeing that a deliberate skelter helter obfuscation of the budgetary objectives is well underway. [emoji108]

Whatever they do they will cite all of the "DO LIST" below and get away with murdering the gospel truth. With the parliamentary majority they hold few would expect the Augusta House to raise red flags that double allocation has made it almost impossible to appraise where the money was hailing from since all three sources of budgetary allocations provided for the same things! If you mention classrooms all budgets will claim THEY DID IT....


But real answer is this the budgetary allocated cash is not there and revenues from "kodi ya Uzalendo" will be reallocated to "miradi ya mikakati" such as paying all kinds of contractors in rolling and forwarding budget. These may include leftovers from Stigler Gorge, SGR construction, a myriad of road works which are underbudgetted and as a result are behind schedules.

Will there be money for interior bridges [emoji563] as regularly promised? We seriously doubt because those undertakings though crucial to spearheading agrarian economy are not perceived as strategic to our highly urbanized politicians.
 


Warioba has equivocation issues to resolve. During Mwendazake era only Sheikh Ponda stood up to rebuke favouritism to Christians in presidential appointments. The vocal Sheikh questioned why Muslims were not given those topmost jobs that they may eat too with their loved ones. Thereafter, Sheikh Ponda had brushes with law enforcers but somehow he survived the most repressive regime in post independence period. During that time, Warioba kept his peace partly because his son was eating - a gratitude of presidential appointment - as a DC. Warioba was obviously apprehensive to jeopardize his son being shown the exit door knowing Mwendazake had thin skin to tolerate criticism. When Warioba son was dumped as the DC, he remained mum as tribalism, nepotism and Christianity were being redefined and recoined! Warioba constitutional draft had acknowledged presidential powers ought to be trimmed because the citizens wanted them truncated. Warioba and his CCM colleagues in the Constitutional commission defied the cherished wishes of the electorate by reinstatement of all presidential appointment powers not excluding the control of the Parliament through ministerial appointments of MPs in the cabinet. The constitutional draft made a mockery of what was the objective of that exercise to begin with. The citizens knew from experience an imperial president was a reincarnation of the colonial reign through stratification of a police state accompanied with extra judicial injustices and overreach.

So coming out now in full force to urge us to rebuke tribalism and religion biases is very unfortunate. Either he perceives SSH too weak to activate reprisals as he had recoiled himself during Mwendazake rule of tyranny or he just received a baptism of fire [emoji91][emoji1745][emoji23]. We need him to answer us how did the commission he chaperoned honour the majority views of shedding presidential powers during drafting of constitutional proposals.

May be then...May be after being satisfied with his "statement of defence" or exercising his rights to a riposte we will begin beaming him in a different light. But until then he remains a controversial figure of interest.
