The court will listen to all the arguments and decide according to the law. Him twisting the words which he was trusted to translate correctly (even if he was joking) is what the judgement will base on. What he did might be a practical joke in private, but its out in public domain now, and his action might course an offence to others who don't understand English and they believe everything he said that is exactly what the lady was saying. but in kenya, 5 days ago, the high court declaired the defamation laws unconstitutional because they they limit freedom of speech (freedoms and rights are like the foundation of the constitution so they trump any law) .... this is because polititians and state officials (including the president himself- remember the university student? ) have been using the law to clamp down on media,jounerlist,civil society or anyone who speaks bad about them....

thriuth parliament, all criminal defamation law will have to be recrafted and be written under civil defamation law.... unlike in the criminal, civil defamation dont carry a jail term, punishments is apology, recanting you statment. the worst punshment anyone can get from a court is compensation in monitary value, the court will quantify the damage done to the victim and decide how much to pay, but no one will be going to jail
