Then your action of arresting the guy shows how dictatorial your leadership is.
Its a law of the land misleading the public with false information in punishable by 3 month on jail or fine of $1,300 or both. Sio kila kitu ni rais au serikali vingine ni sheria ya nchi. BTW didn't we witness a university student jailed for 2 years in Kenya for insulting President Kenyatta? Was a blogger not arrested in Kenya for spreading false information about Chase Bank? What about Abraham Mutai, why was he arrested?

but he din't mislead the public... its my understanding he was not the one who posted the video.... I doubt that was his camera, all he is guilty of is wrong translation (the worst purnishment he should get is loose his job as a tour guide and get permanent ban as any kind of guide)

The court will listen to all the arguments and decide according to the law. Him twisting the words which he was trusted to translate correctly (even if he was joking) is what the judgement will base on. What he did might be a practical joke in private, but its out in public domain now, and his action might course an offence to others who don't understand English and they believe everything he said that is exactly what the lady was saying. Its all in the context, what he said, when he said it, and to whom he was saying to.

This case can be prosecuted under two similar laws, Cyber Crime act 2015 or Media Service act 2016. It's all depends with prosecutor choosing which direction to take. Both those law have been amended to put a blame on an both parties, producer of false information and the distributor.

Prosecution? Whom did he injure? If it's not the lady who gave the go ahead those are crap laws

the guy doesnt qualify in any of those laws, unsolicited messages are msg that the recepient (recieves electronically) did not concent to.....
all those laws come down hard on who ever electronically transmitted the message knowingly or unknowingly of what the translation said.....
there must some other simple law about lying to someone else with the intent of embaracing or causing emotional harm to the person cause this guy must have known that the video will reach someone else who understood what he said....

but in kenya, 5 days ago, the high court declaired the defamation laws unconstitutional because they they limit freedom of speech (freedoms and rights are like the foundation of the constitution so they trump any law) .... this is because polititians and state officials (including the president himself- remember the university student? ) have been using the law to clamp down on media,jounerlist,civil society or anyone who speaks bad about them....

Kafrica your looking at this in the wrong way. I said it before, its all in the context, listen to the first clip and put translation on one side. Who was he referring too.

If the state wants you, the state will get you, and this is worldwide. Prosecution they can even choose to take economical crime and sabotage route because the man works on an area of interest [economically].
