Agriculture minister William Ruto wants the secret envelope containing names of the post-election violence suspects handed over to the International Criminal Court at The Hague without further delay.

Mr Ruto says the two-month period given by former UN secretary-general Kofi Annan to Kenya to make a new attempt at setting up a local tribunal to try the suspects was unnecessary.

“Kofi Annan should hand over the envelope that contains names of suspects to the International Criminal Court at The Hague so that proper investigations can start,” Mr Ruto said. “Mr Annan should allow us to move forward. We cannot just get stuck in one place addressing the same thing.”
Mr Ruto’s latest stand contradicts the position of Prime Minister Raila Odinga, leader of his ODM party, who prefers a local tribunal.
A government motion to set up a special local tribunal was defeated in Parliament earlier this month, raising the possibility that suspects whose names were given to Mr Annan in a sealed envelope by the Waki Commssion could be taken to The Hague for trial.
The Hague option was to be activated should Kenya fail to establish a local tribunal as proposed by the commission that investigated the post-election violence.
Mr Ruto – whose constituency was among those worst hit by violence — spoke during the week he weathered a storm in Parliament over a maize scandal in which brokers are believed to have benefited by trading with national food security reserves at a time when the country was facing widespread hunger.

Very incriminating,,evidence,,,,from the prosecution side.

to people in his house,,,which was,,2 km from a police station,,

Can somebody please tell me why ICC has to adjorn becuase witnessess are withdrawing. Hii naona ni njia moja ya ICC kupotezea hawa viongozi uhuru na ruto muda.

mashahidi wakijitoa kule ambako wamefichwa uholanzi, bensouda anasema wamehongwa na serikali kuu ya uhuru..

....where the ICC allows the OTP to openly make such statements without evidence speaks volumes about the manner in which the cases would be handled hence forth

WI more and more witnessess keep steping down, or is this a trick bensouda is using to prolong the period and drag court hearings ama waht??

Mnamo siku ya Jumapili, Rais Kenyatta alisema kuwa ICC lazima isikize kesi hizo kwa ratiba nzuri ambayo itawapa viongozi hao muda wa kurejea nyumbani kwani wote hawawezi kuwa nje ya nchi kwa wakati mmoja.

Kesi dhidi ya Kenyatta inatarajiwa kuanza kusikilizwa mwezi Novemba.

Mkuu wa kituo cha redio kilichodaiwa kuchochea mapigano katika mojawapo ya maeneo yaliyokumbwa na mapigano, Joshua arap Sang , ameshtakiwa kwa kosa la kuchochea mapighano na kusaidia watu kuyaandaa mapigano hayo.

Mnamo siku ya Jumamosi, Kenyatta aliwakabidhi hundi ya zaidi ya dola elfu nne familia za watu ambao walilazimika kutoroka makwao kufuatia ghasia za baada ya uchaguzi mkuu na ambao bado walikuwa wanaishi katika kambi za wakimbizi.

Wiki jana bunge la Kenya lilipitisha hoja ya mjadala wa Kenya kujiondoa katika mahakama ya ICC.

Mr. Ahmed Khan, the lawyer for the Kenyan Deputy President at the ICC trials, on Tuesday made a statement that has wounded my self-esteem as an African and one who has before been forced to seek safety elsewhere. Dismissing Prosecution witnesses Khan likened them to asylum seekers (Africans) who he accused of routinely lying so as to get asylum (in the West). He repeated this claim today in a BBC interview. Most astonishing is that coated in beautiful English was a remark that carried a value of racism, the type routinely banded around against African victims of oppressive systems who flee to the West for fear of persecution. Khan has grown up in the serene atmosphere of the West and therefore has no idea of living in fear of persecution and death. He can therefore be forgiven of his school boy's ignorance of reality. But to us victims of brutality this is as real as oxygen.

Bensouda witness to recount Kiambaa church fire!

THE first prosecution witness against Deputy President William Ruto and journalist Joshua Sang arrived at The Hague on Thursday evening ready.

Witness 536, like the other first ten prosecution witnesses, will try to help the judges understand the motive of the Kiambaa church attacks, how they happened and their political context. On Tuesday, the witness will describe the Kiambaa church arson attack on January 1, 2008 that led to the death of between 17 and 35 people.

"The first Prosecution witness, Witness 536, will testify about this incident. In the slide currently before the Chamber, you can see the remains of bicycles which amongst other objects were used to barricade the doors of the church," the prosecution told the ICC judges this week. The second witness, P-464,is a European based expert who will describe the historical roots of the violence.

Sociologist Herve Maupeu will describe the likely causes of the 2007/8 post-election violence but will not give evidence on the roles that Ruto and Sang allegedly played.

"In order to understand the accused's motive and opportunity to commit the crimes for which they are charged, it is necessary to have an insight into the political and historical background against which these crimes were committed, including the Kenyan political environment," the prosecution said.

The Prosecution will then call two political overview witnesses, Witnesses 326 and 323, to provide further insights on the perceptions of the Rift Valley population.

The first witness is a woman who was a victim of the Kiambaa fire and who was the cause of the adjournment last week until next Tuesday.

Her delayed arrival is attributed to a last minute change in the prosecution witness list after the first three witnesses withdrew.

During the hearings on Wednesday, Ruto's lawyer Karim Khan protested the delay."There's been previous orders of the Court regarding the Defence entitlement to have at least the next ten witnesses in order. Because the first three witnesses have withdrawn, we don't know who are going to come," Khan said.

One witness, who withdrew last week, lost his father and brother in the Kiambaa fire but said he was no longer willing to testify as he had no recollection of Ruto and Sang organising the violence or inciting people.
According to the prosecution, Ruto and Sang were part of a network that organised and fundraised for the attacks, allegedly carried out by Kalenjin youths.

The prosecution says that attackers, sent by Ruto and Sang, barricaded the victims inside the Kiambaa church and set it on fire and many occupants were trampled to death, or burnt alive. It adds that others who managed to escape the flames were hunted down and hacked to death.

In an attempt to distance Ruto and Sang from the incident, lawyers Khan and Katwa Kigen this week played media broadcasts of their clients calling for peace.

Khan showed a video of Ruto addressing the media calling for peace and calm after the Kiambaa fire. Kigen played a radio broadcast of Sang telling the Kalenjin community that people should codemn the attack on a church.

Other witnesses will testify how large numbers of Kalenjin youths were ferried into certain locations by lorries. Witnesses will also identify members of the alleged network as leading the attacks in Turbo town, Kimumu, Kapsabet town and Nandi Hills.

Others will testify that network members provided transport, food and refreshment to the attackers. The prosecution will argue that at least 200 people were killed as a result of these attacks.

Meanwhile a family in Naivasha has accused the ICC of holding their son against his wish. The family is accusing the ICC of coercing their 44 year old son to testify in the post election violence cases despite his calls to pull out.
In 2011 the father of three and his family left the country without informing them. The family, who wished to remain anonymous, said that he called last week saying that he wished to return home.

"He called us last week saying that he was among those listed to testify next week but his phone was disconnected before he could avail more information," said a relative.

Deputy President William Ruto arrived in the Netherlands on Monday for the resumption of his trial by the International Criminal Court at The Hague.

The Deputy President, alongside one-time radio journalist Joshua arap Sang, is facing charges of murder, deportation and persecution, related to the 2007/8 post-election violence.

On Monday, the Nation established that the prosecution has lined up 10 witnesses between Tuesday and October 4 when the trial chamber adjourns for a week, according to the initial court calendar.

The first prosecution witness takes the stand today after proceedings were adjourned last week.

According to the legal representative for the victims, Mr Wilfred Nderitu, there is no specific sequence for the appearance of the witnesses.

“There are no specific numbers of witnesses lined up this week but we expect that 10 will testify during this session,” said Mr Nderitu.

A woman, who was a victim of the Kiambaa Church arson attack, will be the first on the stand Tuesday.

Lead prosecution counsel Antony Steynberg had indicated that the prosecution would call up to “22 victims and witnesses, common Kenyan people, who will describe the attacks” in the towns of Turbo, Kapsabet and Nandi Hills and five locations in the greater Eldoret in the case against Mr Ruto and Mr Sang.

The five locations are Kiambaa, Langas, Yamumbi, Huruma and Kimumu.

According to Mr Nderitu, it is not clear whether the witness will testify in public. “That would be a decision to be taken by the chamber at the start tomorrow,” he said.

Lawyers familiar with the operations of the ICC said the public may not be able to see the witness but the rest of the parties will.

“The court can direct that the curtains be drawn as the witness walks into the chamber so that the public do not get to see who the person is. However, the defence has always insisted that they want to see their accusers,” said a lawyer.

“If a witness claims to have heard certain conversations then the defence can know how to handle that after knowing who they are.”

USE OF PSEUDONYMS

However, in exceptional circumstances, the witness might also be protected from the defence.

“Protective measures, may for example include, the use of pseudonyms, the redaction of documents or a disclosure ban or the use of audio-visual techniques to conceal the identity of a person appearing before the court,” ICC spokesman Fadi El Abdallah said.

Mr Ruto will thus, for the first time, come face-to-face with one of his accusers.

The prosecution appeared keen to start the case with the Kiambaa arson attack, in which up to 35 people were killed, to have a powerful beginning to the trial.

The burning of the church shook the world and was reminiscent of the Rwanda genocide.

The prosecution was said to have lined up three witnesses, described as insiders, who took part in the crime but had taken a plea bargain.

They withdrew just before the trial started, sending Ms Bensouda and her team back to the drawing board.

The second witness, Mr Herve Maupeu or witness P-464, is a European-based expert who will provide the historical roots of the violence.

Presiding judge Chile Eboe-Osuji had last week described the request for adjournment as a “shame” although the chamber went ahead and granted it.

This gave Mr Ruto an opportunity to travel back home for five days.

On Monday was an ICC holiday, meaning the trials could only resume Tuesday.

Mr Ruto is accompanied to The Hague by his wife, Rachel, and five MPs.

When he returned last Thursday, Mr Ruto told Kenyans to be ready for a surprise, which could emerge from the proceedings.

The first witness is reportedly a former employee of one of the prominent personalities the prosecution, in its updated Pre-Trial Brief detailing the charges against Mr Ruto and Mr Sang, claimed hosted a meeting of Kalenjin youth at his residence to plan the attack of December 31, 2007 — a day after former President Kibaki was declared winner of the elections.

“On December 31, 2007 at the farm of businessman near Kimuri, approximately 3,000 Kalenjin youths who attended at this location on November 23 and December 26 gathered. Members of this group of youths attacked the Kiambaa Church the next day, including Steven Chamalan Leting, Emmanuel Bor, Kimei Bor as well as a youth called Brown,” the prosecution said.

Statements from witnesses state that up to 350 women, children, elderly and disabled persons from Kiambaa and surrounding areas took shelter at the church, with 150 men outside standing guard.

The prosecution alleges that “Ruto himself had identified Kiambaa as a target for attack and as being densely populated with Kikuyu. Further, Ruto’s close associate, Mark Too, hosted several planning/preparatory meetings at his compound near Kiambaa in the months preceding the elections”.

Those who will view the trial proceedings on television, however, will not be able to see or identify the voice of the witnesses owing to the strict protection procedure that are established by the ICC to secure the physical and psychological well-being of those who testify.

“There is a mechanism in place to ensure the physical and psychological well being of the witness so that the testimony they provide will not endanger their lives and that of their family,” said ICC Outreach official in charge of Kenya and Uganda, Ms Maria Kamara.

The measures include failure to read the name of the witness in the courtroom, occasional testifying in closed sessions, blocking full view of the public, blurring the witness’ face and manipulating the voice.

“The accused, however, has a right of seeing the person who is testifying against them,” she said meaning that Mr Ruto, Mr Sang and their lawyers will see the witness in court.

In extreme cases, however, the accused persons could testify from the witness room at The Hague via video link.

“This is meant to avoid eye contact with the accused person in special circumstances. However, we don’t know the protection measures which will be put in place tomorrow (Tuesday),” explained Ms Kamara.

After giving evidence, the witnesse will be cross-examined by the defence and the attorney for the victims.

Yesterday, there were reports that Ms Bensouda could present American satellite imagery expert Lars Bromley to explain satellite images, including those of Kiambaa Church, which were reportedly captured during the post-election chaos.

The geo-information specialist at the American Association for the Advancement of Science who has extensively documented the atrocities in Darfur and Zimbabwe will be expected to help locate the crisis spots, magnify the images and figure them out as proofs of arson attacks and mass murders.

He will be followed by the Frenchman, Prof Maupeu. Ms Bensouda argues that Prof Maupeu had conducted research in Kenya for many years and understood Kenya’s politics, an attribute that would help the judges understand what led to the violence.

His publications include Physiology of a Massacre in 2002; The Massacre of March 3, 2002, Kariobangi North (Nairobi Kenya) and a paper titled Revisiting Post Election Violence of 2009.

Meanwhile, the International Criminal Court is expanding the detention unit to include a female section in anticipation of the arrival of former Ivory Coast president Laurent Gbagbo’s wife, Simone Gbagbo.

Mr Gbagbo himself is already in detention at the ICC awaiting trial for crimes against humanity.

The first prosecution witness is giving evidence at Kenyan Deputy President William Ruto's trial at the International Criminal Court ( ICC).

Mr Ruto has been charged with crimes against humanity, following allegations that he orchestrated violence after disputed elections in 2007.

Mr Ruto, the first serving official to appear at the ICC, denies the charge.
The court ruled the witness's identity, an alleged survivor of a church arson attack, should not be revealed.
This was for her own safety and she will be known by the number 536.
Chief prosecutor Fatou Bensouda has previously said that witnesses have been intimidated in an attempt to prevent them from giving evidence.
