The Double-edge Jubilee knife that is cutting William Ruto at The Hague: Witness 376 et al.

It is now apparent that Ruto’s entire case at the ICC was largely built by the Kibaki-era security/intelligence machinery. Ruto has even gone ahead and named those responsible for his legal woes at the ICC. .....In light of the Uhuruto marriage, why then have the same people not summoned their “witnesses” to withdraw en-masse and let Ruto’s case automatically collapse? Be your own judge. A legally free Deputy President called William Ruto, with Kenyatta still bound to answer serious criminal charges at the Hague is not exactly what the masters of Jubilee envision for Kenya. It is what it is!


Ruto’s acceding to wise counsel — to continue attending trial — is apparently being met by suspicion within some quarters of Jubilee. Some Jubilee honchos (especially those co-opted from the PNU/Kibaki era) are now looking at Ruto’s move to loyally attend court as an act of audacious ambition. Apparently, Ruto has gone against “advice” from Kenyatta handlers and external supporters like Museveni and Kagame. By continued attendance, he is now being accused of “trying to make the President look bad”. It is just common sense that Ruto’s going against the deferral scheme is on advice from his lawyers who not only know that such deferral plans may not technically cover Ruto, but that it is also bound to fail.


There appears to be a slow fusion developing between certain quarters of the Kibaki regime and the budding Kenyatta administration. Anti-Ruto forces within the previous PNU establishment, temporarily taken aback by the political marriage between Uhuru and Ruto, are slowly beginning to find a voice within the Kenyatta administration. They have probably taken advantage of Ruto’s prolonged absence from the country while on trial. They have calculated that the trend is likely to continue for at least two years —giving them ample leeway to entrench their positions within the administration.


The anti-Ruto brigade of the Kibaki era is not keen to have Uhuru leaving the country for prolonged stay at Hague. They are strong proponents of the deferral project. They are afraid of Ruto intermittently coming back to act as President (while Kenyatta is away) – probably fearing that Ruto might get perfect opportunity to square even with them. Ruto is not the kind of guy to miss an opportunity to tame a potent critic or enemy. They know it quite well. After all, the fingerprints of their work against Ruto are right now playing out in court (Hague) — right in front of Ruto’s eyes.


Genuine witness or Political Hitman?

Ruto’s loyal attendance of court proceedings may thus not be such a rosy affair for him after all. The political chicken are coming back home to test the strength of the intra-Jubilee camaraderie – which is ironically trying to expand to absorb some previously reluctant Kibaki era loyalists (the anti-Ruto crew).


Watch out for witness 376’s continued cross-examination by Ruto’s lawyer, Essa Faal, tomorrow (Monday). Damning testimonies from this witness (& the OTP witness who broke down in court) must be keeping Ruto awake at night in Hague. Witness 376 resisted a tough cross-examination by Faal on Friday, refusing to budge an inch on the contentious madoadoa code word. Ruto’s supporters believe this madoadoa business is all hype concocted by Kibaki-era spies to fix Ruto.

Faal showed judges a video with Raila using the same word, in the context of calling for a “three-piece-suit” voting pattern. Witness 376 steadily stood her ground, saying that whereas Raila’s usage was likely in a political (voting) context, Ruto being a local, was colloquially using the term as an ethnic code — basically calling upon majority Kalenjins to evict minority Kikuyu’s. Of course, this is the same line cemented by Gichangi during the Waki tribunal. This madoadoa argument was the hallmark of Friday’s cross-examination –and the dispute continued into a camera session, with witness 376 clearly enjoying an upper hand in front of the judges.


In short, this witness successfully passed the message to judges that one needs to be a local to understand the context of language usage. This witness was in fact doing the prosecutor’s job –without pay! She is going the extra mile to pin-down Ruto. Is she a genuine witness or a camouflaged political hit-woman? Could she be an isolated simple witness who just happens to be a very brilliant Gikuyu woman? Could she be just any ordinary witness who just by happenstance, intuitively fills in for prosecutorial deficiencies while on trial, many times thinking on her feet?


Ruto and his defense do not think so. They are in fact seeing a tough and legally trained witness, carefully selected and thoroughly prepared by the Kibaki-era NSIS machinery — to testify against Ruto. Ruto and his defense see a witness hired and trained (by the Kibaki-era PNU think-tank) to nail him. They see a woman feigning local traditions and simplicity, yet in reality a sophisticated and clever witness. When Ruto’s defense tried to shake off this witness with the claim that the Gikuyu in the North Rift equally use derogatory code words against the Kalenjin, she brushed it off for irrelevance – because such usage did not incite mass killings.


When the tenacious Faal asked her whether she knew of Gikuyus beheading and displaying heads of slaughtered Luos on sticks, at a place called Langas, she inadvertently revealed a big clue. She admitted being in knowledge of a meeting between the area chief of Langas with both the Luo and Gikuyu communities in the same locality. Ordinary folks rarely know of scheduled security meetings of the provincial administration. What instantly rings in pondering minds is the possibility that this witness could actually be (/or was) affiliated with security (law enforcement) one way or another. NSI? Provincial Administration?….


These are the realities of what are going on in court right now. Ruto must be wondering…”if the Uhuruto marriage is being taken seriously by the Gikuyu establishment, why didn’t these NSIS-prepared witnesses withdraw like other witnesses were purportedly doing?” That’s the elephant currently sitting in the Jubilee tent. Ruto is wondering why anti-Ruto forces of the Kibaki era are still having leeway in the budding Uhuruto administration. He secretly knows there is still potent fear of him among these circles — thus the silent assignment to clip his wings despite all his efforts in “putting” Uhuru into power.



As Ruto sits in court right now, he knows that the tough witness 376 is/was one way or another affiliated with the same government that he is # 2 in. It is therefore not an accident that Ruto’s lawyers a few days ago publicly released a list of people he accuses of having “manufactured” evidence against him, then “coached” witnesses to testify against him. Ruto went public, accusing Mutea Iringo, Martha Karua, Nancy Gitau, and others he deliberately omitted from the list (such as Michael Gichangi, and Githu Muigai) for plotting to permanently fix him politically.


Ruto was likely spurred into doing this because he was now directly facing in court, a tough and credible witness. He is probably expecting similar witnesses to come up, witnesses who have been “ generated, processed, and packaged” by the Mt. Kenya establishment; witnesses who may very likely send him to jail and permanently end his political career.

The chicken are slowly coming back home. Those in denial may not see it yet – but it is what it is!

President Uhuru Kenyatta’s chief advisor on political affairs Nancy Gitau is said to be one of the most powerful figures in the Jubilee administration. She is one of the people mentioned by a prosecution witness at the ICC as having played a role in getting witnesses to fix Deputy President William Ruto before the Waki Commission. In spite of her power and influence for last six years she has been in government, Ms Gitau has never granted a media interview. Our Senior Writer MWANIKI MUNUHE exclusively interviewed her at State House, Nairobi. Excerpts:


You have been mentioned in the ongoing ICC cases as one of the state officials who were procuring witnesses for the Waki Commission to fix the Deputy President William Ruto, what do you make of this?


Many people have been mentioned before the International Criminal Court, I have no idea what number I could be, and many more people will continue to be mentioned. I felt humiliated not because I was mentioned, but because this is the most humiliating thing for Kenya and Africa in general. The point is, I don’t take this ICC business as a comedy; this is a tragedy. Many people will be mentioned but this is a tragedy whichever way you look at it.


You were a senior government official when the Waki Commission was appointed; did you have any role in the commission whatsoever?

I will tell you facts as they are; I attended almost all the Waki Commission hearings. I would attend as an ordinary citizen. I heard all the stories. In fact, I also attended the Krigler Commission meetings. Equally, I had access to the Waki Commission evidence, I spent a whole weekend reading all the 1,900 statements filed with the commission and I read cover to cover of the Waki report. What shocked me is that what I heard in the Waki Commission meetings and what I read in the statements is not what was contained in the report. There was a retreat in Naivasha to discuss this report; I was the first person to say that this matter must never be allowed to go to the ICC. I did not think our institutions had gone to the dogs. We are not a failed state.

But Kenyan Parliament voted in favour of ICC, effectively, the country through Koffi Annan took itself to The Hague. Comment?


No, the motion in Parliament was whether or not a local tribunal should be established. In fact, we did not even seem to know what a local tribunal meant in the first place. That motion of establishing a local tribunal was lost. But that did not mean that a motion to take the country to ICC had been adopted. In other words, failure of this motion was not equal to ICC.


And let me be honest with you, I am not one of the people who give Koffi Annan the credit he has been given by other people. He is part of our problem. He has been part of this long programme just like Maina Kiai. These NGO people have something in common, they are fluent, they know how to hold the fork, and they attend cocktails and are given a platform in big forums which they use to undermine their country and its institutions.

What programme are you referring to?

There has been a programme to portray Africa in a certain way that we are still very primitive. This programme is done for a purpose and that purpose may not be necessarily political. They call it civilisation programme. ICC is part of the programme. NGOs have been used to further this programme by undermining their own institutions and thus setting a certain public opinion. Listen to the description of the dress code of the people who were allegedly cutting each other’s neck have been given. Ask yourself; do you see the people that ICC is describing in your villages, where do they live? When did killing become normal, whose project is this? Africa must see this project for what it is and we must tell them ‘this is your project have it’.

This is a Kenyan case; it is not an African case, why do you keep on talking about Africa and not Kenya?

I say Africa because ICC is about two people, the owners and the clients. ICC like many other people have said was meant for Africa not the European countries. Former colonial masters still think civilisation process is still on, they need tools to do that and ICC is one of them. Why do they shake when Africa threatens a mass exodus yet Africa comprises of just about 27.8 per cent membership? The owners like the Dutch are happy. How much money do you think Kenya is exporting to their countries by all these travels, accommodation, hiring of lawyers. Somebody should do this calculation. They fund NGOs and purport to give independent voices yet the NGOs themselves are part of the owners of ICC.

But there are African lobby groups that are not necessarily Kenyan and are supporting the ICC trials?
I have checked and I think they are about 30 lobby groups. What is clear is that they get their funding from one source that technically owns them. They are agents of neo-colonialism. They are agents of creating the impression that African systems don’t work. Some colonial masters still think they left Africa too soon.


How does you current job and the previous one compare?


I am happy to be working at home. During my previous job at USAID I travelled extensively and nowhere did I hear people talking ill of their countries. Just like in a family set up, you may not like your brother or sister very much but you don’t go shouting about it in the market. I think I am most satisfied working for my country especially working under a hardworking and caring President who feels very strongly about the future of the country.


You mentioned you worked at USAID for about 17 years, what were you doing at USAID?

I was the team leader in the democracy and governance sector, it was an exciting job because I got to travel to many countries across the world. Around 1992 during the multiparty struggles, I spearheaded a programme to strengthen the Kenyan Parliament. We pushed through creation of house committees amongst other legislations. Many of the NGOs you see today got their first funding on my signature including Kenya National Human Rights Commission because at that time, their push coincided with our interest in democracy and good governance. I pushed this programme for about six years. Essentially, my job entailed working closely with the embassy, liaising with state department in the management of human rights and democracy governance programme in Kenya. But before joining USAID, I had worked under Undugu programme; I worked in many slums across the country. I worked in Coast region, Central, Nyanza. I was shocked by life in slums particularly because I had not seen a slum before in my village. But what I never saw in slums is negative ethnicity. People lived in peace and there was no fear of violence.


After 17 years of an exciting job at USAID, why did you quit to join government?

First of all, I did not apply to join the former President Kibaki’s administration. I was called to join the government in the year 2007. Somebody called me and said he was calling from State House who I later learnt was Stanley Murage who would later become my boss. I met him at Serena Hotel, Nairobi. He requested me to join government but I could not agree because it never crossed my mind I would ever work for the government. So I told him I was happy at USAID. He later called me but this time to State House where I met him and after a long discussion, I agreed to take a position in government.

Nancy Gitau schooled in Mukumu Girls in Kakamega County. She is a holder of Bachelor’s Degree in Political Science and Masters, University of Nairobi. Gitau worked for USAID for at least 17 years.

And those who do not know,,,is that,,Uhuru Kenyatta was equally 'fixed' by the
side of ODM, when he was in PNU, led by Mwai Kibaki.

So Ruto is talking of what happened then,,,but not now.

For there is no more ODM nor PNU's,,only the names that
remains.

Uhuru was never the head of PNU,,,he was leading KANU
which was one of those parties that made up PNU.

So if Ruto was fixed,,,,Uhuru had nothing to do with it,,for
PNU had so many people in it,,doing all kinds of functions
as it was with the ODM .

People should stop being this,,shallow,,,making very
funny analysis which make them,,,a laughing stock,
when things do not go the way,,they saw,,in their
dreams.
 
Another thing,,,what Ruto said is that he will continue with the case
until the matter is discussed by the UN as requested by the AU.

He said that,,he did not find it very necessary to discontinue with
the case as what the AU had requested had not been answered.


Also that,,,he preferred his case to continue in his absence even if
their cases are stopped for a year.

But to say that,,now they are differing with each other,,,that is UHURU
and RUTO,,,is a
prayer,,,,

During the formation of the cabinet,,this is what CORD and friends where
waiting,,,,for that great chance where UhuRuto would disagree.

It never happened,,,now,, this one,,,once more.

The opposition and friends,,have always trained their binoculars
and microscopes,,on UhuRuto,,,to identify any crack and when
they nothing,,,,,,they try to create some,,,,unluckily,,,in their
minds.

Before this case,,we were being warned,,,eti dhoruba inakuja na ICC.

One month since the commencement,,,of this ICC cases,,we are yet to see
what was great,,in all these.

We have been entertained as in,,circus,, in that court,,,, witnesses who cannot bee
seen.

That is why i said,,,this ICC court is worse than those courts used to
be run by Mullahs of past Afghanistan.

The fifth prosecution witness Tuesday told the ICC that homesteads and farms belonging to non-Kikuyu families were marked "ODM 41" to signal to attackers which ones to spare from being burnt.


Prosecution witness 487 also told the Trial Chamber V (a) that an Eldoret businessman had provided trucks to ferry the attackers to the witness's village after the presidential election results were announced on December 31, 2007.

Before the elections, the witness said, about 50 Kalenjin youths had been taken to a bush for an initiation ceremony. The prosecution holds that there was training of the youths who were also given oaths to take part in the violence.

The witness who continued with his testimony-in-chief for the second day Tuesday said Mr Jackson Kibor was the owner of two of the trucks that were ferrying youths who attacked his village.


The number of attackers, he said, kept growing forcing non-Kalenjins to leave their homes. At one point, the witness said, they were surrounded by the youths who had taken positions on a raised ground and were only rescued when police officers on a regular patrol shot one of the attackers dead.

Question: Did you know those lorries belonged to whom?

Witness: "At that time, I did not know who the lorries (trucks) belonged to but when the things cooled, I came to know they belonged to Eldoret businessman Jackson Kibor.

Question: Did you say they (trucks) belonged to Jackson Kibor?

Witness: Yes.

Question: Did you know him before?

Witness: I did not know him before.

The witness said the trucks made a number of trips from morning until late in the afternoon, ferrying youths whose numbers kept on growing and who surrounded their village.

He also said he had started spotting the trucks in the morning of December 31, 2007. One of the trucks was white while the other was cream.

"There were no women. Most of them were youths. They were not old according to how they were jumping off the lorries," he said of the people that were emerging from the trucks.

The witness also said that after the election results were announced, non-Kikuyu homesteads and plots were marked so that the attackers could easily identify them as belonging to either Kalenjins or other communities in the location that supported ODM.

The marks were placed on the gates and nearby posts.

"The plots that belonged to non-Kikuyus were marked with sign "ODM 41". Houses that did not have the sign were set on fire," the witness said.

"That sign was written at the gate. If the plot had no gate you could see it written on the post," he added.

Judge Osuji asked: In your neighbourhood where you lived what were the ethnicities?

And the witness replied: Majority were Kalenjins, there were also Luhyas and a few Luos.

Judge Osuji: Did you see ‘ODM 41' before all hell broke loose on your neighbours' plots?

Witness: At location 2, I did not see it.

The witness said that with all the running he lost touch with some of his close relatives whom he later found at a church where they had gone to seek refuge.

Earlier, during the morning session, the witness had said that between November 27 and 28, 2007, he had spotted a number of Kalenjin youths heading to a bush for initiation.

"When they came out, I remember I saw them move towards a place that had been prepared. When they came out they put on ordinary clothes," he said.

The trial lawyer, Mr Ade Omofade, has indicated he will finish the examination-in-chief of the witness today after which the defence of Deputy President William Ruto and his co-accused, Joshua arap Sang will take over.
