Hii taasis imefanya mambo mengi makubwa, huko nyuma, lakini kwa sasa ni muhimu sana ikaangaliwa kwa jicho la karibu na la kipekee ili iweze kukabiliana na ulimwengu wa sasa. Kuna makosa makubwa yamefanyika miaka ya karibuni kwenye 'recruitment', mafunzo na hata usimamizi mzima wa maofisa wake.

Zamani, hata ungemshikia bwana/bibi usalama panga, asingekubali kuwa yeye ni mtu wa usalama. Lakini leo kuna waha vodafasta wamezagaa kila mahali, wakijigamba wanakofanya kazi. Utendaji mbovu na 'kulundikiwa' watu wasio na uwezo wa kazi, naamini unawakatisha moyo hata wale watendaji wazuri. Mwisho wa siku Taasis nzima inaingia doa.

Kwa waliokula chumvi, kuna vichaa wengi sana walikuwa barabarani wakati wa Mwl Nyerere, na tetesi ni kwamba hao watu hawakuwa vichaa, bali watu wa usalama. Hata hivyo, kutokana na ueweledi uliokuwepo kipindi hicho, ilikuwa vigumu kupata ukweli, maana watu wa usalama hawakuwa wanaongea hovyo kama hawa wa siku hizi.

Kwa sasa hivi kuna milango iko wazi mno kwa adui kuingia kwenye 'damu' ya Tanzania. Kwa ujumla vipaumbele ni vya kupitia, siasa iondelewe, na pia tusiIgeuze hii taasis kuwa kama 'wambea wa mtaani kwetu', kwamba unata watu wachunguze fulani anasemaje kuhusu nguo yangu, au baiskeli yangu?

Pamoja na siasa zetu lazima tuwe na chombo imara kinachosimamia Tanzania.
 
Sheria hii pengine imechangia ubovu wa sasa wa TISS.Mh Zitto aliwahi kukiri kujaribu kupeleka mswada wa kubadili hii sheria lakini ikatupiliwa mbali(nguvu ya wanasiasa).

Wito wangu ni tushirikiane kusaidia wapiganaji wetu hawa waweze kufanya kazi yao vizuri ili wanaposhindwa tuwalaumu vizuri.mfano tumelalamika sana jinsi mambo mengi yanavyoharibika TISS wakiangalia tu lakini tukumbuke wao ni washauri tu hawana mamlaka ya kisheria kuchukua hatua.

Inashangaza Jeshi la Polisi kuwa na meno kuliko TISS ambao ni moyo wa nchi!
 
Tatizo nadhani ni kule kutofahamika kwao, hata POLISI wangekuwa hawafahamiki, lazima tungekuwa tunaambiwa kuwa chizi fulani ni Polisi, lakini tutambue pia kuwa maendeleo ya sayansi na technolojia lazima yaende sambamba na mabadiliko ya mbinu za kiutendaji. Hivi kweli inawezakana Usalama wa taifa wakaendelea kutumia mbinu walizokuwa wakizitumia zamani? Labda siku moja wangejitokeza wakatueleza wanavyokabiliana na changamoto hii ya kukua kwa kasi kwa sayansi na technolojia.,La sivyo tutaendelea kuamini kuwa kwa vile hatuwaoni tena machizi basi na usalama wa taifa haupo.

Huu ni mfano mmoja pekee kwamba vitengo hivi lazima viendane na Technologia ya sasa, na ndiyo maana nchi zilizoendelea huchukua vijana wenye IQ kubwa na kusomeshwa na kuingizwa kwenye taasis nyeti.

Nadhani haya mawazo mazuri yanawafikia wahusika. Kuliko kuzilaumu hizi taasisi, tuwe tunazipa ushauri mzuri kama huu kwa vile hivi sasa taifa letu lina wataalamu wa kila aina hivyo tutumie taaluma zetu kuzishauri badala ya kulalamika kama wanasiasa na watu wasiyoitakia mema nchi yetu.
 
usalama wa taifa wa kiukweli ulikuwa active under the late Mwalimu -- huu wa sasa unaegemea umekuwa kama usalama wa ccm.

Kwa mfano haya mambo ya rushwa za mabilioni , udini kuchinjana kwa imani za kidini, kuchoma makanisa, ukabila, ujangiri hadi watu wanatotosha twiga nje ya nchi, madawa ya kulevya, ushirikina (kuua maarubino) nk haya yanatakiwa yashughulikiwe na usalama wa taifa.

sasa ukiona vituko kama hivi unaweza kuhoji uwepo wa taasisi nyeti kama hii.
Umesema kweli tupu. Inwezekanaje usalama wa Taifa wawe mstari wa mbele kuishauri serikali kuivunja mikutano na maandamano ya wapinzani,kwa kisingizio cha taarifa za kiintelejinsia,zinazowajulisha kutakuwa na uvunjifu wa amani,wakati huo huo taarifa zao za kiintelejensia zishindwe kubaini kuwa wapo watu wana mpango wa kuua mapadri, kama vile walivyomuua Padri Mushi licha ya vipeperushi kusambazwa sehemu nyingi Zanzibar, vinavyoeleza wazi wazi dhamira ya watu hao kutaka kuwaua mapadri?!

Inawezekanaje usalama wa Taifa ujifanye kujiapiza kuwa watawatafuta na kuwachukulia hatua watu wote waliomtumia meseji, Spika Makinda kumtaka ajiuzulu wadhifa wake wa Uspika kutokana na kuipendelea wazi wazi CCM,lakini wakati huo huo washindwe kumkamata kinara wa kundi lililomteka na kumtesa Dr Ulimboka,licha ya usalama huo wa Taifa kurahisishiwa kazi na gazeti la Mwanahalisi, kwa kuianika hadharani namba ya simu ya huyo mtu huyo ambaye ndiye aliyekuwa wa mwisho kukutana na Dr Ulimboka, na hao watekaji wa Dr Ulimboka,walimteka mbele yake huyo mtu anayeitwa Ramadhni Ighondu?!

Ni dhahiri kuwa Usalama wa Taifa hauna tena hadhi, kama uliokuwa nao enzi zile za Mwalimu Nyerere,na badala yake kwa sasa unastahili kuitwa ni Usalama wa CCM, na ushahidi ulio wa wazi ni namna walivyovuruga matokeo ya Urais mwaka 2010,ambapo hata leo hii ukiwaendea NEC wakupe matokeo ya Urais ya mwaka 2010 kwa kukutajia idadi halisi ya kura alizopata kila mgombea wa Urais,kwa kila Kata,Wilaya hadi Mkoa, nina uhakika jibu la swali hilo ukilipeka NECTA kuhakikiwa kama ni sawa, nina uhakika, Tume ya uchaguzi itaambulia 'zero' kama walivyoambulia asilimia 60 ya vijana wetu waliohitimu kidato cha nne mwaka jana!!
 
Tukiwashinikiza wabunge waliopo mitandaoni na wanaharakati wetu bila shaka wanaweza kulishawishi bunge kuiboresha sheria hii ambayo mimi naamini ni hatari kwa mstakabali wa nchi yetu hivi sasa.

Tatizo wabunge wengi wanapenda hoja zitakazowapa umaarufu kwa wapiga kura,tuanze na wabunge wa Chadema iwe moja ya ajenda bunge lijalo na specifically nimuombe mh Zitto arudishe tena hii ngoma nadhani madhara yaliyokwisha tokea yanaweza kuwa funzo kubwa kwetu na hawa wanasiasa.

Nadhani suala la mtumishi kuongelea masuala ya ofisni kwake akiwa njwi ni HULKA ya mtu na sidhani kama ni hao wafanyakazi wa TISS pekee bali hata OFISI zingine ziwe za serikali na hata binafsi huwezi kuwakosa watu wa aina hiyo. Kuna mtaalam mmoja alisema ukiona mtu anaongea sana na kujifanya anajua ujue huyo ndo hajui kitu. Ni ukweli usiopingika kuwa watu wengi ambao wanajifanya kujua sana mambo mara nyingi wanakuwa ni waropokaji tu.

mkuu nakubali kuwa ni hulka ya mtu akiwa njwii kuongelea masuala ya kazi yake after being intoxicated. hata rafiki yangu niliye mrefer alikuwa anakunywa moja moto moja baridi. lkn ilikuwa kwa nidhamu. well tunaweza sema enzi hizo bar zilikuwa chache na wao walikuwa na bar zao. lkn nchi za wenzetu ambao tunajifunza mambo kutoka kwao wameweza kudhibiti hivi vitu. why not us mkuu?
 
Sikubaliani na maoni yanayotolewa na hasa yanayotaka TISS wapewe 'meno'. Sijui ni meno gani yanatakiwa lakini nafikiri ni lazima yaambatane na objective ya taasisi hiyo. Chombo Kama hiki kazi yake kubwa ni kukusanya na kuchambua taarifa (intelligence gathering and analysis) na kuzipeleka/kushauri wahusika kuchukua hatua. Hatua zinazotakiwa zinachukuliwa na vyombo husika ambavyo kisheria vimepewa mamlaka k.m. Polisi. Nafikiri mfano mzuri soma gazeti la Raia Mwema taarifa za Chahari na tishio la usalama wake huko Uingereza. Waliopata taarifa hizo ni idara Yao ya ujasusi (MI5/6) lakini waliomfikishia taarifa na kumhakikishia ulinzi ni Polisi.

Hata hivyo ushauri ingekuwa ni sheria imlazimishe anayeshindwa kuchukua hatua kwa ushauri wa taarifa sahihi za usalama au anayechukua hatua zisizotakiwa wakati Ana taarifa na ushauri sahihi wa taasisi hii hawajibike. Ili hii iwe na maana chombo hiki kinatakiwa kiimarishwe lakini pia kitenganishwe na siasa ya kivyama.

Libebwe kuwa la kitaifa sio la umimi.

Nadhani hii ni changamoto kaka, hakika hapo umenena, lakini siamini kama ni hao TISS pekee ndo wana hiyo hullka, sasa tukisema wawe na baa zao, itabidi kila idara idara hata zile zisizo za kiserikali ziwe na baa zao kwa sababu watu wa hulka hiyo wako kotekote.

Tatizo kubwa wanalo wale wanaoamua kitu gani kitendeke au ushauri gani ufanyiwe kazi!! Watawala wa nchi yetu hawaambiliki; mara nyingi hawafuati ushauri !!! Hata katika uteuzi wa watendaji hali ni hiyo hiyo, mawaziri watapendekeza watu wanaoona wanafaa kufanya nao kazi lakini atateuliwa mtu baki kabisa ambae hakuwa short-listed!! Inawapelekea hata watoa ushsuri wawe demoralized!!
 
Bado watu hatumjui nani hasa adui yetu TISS wanalalamika wanaingiliwa na wanasiasa, Afya, Elimu, Ujenzi. Kwa ujumla kila nyanja inalalamikia siasa. Wanasiasa ndiyo walioanza kutumia vibaya nafasi zao ndipo ugonjwa huu ulipoanza kusambaa kwenda taaluma mbalimbali. Watu walianza kuhoji iweje mwanasiasa darasa la saba tu awe na maisha bora zaidi kuliko msomi kama Daktari au Mhandisi? Relative economy au equity. Wataalam waadilifu kabisa wakaanza kula rushwa na kudai mishahara mikubwa, uzalendo ukafa sababu ya wanasiasa.
Mapinduzi katika jamii ni jambo endelevu kadiri maisha yanavyoendelea kwa kuwa mtetezi wa leo akipewa madaraka hugeuka na kuwa mkandamizaji pia, hivyo kila inapobainika kuwa amegeuka sio mtetezi wa jamii tena aondolewe mara moja bila kusubiri. Anaweza kuondolewa kupitia sanduku la kura au mapinduzi ya aina yoyote ya nguvu, kamwe tusifikirie kuna siku ataona huruma.
Mengi yatasemwa kuhusu Taasisi hiyo nyeti, lakini nadhani wengi hatujui inavyofanyakazi zake unajua jambo usilolijua ni kama usiku wa giza, nakumbuka kuna kipndi fulani jamaa mmoja aliposti Kitabu chake hapa JF akielezea namna ambavyo idara ya usalama wa taifa ilivyofanyakazi zake na akatahadharisha kuwa watu tusiojua namna ambavyo taasisi hiyo inafanyakazi tunaweza kufikiri kuwa imelala jambo ambalo si kweli. Binafsi nilipenda sana ile post, sijui yule jamaa yuko wapi ingefaa atuekee tena kile kitabu hapa ili tuwe angalau tunapata uwelewa badala ya kupaki tunalalama tu.

Udhaifu huo uko CAG, TRA, THA, TAKUKURU, mawizarani, mashirika ya umma na yasiyo ya umma, makanisani; kila mtu ni kutafuta mwanya wa kutafuna mapema.

kwa hiyo wanasiasa wanatumia falsafa hiyo ya kula kula; wameiingilia TISS na taasisi nyingine za ulinzi na usalama ili ziwasaidie kulinda maslahi yao na huo ni mwanya (loophole) kwa TISS nao kufanya watakavyo kwa sababu wanaostahili kuwahold in check nao wanaharibu vivyo hivyo!! kwani TISS wao ni mifupa hawana roho na mahitaji?!

Usalama wa taifa umegeuzwa kuwa usalama wa walioshika mpini (SERIKALI); kwa maslahi ya wachache.

Watanzania wote tubadilike; tusipende taifa tulitakalo lijengwe na TISS peke yao, what is our role in the whole quagmire??!

PART 11

THE TANZANIA INTELLIGENCE AND SECURITY SERVICE

4.-(l) There is hereby established a department of Government within the office of the President which shall be known as the TanzaniaIntelligence and Security Service or, when referred to in brief, by the acronym ''TISS''.

(2) Subject to this Act, the intelligence and security department existing before the enactment of this Act shall be deemed to have been established and its employees and officers to have been recruited and appointed in pursuance of the relevant provisions of this Act.

(3) The Director-General may, with the prior written approval of the Minister establish regional and district offices of the Service.

5.-(1) Subject to the control of the Minister, the functions of the Service shall be-

(a) to obtain, correlate, and evaluate intelligence relevant to security, and to communicate any such intelligence to the Minister and to persons whom, and in the manner which, the Director-General considers it to be in the interests of security;

(b) to advise Ministers, where the Director-General is satisfied that it is necessary to do so, in respect of matters -relevant to security,so far as those matters relate to departments or portfolios of which they are in charge;

(c) To cooperate as far as practicable and necessary with such other organs of state and public authorities within or outside Tanzanians are capable of assisting the Service in the performance of its functions.

(d) To inform the President, and any other person or authority which the Minister may so direct, of any new area of potential espionage,sabotage, terrorism or subversion in respect of which the Director-General has considered it necessary to institute surveillance.

(2) It shall not be a function of the Service (a) To enforce measures for security; or (b) To institute surveillance of any person or category of persons by reason only of his or their involvement in lawful protest, or dissent in respect of any matter affecting the Constitution, the laws orthe Government of Tanzania

PART IV

DUTIES,AND POWERS OF TISS
14.-(1) It shall be the duty of the Service to collect, by investigation or otherwise, to the extent that it is strictly necessary, and analyse andretain information and intelligence respecting activities that may on reasonable grounds be suspected of constituting a threat to the securityof the United Republic or any part of it.

(2) The Service shall, in relation to the information dealt with under subsection (1), report to and advise the Government.

(3) The Service may provide security assessments to departments ofthe Government.

(4) The Service may(a) advise any Minister on matters relating to thesecurity of Tanzania; or

(b) provide any Minister with information relating to security matters.

15.-(1) The Service shall, subject to this Act, have power to investigate any person or body of persons whom or which it has reasonable cause to consider a risk or a source of risk of a threat to the state security.

(2) The Service may conduct any investigations which are required for the purpose of providing security assessments pursuant to section 14.

(3) The Servicemay, with the approval of the Minister, enter into an arrangement with-

(a) any person or body of persons;

(b) any local government or other authority; 1996

(c) Any police, force or other policing organisation.authorising the Service to providesecurity assessments.

(4) The Service may, with the approval of the President after consultation with the Minister for Foreign Affairs, enter into an arrangement with the government of a foreign state or an international organization of states authorizing the service to provide the government, institution or organisation with security assessment.

16-(1) Subject to this section no person shall, without the written consent of theMinister, publish or cause or allow to be published in a newspaper or other document, or broadcast or cause or allow to be broadcast by radio or television or otherwise, the fact that any person, other than the Director-General-

(a) is a member of the Service;

(b) is connected in, any way with a member of the service.

(2) The written consent of the Minister in relation to any proceedings in any court may be filed in the court and when so filed shall besufficientauthority to all persons to act in accordance with it.

(3) Any person who fails or refuses to comply with the provisions of this section commits an offence and upon conviction is liable to a fine not exceeding five hundred thousand shillings.

17.-(l) Information and intelligence obtained in the performance of the duties and functions of the Service pursuant to this Act shall not be disclosed by the Service except in accordance with this section.

(2) The Service may disclose information referred to in subsection

(1) For the purposes of the performance of its duties and functions under this Act or the administration or enforcement of this Act or as required by any other law and may also disclose that information-

(a) where the information may be used in the investigation or prosecution of an alleged offence under any law in force in the United Republic, to any public officer having jurisdiction to investigate the alleged ofence and to the Attorney-General or the law officer concernedwith the proceedings in respect of the alleged offence;

(b) where, in the opinion of the Minister, disclosure of the informaion to any Minister or public officer is essential in the public interest and that interest clearly out weighs any invasion of privacy that could result from the disclosure, to that Minister or public officer.

18.-(1) For the purpose of performing its duties and functions under this Act, the Service may, with the prior approval of the Minister-

(a) Enter into an arrangement or otherwise cooperate with any department or other institutions of the Government or a local government authority;Restriction on publication and broadcasting information Authorised disclosure of information Cooperation 1996 10 No. 15 Tanzania Intelligence and Security Service Protection of officers and ernployees Protec tion of sources of information Delegation of powers

(b) After consultation with the Minister for Foreign Affairs, enter into an arrangement or otherise cooperate with the Government of a foreign state or its institution or an international organization
of states or its institution.

(2) Where a written arrangement is entered into pursuant to subsection (1) of section 15(3) or (4), a copy of the arrangement shall be given to the Attorney-General.
