Tumepokea taarifa kutoka Malawi, kuwa kiongozi mpya aliyechaguliwa kwa kura nyingi katika kura za marejeo, Lazarus Chakwera, katika uchaguzi uliokuwa huru na wa haki, ndani ya saa 24, tokea aapishwe, ameondoa kinga ya kutoshtakiwa, aliyokuwa amejiwekea, kiongozi anayeondoka madarakani, Peter Mutharika.

Tunajifunza nini kwa hatua hiyo iliyochukuliwa na kiongozi huyo mpya wa Malawi, Lazarus Chakwera?

Kama Taifa tunachopaswa kujifunza, ni kuona uongozi ni kama dhamana ambayo tumepewa na wananchi, ambapo tunapaswa tujinyenyekeze kwa wananchi wote na tuwatumikie kwa usawa, hao wananchi waliotupa dhamana hiyo tuliyo nayo na tunapaswa tutekeleze majukumu yetu, kwa mujibu wa Katiba ya nchi yetu, bila kuwaonea raia kwa kutumia vyombo vya dola, ambavyo tunaamini kuwa sisi ndiyo tunaovimiliki.

Viongozi wetu pia wanapaswa waache mara moja tabia wanayoiendekeza ya kila kukicha, kupeleka Bungeni miswada mipya ya sheria za ukandamizaji na kujiwekea kinga ya kutoshtakiwa, kama vile wao ndiyo watakaodumu milele madarakani!

Wanapaswa pia kufikiri upya, kama hatua yao ya kupeleka muswada kwa hati ya dharura, kwa viongozi kama vile kuwawekea kinga ya kutoshtakiwa, Spika wa Bunge, Waziri Mkuu na Jaji Mkuu, kama uamuzi huo ulikuwa wa busara.

Ni lazima tujue kuwa ukandamizaji unaozidi kupita kiasi hapa nchini, hautadumu milele, kwa hiyo ni vyema viongozi wetu wakatekeleza majukumu yao kwa haki na kwa mujibu wa Katiba ya nchi, kwani ndiyo kinga pekee ya kudumu, itakayowaacha salama, hata watakapotoka madarakani.

Hujabalance stori yako. Ni kweli amemuondolea kinga Rais aliyepita, lakini ajabu kajiwekea yeye hiyo kinga kisa yuko madarakani. Na ajaye baada yake anamsubiria! Ahahahahahah!

Ikiwa ni chini ya saa 24 tangu kuapishwa kwake, Rais mpya wa Malawi, Dkt. Lazarus Chakwera amemuondolea kinga ya kutoshtakiwa aliyekuwa Rais wa taifa hilo, Peter Mutharika ili aweze kushtakiwa.

Vilevile, ili kuhakikisha kuwa mizizi ya utawala katili uliojawa na rushwa uliopita inang’olewa na kuondoka kabisa serikalini, Rais Chakwera amemtimua kazi Mkuu wa Jeshi la Polisi nchini huko Duncan Mwapasa na kumteua Inspekta Jenerali Dkt. George Kainja kuchukua nafasi hiyo.

Rais Peter Mutharika hakupata muda wa kufuta baraza lake la mawaziri ingawa alitakiwa kufanya hivyo siku chache kabla ya uchaguzi kama ambavyo katiba ya Malawi inamtaka kufanya. Mawaziri waliokuwa katika baraza lake wametakiwa kurudisha mali zote za serikali wanazozishikilia ikiwamo magari waliyopewa na serikali kufikia siku ya kesho kabla ya saa tano asubuhi.

Wakati huohuo, kutakuwapo na mabadiliko makubwa katika Mamlaka ya Mapato ya Malawi yanayotarajiwa kufanywa na Makamu wa Rais Dkt. Chilima ikiwa ni juhudi za kukabiliana na rushwa katika ofisi kubwa za serikali.

Former president Peter Mutharika has been stripped of his immunity from prosecution and that he can now face charges, a law expert has said.

University of Malawi’s Chancellor College dean of law Sunduzwayo Madise said following legal ritual of new leader Lazarus Chakwera being sworn in as President of Malawi after winning an election rerun, the immunity has been inherited by Chakwera while Mutharika has lost it.

“And just like that by operation of the law the immunity that the former president had against prosecution and suits is gone,” Madise wrote on his Facebook wall.

Saulos Chilima, the vice-president, during Mutharika regime and remains in that position as Chakwera’s deputy, accused Mutharika of high-level graft.

Mutharika’s Democratic Progressive Party (DPP) officials were involved in numerous graft scandals including former minister Ben Phiri and Chief Secretary to government Lloyd Muhara.

With law degrees from the University of London and Yale, Mutharika left Malawi in the 1960s to settle in the United States.

He returned to the country in 1993 to help draft its first democratic constitution after the fall of Hastings Banda’s dictatorship.

Mutharika went back to the US but returned home in 2004 when his brother came to power, serving as his informal advisor.

A widower for 30 years, Mutharika has three children. In 2014 he married his second wife Gertrude Maseko, a former member of parliament.

Mutharika has been defeated by Chakwera who secured the required majority, with 58.57% of the vote, the electoral commission said.

Early career
Mutharika received his law degree from the University of London in 1965. He then received his LL.M and JSD degrees from Yale University in 1966 and 1969 respectively.

As a professor, he has taught at University of Dar es Salaam (Tanzania), Haile Selassie University (Ethiopia), Rutgers University (USA), the United Nations Institute for Training and Research Program for Foreign Service Officers from Africa and Asia at Makerere University (Uganda), and for 39 years at Washington University (USA), and has served as an Academic Visitor at the London School of Economics (UK).

He also served as advisor to the American Bar Association's Rule of Law initiative for Africa. He was also the chair of the Institute for Democracy and Policy Studies in Malawi.

US citizenship controversy
Peter Mutharika's candidacy for position as a government minister and his eligibility for presidency had been controversial because of speculation and doubt over his Malawian citizenship.

A senior Political and Administrative lecturer at the University of Malawi, Mustapha Hussein has stated that his "eligibility should be viewed in the context of his being Malawian, he would be above 35 years of age by 2014, and he has not been convicted of any criminal activities for the past seven-year.".

Malawi's laws however, do not allow dual citizenship and it is widely speculated that he obtained US citizenship whilst living in the US and hence, had renounced his Malawian citizenship as is required by law.

Nonetheless, the US embassy in Lilongwe confirmed that he is not a citizen but a Green card holder. The ruling DPP has stated that Mutharika is a Malawian citizen and would run for president as a Malawian citizen and not an American one. There was controversy that, as the holder of a US Greencard, he owes an allegiance to the United States. Therefore, people on the street are of the view that a nation cannot be run by someone who will be spending the minimum of three months in the US annually required to retain permanent resident status. In February 2014, he relinquished his green card and permanent resident status.
