Bandari ya Zanzibar imeshapita IGA na Oman kwa sasa ni mikataba ya HGA

Zanzibar hamuisikii ikiongelewa kwa kuwa yanayofanyika Zanziba sasa hivi ni tayari wapo hatua za utendaji. Mikataba imefikia hatua za kibiashara, siyo IGA tena.

On January 28, Tanzania’s Zanzibar and Oman Investment Authority signed a memorandum of understanding on Thursday to implement a port master plan on the Indian Ocean coastline of the archipelago. The agreement calls for the development of major ports in the coastal areas of Mangapwani and Bumbwini in the Zanzibar Islands.

According to the memorandum, the two parties will cooperate to build a large modern port in Mangapwani, about 25 kilometers north of Malindi Port on San Island, for loading and unloading containers, general cargo, and oil and gas.

Mwini said that this is a major measure taken by the San government to develop the blue economy. It will develop San into a commercial and tourist center in East and Central Africa through the construction of necessary infrastructure in the future. He instructed Sang's relevant government departments to immediately conduct a feasibility study on this multi-billion-dollar project and make sure to make it a success. He also said that the Sang government will retain the plan of the previous government to build a new port in Mpiga Duri (about 3 kilometers north of Malindi Port) and build the port into a fishing port. The existing Malindi Port will be transformed into a special tourist port.Editor/Huang Lij

Serikali bado inaongelea faida za IGA zaidi kuliko madhara yaliyomo kwenye baadhi ya vifungu vya IGA ambavyo kama mikataba ya utekekezaji (HGAs) itaandaliwa katika misingi hiyo. Na kwa kuwa hiyo mikataba ya utekelezaji inabaki siri, kwa nini tusiwe na mashaka?

Kwa vyovyote vile, wenye mawazo kama mimi, tumetia shaka, pamoja na dhamira nzuri ya Serikali, ikitokea kuna sababu za kusitisha mkataba Kifungu cha 23: Muda na Utaratibu wa Kusitisha Mkataba, kina ukakasi. Ukinieleza ukweli wa hicho kifungu, kwa maslahi mapana ya kitaifa, utakuwa umeniweka huru.

Kifungu kidogo cha 4. Nchi Wanachama hazitakuwa na haki ya kushutumu, kujiondoa, kusimamisha au kusitisha Mkataba huu katika hali yoyote, hata ikitokea ukiukwaji wa mkataba (material breach), mabadiliko ya kimsingi ya hali, kuvunjika kwa uhusiano wa kidiplomasia au kibalozi, au sababu zingine zozote zinazotambuliwa chini ya sheria ya kimataifa. Bila kujali yaliyotajwa hapo juu, mgogoro wowote kati ya Nchi Wanachama kuhusiana na hali kama hizo utashughulikiwa kulingana na mahitaji ya Ibara ya 20 ya Mkataba huu.

Ni nini maana ya material breach?

Kifungu cha 20 kinahusu Utatuzi wa Migogoro, Kifungu kidogo cha 3. Migogoro chini ya Mikataba ya Mradi na HGAs pia itatatuliwa kupitia usuluhishi wa kimataifa katika ukumbi na kiti kisichoegemea upande wowote..

Kifungu kidogo hicho ni kinyume na Kifungu cha 21: Sheria itakayo ongoza Mkataba huu itakuwa Sheria ya Uingereza ambapo sheria ya uongozi wa kila HGA na Mikataba ya Mradi husika itakuwa ni kwa sheria za Tanzania

Kifungu Cha ishirini, kimechagua Sheria ya usuluhishi wa Uingereza kwa sababu mkataba huu ni "wa nchi na Nchi" hivyo huwezi kuamini kutumia Sheria ya Nchi mojawapo kutattua migogoro yenu maana hizo Sheria zaweza kubadilishwa mda wowote. Hivyo Nchi mbili zinaamua kuwa Ikitokea tumegombana basi muongozo wetu wa utatuzi uwe kwa mujibu wa Sheria ya Nchi nyingine (Uingereza).

. Aidha, "mikataba yote ya utekelezaji" itakayofuata, hiyo wamekubaliana iongozwe na kusimamiwa na Sheria za Tanzania.

Such contracts as they involve huge investments, its not easy for the parties involved to reveal the time frame. As transparency can jeopardize their venture.

The norm on long term investment ventures is between 33-99 Years but It on

The land lease for commercial or farming lands can be anything between 33, 66 or 99 Years.

Zanzibarthey are on HGA stages now. Dubai with us wwe are on a second stage preparation for third.

1st stage was MoU, 2nd stage is IGA, 3rd Stage is HGA 4th stage are implementation contracts.
