PART II : GENERAL PRINCIPLES, 6.0 General Conditions for use of FORCE ACCOUNT
6.1 The conditions that may justify the use of force account by procuring entity shall be those enlisted under the provision of Section 64(5) of PPA, 2011 and Regulation 167 (1) of The Public Procurement Regulations, 2013 as amended respectively. These shall include any of the following: a) The works are small, scattered and in remote location for which qualified construction firms are unlikely to tender at a reasonable price;

Siye wajuvi wa masuala ya ujenzi tulionya na kuonya, tukaambiwa tunatetea ulaji wetu.
Kuna wawakilishi wetu tuliwatuma hadi Bungeni kupinga Force Accout , lakini walibezwa kuwa makandarasi ni mafisadi wa fedhe za umma.

Sasa kazi nyingi zilifanywa kwa spidi kubwa kwa kumtumia fundi Maiko.
Madudu sasa yanaonekana wazi kwa kupata kazi iliyo chini sana katika viwango, na fedha kuliwa vibaya na wasimamizi na mabosi, kuanzia ma DED hadi Madaktari na waalimu.
Kuna waliofungwa, kama yule mwalimu huko Musoma, na wengine kesi zao ziko Mahakamani na zingine kuendelea kuchunguzwa na TAKUKURU.

Tatizo kubwa ni wanasiasa kujifikiria wana akili kubwa kuzidi zile time tested project administration methods na procedures.

Sasa hela za serikali zimeliwa na wajanja kwa vile supervision systems za kifedha na kiujenzi ni very very poor au hakuna kabisa!

Sasa hivi hata Waziri Mkuu kachoka, anatembelea miradi pamoja na TAKUKURU ikiwepo, kila mradi ni madudu ya kutosha.

-Waziri Mkuu alitembelea mradi wa hospitali huko Songea. milango ilikuwa haifungi-fundi Maiko huyo na daktari kachukuliwa na TAKUKURU
-Huko Tabora , VETA, jengo la mlinzi milioni 11, msimamizi kachukuliwa na TAKUKURU
-Huko Katavi juzi nyaraka zimechomwa moto kuficha ulaji baada ya kumtumia fundi Maiko, TAKUKURU wamepewa kibarua
-Huko Tanga Mkuu wa Mkoa kawapiga wanted ma DED wawili kwa kufanya kazi na fundi Maiko na jengo likawa ndivyo sivyo, TAKUKURU wameitwa
-Huko Ruangwa, kazi ya fundi Maiko, jengo halina madirisha wala milango, Ths 75 million imaeliwa, TAKUKURU wamepewa kazi
-Huko Ikungi fundi Maiko kajenga jengo la Tsha 500milion ndivyo sivyo, DC kawapeleka TAKUKURU
-Huko Mwanza Mkuu wa Mkoa kawaita TAKUKURU, jengo la abiria, uwanja wa ndege kujengwa chini ya viwango na kusua kusua, hela imeliwa, fundi Maiko anachekelea

Kwa sababu hata hawa wanasiasa wetu haawajui waende wapi wa kukiuka taratibu za ujenzi, inabidi wakumbushwe kuwa TAKUKURU hawana muarobaini wa namna ya kurekebisha taratibu zilizopindwa katika ujenzi

Na kosa kubwa ni hao hao wanasiasa.

Force Account kwa kumtumia fundi Maiko imeleta hasara kubwa sana kwa Taifa.


Tunaiomba serikali, hasa wanasiasa, wadhibitiwe na sheria zinazohusu sekta hii ya ujenzi.
Bodi husika za Wizara ya Ujenzi, CRB. AQRB, ERB, NCC zina kazi kubwa kuwaelimisha wanasiasa wanaoingilia kiutendaji uendeshaji wa sekta ya ujenzi.
ni muda muafaka wa Serikali kufanya tathmini ya Miradi iliyotekelezwa kwa Force Account kwa kuangalia kama utekelezaji wa njia hii una tija.

Force account ni njia nzuri ya utekelezaji wa miradi ya Serikali ila bado kuna mapungufu mengi yanayotakiwa kuboresha kutokana na Siasa kuingilia kati na kuweka taaluma pembeni. Hivyo, kufanya wataalam kutekeleza miradi kwa kutokufuata taaluma yao.

Baadhi ya changamoto:-

Miradi mingi kutekelezwa kwa kupangiwa muda wa utekelezaji kutoka kwa viongozi wa juu wa kisiasa bila kuzingatia taaluma. Hivyo, kufanya majengo kujengwa kwa kuharakishwa, wakati jengo linapigwa lipu kesho yake kazi ya skimming inaanza kitu ambacho ni kinyume na taaluma na yote ni kuhakikisha miradi inakamilika kwa kufuata Muda uliopangwa na siyo kuzingatia ubora unaotakiwa na kuogopa kukosa kazi.

Majengo kujengwa kwa kutokuzingatia mchoro. Mchoro ni mmoja ila ujenzi ni tofauti mwingine kalaza tofali, mwingine kasimamisha tofali wakati ukizingatia aliandaa hiyo michoro alizingatia ubora wa jengo na kudumu kwake.

Ukipita uku unakuta ujenzi umejengwa kwa kuweka nondo katika nguzo mlalo lakini mwingine kajenga kwa kumwaga zege la kawaida bila nondo na wote wamekamilisha kazi ila ubora ndo umetofautiana.

Makisio kuonyesha unatakiwa kuweka vigae vya aina fulani lakini ukitembelea miradi mingi vinawekwa vigae ambavyo haviendani na makisio kwa lengo la kupunguza gharama wakati aliyeandaa vyote hivyo alizingatia ubora na kuduma kwa majengo hayo.

Utatuzi wake

Kufanyika kwa tathmini kwa Miradi yote iliyotekelezwa kwa Force Account kuona kama utekelezaji huu unatija na kama hauna tija wapi kwa kuboresha ili uwe na tija zaidi na kuhakikisha miradi yote inayotekelezwa inaendana na ubora unaotakiwa na kusudiwa.

Kuhakikisha mafundi na vibarua wanaotekeleza miradi hii wanapatiwa elimu namna ya kutekeleza miradi ya Serikali kwa kuwajengea uwezo.

Wataalam wanaosimamia Miradi watekeleze wajibu wao kwa kufuata taaluma ili Fedha zote zinazotolewa na Mhe. Rais Samia Suhuhu Hassan ( kodi za Watanzania) matunda yake yaonekana kwa kuwa na majengo imara na yatakayodumu kwa miaka zaidi ya 50.

Wataaam wanaosimamia Miradi wapewe usafiri wa uhakika ili kuhakikisha wanasimamia miradi kwa karibu na pasipo mkwamo wowote.

Idara za Ujenzi zilizochini ya Mkurugenzi ikiwezekana ziboreshwe kwa kuhakikisha Wataalam wote wa ujenzi wanakuwepo na wanapewa vitendea kazi.

(3) Upon satisfying the provisions of subsection (2), the procuring entity shall seek approval of the Government Procurement Services Agency before proceeding on with the procurement. (4) For the purposes of this section, the Minister shall make regulations providing for emergency procurement and on how best quality and value for money would be ensured. (5) The procuring entity shall apply the procedures stipulated in the regulations made under this Act for any procurement undertaken pursuant to the provisions of subsection (1). (6) Where the procurement meets the requirements of subsection (1), the conditions relating to procurement limits, methods, tender processing periods and advertisement may be waived except that conditions relating to tender evaluation and obtaining approval of the tender board shall not be waived.

(3) Upon satisfying the provisions of subsection (2), the procuring entity shall seek approval of the Government Procurement Services Agency before proceeding on with the procurement. (4) For the purposes of this section, the Minister shall make regulations providing for emergency procurement and on how best quality and value for money would be ensured. (5) The procuring entity shall apply the procedures stipulated in the regulations made under this Act for any procurement undertaken pursuant to the provisions of subsection (1). (6) Where the procurement meets the requirements of subsection (1), the conditions relating to procurement limits, methods, tender processing periods and advertisement may be waived except that conditions relating to tender evaluation and obtaining approval of the tender board shall not be waived.
