JOHN Heche: Correct
Nassoro Katuga: You told this Court that when Lissu was visiting stakeholders, he did not say a word encouraging rebellion

Nassoro Katuga: If there is a witness, he said that Lissu used the word rebellion when he met stakeholders
John Heche: Ask me my evidence, I will answer you, do not ask me anyone else's evidence, but the answers I gave are correct.
Nassoro Katuga: It is your evidence that the words we will encourage rebellion and you said that he did not use the word we will encourage rebellion

John Heche: You're telling me that, I don't know.
Nassoro Katuga: Do you know or not that when a politician loses, he doesn't accept it easily?
John Heche: We [CHADEMA]are a democratic party, if you lose you go home.
NASSORO Katuga: Tell the judges if you really went home when you lost?
John Heche: The election was not free and fair
Nassoro Katuga: So you are telling this court that if you lose and go home, it depends on the type of election?
John Heche: Elections are just one of many stages in the whole electoral process, and the Court said that an election that is not free and fair is not an election.
Nassoro Katuga: Did you accept or reject the 2015 election you won?
John Heche: I accepted it even though it had many mistakes.
Nassoro Katuga: Were the elections in your constituency free and fair?

John Heche: I forced the announcement and the election was not free and fair and this country has never had free and fair elections.
Nassoro Katuga: If you were a fair person and not a hypocrite, would you have had the power to refuse or accept being published? Is it a pepepe
John Heche: Explain the meaning of pepepe
Nassoro Katuga: pepepe is word of mouth

John Heche: Correct.
Nassoro Katuga: What law did the Butiama candidate break to join and run for CCM?
John Heche: According to CCM's procedures, you cannot run if you have not been a member for more than five years, so he joined CCM straight away as the Director of the Commission [INEC].
NASSORO Katuga: Is it correct that CHADEMA's position meant that the elections should be moved forward with changes?
JOHN Heche: That's right.
Nassoro Katuga: What law did you explain that allows elections to be brought forward?
John Heche: I didn't explain.
Nassoro Katuga: Is it true that you, Lissu, and Lema went to Kenya to see Raila [Amolo] Odinga?

Nassoro Katuga: Don't you know germs today?
Nassoro Katuga: Yesterday you told the judges that in the video we showed you, was the photo of you or not?
John Heche: Now if the video isn't mine, how can the picture be mine?
Nassoro Katuga: According to the charge Sheet , is the government's in fear or lack of fear not a criterion for the crime of treason?
John Heche : I don't know.
Nassoro Katuga: After your party Chairman was chsrged with this case, you continued your intention to prevent the election
John Heche: Our party's [CHADEMA] position has been the same since 2024, our position is No Reforms, No Elections.
Nassoro Katuga: Do you remember that through the media you said the 2025 elections would not be held and that you were determined?
John Heche: I don't remember.
Nassoro Katuga: Is it true or not that you met with religious leaders to prevent the elections?
John Heche: It's true.
Nassoro Katuga: Did you ever make a statement through East African Radio EA RADIO to inform the public that the 2025 elections will not be held?
JOHN Heche: I've been there so many times I don't remember what you're saying.
Nassoro Katuga: Since you don't remember, are you willing to be reminded through that video?
John Heche: My position is the same as yesterday, that I am not ready because you may have fabricated and often framed cases against people.
Nassoro Katuga: If I say you're not ready because you know the truth, will I be right?
John Heche: I'm not ready because you bring fake things.
Nassoro Katuga: With the consent of the court, I request to show the witness DW5 the video.
Hon. Tundu Lissu : OBJECTION : Honourable judges, the prosecution is not alone in this case. I request that the government attorney not be allowed to remind the witness DW5 because the witness is the one who should request to be reminded of the words he said or wrote before, this is the effect of Section 177 of the Evidence Act. Honourable Judges, if the prosecution wants to use what they have to cross examine the witness DW5, they must follow the procedure of Section 63 as stated in the famous case of Lilian Fortes. Therefore, their request has no legal basis.
Judge DUNSTAN Ndunguru: He is deliberating with his fellow judges for about 7 minutes, let's see what they will decide.
Judge Dunstan Ndunguru : [asks] the prosecution what they say?
Nassoro Katuga: We have heard the objection of the accused [Tundu Lissu]. What is happening now is cross examination and its importance is under section 164 of the Evidence Act which talks about knowing the witness and another to shake the credibility of a witness.
Section 156 of the Evidence Act states that examination in chief must focus on relevant facts and not on cross examination. The witness DW5 has said he does not remember and does not want to be reminded, therefore section 177 is irrelevant.
Section 422
The Republic continues to cross-examine CHADEMA Vice Chairman Mainland John Heche witness DW5
State attorney Nassoro Katuga.: [continues to say] Your Honors, this witness DW5 asked the Court to remind him about the documents and he was reminded. Our cross examination concerns the documents that we have and yesterday we questioned him about the motocar registration cards and there was no objection, section 177 is not applicable here. Also, honorable Judges, you have given this procedure to the decisions yesterday, so you cannot give a decision twice, there will be contradiction. Even during the examination in-chief witness DW5 was shown several reports and he discussed them.Honorable Judges, we have been using this procedure in practice, so we request that we be allowed to continue with cross examination.
HON TUNDU Lissu: Your Honours, the arguments of the state attorney are baseless, he says they are using section 164 of the Evidence Act, it does not allow them to do what they want to do, the section talks about lawful questions during cross examination, it does not talk about how to remind a witness of his previous statement. If you want to remind a witness of his previous statement be it electronic or document you go to section 177, the argument of the government attorney is completely out.
HON. TUNDU LISSU (continues] The State Attorney has said that he is using section 156(2) to say that he can ask any question, this is not an argument, the argument is that you cannot remind a witness under 156(2), if you want to remind a witness you go to 163 or 177, so what he wants to do is completely disallowed.
HON. TUNDU LISSU [continues] The State Attorney has said that this happened yesterday, there was no objection, and that the court issued a decision yesterday. Now if he says there was no objection, then what was the ruling based on? Something like this did not happen yesterday and there was no ruling. The State Attorney has said that it is a matter of practice and not law. Honorable judges, it is a matter of law and not practice.
Relevant provisions ni Section 177 au 163 of the Evidence Act kwahiyo sio suala la practice it is a matter of law
Judge DUNSTAN Ndunguru: We have reviewed all the arguments, section 177 does not state that a witness DW5 shall request to be reminded, so it is appropriate to remind him so that he can answer, so we direct that the witness be reminded.
NASSORO Katuga stands up and plays a video of East Africa Radio
Nassoro Katuga: Does what you speculated have any evidence similar to the evidence you provided yesterday?
John Heche: In what area?
Nassoro Katuga: Is there really evidence of meeting with religious leaders?
John Heche: Correct.

Nassoro Katuga: There are words saying you are determined?
John Heche: There is.
Nassoro Katuga: In your understanding, between the Penal Code and the Constitution, which one creates criminal offenses?
John Heche: I am not a lawyer.
Nassoro Katuga: When you were saying, I do you know?...
John Heche: Don't talk to me like I'm your child, stop the nonsense and harassment.
Judge Dunstan Ndunguru: Let's continue.
Nassoro Katuga: When you were answering during the examination inchief, did you know it was by law?
John Heche: I spoke to my upmost best knowledge.
Nassoro Katuga: It is true that you wanted the Commission to have the authority to demacate constituencies.
Section 423
The Republic continues to cross-examine CHADEMA Vice Chairman Mainland John Heche DW5.
JOHN Heche: INEC is not independent, how can a Commission that is appointed by a CCM member who is also running for elections as presidential candidate be independent? I said the new Commission INEC that will be formed should be independent, don't come with your answers
NASSORO Katuga: Who demacate the electoral constituencies?
John Heche: The process starts at the district council level.
Nassoro Katuga: Read Article 75(3)?
John Heche He is studying.
Nassoro Katuga: Should judges read Article 75(4)?
John Heche: [He reads] that the Commission INEC can demacate new constituencies based on population.
Nassoro Katuga: Is it true that under those articles the Commission INEC can divide constituencies based on population?
JOHN Heche: That's just one of the criteria.
Nassoro Katuga: Is it right or wrong for anyone who listened to the Chairman's speech to choose their own way to interpret the Chairman's speech?
John Heche : I don't know.
Nassoro Katuga: Is it fair or unfair for anyone inspired by the Chairman's speech to choose their own path and use any means to disrupt the election?
John Heche : I don't know.
Nassoro Katuga: Is it fair or unfair for anyone who listened to the Chairman's speech to choose their own path to reject it?
John Heche: I don't know.
Nassoro Katuga: Is burning polling stations and their equipment, is it a way to prevent elections?
John Heche: It's not the way.
.......
Nassoro Katuga: Tell the judges that burning tyres, petrol stations can disrupt the peace
John Heche: I don't know
Nassoro Katuga: Tell the judges on voting day if there is chaos that cannot be prevented, can it prevent voting?
John Heche: I don't know
Nassoro Katuga: Tell the judges that cutting off the fingers of people who volunteered to vote on elections day can scare other people from going to vote
John Heche: I don't know
Nassoro Katuga: Then you call yourself a witness?
John Heche: Yes, you are a witness, you are a lying lawyer who is accusing people of false cases.
Nassoro Katuga: Did you explain to the judges in your testimony that you will prevent the election in what way?
John Heche: Yes, I explained that we will visit religious leaders.
Nassoro Katuga: To prevent the election, do you meet with religious leaders?
John Heche: Because elections are made by spirits? Not people?
Today Katuga is receiving a sticks .
Nassoro Katuga: Is it true or not that burning polling stations is the definition of rebellion?
John Heche: Not true
Nassoro Katuga: What does rebellion mean?
John Heche: to oppose oppressive systems, bad laws and all evils in the country
Nassoro Katuga: Who are the ones supervising polling stations ?
John Heche: The Electoral Commission INEC Tanzania
Nassoro Katuga: Answer again,
John Heche: I have said, I have said, I have said.
Judge Dunstan Ndunguru: We have heard the witness say that it is the Electoral Commission INEC / NEC
