Jesus Jesus Jesus… kuna nn TPA? Yaani TPA wanashindwa ku run hii bandari kweli? Tushapigwa tena na tena, Indians sio kabisa aisee, TPA nilijua walisema watafanya kazi hiyo kwa ufanisi wao wenyewe, kumbe wanaleta TICTS nyingine tena mhindi? Jamani jamani, kuna nn? Kama wamemleta muhindi basi tena tukubali tumeshapigwa. Muhindi hajawahi kufanya uwekezaji kwa faida ya nchi hii hata siku 1 nina uhakika 100% kuanzia hapo TPA mpaka magogoni rushwa imetembea. Hivi kweli mkurugenzi TPA upo serious na hii kazi kweli? Unamleta muhindi? Hii nchi ina laana haki ya mungu

Imenibidi niwafikirie hawa kwanza, ili kuondoa wasiwasi wako katika mambo tunayopishana, kwa sababu ni bora ya hawa kuliko hao wahindi.

Binafsi ningeuliza inakuwaje, miaka zaidi ya 20 ya TICTS, TPA haikuweza kamwe kujiandaa kuwa na uwezo wa kuendesha hiyo sehemu kwa ufanisi.
Sasa haya ndiyo tuyaite maendeleo ya nchi baada ya uhuru? Tunahitaji miaka mingapi zaidi ili tujijengee uwezo wa kuendesha shughuli zetu vizuri?

Hii nchi kunawatu wanaamua kwa maslahi yao tu na hawajali chochote.

Linafanyika katika nchi nyingi zenye bandari kuingia ktk treaties (mikataba maalum) na zile nchi zisizo na bandari kwa namna hii uhakika wa mzigo na meli upo pia treaties hizo haziingiliwi na nani rais/ waziri mkuu yupo madarakani au mabadiliko ya viongozi wa kisiasa.

Ni sisi tu nchi za kiafrika tunaendekeza uzalendo uchwara kuwa na choyo huyu fursa hiyo ya biashara ikiwa haitumiki.

Ethiopia and Eritrea. As a condition of Eritrean independence, landlocked Ethiopia negotiated transit rights through the Eritrean port of Assab.
The exceptions to this rule of strong power seeking transit rights from a weaker power are Bolivia, with transit rights through Peru (but transit rights are denied Bolivia through Chile) and Paraguay through Argentina. In Africa, with the exception of Ethiopia, the landlocked countries have had their transit rights negotiated for them by their former colonial masters. In Asia, Afghanistan had its transit rights "grand-fathered," after 1947, through Pakistan and Iran, but mostly through Pakistan. Mongolia had transit rights negotiated on its behalf by Stalin's Soviet Union. In Europe, only Luxembourg and Liechtenstein are truly landlocked. Luxembourg borders on Belgium and access is through the Belgian port of Antwerp. Liechtenstein uses the Swiss highway system. Switzerland is only half landlocked. The Swiss transit rights are guaranteed through Italy and Germany. Basel, the major industrial city of Switzerland, is on the River Rhine and heavy cargo barges move straight through, via Germany, to Rotterdam, the Dutch port on the North Sea. Austria, Hungary and the former Czechoslovakia use the River Danube as their major arterial for heavy cargo. Armenia, because of hostilities between Russia and Georgia in August 2008, now uses the road link through Turkey.
The second rule of transit treaties is that once they are signed and the infrastructure is in place, transit rights can never, ever be denied. Transit treaties are "in perpetuity." There are no "sunset clauses" in the treaties. Any kind of national emergency in the transiting country or even the hint of political instability in the host country can be used by the transiting country to legally seize the transit land, rivers and port infrastructure and claim "extra-sovereign" rights to protect its rights under the transit treaty. The host country has no legal recourse, whatsoever.
The transiting country can also use the threat of "enlarging" its rights under the original transit treaty, propose lowering of future transit fees under the guise of "seeking efficiencies," "streamlining," "cutting red-tape" and so on, and seek to portray any slow down or mild resistance in the negotiating process as "malafide intent" by the host country or "negotiating in bad faith" by the same. This would, under exceptional circumstances, once again, trigger the potential seizure of transit land, rivers and port infrastructure and give rise to claims of "extra-sovereign" rights. Under international law, the host country can do very little about it. Examples to substantiate this rule abound:

-Serikali/TPA ilipaswa kuandaa vijana wetu wa kitanzania ambao wamehitimu kwenye vyuo vya mbalimbali na hawana ajira miaka 10 iliyopita,
-Vijana wangepewa mafunzo ya manejimenti na uongozi au utawala wa masuala ya bandari.
-Vijana hawa wangekuwa attached kwenye bandari mbalimbali kubwa huko duniani kupata uzoefu kuhusu masuala ya management na uhandisi wa mitambo ya bandari.
-Ninashauri, Serikali au TPA,ingechukua mkopo kutoka taasisi za fedha za nje au ndani kwa ajili ya uwekezaji/kununua vitendea kazi vya kisasa na kutoa mafunzo kwa watumishi,jinsi ya kuvitumia vifaa hivyo.
-Faida ya Uwekezaji huo,ni kuondoa au kupunguza changamoto ya ajira kwa wahitimu wetu, Serikali au TPA kuongeza ukusanyaji wa mapato ya kulipa mkopo, watumishi,na Pato kubwa kwa Serikali.
-Hiyo Kampuni ya India,italeta wahindi kwenye Management,wa kusimamia interest zao/ watanzania wenzetu kitwana,
- Ni nadra kampuni ya India kuwekeza kwenye miundo mbinu,kama watawekeza wataleta mitambo iliyotumika kwenye bandari zao za nje.
-Tanzania itakuwa dumping place,tuliona mkataba na kampuni ya India ya RITES na TRC walileta mabehewa yaliyotumika na mtaji waliupata hapahapa Tanzania,it was a shame and this is going to recur,if the Government is not going to be Keen.
-Kama Serikali/TPA itasisitiza kuendelea na mpango wa kukodisha and kwenye kampuni ya India,tahadhari zichukuliwe kwenye vipengere vya mkataba, suala la uwekezaji miundo mbinu iliyotumika lipigwe marufuku na masuala yote yatakayo ahidiwa kwenye mkataba yatekelezwe kwa muda mwafaka.
-Mwekezaji atatumia mkataba huo kama collateral kukopa fedha kwenye mabenki yetu au mabenki ya India.
-Mkataba wa ukodishaji wa Berths hizo 4-11 upitiwe na bunge letu kwa niaba ya wananchi,tumechoka kupigwa na watanzania wenzetu ambao hawana uzalendo na huruma kwa watanzania wenzao.
-Serikali inakwama wapi, hatuna watalaam au tamaa za watu binafsi.

Malawi pia wanayo inaitwa Malawi Cargo, ila kama tunavyolalamikia wa kwetu, na wao wameshindwa kuzitumia ipasavyo. Yamebaki magofu....

Inawezekana kuna tofauti na hilo la "Transit" kama ulivyolizungumzia hapo; na jinsi mimi nilivyokuelewa mwanzo.

Hii "transit treaty', bado hao majirani wataitegemea TPA na uozo wake hadi mizigo yao ifikishwe kwenye vituo vyao.

Mimi nilidhani wazo lako ni la kuwaruhusu hawa majirani, pengine kuwa na ghati zao maalum kwenye hiyo hiyo bandari inayoshughulikia mizigo yao na kuimiliki na kuiendesa sehemu hiyo, mbali kabisa na kuingiliwa na mamlaka ya TPA.

Na kama hilo haliwezekani kutokana na ufinyu wa bandari, basi tukubaliane kuwekeana mikataba, wajenge bandari zao wenyewe ambazo meli zitakuwa zikishusha mizigo hapo, na wao wakiwa ni wamiliki wa maeneo hayo na kuyaendesha wenyewe kwa ufanisi wanaoona wanao; kuliko kuendelea kuwategemea TPA.

Ninaelewa kuna maswala mengi yanayoweza kuzuia hili, lakini nadhani panaweza kuwa na majadiliano kuyatatua maswala hayo na kuyaweka kwenye mikataba ya makubaliano awali ya yote.
