Bado tatizo mama ni katiba yetu hasa katika kuwajibika kwenye mambo ya msingi.Utawala wa nchi unapowekwa kwenye 'auto pilot' ya hawa jamaa na katiba yenye mrengo wa chama kimoja huzaa 'miungu watu'.Hawa hupambana na yeyote anayekosoa Dola au kuchagiza mabadiliko ya mfumo.Huweza kwenda mbali zaidi na kuweka rehani rasilimali za nchi na maisha ya watu,kuunda magenge hatari na kuwaweka madarakani viongozi wanaowataka. Hatuikatai nadharia ya 'Dola bila upanga si Dola' lakini iwe kwa maslahi mapana ya nchi badala ya kikundi kidogo cha watu.

Watu wenye credit mara zote hufungwa na credit hizo kusema wanachofikiri. Jina la Kiranga sijalichagua bila kituo, lina maana kubwa sana. Kiranga hawezi kuwa na credit, credit haitaki Kiranga. Kama ulifikiri napenda credit ulikuwa hujanifahamu bado.

Nathamini uhuru wangu wa kujieleza kuliko kupendwa na watu. Ningekuwa nataka credit nisingejiita "Kiranga". Utampaje credit mtu "Kiranga"? Unajua maana ya Kiranga?

Ningekuwa napenda kupendwa na watu na kupewa credit nisingechukua positions ngumu kukubalika kwa watu wengi, kama kutoamini kwamba mungu yupo, kutomuona Hugo Chavez mwanamapinduzi, kukandya wanaomsakama Ridhiwani kizembe, etc.

Viranga kama sie tusio credit tunaweza kusema chochote kile tunachofikiri. Hilo ni muhimu kuliko credit kwetu.

Zamani binafsi niliwahi hojiwa na polisi juu ya tuhuma fulani. Polisi walionihoji nikawaambia kwangu hampati kitu. Kamanda wao (mwenye shahada ya sheria) alinijibu kuwa walinikamata na kunihoji kutokana na taarifa kutoka TISS chini ya Ikulu.Katika tuhuma zile miye nilipaswa kuwa shahidi wakanigeuza mimi mtuhumiwa.

Aidha, yule kamanda aliniambia tuhuma nyingi zinazoanzia TISS hukwama zikifika mbele ya mahakama. Alisema majukumu ya uchunguzi wa aina ile niliyotuhumiwa kama ungeachwa ufanywe na polisi.Polisi ingewachukua hata miezi sita kuchunguza ili wapate fununu zote na data kamili ili wakilifikisha suala mahakamani mtuhumiwa lazima atiwe hatiani. Akasema TISS huwa wanakurupuka mno tena kupita kiasi.

Baadaye, nikawaza kuwa yamkini madai ya kamanda yule ni kweli. Sasa hoja zikajitokeza hivi yamkini:
  1. Vijana wa TISS ni kundi la maziro ya darasa la saba au kidato cha nne (kama wamesoma hadi kidato cha nne)
  2. Na kama ni watu wenye akili timamu basi walimu wao ni feki huko kwenye chuo chao.
  3. Iwapo walimu wao ni makini na waliobobea, basi mitaala na muhtasari wa kozi zao ni feki.
  4. Kama mitaala yao si feki, yamkini, wameamua kuvuruga kazi zao.(lakini wanavuruga kazi zao ili iweje? "Maisha Boa kwa Kila Manzania" hayajawafikia? Kwa hiyo, wamekata tamaa!!!....)
  5. Kama yoe hapo juu hayawezi kuwa sababu ya kushindwa kwao katika maeneo mengi; TISS watakuwa wameachakutumia taaluma zao na kubaki kutumiwa kisiasa na CCM.
Kipindi kile cha uongozi wa Mwl.Nyerere TISS ilikuwa inasifiwa kwa utumishi bora na ulio makini. Dalili za kuvurugika kwake zilianzia kipindi cha "Utawala (sio uongozi) wa All Mwinyi", Loliondo ikauzwa, walijaribu kuzuia wakashindwa. Mkapa alipokuja "kutawala" mambo yakawa mabovu zaidi. EPA, MEREMETA, DEEPGREEN, nk zikashika kasi.

Muhula wa mdini na mkanda JK TISS imebaki kuwa "Ndiyo" mzee! Wamejazwa watu ovyo ndani ya taasisi hiyo. Mambo yote maovu yamekuwa ndiyo utendaji kazi wa kila siku wa TISS. TISS inafanyakazi chini ya ikulu lakini cha ajabu kina Nape, Mwigulu, Kinana, Riz1, za fest ledi, mafisadi, wenyeviti wa ccm mikoa na wilaya ndiyo hutoa maagizo na amri za nini TISS ifanye kwa siku husika.

TISS ni kichwa cha mwendawazimu. Kila chizi ameigeza TISS kuwa lungu lake.
 
Siku hizi hiki cheo cha kujiita Afisa Usalama wa Taifa Wahusika wanakichukia Title ya kuchukulia Vidosho mtaani ninao Marafiki zangu wengi wapo hapa mjini mwingine wiki iliopita nilikuwa nae mida ilivozidi kwenda kinywaji kikaanza kumkolea akaita kwa njia ya simu vidosho hadi akagonganisha ikalazimu tuhame kiwanja haraka.Nusura Mikweche yetu ivunjwe vioo kwa Chupa.
 
Nadhani suala la mtumishi kuongelea masuala ya ofisni kwake akiwa njwi ni HULKA ya mtu na sidhani kama ni hao wafanyakazi wa TISS pekee bali hata OFISI zingine ziwe za serikali na hata binafsi huwezi kuwakosa watu wa aina hiyo. Kuna mtaalam mmoja alisema ukiona mtu anaongea sana na kujifanya anajua ujue huyo ndo hajui kitu. Ni ukweli usiopingika kuwa watu wengi ambao wanajifanya kujua sana mambo mara nyingi wanakuwa ni waropokaji tu.

Bado ata ww umekosa umakini ktk kujibu hili kwa taasisi nyeti kama hii upuuzi wa mtu kuzungumzia siri za ofisi (siri za usalama ea taifa) ni atari sana. Upuuzi kama huu hautakiwi kabisa ktk taasisi hii ni bora huko kwenye taasisi na sehemu nyingine za kazi.
Mfanyakazi wa namna hii ktk kitengo hiki haitajiki ata kidogo kwa kuwa anauweka rehani usalama wa nchi na swala zima linalochunguzwa au lililochunguzwa.

Ila tatizo ni mfumo uliowekwa,mfumo.ukibadilika,wafanyakazi hao hao,ukiondoa walevi wanaozungumza mambo ya usalama bar wataweza kufanya kazi kwa ufanisi tatizo sasa wanautumikia mfumo wa watu wenye maslai yao hapo.
 

Naamini sasa Usalama wa Taifa letu upo mashakani kama mtu aliyeweka video kwenye mtandao ameshindwa kupatikana hadi muda huu.In terms of Technology hata kama bado intelligence Unit ipo katika era ya matumizi ya cryptology bado tuko nyuma sana ukilinganisha na wenzetu hapa hapa afrika wanaotumia u2 au spacebone satellite intelligence. I really wonder kama usalama wa Taifa unaweza kufanya tendo la espionage kwa maadui zetu wa nje kama hili jambo dogo limetushinda na hadi muda huu mtu huyo hajakamatwa.


Kama taarifa za mipango inayoshabihiana na hii Mwigulu alisema anazo na wakasubiri hadi uhalifu utokee basi kuna tatizo kubwa sana.
Kwa taifa ambalo ni ambitious,Usalama wa Taifa ni taasisi inayotakiwa kufanya kazi kwa weledi kuliko idara yoyote ile.Weledi wake hautakiwi kutiliwa shaka yoyote kwa viwango vya kitaifa,kiakanda(regional) au kimataifa kwa maana pana zaidi.TISS inatakiwa kutengeneza mfumo ambao ni more sophisticated katika kufanya information sharing wakati huo huo ikijaribu kuimarisha vitengo vilivyopo ili kutimiza malengo ya idara na taasisi kwa ujumla kama ilivyo mifumo ya mataifa makubwa kama Mkakati wa ulinzi na usalama wa Marekani,Uingereza,Pakistan,Is rael,Afrika Kusini,China,India na Canada

Ingawa miakati mingi ya mataifa yaliyoendelea imekua sensitive zaidi kwenye maslahi yao ya kiuchumi na ushindani wa nguvu na mamlaka kimataifa(Power Interests) lakini kwa taifa lililofikisha umri wa miaka 50 ni lazima liwe ambitious na kwa kuanzia ni lazima tungeanza na kanda yetu ya Maziwa makuu,Afrika Mashariki na Afrika kwa ujumla.

Kwa mfano tuna washindani wetu kiuchumi na power struggle hapa east afica ambao ni Kenya.Hatujaweza vya kutosha kwenye Economic intelligence kule Kenya inagawa wao wamewekeza hapa kwetu.Leo hii Kenya ina-export TANZANITE,Wana-Export gold n.k.Balance of trade kati ya Tanzania na Kenya ni subject of Economic intelligence.tunapotunga sera zetu za kiuchumi tunatakiwa tutumie taarifa za kiinteligesnsia kwa kutumia wataalamu waliobobea na pia tuangalie possible scenarios na move za washindani wetu.Katika maofisa ubalozi wetu walioko Kenya tujiulize ni wangapi wenye uwezo kusimamia maslahi yetu ya kiuchumi hapa EAC au ukanda kupitia economic power house(Kenya) katika ukanda huu?

Kuna mgogoro kati ya dola na sarafu yetu.Je hakuna uwezekano kwamba dola zimekua zikinunuliwa kwa wingi na kuwa smuggled kwenda Kenya ili kuhujumu uchumi wetu na ku-frustrate fisical na monetary policy zetu?

Mosi,Kuongeza nafasi na umuhimu wa idara ya mahakama na vyombo vya kutoa haki.Lengo hapa linatakiwa kuwa juu ya kuunganisha idara za mahakama,wizara ya mambo ya ndani na vitengo vyake kwa kuzingatia upeanaji wa taarifa huku haki za msingi za kiraia zikilindwa pamoja na uhuru wake tofauti na ilivyo sasa ambako TISS inatuhumiwa kutumika kuhujumu haki za kiraia kwa visingizio lukuki.Lengo kuu liwe kulinda haki na uhuru wa watu bila kuathiri maslahi ya jumla.Hili linahitaji ushirikiano kuanzia serikali kuu,mikoa,wilaya,majimbo ya uchaguzi,kata na hata ngazi ya mitaa pamoja na sekta binafsi

Pili,Utengenezwe utamaduni mpya wa kuahamasisha mawazo mbadala na matumizi ya weledi(professionalism/expertise):Kubadili utamaduni ndani ya TISS ni muhimu sana ili kuepuka mimosa ya kimkakati. Tano,TISS ibadili utamaduni wa kuhitaji-kujua kwenda Kuhitaji-kutoa taarifa(changing from the culture of need-to-Know to need-to-share):Ili kuongeza ushirikiano na ufanisi katika kila ngazi ni lazima mtazamo wa idara hii ubadilike na suala la kutoa taarifa liwe ndiyo njia kuu ya kufanikisha malengo ya idara katika ngazi zote kwa hiyo kuna haja ya kuangalia jinsi taarifa zinavyofika kwa ubora unaotakiwa,kwa usahihi na kwa muda muafaka na hili ni muhimu na litasaidia zaidi kuwa karibu na watunga sera(policy makers)

Sita,Kuimarisha na kupanua zaidi uhusiano kati ya TISS na washirika wa ndani ya nchi na vitengo vingine vya kijasusi vya mataifa ya nje:Hii ni kwa kuwa tunaweza kuwa na common threats kwenye uchumi,kiitikadi,kiutamaduni,k iulinzi n.kHata hivyo taarifa za kijasusi kutoaka kwa washirika wetu ni lazima ziangaliwe kwa umakini wa hali ya juu na pia tuwe na taarifa zetu ambazo tunaweza kulinganisha na taarifa za washrika wetu.Hizi kwa kijasusi zinaitwa ‘Corroboration codification’

PART 11

THE TANZANIA INTELLIGENCE AND SECURITY SERVICE

4.-(l) There is hereby established a department of Government within the office of the President which shall be known as the TanzaniaIntelligence and Security Service or, when referred to in brief, by the acronym ''TISS''.

(2) Subject to this Act, the intelligence and security department existing before the enactment of this Act shall be deemed to have been established and its employees and officers to have been recruited and appointed in pursuance of the relevant provisions of this Act.

(3) The Director-General may, with the prior written approval of the Minister establish regional and district offices of the Service.

5.-(1) Subject to the control of the Minister, the functions of the Service shall be-

(a) to obtain, correlate, and evaluate intelligence relevant to security, and to communicate any such intelligence to the Minister and to persons whom, and in the manner which, the Director-General considers it to be in the interests of security;

(b) to advise Ministers, where the Director-General is satisfied that it is necessary to do so, in respect of matters -relevant to security,so far as those matters relate to departments or portfolios of which they are in charge;

(c) To cooperate as far as practicable and necessary with such other organs of state and public authorities within or outside Tanzanians are capable of assisting the Service in the performance of its functions.

(d) To inform the President, and any other person or authority which the Minister may so direct, of any new area of potential espionage,sabotage, terrorism or subversion in respect of which the Director-General has considered it necessary to institute surveillance.

(2) It shall not be a function of the Service (a) To enforce measures for security; or (b) To institute surveillance of any person or category of persons by reason only of his or their involvement in lawful protest, or dissent in respect of any matter affecting the Constitution, the laws orthe Government of Tanzania

PART IV

DUTIES,AND POWERS OF TISS
14.-(1) It shall be the duty of the Service to collect, by investigation or otherwise, to the extent that it is strictly necessary, and analyse andretain information and intelligence respecting activities that may on reasonable grounds be suspected of constituting a threat to the securityof the United Republic or any part of it.

(2) The Service shall, in relation to the information dealt with under subsection (1), report to and advise the Government.

(3) The Service may provide security assessments to departments ofthe Government.

(4) The Service may(a) advise any Minister on matters relating to thesecurity of Tanzania; or

(b) provide any Minister with information relating to security matters.

15.-(1) The Service shall, subject to this Act, have power to investigate any person or body of persons whom or which it has reasonable cause to consider a risk or a source of risk of a threat to the state security.

(2) The Service may conduct any investigations which are required for the purpose of providing security assessments pursuant to section 14.

(3) The Servicemay, with the approval of the Minister, enter into an arrangement with-

(a) any person or body of persons;

(b) any local government or other authority; 1996

(c) Any police, force or other policing organisation.authorising the Service to providesecurity assessments.

(4) The Service may, with the approval of the President after consultation with the Minister for Foreign Affairs, enter into an arrangement with the government of a foreign state or an international organization of states authorizing the service to provide the government, institution or organisation with security assessment.

16-(1) Subject to this section no person shall, without the written consent of theMinister, publish or cause or allow to be published in a newspaper or other document, or broadcast or cause or allow to be broadcast by radio or television or otherwise, the fact that any person, other than the Director-General-

(a) is a member of the Service;

(b) is connected in, any way with a member of the service.

(2) The written consent of the Minister in relation to any proceedings in any court may be filed in the court and when so filed shall besufficientauthority to all persons to act in accordance with it.

(3) Any person who fails or refuses to comply with the provisions of this section commits an offence and upon conviction is liable to a fine not exceeding five hundred thousand shillings.

17.-(l) Information and intelligence obtained in the performance of the duties and functions of the Service pursuant to this Act shall not be disclosed by the Service except in accordance with this section.

(2) The Service may disclose information referred to in subsection

(1) For the purposes of the performance of its duties and functions under this Act or the administration or enforcement of this Act or as required by any other law and may also disclose that information-

(a) where the information may be used in the investigation or prosecution of an alleged offence under any law in force in the United Republic, to any public officer having jurisdiction to investigate the alleged ofence and to the Attorney-General or the law officer concernedwith the proceedings in respect of the alleged offence;

(b) where, in the opinion of the Minister, disclosure of the informaion to any Minister or public officer is essential in the public interest and that interest clearly out weighs any invasion of privacy that could result from the disclosure, to that Minister or public officer.

18.-(1) For the purpose of performing its duties and functions under this Act, the Service may, with the prior approval of the Minister-

(a) Enter into an arrangement or otherwise cooperate with any department or other institutions of the Government or a local government authority;Restriction on publication and broadcasting information Authorised disclosure of information Cooperation 1996 10 No. 15 Tanzania Intelligence and Security Service Protection of officers and ernployees Protec tion of sources of information Delegation of powers

(b) After consultation with the Minister for Foreign Affairs, enter into an arrangement or otherise cooperate with the Government of a foreign state or its institution or an international organization
of states or its institution.

(2) Where a written arrangement is entered into pursuant to subsection (1) of section 15(3) or (4), a copy of the arrangement shall be given to the Attorney-General.
