Suala la Mkaguzi Mkuu wa Hesabu za Serikali (CAG) na Vipengele kadhaa vya Kisheria

Matumizi ya neno kama katika Ibara ya 3 yanafanya uchunguzi kuwa ni UTASHI na sio LAZIMA.

Na hiki kipengele umekiona?
Huoni kinamlazimisha Rais ampe muhula wa pili CAG la sivyo afuate utaratibu mzima wa ibara ya 144(3) kama ataamua kutomuongezea mkataba wamiaka mitano?

Acha kutetea uvunjifu wa sheria mkuu, Ni dhahiri Shahiri JPM kavunja sheria kwenye uteuzi huu wa CAG mpya.

Pia Ibara ya 2 inalazimisha Ibara ya 4 itimizwe ili CAG aondolewe. Sasa Ibara ya 4 inatimizwaje?

Hiyo sio hoja ya msingi... hoja ya msingi ni kwamba Rais hawezi kumuondoa CAG bila kumuundia tume, though thanks for the correction!

Hata hivyo, nimesema tenure in the office kwa sababu ile miaka 65 iliyowekwa na Bunge ipo kwenye kipengele cha tenure in the office!

First, no need to get personal here. It’s a sign of losing the argument. Me being this or that is neither here or there.

Back to the subject at hand.

I said, ‘shall’ as an auxiliary [modal] verb, fundamentally, means the same thing across the board.

What do I mean by that? I mean this: it is used to express a necessity [ulazima].

Looking at your reference, I see ‘shall’ basically mean the same thing as I’m saying.

Now, after reading it, what do you say? Does it mean something fundamentally different from your reference source?

But, when used in a sentence with other words, context becomes paramount.

You can’t tell me that ‘shall be eligible for renewal’ is exactly the same as ‘shall be renewed’.

The latter is more firm [tightened] whereas the former has a wrinkle in it. That being the word ‘eligible’.

You haven’t realized what you are saying is what I’m saying also?

Chige, neno "shall" limetumika pia ibara ya 33 na 40, kwahiyo mwakani uchaguzi wa Rais usiwepo kwani atarudi tu ofisini kwa mujibu wa tafasiri yako.
 
CAG amestaafu kwa mujibu wa sheria

Yaani mnaamuaga tu kujitoa ufahamu na kulazimisha kutokuelewa. Amestafu kwa mujibu wa sheria ipi hata point hamuweki. Watu wakitoa ufafanuzi kwa ajili ya kurekebisha mnawaita wapinzani sijui ujinga huu utaendelea hadi lini. Hii Nchi ni yetu wote na sheria tuliziweka wenyewe lazima tuzifuate, mtu atakayekiuka lazima aelezwe wala sio upinzani. Misitaki kuamini kuwa huelewi kinachoelezwa ila umeamua tu kuchagua hicho unachokisema kwa faida zako binafsi na huo ndo ubinafsi.
