6. Tenure of office
(1) The Controller and Auditor-General shall hold office for the fixed term of five years and shall be eligible for renewal for one term only.
(2) Unless the question of removal becomes the subject of investigation in terms of Article 144(3) of the Constitution, the Controller and Auditor-General shall vacate office-
(a) upon attaining the age of sixty five years;
(b) if the Controller and Auditor-General resigns- (i) on account of medical grounds or any other grounds which the President considers sufficient; or (ii) by giving six months’ notice to the President.

7. Removal from office
The Controller and Auditor General may be removed from his office for reasons and procedures provided for under Article 144 of the Constitution.

Hii Ibara ya 144 - 2 ipo clear kabisa. Inataka CAG anapoondolewa kwa sababu tajwa hapo juu basi masharti ya Ibara ndogo ya 4 yafuatwe. Masharti hayo ni yapi :

(4) Ikiwa Tume iliyoteuliwa kwa mujibu wa masharti ya ibara
ndogo ya (3) itamshauri Rais kwamba huyo Mdhibiti na Mkaguzi
Mkuu wa Hesabu aondolewe kazini kwa sababu ya kushindwa
kufanya kazi kutokana na maradhi au sababu nyingine yoyote
au kwa sababu ya tabia mbaya, basi Rais atamwondoa kazini.

Kwa hiyo Ibara ya 2 inalazimisha kuundwa kwa tume. Na imesisitiza CAG HATOWEZA kuondolewa pasi na 4 kutimizwa.

Je kama Rais hakuunda tume kama alivyofanya kwa Assad yupo sahihi?

Ibara ya 3: Inasema kama Rais anahitaji KUCHUNGUZA jambo la kumuondoa kazini CAG ataunda tume. Kumbe basi Rais atakapoona CAG amekiuka Ibara ya 2 analazimika kufanya Ibara ya 3 ili Ibara ya 4 itimie.

Kumbe basi Katiba inamtaka Rais achunguze shtaka la kumuondoa CAG ofisini. Na atachunguza kwa kuunda tume.

Kuna namna hizi za CAG kuondoka kwenye cheo hicho, katiba inaainisha.

Kwa vifungu ulivyovileta wewe mwenyewe, nimevinukuu hapo juu.

1. Kwa uchunguzi wa impeachment tribunal kama inavyosema article 144 (3)
2. Akifika umri wa miaka 65.
3. Akijiuzulu -i) kwa sababu za afya au nyingine zozote ambazo rais atazikubali au -ii) Kwa kumpa rais notisi ya miezi sita.

Hizi ndizo namna pekee zilizoainishwa kikatiba.

Sasa Assad.

1. Hajaundiwa impeachment tribunal
2. Hajafikisha umri wa miaka 65
3. Hajajiuzulu

Rais katumia kifungu gani cha katiba kumuondoa?

Haha mkuu unachanganya mambo hapa, kuna tofauti kati ya tenure of office na removal from office.

Katiba ipo silent kwa tenure of office.

Kiranga yupo sahihi! lakini wewe haupo sahihi sana kwamba "katiba ipo silent kwa tenure"!

Katiba yetu ina Ibara Kadhaa ambazo zinatungiwa Sheria na Bunge! Kwa mfano, kwa hili la CAG, utaona katiba imetoa tenure to the office ni miaka 60 lakini ikatoa mandate kwa Bunge kufanya vinginevyo:- 144(1)

Without prejudice to the other provisions of this Article, the Controller and Auditor-General of the United Republic shall be obliged to vacate office upon attaining the age of sixty or any other age which shall be prescribed by a law enacted by Parliament.

Kwa kutumia mamlaka hayo, ndipo Bunge kupitia Public Audit Act 2008 Ibara ya 6(2)(a) ikasema:-

Unless the question of removal becomes the subject of investigation in terms of Article 144(3) of the Constitution, the Controller and Auditor-General shall vacate office upon attaining the age of sixty five years;

Kwamba, CAG ataachia ofisi atakapofikisha umri wa miaka 65 unless kama atatakiwa KUONDOLEWA kwa mujibu wa Katiba Ibara ya 144 (3).

Imetumika reference ya 144(3) kwa sababu Ibara ya 144(2) inasema:-

The Controller and Auditor-General may be removed from office only for inability to perform the functions of his office (either due to illness or to any other reason) or for misbehaviour, or for violating the provisions of the law concerning the ethics of public leaders and shall not be so removed except in accordance with the provisions of subarticle (4) of this Article.

Kwanza, hapo ndipo mtakapoona msingi wa matumizi ya neno SHALL na MAY.

Hapo katiba inatoa UWEZEKANO wa CAG kuondolewa ikiwa limetokea moja au combination ya hayo yaliyotajwa!!

The question is: Kwavile Rais anaona CAG ni mgonjwa au ame-violate sheria fulani, je anaweza kumfuta kazi hapo hapo?!

Jibu ni HAPANA, kwa sababu "...shall not be so removed except in accordance with the provisions of subarticle (4) of this Article" inayosema:-

If the Special Tribunal appointed in accordance with the provisions of subarticle (3) advises the President that the Controller and Auditor-General be removed from office on grounds of inability to perform functions of his office due to illness or any other reason or on grounds of misbehaviour, then the President shall remove him from office.

Kumbe pamoja na Rais kuona CAG anastahili kuondolewa ama kwa kutokana na ugonjwa, au kuna miiko ameivunja, bado hawezi kumuondoa hadi Tume aliyoiunda inamshauri kufanya hivyo, na hapo Rais atamuondoa CAG?

Sasa hiyo Special Tribunal ni ipi? Jibu ni hiyo iliyotajwa kama subarticle 3 inayosema:- if the President considers that the question of the removal of the Controller and Auditor-General from office under the provisions of this Article needs to be investigated, then the procedure shall be as follows:
(a) the President shall appoint a Special Tribunal which shall consist of a Chairman and not less than two other members. The Chairman and at least half of the other members of that Special Tribunal shall be persons who are or have been Judges of the High Court or of the Court of Appeal in any country within the Commonwealth.

That being said, Rais HAWEZI kumuondoa CAG bila kuunda hiyo tume! Hata hivyo, kama nilivyopata kusema hapo awali kwamba Rais anaweza KUMLAZIMISHA CAG kujiuzuru!

Lakini kwavile KULAZIMIHA haipo kwa mujibu wa katiba au sheria, CAG anaweza kugoma kuachia ngazi, na hapo Rais kama anaona uamuzi wake ulikuwa sahihi, anaweza kurudi kwenye katiba kuangalia anamuondoa ondoa vipi... JIBU NDO HILO HAPO JUU ambalo hamlipendi!!

Napenda kujitokeza hasa pale nikiona Katiba ya nchi inakiukwa ama na mtu ama na Sheria yoyote...
Hili ya CAG Prof. Assad kutumbuliwa...
Ukweli ni kwamba Sheria ya Public Audit Act ya 2008 imekiuka Katiba kwenye kipengele cha ajira ya CAG. Katika Katiba ya nchi ni kwenye kipengele cha umri wa CAG kustaafu tu ndio Katiba iliacha mwanya kwa Bunge kutunga sheria ya kubadilisha umri wa CAG kustaafu (Ibara ya 144 (1). Otherwise Katiba haitoi nafasi kwa Bunge kutunga Sheria au kipengele cha Sheria cha kubadilisha masharti mengine ya ajira ya CAG.
Hivyo kwa mujibu wa Ibara hiyo 144 (1) ya Katiba, ilikuwa sahihi kwa Bunge kurekebisha sheria ya Ofisi ya CAG ili umri wa kustaafu wa CAG uwe miaka 65 kutoka ile 60 iliyoko kwenye Katiba. Lakini haikuwa sahihi kwa Bunge kuweka masharti mengine kwenye sheria kama ya ajira ya mkataba wa miaka 5 kwa CAG na kwamba ni eligible tu kuongezewa miaka mingine mitano (at the pleasure ya mteule). Hapa Sheria imekwenda kinyume na Katiba, and therefore is unconstitutional. Kipengele cha Sheria hii kinachoweka ukomo wa miaka 5 wa mkataba wa CAG inatakiwa ipingwe Mahakamani kwa kwenda kinyume na Katiba ya nchi.
Katiba inataka CAG akae madarakani hadi afikishe miaka 65, labda kama anaondolewa kwa mujibu wa Ibara ya 144 (2) na kwa utaratibu wa Ibara ya 144 (3), na si vinginevyo ..
Halafu sheria yenyewe inaongeza tu mkanganyiko. Section 6 (1) inazungumzia tenure ya 5 years and possible renewal of another 5 years only, lakini section 6 (2) inakubaliana na Katiba kwamba CAG atakaa madarakani hadi afikishe miaka 65, unless amekosa sifa kwa mujibu wa Ibara ya 144 (2) ya Katiba.... BUNGE, FUTA VIPENGELE VIBOVU VYA SHERIA HII
