The International Court of Justice issues a series of provisional measures against Israel on the basis that the rights of the Palestinians not to be subject to genocide must be protected before the court can make a final ruling on the merits of the case.

The court says that Israel must “take all measures in its power” to prevent the commission of genocidal acts against the Palestinians as laid out in Article 2 of the Genocide Convention.

A former adviser to late Israeli President Shimon Peres has called the ICJ a “kangaroo court” and said it is a “joke” that South Africa has even brought up the case.

“Who cares? Literally who cares what the ICJ says?” Mitchell Barak, CEO of Israel-based Keevoon Global Research, told Al Jazeera in response to a question on the impact of a potential disfavourable ruling for Israel and Benjamin Netanyahu.

“I’m not going to get concerned about it. At the end of the day, we have to defend our country, we have to get our hostages back. And it’s really not going to matter, it’s just not going to matter,” he said.

“South Africa has their own internal problems. They have an election coming up, so they figure that instead of dealing with issues like crime and poverty in South Africa, ‘let’s call out attention and be the international champion of Hamas and the Palestinians’.”

Wayahudi wana kila sababu za kujilinda dhidi ya mazombi ya kidini yanayoamini kwamba yameamrishwa yafute jamii ya Wayahudi, hivyo hata mahakama ingeamrisha vinginevyo bado wangekiuka, maana wakilegea tu ndio basi wanafutwa.

Adui anajificha ndani ya watoto na akina mama, anafyatua maroketi akiwa ndani ya makambi ya wakimbizi, aisei namfyatua tu, yaani ahata Israel wamejaribu sana kujidhibiti, ingekua mataifa yasiyojali kama vile Warusi au Wachina, hiyo Gaza ingekua mavumbi.

The International Court of Justice said Israel must take “all measures” to “ensure with immediate effect that its military does not commit any acts” which could fall foul of the Genocide Convention.

In a preliminary ruling on the accusation of genocide brought by South Africa, the court’s 17-judge panel on Friday issued six such measures, ordering Israel to take steps to limit the death and destruction caused by its military campaign, as well as to prevent and punish incitement to genocide, and to ensure the provision of humanitarian aid to Gaza.

Na ifahamike kuwa mahakama hii ya ICJ siyo kama ile ICC, hii haina meno. Unaweza usitekeleze chochote kile, na hakuna kitakachotokea. Ni mahakama ya kisiasa.

Note:

The ICJ court’s decisions are binding and cannot be appealed, but it has no way of enforcing them.
