Bodi ya Mamlaka ya bandari nchini imekubaliana kutohuisha mkataba wa kampuni ya kupakua na kupakia makontena bandarini ya TICTS na badala yake itatafuta muwekezaji mwingine. Chanzo cha taarifa kinasema pande hizo mbili zilishindwa kufikia makubaliano baada ya mkataba wa miaka 5 kufikia tamati na baadae kuongeza mitatu.

Mwaka 2017 Rais Magufuli aliielekeza TPA kufanya mapitio ya mkataba wao na TICTS ikiwa ni miezi mitano baada ya CAG Assad kuonesha mkataba ulikuwa na mapungufu. Baada ya marekebisho Serikali iliweka tozo mara mbili yake kwa TICTS iliyokuwa inalipwa kwa mwaka kutoka $ milioni 7 mpaka 14 mwaka 2017.

Kwasasa TPA itaendesha gati namba 8-11 zilizokuwa chini ya sekta binafsi kwa miaka 20 sasa.

Dar es Salaam. The Tanzania Ports Authority (TPA) will not renew its contract with the Tanzania International Container Services (Ticts) Limited, which has been handling containers at berths number 8 to 11 of the Dar es Salaam Port.


Reliable sources revealed that the TPA board has resolved to terminate the contract and look for another investor.

Ticts had a five-year lease agreement which expired on September 30, 2022 but it was extended for another three months to give more time for the two parties to discuss the possibility to renew the contract.

However, the source said the two sides failed to agree on renewal terms.

“The board of TPA agreed not to renew the lease contract with Ticts and look for another operator,” said the source who did not want to be named.

The board told the management to prepare a notice that will be served to Ticts, informing its resolve not to renew the agreement, in what the board described as to safeguard the interest of the authority, the government, and the nation at large. Efforts to get comments from Ticts did not materialize until the time of press.

Unfavourable offer
It is said that Ticts’ new offer for consideration of renewal of the lease agreement for another term entailed that the firm should be allowed to manage berths 8 to 11 as well as berths 5 to 7 on behalf of TPA.

The offer also stated that Ticts will pay a fixed annual rental of $30 million, escalating at three percent per annum; and that the firm will also pay a royalty fee of $29 per container of twenty-foot equivalent unit (TEU), escalating at four percent per annum; as well as requesting a suspension of key performance indicators (KPI) targets.

However, the government negotiation team ruled that the offer never met its requirements which includes an annual fixed rental of $30 million with effect from October this year, escalating at eight percent per annum.

The negotiation team also required a royalty fee of $29 per container, effectively from October this year and escalating at eight percent per annum thereafter.

The team also demanded the container output target as per the existing lease agreement of 2017, shall be calculated as 7.4 percent of the minimum guaranteed throughput of 657,946 TEU of year 2021 effectively from October 2022 escalating at 7.4 percent annually for the remaining term.

Ticts was also said to have provided conditions that could not be acceptable by the TPA, including a demand to suspend key performance indicators. TPA said could not have a contract that does not have functioning key performance indicators (KPIs), which determine the royalty payment.

The condition to manage berths 5 to 7 could also not be accepted because there are other plans currently being implemented by TPA at the respective berths.

TPA takes charge
TPA will now operate berths 8 to 11 that have been under the private sector for over twenty (20) years so as to get the revenues forecasted to be collected from cargo handled at those respective berths.

According to the source, in fact the initial term of the lease agreement between TPA and TICTS Limited expired at the end of September this year. And the negotiations between the Parties for renewal of the Lease Agreement failed after not agreeing on terms for renewal.

In 2008, Parliament passed a resolution instructing the government to terminate the contract extension. However, that was followed by a five-year contract extension in 2017.

In September 2017, President John Magufuli directed TPA to review its contract with Ticts. That came only five months after the CAG, Prof Musa Assad, revealed that the contract had numerous defects. After reviewing the contract in 2017, the government doubled the annual fee Ticts pays for leasing the lucrative container terminal from $7 million to $14 million.

Ticts was also required to ensure 37 percent annual growth of container traffic.

Hata pale wananchi walipoilalamikia serikali kuhusu mkataba huo,serikali iliongeza mkataba kabla ya expire date ya awali.
Magu alinguruma lakini aliishia kuongeza kodi tu ya upangaji tu.
Yawezekana TICS kama kampuni sio tatizp,tatizp ni baadhi ya watawala waliojiwekea maslahi yao binafsi.
Ninakubaliana nawe mkuu 'sblandes', matatizo yetu yote hapa nchini kwetu ni uongozi mbaya na kwa hiyo serikali mbaya, ndiyo maana nchi hii pamoja na kubalikiwa sana, haitaendelea hadi hapo tutakapowapata viongozi wanaojali maslahi ya nchi yao na wananchi wake.

Sasa tatizo linabaki palepale jinsi ya kuwapata viongozi hawa. Najua wapo, na pengine wengi wao hata hawajitokezi mbele watu wawaone.

Tanzania kwa sasa inahitaji kutikiswa sana iondokane na usingizi mkubwa unaoinyemelea.

Kwa mwendo huu wa sasa, hatufiki popote.
 
Ninakuomba uelewe kwamba TICTS ni kitawi tu kilichopo hapa Tanzania ambacho ni sehemu ya kampuni kubwa duniani.

Hata hao Dubai wakija hapa, wanaweza kuunda tu kitawi chao hapa kwetu kuendesha shughuli zao.

Baada ya kuhudumu kwa miaka 22 katika Bandari ya Dar es Salaam, hatimaye ndoa ya kampuni binafsi ya kimataifa ya kuhudumia makontena Tanzania (TICTS) na Mamlaka ya Bandari Tanzania (TPA) imekoma rasmi mwaka huu.

Hatua hiyo inakuja baada ya mkataba wa miaka mitano wa wawili hao uliosainiwa Julai 6, 2017 kufikia ukomo Septemba 30, mwaka huu, licha ya kuwepo kipengele cha kuuhuisha, menejimenti ya TPA imetaka kuusitisha.

TICTS imehudumu katika bandari ya Dar es Salaam kwa miaka 22 sasa tangu mwaka 2000 kwa mara ya kwanza iliposaini kutoa huduma ya makontena.

Kulingana na taarifa hiyo ya ndani kutoka menejimenti kwenda kwa Bodi ya Wakurugenzi ya TPA, mkataba kati ya wawili hao uliisha Septemba 30, 2022 na mazungumzo kati ya pande mbili hayakufanikiwa.

Chanzo chetu kilieleza tayari TPA imewasilisha taarifa kwa Bodi ya Wakurugenzi inayoongozwa na Inspekta Jenerali wa Polisi (IGP) mstaafu Ernest Mangu kusudio la kutokuendelea na TICTS.

Aidha, TPA inayoongozwa na Plasduce Mbossa imeomba baraka za bodi ili waweze kuiandikia barua kampuni hiyo kutohuisha mkataba huo, na tayari wamejipanga kusimamia wenyewe shughuli zilizokuwa zikifanywa na TICTS.

“Sina shaka hata kidogo kwamba bodi itakubali ombi hili. Na tayari tumejipanga kuhakikisha tunasimamia wenyewe wakati tunatafuta mtu mwingine ambaye atakuwa na uwezo mkubwa zaidi,” alisema kigogo mmoja wa TPA.

Gazeti hili jana kwa nyakati tofauti, lilimtafuta Mbosa kujua wapi hawakuelewana kwenye mazungumzo yao na TICTS, lakini hakupatikana kwani simu yake ya mkononi ilikuwa ikiita pasina kupokelewa na hata alipotumiwa ujumbe hakuujibu. Jitihada hizo zilifanyika pia kwa kuutafuta uongozi wa TICTS bila mafanikio.

Katika maelezo ya menejimenti ya TPA kwenda kwa bodi yanaeleza kumweka kando TICTS kunalenga mahitaji ya hatua nyingine zinazopaswa kuchukuliwa na uongozi, katika kutekeleza wajibu wake wa kusimamia mkataba ili kulinda masilahi ya mamlaka, Serikali na Taifa kwa ujumla.

Hata hivyo, mtoa taarifa wetu alieleza kabla ya kukamilika kwa mkataba huo Serikali kupitia Wizara ya Ujenzi na Uchukuzi, Mei 16, mwaka huu iliunda timu ya wataalamu kujadiliana na TICTS kuhusu kuongeza mkataba na ilihusisha vikao vitatu.

Alisema vikao hivyo viliendelea Septemba 7, mwaka huu kutengeneza njia ya mashauriano zaidi na mamlaka za juu katika maeneo matatu ambayo hawakuwa wamefikia muafaka ambayo ni ukodishaji wa kudumu wa mwaka, ada ya mrabaha ya kila mwezi na upitishaji wa kontena.

Chanzo chetu hicho kiliendelea kueleza kuwa Septemba 23, mwaka huu bodi ya wakurugenzi ya TPA iliridhia ombi la menejimenti la nyongeza ya mkataba wa miezi mitatu kukamilisha makubaliano ambao utaisha Desemba 31.

Hata hivyo, Oktoba 21, mwaka huu TICTS iliwasilisha ombi la kuongeza mkataba ambalo halikufikia viwango vilivyotakiwa na TPA.

“Hatua ya kutohuishwa kwa mkataba huo ni muhimu kwa kuwa menejimenti itapata fursa ya kuendesha gati 8 hadi 11 ambazo zimekuwa chini ya sekta binafsi kwa muda miaka 20, ili kupata mapato yanayotarajiwa kukusanywa,” alisema

Kabla ya uamuzi wa menejimenti wadau walianza kupinga kuendelea kwa mkataba kati ya TICTS na TPA, kwa madai kuwa kampuni hiyo haina utendaji wa kuridhisha.

Julai 23, mwaka huu, msemaji wa sekta ya mawasiliano, teknolojia, habari na uchukuzi wa ACT Wazalendo, Ally Salehe alisema suala la TICTS kukodishwa tena au la, linapaswa kuchukuliwa kwa umakini na kufikiwa uamuzi wenye kujali na kulinda uzalendo.

“Serikali isitishe nyongeza ya mkataba wa kukodisha kitengo cha makasha kati yake na TICTS, kwa kuwa ni wazi imeshindwa kukidhi matarajio ya Serikali yanayolenga kuongeza tija kwenye bandari yetu,” alisema Salehe.
