Viongozi wa dini waliokutana Rais Samia Wamemshauri kuifuta kesi ya Mbowe

Siku nyingine ni bora kukaa kimya kuficha ujinga wako.
 
Kwa sababu tumeshausikiliza upande wa akina Swila ni vema taifa likamsikia na Mbowe pia
Na ndicho kinachoenda kufanyika. Kesi hii haiondolewi bila utetezi kukamilisha utetezi wao. Hukumu itatokana na mnyukano wa mashahidi wa pande zote. Ni muhimu utetezi ufanye ili tujue mbivu na mbichi
 
Kwahiyo serikali iachane na hayo maombi ya viongozi wa dini si ndio?
Ndiyo, hayana maana kwa sasa. Lazima utetezi ufanywe ili hukumu isimamie kwenye hoja za kisheria zilizopambaniwa
 

Mbinyo mbinyo chanya. Nitashangaa serikali hii kutotumia kauli hii ya viongozi wa Dini / Imani kama daraja la kutokea upande wa pili la daraja ambapo watakuta nchi ya ahadi iitwayo Umoja wa Taifa la Tanzania.

Serikali kuwa sikivu ni pamoja na kukubaliana na ushauri wa viongozi hawa wa Kiroho wenye wafuasi wengi ndani ya Taifa letu kuwa sasa serikali hii ivuke daraja toka upande wa awamu ya tano na kwenda upande wa pili wa awamu ya sita.

Uvukaji huu wa daraja utahesabiwa kama rasmi sasa awamu ya sita inajisimamia yenyewe na kuanza kujijengea legacy yake.

The Prevention of Terrorism Act is fraught with legal defects.[10] It is beyond the scope of this paper to go into all the shortcomings.

Suffice to say that the act curbs democracy, free association, exchange of information, the right to own property, etc.

There are also sections, which give the Minister of Home Affairs undue powers to declare any person a ‘terrorist’ on mere suspicion.

In a country where the Church controls the government, one can only imagine the dangers facing Islam.

The law empowers the Minister to freeze bank accounts of any suspected ‘terrorist organisation’ or individual. Nowhere is the law frightening than in part V 28 (6). This section deserves special mention.

It stipulates that:

A police officer who uses such force as may be necessary for any purpose, in accordance with this Act, shall not be liable, in any criminal or civil proceedings, for having, by the use of force, caused injury or death to any person or damage to or loss of any property.

Muslims were concerned because the parliament was being manipulated by a foreign power in partnership with the Christian lobby to legitimise oppression against them.

It was now legitimate to kill ‘Muslim fundamentalists’ or suspected ‘terrorists’ on mere suspicion.

There were many good reasons for Muslims to register concern. There had been incidences in the past where state organs have used excessive force against Muslims resulting into deaths of Muslims.

The act in a multi racial society like Tanzania incites racial and religious hatred against Muslims particularly those not of black African origin.

The Act managed to fan fear and hatred against Muslims whipping up a frenzy of Islamophobia in the country.

The smoke bombing of mosques and mass arrests of sheikhs over the years, were one of the means of intimidating Muslims and rescuing the Church from its predicament.[11]

What was there to prevent state organs from applying the Act in subverting Islam?

In the Rivonia Trial, the ‘accused’ addressed this problem by using the courts as a site of struggle. They argued that the law was drawn up without the consent of the majority; it was enforced to ensure the perpetuation of an unjust system, and therefore the struggle would be waged to establish a new system, including a legal system that would embody the values of a non-racial constitution that protected human rights.

For the accused, the courtroom became a new site of struggle. The defendants’ daily appearances in court drew large crowds that filled up the courtroom and streets outside the court. Many supporters were in violation of numerous influx control regulations, and the courts for them too, became new sites of struggle.

In presenting the prosecution’s case, Yutar claimed that the accused were all members of what he considered ‘a cabinet of the government soon after the overthrow of the state’. In this cabinet, Mandela was Deputy Minister and Minister of Defence, while Govan Mbeki was Minister of European Affairs. The rest of the accused each had a cabinet portfolio.




Often referred to as "the trial that changed South Africa,” in October 1963, ten leading opponents of apartheid went on trial for their lives on charges of sabotage.
